The new form of the design is evident in its graphic and textual layout, as well as the original overall color scheme and its background with marked packaging assembly lines. The cosmetics packaging that is the subject of the industrial design is shown in the attached illustrative material, showing the packaging in an unfolded top view, in which: Fig. 1 – shows an unfolded view of the packaging intended for a cosmetic bar for hair, body, and intimate care; Fig. 2 – shows an unfolded view of the packaging intended for a shampoo and conditioner bar; Fig. 3 – shows an unfolded view of the packaging intended for a shampoo bar. The industrial design for body and hair care cosmetics in a cube shape is characterized by its cuboid shape, with rectangular walls arranged vertically, with horizontal text and graphics. All surfaces of the rectangular walls, with assembly lines marked, feature a multicolored background with fanciful, colorful leaves and flowers of unspecified plants, as well as butterflies. The primary distinctive graphic element is a square, centrally located on the front, upper, vertical display wall of the packaging, with a richly colored background, inverted at a 45-degree angle, its corners facing the sides of the packaging surface. The inverted square has a white background, with a small graphic embellishment imitating the leaf of an unspecified plant in the upper corner. Below this is a horizontal two-line inscription in medium-sized black capital letters, consisting of the words "BARWY BOTANIKI" (BARWY BOTANIKI), the name of the product series. Below, in the center of the inverted square, the product name and its intended use are placed horizontally across several lines in larger black capital letters in Polish and smaller ones in English. Below these inscriptions is a small-print text describing the product. At the bottom of the square, in its lower corner, is a stylized image of a leaf and the number 100 with the % symbol, below which is the word VEGAN. Next to the leafy branch on the left, on an irregular white background, are multidirectional arrow symbols with the number 0% and the status WASTE, while on the other right side, there's an image of bottles and the number 0% with the word PLASTIC at the bottom. Below the inverted square, below its bottom corner, is an elongated horizontal rectangle with a black background, bearing the manufacturer's logo in white. On the bottom wall adjacent to the upper, display surface of the packaging, is a white rectangle with inscriptions in Polish and English in small black print, informing about the product's use-by date. Adjacent to the left side of the upper display area, the side wall, shaped like a vertically elongated rectangle, features a vertical rectangle with a white background, with the product name and intended use displayed at the top. Below this are black dots separating the drawings of three partial female busts, separated by black rectangles with white words: LATHER APPLY & RINSE NICE, with the hands of the partial female busts imitating the movements of body and hair care. Next to the white rectangle with the product name and the drawings of partial female busts, is a tangentially elongated black rectangle with text in Polish and English along the vertical lines of the walls, printed in separate white print, providing information on how to use the product. Located on the right side of the upper, display surface of the packaging, the side panel has a vertically elongated rectangle on a white background at its bottom. The top of the rectangle displays the manufacturer's full details and the product's origin. Next to it is the product's weight. Below it is the product code, which features a stylized PL 27544 3 flower design at the top right. The back panel of the industrial design packaging has a relatively large vertically elongated rectangle on a white background, displaying required, essential, and useful product information in Polish and English in small black print, in bold areas. Beneath the white rectangle at the bottom of the back panel is a horizontal rectangle on a black background, also displaying the product's composition in small white print. The remaining elements, particularly those enclosing the packaging with a richly colored background, feature various colorful plant and floral motifs, as well as butterflies within white rectangles. The lettering is in black, while the lettering within the black rectangles is in white. The cosmetics packaging based on the industrial design in question, shown in the attached illustration in an unfolded top view as Fig. 1, shows packaging intended for a cosmetic bar for hair, body, and intimate care. The packaging is shaped like a rectangular box with rectangular walls. The packaging and all of its walls feature a multicolored background consisting of loosely spaced colorful spots ranging from pink to blue to green, with fanciful leaf drawings in shades ranging from medium green to dark green, and small purple leaves, with black dots scattered throughout the background. The upper, central, display wall of the packaging, shaped like a slightly vertically elongated rectangle, features a dominant graphic element in the center: a square at an inverted 45-degree angle with its corners pointing toward the side walls of the rectangle. The square has a white background, with a stylized branch with leaves at the top and the two-line inscription "BARWY BOTANIKI" (BARVY BOTANIKI) below. Below this, a horizontal, multi-line text identifying the product inside the package: 3-in-1 BARCH FOR HAIR, BODY, INTIMATE ZONES, written in large capital letters and below in smaller English: BODY, HAIR & INTIMATE HYGIENE BAR. At the bottom, there are inscriptions describing the product's ingredients and benefits. In the bottom corner of the square is a stylized leaf and the number 100 with a % sign, below which is the word VEGAN. Next to the branch with leaves on the left, on an irregular white background, are multi-directional arrow symbols with the number 0 and a % sign, and the word WASTE below them. On the right side, also on an irregular white background, there's an image of bottles and the number 0 with a % sign and the word PLASTIC at the bottom. Beneath the inverted square, below its bottom corner, is an elongated horizontal rectangle with a black background, on which is placed the manufacturer's logo in white, in the form of a stylized oval parrot head and the word "barwa" (color), below which is the word "COSMETICS." The logo is a registered trademark of the applicant. On the lower wall, adjacent to the upper display area of the packaging, is a white rectangle with inscriptions in Polish and English in small black print, informing about the product's use-by date. On the left side of the upper display surface of the packaging, which is in the shape of a vertically elongated rectangle with a colored background, there is also a vertically elongated white rectangle, on top of which there is a four-line inscription in black capital letters in various sizes: CUBE 3 in 1 HAIR, BODY INTIMATE ZONES. Below this inscription there is a horizontal line of many dots, and below this there are one, below the other stylized drawings of partial female busts separated by horizontal black rectangles with white text: LATHER APPLY & RINSE NICE, where the position of the hands of partial female busts imitates the movements of body and hair care. Next to the white rectangle with the product name and images of female busts is a tangentially elongated vertical rectangle on a black background, with text in Polish and English along its vertical sides, printed in small white print, providing information on the product's use. Located on the right side of the upper display area of the PL 27544 4 packaging, the lower side wall features a vertically elongated rectangle on a colorful background. The full manufacturer's details and product origin are displayed horizontally at the top, and the product weight is displayed vertically next to it. Below that is the product code, which features a stylized image of flowers at the top right. The back wall of the packaging has a relatively large vertical white rectangle on a white background, with the required, essential product information in Polish and English displayed in small black print, occasionally oiled. Beneath the white vertical rectangle, at the bottom of the back wall of the packaging, is a horizontal rectangle with a black background, on which the product's ingredients are also printed in small white print. The second variation of the design, showing the unfolded packaging of a cosmetic bar intended for hair care and conditioner, in Fig. 2 also takes the form of a rectangular cardboard box, the background of which is a grid of tiny blue dots and stylized drawings of undefined leaves in green, blue, and brick-red colors, flowers and vegetation, and blue and black butterflies. On the central, display-oriented, upper surface of the packaging, the dominant square, inverted at a 45-degree angle, there is an inscription placed one below the other under the name of the product series: 2 in 1 SHAMPOO AND CONDITIONER and below it, written in smaller fonts in English: BAR SHAMPOO & CONDITIONER. In a white, vertically elongated rectangle located on the left side of the wall adjacent to the upper surface of the packaging, there is a horizontal four-line inscription at the top: 2 IN 1 SHAMPOO AND CONDITIONER IN A BAR. The remaining graphic elements are as in the description and the first version of this application. The third variant of the packaging, in the shape of a rectangular cardboard box, shown in Fig. 3 in an unfolded top view, intended for a shampoo bar has a white background with black dots scattered irregularly and fanciful purple and various shades of green leaves, as well as purple-brown flowers of unspecified plants. In the center of the upper display surface of the packaging is a dominant square, inverted at a 45-degree angle, with a horizontal inscription in Polish and English: SHAMPOO BAR • SHAMPOO • while maintaining all the graphic and verbal elements contained in the description and the first and second variants of the application. ESSENTIAL FEATURES OF AN INDUSTRIAL DESIGN Packaging for body, hair, and intimate care cosmetics in the form of a rectangular box with a multicolored background, as per the industrial design, is characterized by the following: ? The packaging with a colorful multicolored background also features fanciful drawings of leaves in various shades of green, purple, and blue, and flowers in brick-red and purple-brown, unspecified plants, and butterflies with black dots scattered between them. ? On the colorful multicolored background with fanciful drawings of leaves, flowers, and butterflies, there are various rectangles on individual sides of the packaging with white or black backgrounds and inscriptions in contrasting colors. ? On the front, upper display wall of the packaging is a dominant square, inverted at a 45-degree angle, with a white background, on which are placed black lettering in Polish and English identifying the series name and product type, along with its purpose and advantages. In the corners of the dominant square, inverted at a 45-degree angle, are small graphic embellishments and additional information related to the product. On the left side wall of the packaging is a vertically elongated rectangle, with lettering at the top identifying the product name and type, and below are line drawings of partial female busts with drawings of hands imitating the use of the product. The remaining side and back walls of the packaging feature text in white and black rectangles that further define the product, its composition, method and date of use, manufacturer's details, product origin, weight, and all required, useful, and essential information about the product contained within the packaging.
