Abstract
Dispositivo accesorio con fijación magnética. Se describen un mecanismo y un método de fijación magnética. El mecanismo de fijación magnética se puede usar para fijar de forma desprendible al menos dos objetos conjuntamente en una configuración preferida sin sujetadores y sin intervención externa. El mecanismo de fijación magnética se puede usar para fijar de forma desprendible un dispositivo accesorio a un dispositivo electrónico. El dispositivo accesorio se puede usar para aumentar la funcionalidad de la utilidad del dispositivo electrónico.

Declaración motivada según los artículos 29.6 y 29.7 del Reglamento de ejecución de la Ley 11/1986, de 20 de marzo, de Patentes sobre la novedad y la actividad inventiva; citas y explicaciones en apoyo de esta declaraciónReivindicaciones 1-16Se considera D01 el documento del estado de la técnica anterior más próximo al objeto de la reivindicación 1. En este documento se describe el siguiente dispositivo (las referencias entre paréntesis se refieren a D01):Unidad accesoria que comprende una bisagra (10) para su unión con una unidad anfitrión (4) que tiene una pantalla de visualización (6), y una tapa flexible (8) conectada giratoriamente a la bisagra con forma y tamaño en concordancia con la pantalla de visualización (6), en uno de cuyos extremos se sitúa una protuberancia (12) que junto con un área (66, 68) de la pantalla forma un sensor que detecta una configuración cerrada y en consecuencia permite la alteración del estado de funcionamiento de la pantalla (ver párr. 19-20).La diferencia entre este dispositivo y el reivindicado reside en los medios mediante los cuales la unidad anfitrión detecta el cierre o apertura de la tapa, que en D01 consisten en un sensor de presión (12,66) mientras en la solitud se trata de un sistema constituido por un imán y un sensor Hall.No obstante, este tipo de mecanismo es ampliamente conocido en el sector de la técnica relacionada, tal y como el propio documento D01 menciona (ver párrafo 2) y como se puede también constatar, por ejemplo, en el dispositivo descrito en D03 (ver párr. 22-23, fig. 2). Por tanto, el sistema de imanes y sensor Hall reivindicado se trataría de una de las alternativas equivalentes conocidas para detectar la configuración cerrada de una tapa sobre una pantalla electrónica, al alcance de cualquier experto en la materia y por tanto de implementación obvia.Por todo lo anterior, se considera que a la vista del contenido del documento D01 la reivindicación 1 no satisface el requisito de actividad inventiva establecido en el Art. 8.1 de la Ley de Patentes 11/86.Por otra parte, las reivindicaciones 3, 8-9 y 15-16, dependientes de la reivindicación 1, no comprenden características adicionales o alternativas que satisfagan el requisito de actividad inventiva (Art. 8.1 LP) frente al documento D01.En cuanto a las reivindicaciones 10-14, referidas a la conexión y comunicación entre la unidad accesoria y la unidad anfitrión, en el documento D02 se describe una unidad accesoria (204) unida giratoriamente a un unidad anfitrión (100) y que se comunica con esta mediante una interfaz de información y mediante conexiones a través de la bisagra (ver párr.3642 y figuras).Se considera que la mera yuxtaposición de los elementos descritos en D01 y D02 llevaría a la solución reivindicada en las reivindicaciones 10-14, y que por tanto la combinación de estos documentos afecta al requisito de actividad inventiva (Art.
- 8.1 LP) de las mismas.En cuanto a la reivindicación 2 y el resto de las reivindicaciones dependientes 4-7, referidas a la región plegable que une unos segmentos primero y segundo de la tapa, y los insertos magnéticos que comprenden éstos, incorporan características novedosas frente al estado de la técnica anterior. Además estas características entrañan una contribución técnica frente al estado de la técnica anterior que no sería obvia para un experto en la materia.Así la región plegable junto con la característica de detección de la configuración abierta o cerrada de la tapa permite la presentación del contenido visual de la pantalla sobre una determinada área parcial de la pantalla, lo que constituye una ventaja técnica del dispositivo reivindicado frente al estado de la técnica anterior.Por otra parte, los insertos magnéticos permiten la fijación de una estructura de soporte para la unidad anfitrión que debido a la configuración de la región plegable presenta diferentes formas de uso, lo que asimismo proporciona una ventaja técnica. Se considera que la implementación de estas características novedosas en cualquiera de los dispositivos descritos en el estado de la técnica anterior, con objeto de dotar al conjunto formado por la unidad anfitrión y la unidad accesoria de las ventajas mencionadas requeriría de un cierto esfuerzo inventivo por parte de un experto en la materia.Por tanto, a la vista del estado de la técnica anterior las reivindicaciones 2, 4-7 satisfacen los requisitos de novedad y actividad inventiva que se establecen en los Artículos 6.1 y 8.1 de la Ley de Patentes 11/86.OPINIÓN ESCRITAReivindicaciones 17-25Análogamente a lo expuesto con anterioridad, la reivindicación 17, referida a una cubierta protectora con las características técnicas de la unidad accesoria de la reivindicación 1, no satisface el requisito de actividad inventiva (Art. 8.1 LP) frente al documento D01.Asimismo, siguiendo los argumentos presentados anteriormente, se considera que las reivindicaciones 18-25 satisfacen los requisitos de novedad (Art. 6.1 LP) y actividad inventiva (Art. 8.1 LP) frente al estado de la técnica anterior.Reivindicaciones 26-30Se considera D02 el documento del estado de la técnica anterior más próximo al objeto de las reivindicaciones 26-30. Este documento afecta a la novedad y actividad inventiva de estas reivindicaciones, tal y como se explicará a continuación. Este documento describe el siguiente dispositivo (las referencias entre paréntesis se refieren a D02):Dispositivo accesorio separable que comprende los siguientes elementos:-un cuerpo (204); -una interfaz de usuario (219,220); -un conjunto de bisagras (202) con un conector (300) para la comunicación entre la interfaz y un circuito externo (100); -una bisagra adaptada para recibir de forma separable el circuito externo, de forma que al estar ambos unidos el dispositivo accesorio se mueve entre una posición cerrada y otra abierta por medio de la bisagra y la información puede pasar directamente entre la interfaz de usuario y el circuito externo (figura 6).En vista de lo anterior, todas las características que definen el dispositivo de la reivindicación 26 están idénticamente descritas en D02 por lo que no se satisface el requisito de novedad del Artículo 6.1 de la Ley de Patentes 11/86.Las reivindicaciones 27-30 no comprenden características adicionales que en combinación con las características de la reivindicación 26, de la que dependen, satisfagan los requisitos de novedad (27, 29) o actividad inventiva (28,30) según los Art. 6.1 y 8.1 de la Ley de Patentes, respectivamenteReivindicaciones 31-38El objeto de las reivindicaciones 31-34 se considera anticipado por el contenido del documento D01. Del mismo modo que en el caso de la reivindicación 1 y alguna de sus reivindicaciones dependientes, la diferencia entre el dispositivo descrito en D01 y el reivindicado en la solicitud reside en los medios mediante los cuales la unidad anfitrión detecta el cierre o apertura de la tapa, que en la solitud son un elemento magnético y un sensor Hall.Tal y como se explicaba anteriormente, este mecanismo es ampliamente conocido en el estado de la técnica, y por tanto se considera una alternativa equivalente, cuya implementación sería obvia para un experto en la materia.Por tanto las reivindicaciones 31-34, a la vista del estado de la técnica anterior a la solicitud, no satisfacen el requisito de actividad inventiva (Art. 8.1 LP).En cuanto a las reivindicaciones 35-38, presentan ciertas características novedosas referidas a la presencia de ciertos segmentos flexibles en la configuración de la unidad accesoria que tienen como efecto técnico la presentación del contenido visual en zonas parciales de la pantalla, lo que dota al dispositivo de una mayor versatilidad. Se considera que la modificación del dispositivo descrito en D01 para llegar a la solución definida en las reivindicaciones 35-38 requeriría de un cierto esfuerzo inventivo por parte de un experto en la materia.Por tanto, en vista del estado de la técnica anterior, las reivindicaciones 35-38 satisfacen los requisitos de novedad y actividad inventiva (Art. 6.1 y 8.1 LP).En conclusión, a las vista del estado de la técnica anterior, satisfacen los requisitos de patentabilidad establecidos en Art. 4.1 LP, las reivindicaciones 2,4-7,18-25, 35-38.
