Przedmiotem wzoru przemyslowego jest butelka czworoscienna przeznaczona do napojów, w tym szczególnie do napojów alkoholowych. Istota wzoru oraz jej odmian, w odniesieniu do powszechnie znanych i stosowanych butelek, jest ksztalt wydluzonej szyjki, oraz proporcje tej szyjki w stosunku do pozostalej czesci korpusu, a takze oryginalne uksztaltowany czworoscienny korpus oraz umieszczone na nim rysunki i napisy. Przedmiot wzoru uwidoczniony jest na rysunkach, na których fig. 1 - przedstawia butelke w widoku z przodu, fig. la - przedstawia rzut z góry butelki oraz fig.2 - przedstawia odmiane butelki w widoku z przodu, 2a - przedstawia rzut z góry tej odmiany butelki. Jak pokazano na rysunkach fig. 1 i fig. la - butelka posiada wydluzona, wysoka szyjke, która u góry zakonczona jest ozdobna zakretka, ponizej - na niewielkiej wysokosci - ma ksztalt walca, a jeszcze nizej - ksztalt zblizony do czworosciennego ostroslupa scietego o sciankach lukowo wkleslych do srodka i scietych krawedziach bocznych - co w obwodowych konturach scianek bocznych daje w widoku z góry ksztalt osmiokata. Bryla tego ostroslupa dolna podstawa laczy sie osmioscianem stanowiacym zasadniczy korpus butelki. Korpus w dolnej czesci jest na calym obwodzie powiekszony. Górna krawedz konturowa tego powiekszenia na przedniej i tylnej sciance butelki, a takze na sciankach bocznych ma ksztalt wygietego w góre luku, natomiast na sciankach naroznych jest prosta.W rzucie z góry korpus ma ksztalt kwadratu o bokach lekko wypuklych na zewnatrz oraz skosnie scietych narozach, z których wyprowadzone sa narozne scianki szyjki posiadajace w tym rzucie ksztalt trójkatów o wierzcholkach zanikajacych w kierunku osi butelki. Ponadto szyjka butelki ozdobiona jest rozmieszczonymi na jej powierzchni drobnymi gwiazdkami, natomiast na sciance czolowej korpusu butelki umieszczony jest stylizowany napis The Old York Vodka, z ponizej - rysunek obrazujacy fragment miasta z wysokimi budowlami i pod tym rysunkiem kolejny napis - Old York wykonany takze stylizowanymi literami. Równiez na zakretce - na jej obwodowej, bocznej oraz na górnej sciance umieszczony jest ozdobny napis Old York. Odmiana butelki przedstawiona na iysunkach fig. 2 i fig. 2a rózni sie od butelki zilustrowanej na rysunkach fig 1 i la tym, ze na szyjce nie posiada ozdobnych gwiazdek. Tak wiec charakteryzuje sie ona tym, ze jej szyjka u góry zakonczona jest ozdobna zakretka, ponizej na niewielkiej wysokosci ma ksztalt walca, zas jeszcze nizej przybiera ksztalt czworosciennego ostroslupa scietego o sciankach lukowo wkleslych do srodka i scietych krawedziach bocznych - co w obwodowych konturach scianek bocznych daje w widoku z góry ksztalt osmiokata. Równiez na zakretce - na jej obwodowej bocznej oraz na górnej sciance umieszczony jest ozdobny napis Old York. Kolejna odmiana butelki przedstawiona na rysunkach fig. 3 i fig. 3a - charakteryzuje sie tym , ze szyjka u góry zakonczona jest gwintowanym nadlewem,ponizej na niewielkiej wysokosci ma ksztalt walca, a jeszcze nizej przybiera ksztalt zblizony do czworosciennego ostroslupa scietego o sciankach lukowo wkleslych do srodka. Bryla tego ostroslupa dolna podstawa laczy sie z czworoscianem stanowiacym zasadniczy korpus butelki. Na przedniej czolowej sciance korpusu, a takze na przeciwleglej, tylnej jego sciance, wykonany jest owalny nadlew z wyprowadzonymi symetrycznie na boki dwoma ramionami w postaci luków. Luki te lacza obydwa owalne nadlewy tj. owal z przedniej oraz tylnej scianki. W rzucie z góry korpus ma ksztalt kwadratu o lekko wypuklych na zewnatrz bokach oraz zaokraglonych narozach. Wzór butelki z wydluzona szyjka wykonany jest w 3-ech odmianach w tym: fig. 1 i fig. la - przedstawia wzór butelki czworosciennej z ozdobnymi gwiazdkami na szyjce butelki fig.2 i fig. 2a - przedstawia butelke czworosciennabez ozdobnych gwiazdek, tj z gladka szyjka; Jak wynika z opisu i rysunków cechy istotne wzoru to: - wydluzona czworoscienna szyjka radykalnie zmieniajaca proporcje w stosunku do pozostalej czesci korpusu; - czworoscienny ksztalt korpusu - w obwodowych konturach scianek bocznych posiadajacych ksztalt osmiokata; - powiekszenie dolej czesci korpusu; - ozdobny lukowaty ksztalt górnych krawedzi tego powiekszenia (fig. 1 i fig. 2); - ozdobienie szyjki dekoracyjnymi gwiazdkami (fig. 1). The essence of the design and its variants, in relation to commonly known and used bottles, is the shape of the elongated neck and the proportions of this neck in relation to the rest of the body, as well as the uniquely shaped tetrahedral body and the drawings and inscriptions placed on it. The subject of the design is shown in the drawings, in which Fig. 1 shows the bottle from the front, Fig. 1a shows a top view of the bottle, and Fig. 2 shows a variant from the front, and 2a shows a top view of this bottle variant. As shown in Figures 1 and 1a, the bottle has an elongated, high neck, topped with a decorative cap. Below, at a short height, it is cylindrical in shape, and further down, it resembles a truncated tetrahedral pyramid with walls arcing toward the center and chamfered side edges. The circumferential contours of the side walls give the shape of an octagon when viewed from above. The lower base of this pyramid connects to an octahedron, constituting the bottle's main body. The body is enlarged along its entire circumference in the lower section. The upper contour of this enlargement on the front and rear walls of the bottle, as well as on the side walls, has the shape of an upward curve, while on the corner walls it is straight. Viewed from above, the body is square with slightly convex outward sides and obliquely cut corners, from which the corner walls of the neck extend. In this view, they are triangles with vertices tapering towards the bottle's axis. Furthermore, the bottle neck is decorated with small stars distributed across its surface, while the front wall of the body features a stylized inscription: "The Old York Vodka." Below this is a drawing depicting a section of the city with tall buildings, and below this drawing, another inscription: "Old York," also in stylized lettering. The cap also features a decorative "Old York" inscription on its circumference, side, and top. The bottle variant shown in Figures 2 and 2a differs from the bottle illustrated in Figures 1 and 1a in that it lacks decorative stars on the neck. Thus, it is characterized by a decorative cap at the top, a cylindrical shape at a short distance below, and a truncated tetrahedral pyramid with walls concave inward and beveled side edges—which, in the peripheral contours of the side walls, gives the shape of an octagon when viewed from above. The lower base of this pyramid connects to the octahedron, which constitutes the basic body of the bottle. This body is enlarged along its entire circumference in the lower part. The upper, contoured edge of this enlargement on the front and rear walls of the bottle, as well as on the side walls, has the shape of an upward curve, while on the corner walls it is straight. Viewed from above, the body is square with slightly convex outward sides and obliquely cut corners, from which the corner walls of the neck extend. In this view, the neck has the shape of triangles with vertices tapering towards the bottle's axis. Furthermore, the front wall of the body features a stylized inscription: "The Old York Vodka," and below it - a drawing depicting a section of the city with tall buildings. Below this drawing, another inscription: "Old York" – also in stylized lettering. The cap also features a decorative "Old York" inscription on its circumferential side and top wall. Another bottle variant, shown in Figures 3 and 3a, is characterized by a neck with a threaded riser at the top, a cylindrical riser at a short height below, and a shape resembling a truncated tetrahedral pyramid with walls concave inward. The pyramid's lower base connects to the tetrahedron, which forms the bottle's main body. The front face of the body, as well as the opposite rear face, features an oval riser with two symmetrically extending arms in the form of arcs. These arcs connect the two oval risers, i.e., the ovals on the front and rear walls. Viewed from above, the body is square with slightly outwardly convex sides and rounded corners. The bottle design with an elongated neck is made in three varieties, including: Fig. 1 and Fig. 1a - shows a tetrahedral bottle design with decorative stars on the neck of the bottle; Fig. 2 and Fig. 2a - shows a tetrahedral bottle without decorative stars, i.e. with a smooth neck; As can be seen from the description and drawings, the essential features of the design are: - an elongated tetrahedral neck radically changing its proportions in relation to the rest of the body; - a tetrahedral shape of the body - in the circumferential contours of the side walls having the shape of an octagon; - enlargement of the lower part of the body; - decorative arched shape of the upper edges of this enlargement (Fig. 1 and Fig. 2); - decoration of the neck with decorative stars (Fig. 1).
