Claims
条約 1 9条に基づく説明書 請求の範囲第 1項記載の光デバイスにおいては、メィンビームの反射光をホログラム 素子の第 1及ぴ第 2の領域で回折させた回折光を波長に依らず共通の受光領域で受光 する第 1の受光領域を有している。文献 1に記載の発明では、図 4の記載から明らかな ように、 18 b〜18 d, 19 b〜19 d, 20b〜20 d, 21 b〜21 dのように メインビームの受光領域は波長に依つて異なつた領域である。
さらに、請求の範囲第 1項記載の光デバイスにおいては、第 1及び第 2のサブビーム の反射光をホログラム素子の第 1及び第 2の領域で回折させた回折光を波長に依つて 異なる領域の対となっている第 2の受光領域で受光しており、第 2の受光領域の検出出 力の結線の仕方に工夫をこらしている。 これにより、減算器の数を減らすことが可能と なる。 文献 1に記載の発明では、 図 8の記載から明らかなように、受光領域の検出出力 の結線の仕方が明らかに異なっている。
以上より、 請求の範囲第 1項, 第 2項は進歩性を有している。 なお、 請求の範囲第 9 項, 第 10項は請求の範囲第 7項を引用し、請求の範囲第 7項は請求の範囲第 3項を引 用を引用しているので、 進歩性を有さないとの判断は妥当ではないと思料する。
