権利には、いくつかのタイプがあり、具体的には、これ
らは芸術作品の利用に応じたものである。音楽作品の場
合、まず第１に、作品の音響の再現に関連した権利があ

許可されている法人によって一般に承認される興行権が
生じる。
【００２８】上述の権利は一例である。芸術的オーディ
オビジュアル作品の利用に関連する他の権利が存在し、
または生じる場合がある。同様に、権利の定義、具体的
にはそれらの適用例の条件は変更することができる。し
かし、芸術作品の利用から生じる権利がどのようなタイ
プであっても、また、その適用例がどのような条件であ
っても、本発明の方法およびデバイスを適用することが
できる。
【００２９】前述のように、従来技術のオーディオビジ
ュアル情報を配信するためのデバイスは、権利を有する
人に支払われるべき総額を決定することを可能にする手
段を提供せず、一旦、オーディオビジュアルセレクショ
ンが配信されると、それらに対するいかなる制御も行使
しなかった。その結果、従来技術のそれらのデバイスを
使用したオーディオビジュアル情報の配信は、たいてい
の場合、オーディオビジュアル情報に対応する芸術作品
のサードパーティの権利と関係なく実施されている。

ワークを介してオーディオビジュアル情報の形式で芸術
作品配信専門のサーバに接続されている端末を使用して
芸術作品が命令（command）されるときに、その芸術作
品に対して権利を有する人への使用料および税金の支払
を考慮することを可能にする、オーディオビジュアル情
報を配信するためのデバイスおよび方法を提供すること
によって、この問題を解決することを提案する。

【課題を解決するための手段】次に、本発明の限定的で
ない一実施形態を、図１Ａおよび１Ｂを参照しながら説
明する。以下に説明するデバイスは、音響再現に関連す
る権利、特に音響作品のコピーに関連する権利を考慮す
ることを可能にする。しかし、同じ原理を適用すること
によって、オーディオビジュアル作品のあらゆる種類の
利用に関連するすべての権利を考慮することが可能であ
る。

【発明の実施の形態】本発明による配信デバイスは、双
方向通信リンク３によって少なくとも１つの遠隔端末１
に接続されている、オーディオビジュアル情報を配信す
るためのサーバ２を備える。図１Ａおよび１Ｂには１つ
の端末しか示さない。しかし、本発明によるサーバ２
は、同時に様々なタイプのリンクを介して複数の端末１
に接続することができる。

なる可能なタイプの通信リンクを考慮するために、異な

結を可能にする通信インターフェースを備える。通信管
理モジュールは、一方では、サーバ端末通信方向Ａで、
サーバから連結３のタイプに適した形式で着信する情報
を転記（transcribe)し、もう一方では、端末サーバ通
信方向Ｂで、端末から連結３のタイプに適した形式で着
信する情報を転記する転記手段を備える。通信管理モジ
ュール２０は、端末１から受信した信号から、端末から
の要求、またはサーバ２からの要求への端末１からの応
答を抽出するために、端末１から受信した信号を分析す
る手段を備える。最後に、通信管理モジュール２０は、
要求、またはサーバ内関連モジュールへの応答を、送信
する手段を備える。
【００３４】サーバ２の異なるモジュール間の通信は、
それ自体で知られている双方向バス２５を使用して作成
される。
【００３５】認証モジュールと呼ばれる第１のモジュー
ル２１は、たとえば、サーバ２との接続を確立する責任
を有するすべての端末１の識別を表わす情報の一部を、
データベース２１０に含む。認証モジュール２１は、ユ

れる情報の利用を指定する。実際に、サーバ２によって
送信されるオーディオビジュアル情報には複数の利用が
ある。第１の場合、端末１は、サーバ２に命令された音
楽セレクションをリアルタイムに聴くために使用するこ
とができる。第２の場合、端末１は、サーバ２に命令さ
れた音楽セレクションを、何回でも再生する目的で、記
憶するために使用することができる。したがって、第１
の場合、１回の放送に対して１つの使用料を権利を有す
る人に支払わなければならない。第２の場合では、２つ
の状態が可能である。第１の状況では、一方では、作品
のコピーに対する使用料が計算されて支払われなければ
ならず、もう一方では、セレクションの音響再生ごとに
使用料が計算されて支払われなければならない。第２の
状況では、データの記憶とその無制限の使用に対する支
払いは、ユーザによって一回払いで行われる。この状況
は、オーディオＣＤやカセットなどの従来型の媒体で歌
を購入することに非常に類似している。この場合、使用
料は、ダウンロードごとに一回払いとして計算すること
もできる。すなわち、利用の使用料の支払いは様々な方
法で計算されるので、利用の管理は必然的に異なること
を理解されたい。このような計算法の違いは、適用され
るレートだけでなく、このレートが適用されなければな
らない回数にもある。
【００３６】したがって、登録時には、サーバ２によっ
て端末１に送信されるオーディオビジュアル情報の１つ
または複数の利用を判定するために、たとえばユーザに
知られていないコードまたは固有のキーが端末に割り当
てられる。このコードまたは固有のキーは、端末の識別
子やパスワードに関連付けられている。使用するたび
に、ユーザは、オーディオビジュアル情報の１つに対し
て考えられ得るすべての利用、すなわち、個人的な再現
または公的な再現、オンデマンドまたはセレクションリ
ストのランダム方式でのコピーおよび再現を、当然、把
握するだろう。
【００３７】認証モジュール２１は、サーバ２に登録さ
れている各端末１の接続を管理する手段も含む。この管
理手段については、図２を参照しながら後述する。
【００３８】サーバ２は、グラフィックインターフェー
スと呼ばれる第２のモジュール２２を含む。このインタ
ーフェースモジュール２２は、サーバとの接続を確立済

は認証手順中の認証モジュール２１からの端末１に対す
る要求のどちらかを処理する手段を備える。実際には、
認証手順中、認証モジュール２１は、端末１のサーバへ
のアクセスを認証するために、端末１にそれ自体を識別
することを求めなければならない。この要求は、認証モ
ジュール２１によって通信管理モジュール２０を介して
端末１に送信される要求によって実行される。この要求
は、接続しようと試行中の端末が適切に登録されている
こと、すなわち、その識別子とパスワードがデータベー
ス２１０に正確に含まれていることを検証するために、
端末の識別子とパスワードを求めることを含む。この要

する許可が得られたときにのみ、そのセレクションは端
末に対して使用可能になる。したがって、セレクション
はデータベース形式で記憶することができ、フラグシス
テムは、セレクションが端末へのダウンロードに使用可
能であることを識別することを可能にする。セレクショ
ンの放送またはコピーの権利を有する関係者との合意に
関して、合意が得られたかどうかを示すフラグが使用さ
れる。すべてのフラグが、すべての合意が得られたこと
を示すとき、セレクションはダウンロードに使用可能で
ある。反対に、１つのフラグが、合意が得られていない
ことを示す場合、そのフラグが同じ状態である限り、セ
レクションはダウンロードに対して使用可能ではない。
【００４０】サーバ２は、使用料計算モジュールと呼ば
れる第４のモジュール２４を含む。このモジュール２４
は、各端末１から送信され、受信された、送信されたセ
レクションの利用に関する情報を収集する手段を含む。
収集されたこの情報は、サーバのデータ記憶手段に記憶
される。使用料計算モジュール２４は、また、各セレク
ションのコピーまたは放送の回数に応じて使用料を計算
するためのエレメントを、たとえばデータベースに含
む。これらの計算エレメントは、具体的には、セレクシ

にセレクションが送信されるとすぐに、通信管理モジュ

信されているか、それとも一回限りの支払いで無制限に
使用することを意図して記憶するために送信されている
か、それとも使用料の計算を生じる他のなんらかの利用
のために送信されているかを示すことによって、使用料

前述のように、セレクションがリアルタイムに聴かれる
だけであれば、現在施行されている法律では、媒体の変
更はなく、したがって、再現の権利だけが支払われるべ
きとされる。これとは反対に、送信されたセレクション
を記憶することが許可されている端末１にセレクション
が送信される場合、コピー権利が支払われるべきとされ
る。別の例では、セレクションが公共の場所で再生され
ることが意図される場合、興行権も支払うべきとされ
る。
【００４１】同様に、各端末１が、サーバ２への各接続
中に、記憶する目的でサーバ２によって送信されたセレ
クションを受信するとき、情報は、端末１で受信したセ
レクションがすでに再生された回数を決定する。管理モ
ジュール２０は、この情報を受信すると、データベース
に記憶されている計算エレメントに応じて、権利を有す
る関係者の各々に支払われるべき使用料の正確な計算を
実行することができる、使用料計算モジュール２４の情
報収集手段にその情報を通知する。記憶および再生に対
する使用料が一回限りの支払いの形式で支払われる場合
でも、端末１で受信したセレクションが再生された回数
を決定する情報は、後述するような情報の目的のために
要求され、記憶される。
【００４２】本発明による各端末１は、マイクロプロセ
ッサをもったデバイス１０の周囲に編成される。このデ
バイス１０は、具体的には、サーバとの通信、セレクシ
ョンを選び命令すること、リアルタイムにセレクション
を聴くこと、セレクションの記憶および記憶されたセレ
クションの還元の管理を可能にする、複数の制御回路１
１、１２、１３、１４を含む。第１の制御回路１１は、
サーバ２との通信リンク３との通信インターフェースを
構成する。この第１の制御回路１１は、電話リンク、衛
星リンクまたはケーブルリンクである場合があるリンク
と一致させることができる。この第１の回路１１の機能
は、サーバの管理モジュールの機能と実質的に同じだ
が、ただし端末１の側にある。実際には、第１の制御回
路１１は、リンク３を介して着信したデータＡがマイク

の変形形態によれば、第３の回路１３は、以下でＤＳＰ
（デジタル信号プロセッサ）として示す信号プロセッサ
の周辺に作成される。ＤＳＰは、その入力でセレクショ
ンに対応するオーディオビジュアル情報のストリームを
受信する。このオーディオビジュアル情報は、圧縮、ま
たは符号化および可能な場合は暗号化されたデジタルデ

暗号化される。ＭＭＰ形式のデータは、ＭＰ３形式でデ

の１３１０の暗号化解除モジュールによって暗号化解除
される。このデータフローは、ＷＡＶ形式などの標準の
デジタル形式によって圧縮解除されたデータの流れを出
力部で獲得することを可能にする復号化モジュール１３

との間のリンクが初期化される。この初期化は、特に、
サーバの管理モジュール２０と端末の第１の回路１１と
の間の接続に対応する。次に、認証を要求するステップ
４０２がある。このステップでは、サーバ２は、端末の
識別子およびパスワードを請求するために、認証モジュ
ール２１を介して端末に要求を送信する。たとえばサー
バ２のグラフィックインターフェースモジュール２２ま
たは端末のグラフィックモジュールによって生成され
た、識別子を入力するための第１のゾーンとパスワード
を入力するための第２のゾーンとを含む歓迎用の画面
（welcome screen）を表示することによって、この要求
の受信は端末１で翻訳される。ユーザは、登録手順中に
自分に割り当てられた識別子とパスワードを入力し、次
いで自分の入力を確認する。この確認によって、サーバ
によって送信された要求に対する応答の送信が可能にな
る。認証を請求するこのステップは、識別子とパスワー
ドが端末１に記憶されているときは自動化することがで

すぐに、識別子とパスワードは特別の表示なしにサーバ
に戻される。

セレクションを記憶することを許可されているかどう
か、端末がリアルタイムにセレクションを実行すること
だけを許可されているかどうか、端末が以前に記憶した
セレクションを何回でも実行することが許可されている
かどうかを検証する。端末が記憶することを許可されて
いる場合、第５のステップ４０５で、報告ファイルを請
求する要求が端末に送信される。端末がセレクションを
記憶することを許可されていない場合、セレクション選
択ステップと呼ばれる第６のステップ４０６がトリガさ
れる。勿論、セレクションの他の利用が端末１で可能な
とき、対応する情報が認証モジュールに含まれる。
【００７１】セレクションを記憶することが許可された
端末１は、報告ファイルを請求する要求を受信すると、
報告ファイルが情報を含む場合はその報告ファイルの内
容をサーバに送信し、次いでそのファイルを空にする。
報告ファイルが空の場合、端末はそのファイルが空であ
ることを示すメッセージを送信する。指定された時間間
隔の後でサーバが回答を受信しない場合、サーバは、８
番目のステップで端末との通信を切断するか、またはそ
の要求を反復する。サーバが回答を受信すると、通信管

実、グラフィックインターフェースモジュール２２によ
って生成された対話画面または音声メッセージのどちら
かを端末に送信することによって構成される。これらの
画面は、特に、セレクションライブラリ２３からグラフ
ィックインターフェースモジュール２２によって読み込
まれた、使用可能なセレクションのリストを含む。可能

通知する。端末がセレクションを記憶することを許可さ
れていない場合、すなわち端末がセレクションをリアル
タイムに聴くことしか許可されていない場合、サーバ２
の通信管理モジュール２０は、使用料計算モジュール２
４に、命令されたセレクションのリストの各セレクショ
ンを再現する権利と、場合によっては現在施行されてい
る法律に応じてコピーする権利とを記録するように通知
する。
【００７３】要求している端末に、命令されたセレクシ
ョンに対応するデジタルデータを送信することに引き続
き、ユーザに、少なくとも１つのセレクションを再度命
令し、次いで、再度セレクションステップから開始して
プロセス全体を実行することを可能にするか、それとも
サーバ２との接続のシャットダウンを可能にするため
に、グラフィックインターフェースモジュール２２によ
って生成された画面を端末１に送信することができる。

スのセキュリティを向上させるために、暗号化方法は、
少なくとも２つの暗号化キーを統合する。端末が登録さ

【００７６】端末１にインストールされたソフトウェア
エレメントは、端末１に記憶されたセレクションの利
用、またはサーバへの接続が行われたときのモードや時
間帯などの統計的情報を収集する手段を含むことができ
る。それらの収集手段は、端末のデータ記憶手段に関し
て報告する、統計的情報をファイルに記憶する手段を含
む。収集手段は、端末からサーバ２への接続が行われた
ときに、このファイルに含まれる情報をサーバ２に送信

【００８２】支払の第３の方法は、セレクションの命令
に対する規則的な支払いに基づくものである。この支払
いのモードでは、端末１に歌が送信されるたびに、サー
バの支払モジュールが、端末に関連付けられた口座を更
新する。その後、定期的に、サーバの支払モジュール
は、勘定を清算するために請求書を発行し、その請求書
は、その口座に関連付けられた端末１のユーザに送信さ

  1. 【請求項１】 サーバ（２）と、双方向通信（３）によ
    ってサーバに接続された少なくとも１つの端末（１）と
    の間でオーディオビジュアル情報を配信する方法であっ
    て、 サーバにおいて、各端末について、端末を一意的に識別
    しかつ端末のタイプを登録するための登録ステップと、 サーバへの端末の接続ごとに、サーバによって端末を認
    証する認証ステップ（４０２）と、 サーバへの端末の接続中に端末のユーザによって選ばれ
    たオーディオビジュアル情報（４０６）の少なくとも１
    つのセレクションをダウンロードするステップ（４１
    ３）であって、オーディオビジュアル情報のセレクショ
    ンを送信する形式は、宛先端末だけが該セレクションを
    利用することができるような形式であるステップ（４１
    ３）と、 オーディオビジュアル情報の各セレクションの利用をサ
    ーバのデータベースに記憶するステップとを含むことを
    特徴とするオーディオビジュアル情報を配信する方法。

    リアルタイムに実行すること、または宛先端末上でオー
    ディオビジュアル情報を実行する目的でオーディオビジ
    ュアル情報を記憶すること、またはオーディオビジュア
    ル情報を宛先端末上に記憶した後でオーディオビジュア
    ル情報をリアルタイムに実行することのいずれかを含む
    ことを特徴とする請求項１に記載のオーディオビジュア
    ル情報を配信する方法。
  3. 【請求項３】 認証ステップ（４０２）が、端末（１）
    が、該端末（１）にダウンロードされたオーディオビジ
    ュアル情報の所望の利用に関係する記憶された情報を送
    信するステップ（４０７）を含むことを特徴とする請求
    項１または２に記載のオーディオビジュアル情報を配信
    する方法。
  4. 【請求項４】 オーディオビジュアル情報に権利を有す
    る関係者の各々に支払われるべき使用料の総額を決定す
    るために、サーバが、端末（１）にダウンロードされた
    オーディオビジュアル情報の利用に関係する、記憶され
    または受信された情報を処理するステップを含むことを
    特徴とする請求項３に記載のオーディオビジュアル情報
    を配信する方法。
  5. 【請求項５】 登録ステップが、オーディオビジュアル
    情報が端末に送信される形式および指定された利用に対
    応する形式に応じて、復号化手段および暗号化解除手段
    またはその一方を送信するステップを含むことを特徴と
    する請求項１から４のいずれか一項に記載のオーディオ
    ビジュアル情報を配信する方法。
  6. 【請求項６】 端末のタイプが、端末上でのオーディオ
    ビジュアル情報の利用を規定することを特徴とする請求
    項１から５のいずれか一項に記載のオーディオビジュア
    ル情報を配信する方法。
  7. 【請求項７】 認証ステップ中、またはユーザの選択
    中、またはダウンロードステップの前に、命令されたセ
    レクションに対して支払うステップを含むことを特徴と
    する請求項１から６のいずれか一項に記載のオーディオ
    ビジュアル情報を配信する方法。
  8. 【請求項８】 端末とサーバとの間の接続中に、端末に
    よって記憶されたセレクションの利用に関する統計的記
    録を端末に記憶するステップと、該統計的記録に対応す
    る情報を端末によって送信するステップとを含むことを
    特徴とする請求項１から７のいずれか一項に記載のオー
    ディオビジュアル情報を配信する方法。
  9. 【請求項９】 複数の音楽セレクションおよびビデオセ
    レクションまたはその一方を表わすためのオーディオビ
    ジュアル情報を含む大容量データ記憶手段（２３）を含
    むサーバ（２）と、データ記憶手段（１４０）およびサ
    ーバ（２）との双方向通信リンク（３）を含む少なくと
    も１つの端末（１）とを備えるオーディオビジュアル情
    報を配信するためのデバイスであって、サーバ（２）の
    データ記憶手段が、端末に送信されたオーディオビジュ
    アル情報の利用を規定する各端末の識別を含み、各端末
    （１）が、サーバ（２）との通信リンク（３）を介して
    少なくとも１つのセレクションを選ぶこと（１２１、１
    ２２）をユーザに可能にするためのユーザとの対話式手
    段と、オーディオビジュアルセレクションを表わす、サ
    ーバ（２）によって送信された情報を実行する手段（１
    ３、１３０）とを備えることを特徴とする、オーディオ
    ビジュアル情報を配信するためのデバイス。
  10. 【請求項１０】 各端末（１．１．１から１．ｎ．
    ｎ３）が、双方向リンクを介してマルチサービスサーバ
    （４．１から４．ｎ）に接続されており、マルチサービ
    スサーバ（４．１から４．ｎ）も同様に双方向リンクを
    介してサーバ（２）に接続されており、各マルチサービ
    スサーバ（４．１から４．ｎ）が、一方で、サーバ
    （２）から端末（１．１．１から１．ｎ．ｎ３）に向け
    られた各メッセージを送信し、もう一方で、端末（１．
    １．１から１．ｎ．ｎ３）からサーバ（２）に向けられ
    た各メッセージを送信するための手段を備えることを特
    徴とする請求項９に記載のオーディオビジュアル情報を
    配信するためのデバイス。
  11. 【請求項１１】 実行する手段が、サーバ（２）から送
    信されたオーディオビジュアル情報を端末上でリアルタ
    イムに実行する手段を備えることを特徴とする請求項９
    または１０に記載のオーディオビジュアル情報を配信す
    るためのデバイス。
  12. 【請求項１２】 端末の実行する手段が、送信されたオ
    ーディオビジュアル情報の再利用を禁止する手段（１３
    ３．１、１３３．２、１３３．３）を含むことを特徴と
    する請求項１１に記載のオーディオビジュアル情報を配
    信するためのデバイス。
  13. 【請求項１３】 端末の実行する手段が、送信されたオ
    ーディオビジュアル情報を記憶する手段を備えることを
    特徴とする請求項１１に記載のオーディオビジュアル情
    報を配信するためのデバイス。
  14. 【請求項１４】 端末が、サーバから端末に送信された
    セレクションの利用に関係する情報を記録する手段を備
    えることを特徴とする請求項１１に記載のオーディオビ
    ジュアル情報を配信するためのデバイス。
  15. 【請求項１５】 サーバが、セレクションの利用に関係
    する、各端末によって送信された情報から、サーバによ
    って記録され、端末に送信されたセレクションの利用に
    権利を有する関係者の各々に支払われるべき使用料を計
    算する手段を備えることを特徴とする請求項１４に記載
    のオーディオビジュアル情報を配信するためのデバイ
    ス。
  16. 【請求項１６】 利用手段が、デジタル情報を提供する
    ためにサーバによって送信されたオーディオビジュアル
    情報を復号化する手段を備えたＤＳＰと、ＤＡ変換器
    と、データ記憶手段に対する少なくとも１つのデジタル
    情報用出力部と、デジタル情報の記憶を許可するための
    または許可しないための、各デジタル出力部用のコマン
    ド手段とを備えることを特徴とする請求項１１に記載の
    オーディオビジュアル情報を配信するためのデバイス。
  17. 【請求項１７】 対話式手段（１２１、１２２）が、少
    なくとも１つの対話画面を表示するためのディスプレイ
    手段に関連付けられたポインタおよびタッチ画面もしく
    はその一方、または少なくとも１つの音声メッセージを
    変換するためのオーディオ変換手段に関連付けられた音
    声コマンドシステム、またはこれらの組み合わせを備え
    ることを特徴とする請求項９から１６のいずれか一項に
    記載のオーディオビジュアル情報を配信するためのデバ
    イス。
