Przedmiotem wzoru przemyslowego jest butelka, która przeznaczona jest do rozlewania, przechowywania i transportu plynów, w szczególnosci likierów i wódek oraz do wykorzystania w przemysle spozywczym. Bliskim odpowiednikiem wzoru przemyslowego wedlug zgloszenia, jest wzór przemyslowy nr 49548 pt. „Butelka", opublikowany w oficjalnym biuletynie Rospatentu „Wzory przemyslowe", Moskwa, 2001 r., nr 11, str. 48, zarejestrowany na rzecz „Alfa-Eko- M" L.t.d. Wzór przemyslowy wedlug zgloszenia rózni sie od najblizszego odpowiednika ksztaltem szyjki, oraz usytuowaniem i ksztaltem nacieku wykonanego na kryzie wienczacej korpus butelki a takze owalem z liczba ,1872" umieszczonym na ksztaltowym nadlewie, jak równiez dwoma wypuklymi napisami „Nemiroff wykonanymi w pionowych zaglebieniach, umieszczonych na bocznych powierzchniach korpusu, oraz obecnoscia na tylnej stronie butelki w dolnej czesci korpusu elementu reliefowego z karbem posrodku. Butelka wedlug zglaszanego wzoru przemyslowego przedstawiona zostala na rysunku, na którym fig 1 pokazuje butelke w widoku z przodu, fig. 2 butelke w widoku z boku. Korpus 1 butelki ma ksztalt stozka, zwezajacego sie ku dolowi i zwienczony jest u góry kryza 2 o powierzchni sferycznej, która w srodku przechodzi w stozkowata lekko wypukla u dolu szyjke 3, zaopatrzona u góry w cylindryczny wieniec 4, po którym nastepuje koncówka z gwintem na zakretke. Po bokach kryzy 2 wykonano naciek ksztaltowy 5 w postaci dwóch wystepów -jezyczków" splywajacych w dól, przy czym naciek ksztaltowy 6 po stronie przedniej ma ksztalt zblizony do pólkola wypukloscia skierowanego w kierunku dna, na którym znajduje sie plytka 7 w ksztalcie owalu. Dolna linia owalu 7 ma ksztalt zbiezny z ksztaltem nadlewu 6 a czesc górna jest zwierciadlanym odbiciem czesci dolnej, przy czym owal 7 usytuowany jest symetrycznie wzgledem wypuklosci nadlewu 6 i w srodku ma wpisana liczbe „1872". Na bocznych powierzchniach korpusu 1 butelki wykonane sa pionowe zaglebienia 8, w którychumieszczono wypukle napisy „Nemiroff 9 Czesc dolna butelki lagodnie przechodzi w dno 10 w ksztalcie wyokraglonego wgiecia, zas na tylnej stronie korpusu, w dolnej czesci, wykonano element reliefowy 11 z karbem 12 posrodku. W butelce stanowiacej najblizszy odpowiednik wzoru przemyslowego wedlug zgloszenia, szyjka w dolnej czesci zaopatrzona jest naciek w ksztalcie kropli, zas nadlew wykonany na kryzie ma postac karczku sukienki, laczacego sie z boku z ozdobnikiem w postaci linii wygietej w góre, pod która znajduje sie owalna ramka z liczba „1860" w srodku. Powierzchnie boczne, zaopatrzone sa natomiast w „nisze", w których wykonano elementy dekoracyjne w postaci stylizowanych herbów Imperium Rosyjskiego z umieszczonymi pod nimi liczbami. Butelka stanowiaca przedmiot niniejszego zgloszenia jest produkowana na skale masowa w warunkach produkcji z wykorzystaniem istniejacych urzadzen i technologii.fig.1 fig.2 PLThe subject of the industrial design is a bottle intended for bottling, storing, and transporting liquids, particularly liqueurs and vodkas, and for use in the food industry. A close equivalent of the industrial design, according to the application, is industrial design no. 49548 entitled "Bottle," published in the official Rospatent bulletin "Industrial Designs," Moscow, 2001, no. 11, p. 48, registered in favor of "Alfa-Eko-M" L.t.d. The industrial design according to the application differs from its closest equivalent in the shape of the neck, the location and shape of the indentation made on the flange crowning the body of the bottle, as well as the oval with the number "1872" placed on the shaped boss, as well as two convex inscriptions "Nemiroff" made in vertical recesses placed on the side surfaces of the body, and the presence on the back of the bottle in the lower part of the body of the relief element with a notch in the middle. The bottle according to the applied industrial design is presented in the drawing, where Fig. 1 shows the bottle in a front view, Fig. 2 shows the bottle in a side view. The body of the bottle 1 has the shape of a cone, narrowing downwards and is topped with a flange 2 with a spherical surface, which in the middle turns into a slightly convex conical at the bottom, a neck 3, provided at the top with a cylindrical rim 4, followed by a tip with a thread for a cap. On the sides of the flange 2, a shaped infiltration 5 is made in the form of two protrusions - "tongues" flowing downwards, while the shaped infiltration 6 on the front side has a shape similar to a semicircle with its convexity directed towards the bottom, on which there is an oval-shaped plate 7. The lower line of the oval 7 has a shape convergent with the shape of the riser 6 and the upper part is a mirror image of the lower part, where the oval 7 is situated symmetrically in relation to the riser convexity 6 and has the number "1872" inscribed in the middle. On the sides of the bottle's body 1, vertical recesses 8 are made, in which the convex inscriptions "Nemiroff" 9 are placed. The lower part of the bottle gently transitions into the bottom 10 in the form of a rounded dent, while on the rear side of the body, in the lower part, a relief element 11 is made with a notch 12 in the middle. In the bottle that is the closest equivalent of the industrial design according to the application, the neck in the lower part is provided with a drop-shaped infusion, while the ledge made on the collar has the form of a dress yoke, connected on the side with an ornament in the form of a line bent upwards, below which there is an oval frame with the number "1860" in the center. The side surfaces, on the other hand, are provided with "niches" in which decorative elements in the form of stylized coats of arms of the Russian Empire with numbers placed below them. Essential features The industrial design is characterised by: - the body being in the shape of a cone narrowing towards the bottom; - the upper part of the bottle being in the shape of a spherical surface; - vertical recesses on the side surfaces; - the presence of an oval on the front side of the spherical surface of the bottle; differs from: - the upper part of the bottle being in the shape of a spherical surface; - vertical recesses on the side surfaces; - the presence of an oval on the front side of the spherical surface of the bottle; distinguishes itself by: - the shape of the neck being in the form of a cone widening towards the bottom, slightly convex in its lower part; - the presence of a shaped infiltration on the flange; - placing an oval with the number "1872" on the shaped drip; - making a drip on the front side of the bottle in the shape of a convexity directed towards the bottom; - making a drip on the sides of the bottle in the shape of two downward-directed protrusions - "tongues"; - presence of a convex inscription "NemirofT" in vertical recesses located on the side surfaces of the body; - making the inscription "NemirofT" in Latin letters; - presence on the back side of the bottle, in the lower part of the body, of a relief element with a notch in the middle.
