Opis wzoru przemyslowego Przedmiotem wzoru przemyslowego jest etykieta opakowania produktu czekoladowego, wykonana z papieru lub folii tworzywowej. Nowa i oryginalna postac wzoru przemyslowego przejawia sie w jego ksztalcie oraz ukladzie graficzno-slowno-kolorystycznym etykiety. Przedmiot wzoru przemyslowego zostal uwidoczniony na zalaczonym materiale ilustracyjnym w trzech odmianach jego wykonania, na którym fig. 1 przedstawia pierwsza odmiane wykonania etykiety opakowania „czekolady mlecznej" w widoku z przodu, fig. 2 - druga odmiane tej etykiety dla „czekolady krakowskiej gorzkiej" w widoku z przodu, a fig. 3 - trzecia odmiane tej etykiety dla „krówkowej mlecznej czekolady nadziewanej" w widoku z przodu. Jak pokazano na zalaczonym materiale ilustracyjnym fig. 1-3 wszystkie te odmiany wzoru przemyslowego stanowiace etykiety opakowan produktów czekoladowych, stanowia dwa prostokatne elementy o róznych tlach kolorystycznych, oddzielonych od siebie biala pionowa pogrubiona linia, przy czym lewostronne ich elementy maja identyczne elementy slowne „Wawel czekoladowa tradycja", wykonane stylizowanymi literami w kolorze bialym umieszczone na identycznym brazowym tle prostokatnym, natomiast prawostronne ich elementy maja zróznicowane kolorystycznie tla prostokatne, posiadajace zróznicowane elementy slowne i po dwie podobne do siebie czekoladki pokazane w widokach perspektywicznych. Róznice pomiedzy poszczególnymi odmianami wzoru przemyslowego pokazanymi na materiale ilustrujacym fig. 1-3 polegaja tylko na zróznicowanych tlach kolorystycznych ich prawych prostokatnych czesci oraz zróznicowanych ich elementach slownych i czesciowo elementach graficznych, spelniajacych funkcje przekazania informacji o smaku danej czekolady i tak: – etykieta opakowania produktu czekoladowego wedlug pierwszej odmiany jej wykonania pokazana na fig. 1 charakteryzuje sie tym, ze jej lewostronna czesc na prostokatnym brazowym tle posiada usytuowane lukowo w centralnej jej czesci slowo „Wawel", wykonane stylizowanymi znacznie pogrubionymi literami w kolorze bialym, a pod nimi poziomo usytuowane slowa „Czekoladowa Tradycja", wykonane stylizowanymi cienkimi literami w kolorze bialym, prawa strona tej etykiety z prostokatnym niebieskim tlem usytuowanym na przedluzeniu strony lewej posiada umieszczone w górnej jej czesci slowo „MLECZNA", wykonane znacznie pogrubionymi stylizowanymi literami w kolorze bialym, a pod nimi slowo „CZEKOLADA", wykonane duzymi drukowanymi i cienkimi literami w kolorze bialym, natomiast pod nimi umieszczone sa dwie czekoladki w kolorze jasno brazowym, usytuowane skosnie wzgledem siebie o identycznych prostopadlosciennych trójstopniowych ksztaltach, na których górnych najwyzszych powierzchniach wykonane sa dwie pary lukowych kanalków skierowane w strone dluzszych boków tych powierzchni; – etykieta opakowania produktu czekoladowego wedlug drugiej odmiany jej wykonania pokazana na fig. 2 charakteryzuje sie tym, ze posiada lewa jej czesc identyczna jaka posiada etykieta wedlug pierwszej odmiany jej wykonania pokazana na fig. 1, natomiast prawa strona tej etykiety z prostokatnym brazowym tlem i jego odcieniem usytuowana równiez na przedluzeniu strony lewej posiada umieszczone w górnej jej czesci i usytuowane w trzech rzedach slowa: „GORZKA - KRAKOWSKA - CZEKOLADA", wykonane duzymi literami o zróznicowanych ich grubosciach w kolorze bialym, a pod nimi umieszczone sa dwie czekoladki w kolorze brazowym, usytuowane takze skosnie wzgledem siebie o identycznych prostopadlosciennych trójstopniowych ksztaltach, na których górnych najmniejszych powierzchniach wykonane sa równiez dwie pary lukowych kanalków, skierowanych w strone dluzszych boków tej powierzchni; – etykieta opakowania produktu czekoladowego wedlug trzeciej odmiany jej wykonania pokazana na fig. 3 charakteryzuje sie tym, ze posiada lewa jej czesc podobna jaka posiadaja etykiety wedlug pierwszej i drugiej odmiany jej wykonania pokazane na fig. 1 i 2, natomiast prawa strona tej etykiety z prostokatnym brazowo-bialym tlem utworzonym z profilowych bialych elementów, usytuowana równiez na przedluzeniu strony lewej posiada umieszczone w górnej jej czesci slowo: „KRÓWKOWA", wykonane pogrubionymi literami w kolorze zóltym, a ponizej niego slowa: „MLECZNA CZEKOLADA NADZIEWANA", wykonane cienkimi drukowanymi literami w kolorze zóltym, a pod nimi w wiekszosci na bialym tle dwie skosnie usytuowane czekoladki o prostopadlosciennych, dwustopniowychPL 20570 3 ksztaltach w kolorze brazowym z otwartymi ich czolami uwidaczniajacymi dwukolorowa zawartosc, z bocznym prostopadlosciennym elementem w kolorze jasnobrazowym nawiazujacym do smaku tej czekolady, natomiast powyzej tych czekoladek i z prawej ich strony umieszczony jest rysunek imitujacy stylizowana laciata czarno-biala krowe. The new and original form of the industrial design is manifested in its shape and the graphic-word-color layout of the label. The subject of the industrial design has been shown in the attached illustrative material in three versions of its design, in which Fig. 1 shows the first version of the label for the "milk chocolate" packaging in a front view, Fig. 2 - the second version of this label for "Krakow dark chocolate" in a front view, and Fig. 3 - the third version of this label for "filled milk fudge chocolate" in a front view. As shown in the attached illustrative material Figs. 1-3, all these versions of the industrial design constituting labels for packaging of chocolate products are two rectangular elements with different colour backgrounds, separated from each other by a white vertical bold line, while their left-hand elements have identical word elements "Wawel chocolate tradition", made in stylised white letters placed on an identical brown rectangular background, while their right-hand elements have different colour backgrounds. rectangular background colors, with varied word elements and two similar chocolates shown in perspective views. The differences between the individual variations of the industrial design shown in the material illustrating figs. 1-3 consist only in the different colour backgrounds of their right rectangular parts and their different word elements and partially graphic elements fulfilling the function of conveying information about the taste of a given chocolate, and so: - the chocolate product packaging label according to the first variation of its design shown in fig. 1 is characterised in that its left-hand part on a rectangular brown background has the word "Wawel" placed in an arc shape in its central part, made in stylised, significantly bold letters in white, and below them the words "Czekoladowa Tradycja" placed horizontally, made in stylised, thin letters in white, the right-hand side of this label with a rectangular blue background situated as an extension of the left-hand side has the word "MLECZNA" placed in its upper part, made in significantly bold letters in white, in bold stylised white letters, and below them the word "CHOCOLATE", in large, block and thin white letters, while below them there are two light brown chocolates, positioned obliquely to each other, with identical three-step cuboid shapes, on the upper highest surfaces of which there are two pairs of arched channels directed towards the longer sides of these surfaces; – the label for packaging of a chocolate product according to the second variant of its design shown in fig. 2 is characterised in that it has its left part identical to the label according to the first variant of its design shown in fig. 1, while the right side of this label with a rectangular brown background and its shade, also situated on the extension of the left side, has in its upper part and situated in three rows the words: "GORZKA - KRAKOWSKA - CZEKOLADA", made in capital letters of varying thicknesses in white, and under them there are two brown chocolates, also situated obliquely with respect to each other, of identical cuboid three-step shapes, on the upper smallest surfaces of which there are also two pairs of arc-shaped channels, directed towards the longer sides of this surface; – the label for packaging of a chocolate product according to the third variant of its design shown in fig. 3 is characterized by the fact that its left part is similar to that of the labels according to the first and second variant of its execution shown in figs. 1 and 2, while the right side of this label with a rectangular brown and white background made of profile white elements, also situated on the extension of the left side, has the word: "KRÓWKOWA" placed in its upper part, written in bold yellow letters, and below it the words: "MLECZNA CZEKOLADA NADZIEWANA", written in thin yellow block letters, and below them, mostly on a white background, two obliquely positioned chocolates with cuboid, two-step shapes in brown with their open fronts revealing the two-coloured content, with a side cuboid element in light brown referring to the taste this chocolate, while above these chocolates and to the right of them there is a drawing imitating a stylized spotty black and white cow. Essential features of the industrial design The label of the chocolate product packaging presented in three versions in the attached illustrative material fig. 1-3 is characterized by the fact that: – it has the shape of a rectangular flat figure made of two rectangular elements with different colour backgrounds, separated from each other by a bold white line, the left-hand rectangular elements of which have an identical brown background and identical word elements placed on it, containing the word "WAWEL" arranged in an arc and made in stylized, significantly bold letters in white, and under it the words "Chocolate Tradition", made in thin white letters, while the right-hand rectangular elements constituting an extension of these left-hand elements have different colour backgrounds, on which two brown chocolates are placed, placed diagonally to each other with similar three-step cuboids and two-step shapes, on the upper, smallest surfaces of which two pairs of arched channels are made, directed towards the longer sides of these surfaces, wherein – the right-hand rectangular element of this label has a blue background, and in its upper part above the figures of two chocolates there is the word "MLECZNA" written in large, significantly bold white letters, and below them the word "CZEKOLADA" written in thin, block letters in white as shown in Fig. 1; – the right-hand rectangular element of this label has a brown background and its shades, and in the upper part above the figures of two chocolates there are the words "GORZKA - KRAKOWSKA - CZEKOLADA" in three rows below each other, written in block letters of varying thickness in white as shown in fig. 2; – the right-hand rectangular element of this label has a brown and white background, and in the upper part above the figures of two chocolates with their open front ends revealing their pink and cream interior there is the word "KRÓWKOWA" and below it the words "MLECZNA CZEKOLADA NADZIEWANA", all written in yellow, while below these words on a white background there is a drawing imitating a stylised spotted black and white cow, as shown in fig. 3.
