Nowa i oryginalna postac wzoru przemyslowego przejawia sie w ksztalcie opakowania, ukladzie linii oraz ukladzie slowno-graficzno- kolorystycznym elementów umieszczonych na scianach tego opakowania. Przedmiot wzoru przemyslowego zostal przedstawiony na zalaczonym materiale ilustracyjnym, na którym fig. 1 przedstawia opakowanie slodyczy wypelnione galaretkami czekoladowymi w widoku perspektywicznym, a fig.2- to samo opakowanie w widoku z przodu. Opakowanie slodyczy w stanie wypelnionym galaretkami czekoladowymi i zgrzanymi wszystkim górnymi jego bokami wedlug wzoru przemyslowego stanowi bryla utworzona z prostokatnej podstawy, której dwa przeciwlegle krótsze boki polaczone sa z bocznymi scianami, w ksztalcie prostokata zwezajacego sie ku górze, poczawszy od okolo polowy ich wysokosci w ksztalt zblizony do trójkata równobocznego, natomiast dwa dluzsze boki tej podstawy polaczone sa z przednia i tylna sciana prostokatna, które tworza wspólne boczne krawedzie ze scianami bocznymi, przy czym górne konce wszystkich czterech scian polaczone sa ze soba. Z kolei, w dolnej czesci przedniej sciany opakowania wykonane jest wyjecie zblizone do trapeza prostokatnego z wkleslym lukowo górnym jego bokiem, przysloniete folia przezroczysta, pozwalajaca na wizualne sprawdzenie zawartosci tego opakowania, natomiast nad tym wyjeciem znajduja sie usytuowane obok siebie rysunki obrazujace czekoladke pelna, polowe tej czekoladki, trzy owoce wisni z lodyzkami i listkiem, dwie gruszki, dwie poziomki z listkami oraz kwiat rózy z listkami, wszystkie w ich naturalnych kolorach. Nad tymi rysunkami znajduje sie fragment pierscienia eliptycznego w kolorze czarnym, a nad nim lukowo usytuowany napis „polskie smaki" wykonany malymi stylizowanymi literami w kolorze ciemnozielonym, zas pomiedzy nim i wyjeciem trapezowym znajduje sie okragle brazowe pole z napisem „Wawel" otoczone pierscieniem w kolorze bialoszarym, na którym znajduje sie napis „100 lat doswiadczenia i tradycji" wykonane duzymi drukowanymi literami. Poza tym na górnym wielobocznym pasmie znajduje sie element zblizony do prostokatnego z wkleslym dolnym bokiem w kolorze ciemnobrazowym, na którym wykonany jest stylizowanymi literami w kolorze zblizonym do zóltego napis „Wawel", a pod nim na zielonym tle znajduje sie napis „Mieszanka krakowska" wykonany malymi stylizowanymi literami w kolorze bialym, natomiast ponizej niego kolejny napis „galaretki w czekoladzie" wykonany drukowanymi literami w kolorze czerwonym. Dodatkowo na bocznych scianach tego opakowania na ich zielonym profilowym polu znajduja sie rysunki obrazujace czekoladki zawiniete w zakrecane na koncach owijki w kolorze czerwonym, zóltym i zielonym oraz usytuowane nad nimi rysunki wisni, poziomek, gruszek i kwiatu rózy, w ich naturalnych kolorach. The new and original form of the industrial design is reflected in the package's shape, line layout, and the word-graphic-color arrangement of elements placed on the sides of the package. The industrial design is presented in the attached illustration, in which Fig. 1 shows a perspective view of the confectionery package filled with chocolate jellies, and Fig. 2 shows the same package from the front. The confectionery package, when filled with chocolate jellies and with all its upper sides welded according to the industrial design, is a solid made of a rectangular base, the two opposite shorter sides of which are connected to the side walls, in the shape of a rectangle tapering upwards, starting from about half of their height into a shape similar to an equilateral triangle, while the two longer sides of this base are connected to the front and rear rectangular walls, which form common side edges with the side walls, with the upper ends of all four walls being connected to each other. All the walls of the packaging are green, with the lower ends of these walls having a circumferential rectangular stripe abutting the base, formed from alternating vertical narrow stripes in red, blue, pink, yellow, navy blue, and green and its shades. The upper ends of these walls have a significantly higher circumferential rectangular stripe with a circumferentially corrugated lower side, also formed from narrow, scalene stripes vertically arranged, in colors analogous to those in the lower circumferential rectangular stripe. Furthermore, the upper, flattened2 rectangular stripe of this stripe has transversely arranged channels and protrusions, giving the impression of wrinkling on these surfaces, the central part of which has a rectangular opening with rounded shorter sides and a semicircular opening on the upper, longer side. In the lower part of the front wall of the package, there is a recess similar to a rectangular trapezoid with a concave, arched upper edge, covered with a transparent foil, allowing for a visual inspection of the package's contents. Above this recess are side-by-side drawings depicting a full chocolate, half a chocolate, three cherries with stems and a leaf, two pears, two strawberries with leaves, and a rose with leaves, all in their natural colors. Above these drawings is a fragment of an elliptical ring in black, and above it, an arc-shaped inscription reading "Polish Tastes" in small, stylized dark green letters. Between this and the trapezoidal recess is a round brown field with the inscription "Wawel," surrounded by a ring in white and gray, on which is the inscription "100 years of experience and tradition" in large, block letters. In addition, on the upper polygonal band there is an element almost rectangular with a concave lower side in dark brown, on which the inscription "Wawel" is written in stylized letters in a color close to yellow. Below it, on a green background, there is the inscription "Mieszanka krakowska" written in small, stylized letters in white, while below it, on a green background, there is another inscription "jelly in chocolate" written in block letters in red. In addition, on the side walls of this package, on their green profile field, there are drawings of chocolates wrapped in twisted wrappers in red, yellow and green, and above them drawings of cherries, strawberries, pears and a rose flower, in their natural colors. Essential features of the industrial design The packaging of sweets, especially chocolate jellies, made of plastic foil, shown in the illustrations in Fig. 1 and 2, is characterized by the following: - when filled with jellies, it is a solid made of a rectangular base, the two opposite shorter sides of which are connected to the side walls in the shape of a rectangle that narrows upwards, starting from about half of their height in a shape similar to an equilateral triangle, while the two longer sides of this base are connected to the front and rear rectangular walls, which form common side edges with the side walls, the upper ends of all four walls being connected to each other;3 - all the walls of the packaging are green, and the lower ends of these walls have a circumferential rectangular strip in contact with its base, made of alternating vertically arranged narrow bands in the following colours: red, blue, pink, yellow, navy blue and green and its shades, while the upper ends of these walls have a circumferential, much higher rectangular band with a circumferentially wavy lower side, also made of narrow, scalene strips arranged vertically, in colours analogous to those in the lower circumferential rectangular band; - on the upper flattened rectangular band there are transversely situated channels and protrusions giving the impression of wrinkling of these surfaces, in the central part of which there is a rectangular opening with rounded shorter sides and a semicircular opening in the upper longer side; - in the lower part of the front wall of the packaging there is an opening similar to a rectangular trapezoid with a concave arc at the top, covered with a transparent foil, allowing for a visual inspection of the contents of the packaging, while above this opening there are drawings placed next to each other showing a full chocolate, half of this chocolate, three cherries with stems and a leaf, two pears, two strawberries with leaves and a rose flower, all in their natural colours, - above the above-mentioned drawings there is a fragment of an elliptical ring in black, and above it an arc-shaped inscription "Polish tastes" written in small, stylised dark green letters, while between it and the trapezoidal opening there is a round brown field with the inscription "Wawel" surrounded by a ring in white and grey, on which there is the inscription "100 years of experience and tradition" written in large block letters; - on the upper polygonal band there is an element close to a rectangle with a concave lower side in dark brown, on which the inscription "Wawel" is written in stylized letters in a color close to yellow, and below it on a green background there is the inscription "Mieszanka krakowska" written in small stylized letters in white, while below it there is another inscription "jelly in chocolate" written in block letters in red; - on the side walls of this packaging, on their green profile field there are drawings of chocolates wrapped in twisted wrappers in red, yellow and green, and above them drawings of cherries, strawberries, pears and a rose flower, in their natural colors.1 Fig.12 Fig.2 PL PL PL PL PL PL
