一种机动车交通违法实时告知、确认的系统及方法
技术领域
   本发明涉及交通违法自动处理技术,尤其涉及一种机动车交通违法实时告知、确认的系统及方法。
背景技术
   随着现代社会的发展,机动车交通管理的重要性日益徒现。长期以来以交警现场查处交通违法行为的执法模式已明显力不从心,难以从根本上遏制交通违法行为多发的势头。现已广泛应用于当前道路交通管理的电子警察系统,作为非现场执法的一种现代化手段,从最早的的闯红灯违章拍摄设备的基础上,已延伸开发出对超速、逆行、不按道行驶、压线等多种违法现象的全过程,进行自动监测和记录,并通过图像远程传输及数据库等技术,使执法部门能将记录到的图像作为车辆违法的充分证据,能在过后对机动车、驾驶人的交通违法行为进行追究和处罚,从而大大提高了将机动车交通违法行为,置于全天候、全覆盖道路交通监管的力度。
   目前,随着现代科技的进步,各类电子警察系统层出不穷、日新月异。但是,电子警察这种非现场执法系统和方法尚存许多遗憾之处。例如:车牌识别、数据获取和违章确认的成功率有待提高,功能单一,模块分散,生成发单效率低、时滞长;当事人难以当场有效获知交通违法记录,无法及时得到警示、纠正和教育,在不知情的无意识情况下,还可能直接导致多次重复的交通违法和累计巨额的罚款;违章信息传递的滞后性,使得当事人因事过境迁无法回忆当时有无违法及具体情节,难以有效行使法律赋予其的陈述和申辩的权利,面对随之而来的行政处罚,往往产生较大的抵触情绪;过分依赖电子警察非现场执法拍摄的违法记录进行经济性处罚,助长了管理部门简单执法、罚款创收等不良作风;非现场执法记录的一般是车辆违法的事实,难以确认具体违法的驾驶人,经常出现违法驾驶人为规避扣分、大额罚款和接受培训,甚至是吊扣证照,屡屡出现找人替代接受处罚所谓“买分”的情况。
   一般来说,电子警察须将违法行为形成的视听资料需经过提取,还须再经过人工审查无误后,才能成为行政处罚的证据,然后由交通警察按照《道路交通安全法》的规定对违法行为予以行政处罚。对不能确定驾驶人的,可以对违法的机动车车主或者管理人依法予以处罚。电子警察等拍摄的违法行为记录,交通管理部门应当在道路交通安全违法行为发生之日起15日内,采取短信、电话等方式告知违法行为人接受处理的时间、地点;当事人逾期未到指定地点接受处理的,可以采取邮寄书面通知或者公告方式告之。由于现在大多数违法数据的审查和鉴别还需人工操作,所以在上述法定期限内一般都无法送达行政处罚通知书。另外,交通管理部门承担非现场执法的现有电子警察设备,由于技术方面的缺失,对关于情节轻微,未影响道路通行的,及时指出违法行为,做出给予口头警告后放行等法律处置,尚不能提供足够的技术支撑。
   因此,现有的机动车交通违法自动处理系统已无法满足社会发展的要求,需要作出创新和改进。
发明内容
   本发明所要解决的技术问题在于:提供一种机动车交通违法实时告知、确认的系统及方法,不仅能使当事人当场获知交通违法记录,及时得到警示、纠正和教育,有效行使其陈述和申辩的权利;而且又能为交通管理部门尽快确认具体违法的驾驶人,避免其找人替代接受处罚的情况出现,更加以人为本,增强交通参与者遵守交通法规的自觉性、主动性和交通安全法制意识,形成良好的交通氛围,预防道路交通违法、交通事故的发生,实现对交通违法行为的有效管理和遏制的效果。
为解决上述技术问题,本发明提出了一种机动车交通违法实时告知、确认的系统,包括用户终端设备、电子警察设备以及交通管理中心,其中,
   所述用户终端设备用于录入驾驶人员、机动车车主、机动车的识别信息,然后通过网络通讯系统将识别信息上传至所述交通管理中心进行注册或取消,并接收、显示所述交通管理中心发送的车辆的涉嫌违法信息后,向交通管理中心反馈需要了解、申诉或确认的信息;
   所述电子警察设备用于对过往的违法车辆进行监测取证,然后通过网络通讯系统将所获取的涉嫌违法信息上传至所述交通管理中心;
   所述交通管理中心具有后台业务计算机中心和数据库,其用于对来自电子警察设备上传的车辆涉嫌违法信息和用户终端设备注册或取消的识别信息进行接收、存储和分析判断,并根据分析判断的情况向用户终端设备发送相关告知、提醒和举证信息。
   进一步地,所述用户终端设备包括中央处理器以及分别与该中央处理器连接的第一通讯模块、信息输入模块、信息显示模块和语音播报模块,所述第一通讯模块用于收、发信息;所述信息输入模块用于输入文字、语音和影象信息;所述信息显示模块用于显示文字、图像信息。
   进一步地,还包括用户身份信息卡,用户身份信息卡上记载着驾驶人员、机动车车主的识别信息,所述信息输入模块读取用户身份信息卡记载的识别信息后上传至所述交通管理中心进行注册或取消。
   进一步地,所述第一通讯模块采用光纤网络模块、ADSL有线网络模块、GPRS/CDMAIX或其他频道无线通讯模块中的任一一种进行通讯,以将识别信息上传至所述交通管理中心进行注册或取消。
   进一步地,所述电子警察设备包括拍摄装置、工控主机以及分别与该工控主机连接的图象处理模块、抓拍模块、车辆牌照识别模块和第二通讯模块,所述拍摄装置与图象处理模块连接。
   进一步地,还包括辅助光源、与所述工控主机连接的辅助光源控制模块,所述辅助光源与辅助光源控制模块连接。
   进一步地,所述第二通讯模块采用光纤网络模块、ADSL有线网络模块、GPRS/CDMAIX及其他频道无线通讯模块中的任一一种进行通讯,以将所获取的涉嫌违法信息上传至所述交通管理中心。
   为解决上述技术问题,本发明还提出了一种机动车交通违法实时告知、确认的方法,包括下列步骤:
   步骤一:通过用户终端设备录入驾驶人员、机动车车主、机动车的识别信息,然后通过网络通讯系统将识别信息上传至交通管理中心进行注册或取消;
   步骤二:电子警察设备对过往的违法车辆进行监测取证,然后通过网络通讯系统将所获取的涉嫌违法信息上传至交通管理中心;
   步骤三:交通管理中心通过后台业务计算机中心对接收到的车辆的涉嫌违法信息、识别信息进行匹配对比分析,无须经过人工审查,实时将所获取的涉嫌违法车辆的涉嫌违法信息发送至已注册的用户终端设备,并将涉嫌违法信息记录在数据库中;
   步骤四:用户终端设备接收到车辆的涉嫌违法信息后,驾驶人员和或机动车车主向交通管理中心反馈需要了解、申诉或确认的信息,交通管理中心将用户终端设备回复的反馈信息记录保存在数据库中。
   进一步地,所述步骤三中还包括:交通管理中心对驾驶人员的信息和机动车车主的信息进行对比判断,如果驾驶人员的信息与机动车车主的信息相同,交通管理中心将用户终端设备设置为便捷操作功能;如果驾驶人员的信息与机动车车主的信息不同,交通管理中心则通过相应通讯系统将涉嫌违法信息同时告知驾驶人员和机动车车主,并将相应的信息记录在的驾驶人员、机动车车主各自的数据库中。
   进一步地,所述步骤四中还包括:交通管理中心对驾驶人员和机动车车主回复的各类信息都记录保存在数据库中,并与相关待处理违法个案信息进行相互链接。
   上述技术方案至少具有如下有益效果:本发明通过采用用户终端设备录入驾驶人员、机动车车主、机动车的识别信息,然后通过网络通讯系统将识别信息上传至交通管理中心,并接收、显示交通管理中心发送的涉嫌违法信息,在安全、方便的时间向交通管理中心反馈需要了解、申诉或确认的信息;通过电子警察设备对过往的违法车辆进行监测取证,然后通过网络通讯系统将所获取的涉嫌违法信息上传至所述交通管理中心;再通过交通管理中心对电子警察设备上传的涉嫌违法信息和用户终端设备录入的识别信息进行分析判断,并存储在交通管理中心的数据库中,同时根据分析判断的情况向用户终端设备发送相关告知、提醒和举证等信息。不仅能使当事人当场获知交通违法记录,及时得到警示、纠正和教育,有效行使其陈述和申辩的权利;而且又能为交通管理部门尽快确认具体违法的驾驶人,避免其找人替代接受处罚的情况出现,更加以人为本,增强交通参与者遵守交通法规的自觉性、主动性和交通安全法制意识,形成良好的交通氛围,预防道路交通违法、交通事故的发生,提高对交通违法行为的有效管理和自动化处理的实时性、交互性及合法性的综合效果。

   需要说明的是,在不冲突的情况下,本申请中的实施例及实施例中的特征可以相互组合。下面结合附图对本发明做进一步描述。
   实施例一
   如图1至图3所示,本发明实施例一的机动车交通违法实时告知、确认系统包括用户终端设备10、电子警察设备20以及交通管理中心30,其中:
   用户终端设备10用于录入驾驶人员、机动车车主、机动车的识别信息,然后通过网络通讯系统将识别信息上传至交通管理中心30进行注册或取消,并接收、显示交通管理中心30发送的相关告知、提醒和举证信息。具体地,识别信息为驾驶人员的身份信息、机动车车主姓名单位、号牌信息等各种数据,可以根据交通管理部门的要求制定,在此不做限定;用户终端设备10包括中央处理器11以及分别与该中央处理器11连接的第一通讯模块12、信息输入模块13、信息显示模块14和语音播报模块15,第一通讯模块12用于收、发信息;信息输入模块13用于输入文字、语音、影象等信息;信息显示模块14用于显示文字、语音、影象等信息。在实施过程中,第一通讯模块12可以采用光纤网络模块、ADSL有线网络模块、GPRS/CDMAIX或其他频道无线通讯模块中任一一种模块进行通讯,以将识别信息上传至所述交通管理中心30进行注册或者取消,用户终端设备10可供驾驶人员和机动车车主(或管理人)以文字、语音和图象等方式中的一种或其组合向交通管理中心30的后台业务计算机中心进行信息传送,交通管理中心30的后台业务计算机中心可采用声、光、文字、语音和图象等方式中的一种或其组合通过用户终端设备10向驾驶人员和机动车车主(或管理人)进行警示和信息传送。
   电子警察设备20用于对过往的违法车辆进行监测取证,然后通过网络通讯系统将所获取的涉嫌违法信息上传至交通管理中心30。具体地,电子警察设备20包括拍摄装置21、工控主机22以及分别与该工控主机22连接的图象处理模块23、抓拍模块24、车辆牌照识别模块25和第二通讯模块26,拍摄装置21与图象处理模块23连接。在实施过程中,第二通讯模块26也可以采用光纤网络模块、ADSL有线网络模块、GPRS/CDMAIX及其他频道无线通讯模块中任一一种模块进行通讯,以将所获取的涉嫌违法信息上传至交通管理中心30,当车辆涉嫌违法、违章时,拍摄装置21启动对该违法车辆进行取像,并将图片发送至车辆牌照识别模块25,车辆牌照识别模块25从图片中提取出车辆号牌信息后,将电子警察设备20所在的地点信息连同违法车辆牌照号、违法时间等完整、有效的车辆涉嫌违法信息发送交通管理中心30并存储至交通管理中心30的数据库中。
   交通管理中心30具有后台业务计算机中心和数据库,交通管理中心30用于接收、分析判断来自电子警察设备20上传的车辆涉嫌违法信息和用户终端设备10录入的识别信息,并存储在交通管理中心30的数据库中,同时根据分析判断的情况向用户终端设备10发送相关告知、提醒和举证信息。
   使用时,若干个电子警察设备20固定或移动地设置于交通道路监测点上,其数量根据实际需要而定,电子警察设备20对过往车辆进行检测,对违法车辆进行取证并将包括违法车辆号牌信息在内的完整的车辆涉嫌违法信息,通过第一通讯模块12上传并存储至交通管理中心30后台业务计算机中心的数据库中。
   若干个用户终端设备10既可以随车安装或设置于机动车车主(或管理人)相对固定的场所,也可以便携形式由驾驶人员和机动车车主(或管理人)随身携带,其数量根据实际需要而定,驾驶人员和机动车车主的身份信息根据使用需要和变化,可以通过键盘、音像等输入装置录入用户终端设备10或变更原有记录,对驾驶人员和机动车车主的新的身份信息进行录入或刷新,并通过第一通讯模块12上传并存储至交通管理中心30的数据库中。
   设置于交通道路监测点上的电子警察设备20,对涉嫌各类违法、违章的过往车辆进行抓拍,交通管理中心30的后台业务计算机中心根据抓拍到的违法车辆的号牌信息与驾驶人员和机动车车主预先储存在数据库中的信息进行实时比对,如发现信息相匹配,则立即通过第二通讯模块26向驾驶员和机动车车主的用户终端设备10发出告知和要求确认的信息,驾驶员和机动车车主也可以用户终端设备10及时向交通管理中心30的后台业务计算机中心反馈信息。
   本发明不仅能使当事人当场获知交通违法记录,及时得到警示、纠正和教育,有效行使其陈述和申辩的权利;而且又能为交通管理部门尽快确认具体违法的驾驶人,避免其找人替代接受处罚的情况出现,更加以人为本,增强交通参与者遵守交通法规的自觉性、主动性和交通安全法制意识,形成良好的交通氛围,预防道路交通违法、交通事故的发生,实现对交通违法行为的有效管理和遏制的效果。
   实施例二
   本实施例与实施例一的不同之处在于,还包括辅助光源27、与工控主机22连接的辅助光源控制模块28,辅助光源27与辅助光源控制模块28连接。因此,电子警察设备20还可以根据当前坏境照度,通过辅助光源27辅助取像,使得录制、抓怕的图像信息更加清晰。
   实施例三
   参照实施例一,在用户终端设备10录入驾驶人员、机动车车主、机动车的识别信息的过程中,本发明实施例的机动车交通违法实时告知、确认系统还可以包括用户身份信息卡40,用户身份信息卡40上记载着驾驶人员、机动车车主的识别信息,信息输入模块13读取用户身份信息卡40记载的识别信息后上传至所述交通管理中心30进行注册或取消。这样,用户可以预先将识别信息记录在用户身份信息卡40中,使用时插入用户终端设备10的卡槽中,自动识别录入或变更原有记录,使用更加方便。
   实施例四
   如图4所示,本发明实施例的机动车交通违法实时告知、确认方法包括下列步骤:
   步骤一:通过用户终端设备10录入驾驶人员、机动车车主、机动车的识别信息,然后通过第一通讯模块12将识别信息上传至交通管理中心30进行注册或取消。具体地,机动车车主使用用户终端设备10或其他设备,通过预制的用户身份信息卡40、键盘输入、语音输入、影象输入等形式,将机动车车主姓名单位、号牌信息、机动车车主(管理人)的通信地址、电话号码通过自助、人工等方式上传至交通管理中心30,并保存到交通管理中心30的数据库中,如因变化可及时更新,以及便于交通管理中心30准确辨识机动车车主(管理人)行貌、声音和特设密码(如银行网络支付、手机支付等)等识别信息。
   步骤二:电子警察设备20对过往的违法车辆进行监测取证,然后通过第二通讯模块26将所获取的车辆涉嫌违法信息上传至交通管理中心30。
   步骤三:交通管理中心30通过后台业务计算机中心对接收到的车辆的涉嫌违法信息、识别信息进行匹配对比分析,如果匹配则及时将所获取的涉嫌违法车辆的涉嫌违法信息发送至已注册的用户终端设备10,并将涉嫌违法信息记录在数据库中。具体地,电子警察设备20发现车辆涉嫌违法、违章时,通过拍摄装置21、图象处理模块23、抓拍模块24进行摄像、拍照进行取像,以及车辆牌照识别模块25提取出车辆号牌信息后,无需经人工审查车辆违法证据的完备性,交通管理中心30的后台业务计算机中心可与比对机动车车主、驾驶员数据库中相关信息,如匹配可及时将该电子警察设备20所获取的涉嫌违法车辆牌照号、违法类型、违法地点、违法时间等信息直接发送至队机动车车主、驾驶员。
   步骤四:用户终端设备接收到车辆的涉嫌违法信息后,在确保安全情况下、方便的时间向交通管理中心反馈需要了解、申诉或确认的信息;交通管理中心30将用户终端设备10回复的反馈信息记录保存在数据库中,并根据回复信息对用户进行选择性处理。具体地,预先注册登记在交通管理中心30的机动车车主、驾驶员数据库中的机动车车主、驾驶员,在接收到交通管理中心30发送的车辆涉嫌违法类型、违法地点、违法时间等信息的警示后,可在确保驾驶安全的前提下,尽快做出回复信息,及时表明或与该车辆违法个案无关要求免责,或还需过查看电子警察设备20搜集的关于该违法车辆个案的地点、时间及具体违法行为等证据信息,再行申辩最终做出确认或否认的意思表示,避免电子设备的机械误判,更加科学,以人为本,而且交通管理中心30的后台业务计算机中心将反馈信息,记录在机动车违法数据库中,并与机动车车主、驾驶员数据库建立相关链接,方便以后交通管理中心30在查处该车辆涉嫌违法个案中,判断其对涉嫌违法行为反映及时度、真实度和认识态度,结合其以往违法次数、频度和种类,作为对机动车车主、驾驶员能否从轻、减轻或免予处罚的重要依据。
   实施例五
   本实施例与实施例四的不同之处在于,所述步骤三中还包括:交通管理中心30对驾驶人员和机动车车主的信息进行对比判断,如果驾驶人员和机动车车主的信息相同,交通管理中心30将用户终端设备10设置为便捷操作功能;如果驾驶人员和机动车车主信息不同,交通管理中心30将驾驶人员的信息记录在相应的驾驶员数据库中,并通过第一通讯模块12将涉嫌违法信息及时告知机动车车主。具体地,比如机动车变更驾驶人员,新的驾驶人员可使用用户终端设备10及时更新相关信息,交通管理中心30的后台业务计算机中心则记录在相应的机动车车主、驾驶员数据库中,并通过相应通讯系统及时告知机动车车主或管理人,以便机动车车主或管理人第一时间了解情况,避免责任纠纷,机动车车主或管理人也可主动通过自己的用户终端设备10,代替新的驾驶人员向交通管理中心30的后台业务计算机中心变更驾驶人员的相关信息,并通过系统告知及提醒新驾驶人员。
   实施例六
   本实施例与实施例四的不同之处在于,所述步骤四中还包括:交通管理中心30对驾驶人员和机动车车主回复的各类信息都记录保存在数据库中,并与相关待处理违法个案信息进行相互链接。方便在查处该车辆、该驾驶员涉嫌违法个案中,判断其对涉嫌违法行为反映及时度、真实度和认识态度,结合其以往违法次数、频度和种类,作为对机动车车主、驾驶员能否从轻、减轻或免予处罚的重要依据,从而提高对交通违法行为的有效管理和自动化处理的实时性、交互性及合法性的综合效果。
   现有广泛使用的GPRS/CDMAIX无线通讯模式的手机,就可以作为机动车车主(或管理人)、驾驶人员的一种便携形式用户终端设备,机动车车主的身份的变化和车辆驾驶人员的更换,可以键盘、手写笔等输入装置录入或变更原有记录,通过短信、彩信、微信或上网等形式存储至交通管理中心30的后台业务计算机系统的驾驶员、机动车车主信息数据库中。系统可采用文字、语音和图象等方式中的一种通过手机终端设备向驾驶人员和机动车车主(或管理人)进行警示和信息传送。系统以当值交警的名义可以要求机动车车主(或管理人),特别是驾驶人员,优先采用任何一种能准确辨识其行貌、声音和特设密码等身份信息的通讯方式,向交通管理中心反馈其需要了解、申诉或确认的信息。系统还可结合已安装的具备自动搜寻机动车随车手机信号并能确定手机号码功能的电子警察设备,主动发送相关告知、提醒和举证等信息,或建议和引导持有该手机而未加入系统的机动车车主(或管理人)、驾驶人员尽快录入或变更登记。
   综上所述,下面对本发明的机动车交通违法实时告知、确认系统及方法进行详细描述。
   在用户终端设备10端,主要执行以下步骤:

   U22、驾驶员、机动车车主(管理人)收到交通管理中心30机动车涉嫌违法并要求回复的信息,在确保交通安全前提下;首先可就违法主体(车或人)进行异议或确认;
   U23、驾驶员、机动车车主(管理人)还可回复交通管理中心30需另外安排时间查看相关证据再行确认或申辩;
   U24、驾驶员、机动车车主(管理人)还可回复交通管理中心30需现场立即查看相关证据以便确认或申辩;
   U25、驾驶员、机动车车主(管理人)现场立即查看相关证据,还可回复交通管理中心30需另外安排时间进行确认或申辩;
   U26、驾驶员、机动车车主(管理人)现场回复提出其他意见。
   在电子警察设备20(如超速电子警察)端,主要执行以下步骤:
   P11、读取超速电子警察运行参数,如限制车速Vi、地点、车道号等;
   P12、启动车辆检测功能;
   P13、判断当前车道是否有车辆通过,若是则进入步骤P14,否则返回步骤P12;
   P14、启动测速功能,获得当前车速Vo;
   P15、判断Vo是否大于Vi,若是则说明车辆超速行驶,进入步骤P16,否则返回步骤P12;
   P16、启动图象处理模块23、辅助光源控制模块28、车辆牌照识别模块25;
   P17、启动抓拍模块24,生成超速违法记录,包括违法车辆图片,其牌照号、违法地点、违法时间、车速等信息;
   P18、将超速违法记录上传到机动车违法数据库中。
   在交通管理中心30的后台业务计算机中心端,主要执行以下步骤:
   E31、提取涉嫌违法机动车号牌信息或其他车辆识别信息,并与机动车车主、驾驶员数据库中的预留信息进行实时比对,如发现匹配记录则;
   E32、分别机动车车主(管理人)、驾驶员机动车涉嫌违法被记录发送告知、询问信息(如:你(驾驶)的号牌xxx机动车在以下时间、地点被交通技术监控设备记录有交通违法行为,如有异议请提出陈述和申辩。收到可回复!),并可同时要求机动车车主(管理人)、驾驶员优先以最能证明本人身份的形式(顺序为与留存备案于交通管理部门特征相同的现场本人驾车视频、声音及特定电话手机号码)进行回复;
   E33、如机动车车主(管理人)回复否认本车违法(规),系统提醒车主(管理人)注意车辆管理及交通安全,将往来信息录入系统相关数据库;如驾驶员回复否认本人驾驶该车违法(规),系统提醒驾驶员注意交通安全和及时变更登记信息,将往来信息录入系统相关数据库;
   E34、如机动车车主(管理人)回复需另外安排时间查看相关证据再行确认或申辩,系统提醒车主注意交通安全和及时处理违章,并将往来信息录入系统相关数据库;如驾驶员回复需另外安排时间查看相关证据再行确认或申辩,系统提醒驾驶员注意交通安全和及时处理违章,将往来信息录入系统相关数据库;
   E35、如机动车车主(管理人)回复要求立即查看相关证据以便确认或申辩,系统提醒车主注意交通安全,同时发送违法(规)图片、视频等信息;如驾驶员回复要求立即查看相关证据以便确认或申辩,系统提醒驾驶员注意交通安全,同时发送违法(规)图片、视频等信息;
   E36,如机动车车主(管理人)、驾驶员查看相关证据后,回复确认违法(规),系统提醒注意交通安全和及时按相关规定处理违章,并将往来信息录入系统相关数据库:
   E37、如机动车车主(管理人)、驾驶员查看相关证据后,回复不确认违法(规)并现场提出申辩,系统提醒注意交通安全和及时按相关规定处理违章,并将往来信息录入系统相关数据库:
   E38、、不论机动车车主(管理人)、驾驶员是否现场确认或申辩,系统将包括驾驶员、机动车车主(管理人)回复在内的所有往来信息录入交通管理信息系统,并将驾驶员、机动车车主、机动车的涉嫌违法信息数据库与相关待处理违法个案信息进行相互链接。
   本发明能使当事人当场有效获知涉嫌交通违法的记录,及时得到警示、纠正,又便于其能有效行使陈述和申辩的权利,更好地接受交通管理部门做出的合理处罚;同时又能为交通管理部门尽快确认具体违法的驾驶人,避免其找人替代接受处罚所谓“买分”情况的出现;对可能因指示不清、路况不明等客观因素造成的初犯、偶犯,情节轻微,未影响道路通行,交通管理部门可依法作出给予警告、免予或从轻、减轻等处罚的情形,提供了足够的技术支撑;综合提升执法的教育功能、执法效率和公平度,有效预防和减少了道路交通违法、交通事故的发生,体现对交通违法行为进行强化管理和遏制的效果。
   以上所述是本发明的具体实施方式,应当指出,对于本技术领域的普通技术人员来说,在不脱离本发明原理的前提下,还可以做出若干改进和润饰,这些改进和润饰也视为本发明的保护范围。

Claims (10)

  1. 一种机动车交通违法实时告知、确认的系统,其特征在于,包括用户终端设备(10)、电子警察设备(20)以及交通管理中心(30),其中,
       所述用户终端设备(10)用于录入驾驶人员、机动车车主、机动车的识别信息,然后通过网络通讯系统将识别信息上传至所述交通管理中心(30)进行注册或取消,并接收、显示所述交通管理中心(30)发送的车辆的涉嫌违法信息后,向交通管理中心(30)反馈需要了解、申诉或确认的信息;
       所述电子警察设备(20)用于对过往的违法车辆进行监测取证,然后通过网络通讯系统将所获取的涉嫌违法信息上传至所述交通管理中心(30);
       所述交通管理中心(30)具有后台业务计算机中心和数据库,其用于对来自电子警察设备(20)上传的车辆涉嫌违法信息和用户终端设备(10)注册或取消的识别信息进行接收、存储和分析判断,并根据分析判断的情况向用户终端设备(10)发送相关告知、提醒和举证信息。
  2.    根据权利要求1所述的机动车交通违法实时告知、确认的系统,其特征在于,所述用户终端设备(10)包括中央处理器(11)以及分别与该中央处理器(11)连接的第一通讯模块(12)、信息输入模块(13)、信息显示模块(14)和语音播报模块(15),所述第一通讯模块(12)用于收、发信息;所述信息输入模块(13)用于输入文字、语音和影象信息;所述信息显示模块(14)用于显示文字、图像信息。
  3.    根据权利要求2所述的机动车交通违法实时告知、确认的系统,其特征在于,还包括用户身份信息卡(40),用户身份信息卡(40)上记载着驾驶人员、机动车车主的识别信息,所述信息输入模块(13)读取用户身份信息卡(40)记载的识别信息后上传至所述交通管理中心(30)进行注册或取消。
  4. 根据权利要求2所述的机动车交通违法实时告知、确认的系统,其特征在于,所述第一通讯模块(12)采用光纤网络模块、ADSL有线网络模块、GPRS/CDMAIX或其他频道无线通讯模块中的任一一种进行通讯,以将识别信息上传至所述交通管理中心(30)进行注册或取消。
  5.    根据权利要求1所述的机动车交通违法实时告知、确认的系统,其特征在于,所述电子警察设备(20)包括拍摄装置(21)、工控主机(22)以及分别与该工控主机(22)连接的图象处理模块(23)、抓拍模块(24)、车辆牌照识别模块(25)和第二通讯模块(26),所述拍摄装置(21)与图象处理模块(23)连接。
  6. 根据权利要求5所述的机动车交通违法实时告知、确认的系统,其特征在于,还包括辅助光源(27)、与所述工控主机(22)连接的辅助光源控制模块(28),所述辅助光源(27)与辅助光源控制模块(28)连接。
  7. 根据权利要求5所述的机动车交通违法实时告知、确认的系统,其特征在于,所述第二通讯模块(26)采用光纤网络模块、ADSL有线网络模块、GPRS/CDMAIX及其他频道无线通讯模块中的任一一种进行通讯,以将所获取的涉嫌违法信息上传至所述交通管理中心(30)。
  8.    一种机动车交通违法实时告知、确认的方法,其特征在于,包括下列步骤:
       步骤一:通过用户终端设备(10)录入驾驶人员、机动车车主、机动车的识别信息,然后通过网络通讯系统将识别信息上传至交通管理中心(30)进行注册或取消;
       步骤二:电子警察设备(20)对过往的违法车辆进行监测取证,然后通过网络通讯系统将所获取的涉嫌违法信息上传至交通管理中心(30);
       步骤三:交通管理中心(30)通过后台业务计算机中心对接收到的车辆的涉嫌违法信息、识别信息进行匹配对比分析,无须经过人工审查,实时将所获取的涉嫌违法车辆的涉嫌违法信息发送至已注册的用户终端设备(10),并将涉嫌违法信息记录在数据库中;
       步骤四:用户终端设备(10)接收到车辆的涉嫌违法信息后,驾驶人员和或机动车车主向交通管理中心(30)反馈需要了解、申诉或确认的信息,交通管理中心(30)将用户终端设备(10)回复的反馈信息记录保存在数据库中。
  9.    根据权利要求8所述的机动车交通违法实时告知、确认的方法,其特征在于,所述步骤三中还包括:交通管理中心(30)对驾驶人员的信息和机动车车主的信息进行对比判断,如果驾驶人员的信息与机动车车主的信息相同,交通管理中心(30)将用户终端设备(10)设置为便捷操作功能;如果驾驶人员的信息与机动车车主的信息不同,交通管理中心(30)则通过相应通讯系统将涉嫌违法信息同时告知驾驶人员和机动车车主,并将相应的信息记录在的驾驶人员、机动车车主各自的数据库中。
  10.    根据权利要求8所述的机动车交通违法实时告知、确认的方法,其特征在于,所述步骤四中还包括:交通管理中心(30)对驾驶人员和机动车车主回复的各类信息都记录保存在数据库中,并与相关待处理违法个案信息进行相互链接。
