Opis wzoru przemyslowego Przedmiotem wzoru przemyslowego jest etykieta produktu spozywczego, przeznaczona do umieszczania na opakowaniach jednostkowych. Istote wzoru przemyslowego stanowi nowa i posiadajaca indywidualny charakter postac wytwo- ru, nadana mu przez oryginalny wystrój graficzno-kolorystyczny oraz cechy linii konturów i ksztaltów. Przedmiot wzoru przemyslowego zostal przedstawiony na zalaczonych ilustracjach, na których: 1. Fig. 1 - przedstawia pierwsza odmiane wzoru, 2. Fig. 2 - przedstawia druga odmiane wzoru, 3. Fig. 3 - przedstawia trzecia odmiane wzoru. Wszystkie odmiany wzoru przemyslowego charakteryzuja sie tym, ze w górnej czesci etykiety znajduja sie cztery liscie obwiedzione bialym konturem, przy czym dwa górne liscie sa koloru zielone- go, a kolor dwóch dolnych zalezny jest od smaku produktu. Na górnych lisciach umieszczony jest napis „Kochaj zycie 1936 TYMBARK", przy czym na mniejszym lisciu z lewej strony widnieje ciemno- zielony napis „Kochaj zycie" a na wiekszym lisciu z prawej strony znajduje sie napis TYMBARK wyko- nany duzymi, drukowanymi literami w kolorze jasno - i ciemno-zielonym. Napis jest polozony na linii luku na bialym tle, obwiedziony ciemno-zielona ramka od zewnatrz oraz jasno-zielona od wewnatrz. Na wysokosci liter M, B, A na dolnym brzegu ramki otaczajacej napis TYMBARK umieszczony jest owoc jablka w kolorze czerwonym z jasno-zielonym listkiem. Analogicznie na wysokosci liter M, B, A nad górnym brzegiem ramki widoczne sa cyfry 1936 w kolorze ciemno-zielonym, z których kazda jest obrysowana jasnozielona linia, dajaca efekt przestrzenny - trójwymiarowy. Ponizej, umiejscowiony równiez na lisciu, znajduje sie jasno-zielony napis SYROP o fantazyjnym ksztalcie. W centralnej cze- sci etykiety znajduja sie owoce: cale, jak równiez ich czesci. Ponadto tlo kazdej z etykiet w górnej czesci jest zielone, ponizej rozjasnione bialym pasem, a w srodkowej czesci jest kolorowe (w zalezno- sci od smaku produktu), z charakterystycznym rozjasnianiem w dolnej czesci, w postaci licznych kolo- rowych kropek na bialym tle. Kazda z etykiet ma ksztalt prostokata. Pierwsza odmiana wzoru (fig. 1) charakteryzuje sie tym, ze ponizej napisu „1936 Tymbark" a powyzej napisu „syrop", na lisciu w kolorze rózowym znajduje sie bialy napis „malina". W centralnej czesci etykiety, na czerwono-rózowym tle znajduja sie owoce malin, na których widoczne sa krople wody oraz zielone liscie. Druga odmiana wzoru (fig. 2) charakteryzuje sie tym, ze ponizej napisu „1936 Tymbark" a po- wyzej napisu „syrop", na lisciu w kolorze pomaranczowym znajduje sie bialy napis „pomarancza". W centralnej czesci etykiety, na pomaranczowo-zóltym tle znajduje sie owoc pomaranczy w calosci jak i w czesci, na którym widoczne sa krople wody oraz zielone liscie. Trzecia odmiana wzoru (fig. 3) charakteryzuje sie tym, ze ponizej napisu „1936 Tymbark" a po- wyzej napisu „syrop", na lisciu w kolorze czerwonym znajduje sie bialy napis „wisnia". W centralnej czesci etykiety, na czerwono-fioletowym tle znajduja sie owoce wisni, na których widoczne sa krople wody. Etykieta wykonana jest z folii PVC, przy czym moze byc wykonana z innych materialów. Wykaz odmian wzoru: 1. Fig. 1 - pierwsza odmiana wzoru, 2. Fig. 2 - druga odmiana wzoru, 3. Fig. 3 - trzecia odmiana wzoru. Cechy istotne wzoru przemyslowego: - centralna czesc etykiety stanowia owoce, w calosci jak ich czesci, wchodzace w sklad poszczególnych smaków produktu, - napis „Kochaj zycie 1936 Tymbark Syrop" umieszczone na charakterystycznych dwukolo- rowych lisciach, - biale napisy okreslajace smak napoju, umieszczone powyzej slowa syrop na dolnych li- sciach obwiedzionych bialym konturem, - tlo etykiety w górnej czesci jest zielone, a w dolnej czesci zblizone do koloru prezentowa- nego owocu, rozjasniane u samego dolu etykiety. The essence of the industrial design is the product's new and unique form, imbued with an original graphic and color scheme and the characteristics of contour lines and shapes. The industrial design is presented in the attached illustrations, which: 1. Fig. 1 - shows the first design variant; 2. Fig. 2 - shows the second design variant; 3. Fig. 3 - shows the third design variant. All industrial design variants are characterized by the fact that the upper part of the label features four leaves outlined in white, with the upper two leaves being green, and the color of the lower two depending on the product's flavor. The inscription "Love life 1936 TYMBARK" is placed on the upper leaves, with the smaller leaf on the left side bearing the dark green inscription "Love life" and the larger leaf on the right side bearing the inscription TYMBARK in large, block letters in light and dark green. The inscription is placed on an arc line on a white background, surrounded by a dark green frame on the outside and a light green frame on the inside. At the height of the letters M, B, A, on the lower edge of the frame surrounding the inscription TYMBARK, a red apple with a light green leaf is placed. Similarly, at the height of the letters M, B, A, above the upper edge of the frame, the numbers 1936 are visible in dark green, each outlined with a light green line, creating a three-dimensional effect. Below, also placed on a leaf, is a light green, fancifully shaped inscription reading "SYRUP." The central part of the label features whole and partially cut fruit. Furthermore, the background of each label is green in the upper part, lightened by a white stripe below, and colored in the middle (depending on the product's flavor), with a characteristic highlight in the lower part, in the form of numerous colored dots on a white background. Each label is rectangular. The first variation of the design (Fig. 1) is characterized by the white inscription "raspberry" placed below the inscription "1936 Tymbark" and above the inscription "syrup" on a pink leaf. In the central part of the label, on a red-pink background, there are raspberries with visible water drops and green leaves. The second design variant (fig. 2) is characterized by the fact that below the inscription "1936 Tymbark" and above the inscription "syrup" there is a white inscription "pomarancza" on an orange leaf. In the central part of the label, on an orange-yellow background, there is a whole and part orange fruit with visible water drops and green leaves. The third design variant (fig. 3) is characterized by the fact that below the inscription "1936 Tymbark" and above the inscription "syrup" there is a white inscription "cherry" on a red leaf. In the central part of the label, on a red-purple background, there are cherries with visible water drops. The label is made of PVC foil, but can be made of other materials. Significant features of the industrial design: - the central part of the label consists of fruit, both whole and part, comprising individual product flavors, - the inscription "Kochaj zycie 1936 Tymbark Syrop" placed on characteristic two-color leaves, - white inscriptions specifying the drink's flavor, placed above the word syrup on the lower leaves outlined in white, - the background of the label is green in the upper part, and in the lower part similar to the color of the presented fruit, lightening at the very bottom of the label.
