Przedmiotem wzoru przemyslowego jest czekoladka i jej opakowanie. Nowa i oryginalna postac wzoru przemyslowego przejawia sie w ksztalcie czekoladki oraz jej jednostkowego opakowania, jego kolorystyki z elementami ozdobnymi i napisami. Przedmiot wzoru przemyslowego jest uwidoczniony na zalaczonym rysunku fig. 1- 4 oraz materiale ilustracyjnym fig. 5-8, na których fig. 1 i 5 przedstawiaja czekoladke w opakowaniu jednostkowym w kolorze zóltym i jego odcieniach i napisem „Adwokat", w widoku perspektywicznym, fig. 2 i 6 - odmiane tej samej czekoladki w opakowaniu jednostkowym w kolorze zielonym i jego odcieniach i napisem „Orzech w kremie kawowym", w widoku perspektywicznym, fig. 3 i 7 - kolejna odmiane tej samej czekoladki w opakowaniu jednostkowym w kolorze fioletowym i jego odcieniach i napisem „Sliwka w kremie", w widoku perspektywicznym, a fig. 4 i 8 - kolejna odmiane tej samej czekoladki w opakowaniu jednostkowym w kolorze brazowym i jego odcieniach i napisem „Toffi", w widoku perspektywicznym. Jak pokazano na fig. 1-8 czekoladka w ksztalcie scietego ostroslupa na swych bocznych powierzchniach oraz na górnej powierzchni w ich symetrii ma wystepy w ksztalcie trapezów równoramiennych usytuowanych prostopadle do kwadratowej podstawy, zwienczone z soba w osi symetrii jej górnej powierzchni. Kazda z tych identycznych czekoladek znajduje sie w opakowaniu jednostkowym, scisle przylegajacym do powierzchni zewnetrznej czekoladki i odzwierciedlajacym jej ksztalt zewnetrzny, przy czym poszczególne opakowania jednostkowe róznia sie miedzy soba tylko ich koloiystyka tla i nazwa oznaczenia czekoladki, jak pokazano na materiale ilustracyjnym fig. 5-8. Opakowanie czekoladki pokazane na fig. 1 i 5 w ksztalcie ostroslupa scietego z wystepami trapezowymi na jej bocznych powierzchniach ma kolor zólty i jego odcieni, a wzdluz wystepów trapezowych na zóltym tle ma elementy ozdobne w ksztalcie pasków w kolorze niebieskim z bialymi obrzezami i rozmieszczonymi na niebieskim tle elementami w ksztalcie bialych kwadratów usytuowanych ukosnie wzdluz tych pasków, które zwienczone sa z soba na górnej powierzchni i przysloniete czesciowo elementem o ksztalcie zblizonym do równolegloboku w kolorze bialym z niebieska obwódka i lekko wkleslymi jego bokami, zaopatrzonego w kokardke niebiesko-biala. Odmiana opakowania czekoladki pokazana na fig. 2 i 6 ma identyczny ksztalt zewnetrzny, niebiesko-biale paski i zwienczajacy je bialo-niebieski element równolegloboczny z kokarda niebiesko-biala oraz logo „WAWEL KRAKÓW" jak opakowanie czekoladki pokazane na fig. 1 i 5, a róznica pomiedzy nimi polega na tym, ze odmiana ta ma kolor zielony i jego odcieni, zas na bialym tle zwienczajacego paskielementu równoleglobocznego znajduje sie napis „Orzech w kremie kawowym" w kolorze niebieskim. Druga odmiana opakowania czekoladki pokazana na fig. 3 i 7 ma identyczny ksztalt zewnetrzny, niebiesko-biale paski i zwienczajacy je bialo-niebieski element równolegloboczny z kokarda niebiesko-biala oraz logo „WAWEL KRAKÓW" jak opakowanie czekoladki pokazane na fig. 1 i 5, a róznica pomiedzy nimi polega na tym, ze odmiana ta ma kolor fioletowy i jego odcieni, zas na bialym tle zwienczajacego paski elementu równoleglobocznego znajduje sie napis „Sliwka w kremie" w kolorze niebieskim. Trzecia odmiana opakowania czekoladki pokazana na fig. 4 i 8 ma identyczny ksztalt zewnetrzny, niebiesko-biale paski i zwienczajacy je bialo-niebieski element równolegloboczny z kokarda niebiesko-biala oraz logo „WAWEL KRAKÓW" jak opakowanie czekoladki pokazane na fig. 1 i 5, a róznica pomiedzy nimi polega na tym, ze odmiana ta ma kolor brazowy i jego odcieni, zas na bialym tle zwienczajacego paski elementu równoleglobocznego znajduje sie napis „Toffi" w kolorze niebieskim. The new and original form of the industrial design is reflected in the shape of the chocolate and its individual packaging, its colors, decorative elements, and inscriptions. The subject of the industrial design is shown in the attached drawings figs. 1-4 and illustrative material figs. 5-8, in which figs. 1 and 5 show a chocolate in a unit package in yellow and its shades and the inscription "Adwokat", in a perspective view, figs. 2 and 6 - a variant of the same chocolate in a unit package in green and its shades and the inscription "Orzech w kremie kawowym", in a perspective view, figs. 3 and 7 - another variant of the same chocolate in a unit package in purple and its shades and the inscription "Plum w kremie", in a perspective view, and figs. 4 and 8 - another variant of the same chocolate in a unit package in brown and its shades and the inscription "Toffi", in a perspective view. As shown in Fig. 1-8, a chocolate in the shape of a truncated pyramid has on its lateral surfaces and on its upper surface, in their symmetry, projections in the shape of isosceles trapezoids arranged perpendicularly to the square base, topped with one another at the axis of symmetry of its upper surface. Each of these identical chocolates is contained in a single package, closely adhering to the outer surface of the chocolate and reflecting its external shape, with the individual single packages differing only in their background circle and the name of the chocolate marking, as shown in Fig. 5-8. The chocolate wrapper shown in Figures 1 and 5, in the shape of a truncated pyramid with trapezoidal projections on its sides, is yellow and its shades, and along the trapezoidal projections on the yellow background it has decorative elements in the form of blue stripes with white edges and elements in the form of white squares arranged diagonally along these stripes on the blue background, which are topped with each other on the upper surface and partially covered by an element in the shape of a white parallelogram with a blue border and slightly concave sides, fitted with a blue and white bow. On the white background of the parallelogram element there is the inscription "Adwokat" in blue, while on the blue stripe on the front there is a drawing of the logo with the inscription "WAWEL KRAKÓW" in gold. The chocolate wrapping variation shown in Figs. 2 and 6 has an identical external shape, blue and white stripes and a blue and white rhomboid element topping them with a blue and white bow and the "WAWEL KRAKÓW" logo as the chocolate wrapping variation shown in Figs. 1 and 5, and the difference between them is that this variation is green and its shades, and on the white background of the rhomboid element topping the stripe there is the inscription "Orzech w kremie kawowym" in blue. The second variant of the chocolate wrapper shown in Fig. 3 and 7 has an identical external shape, blue and white stripes and a blue and white rhomboid element topping them with a blue and white bow and the "WAWEL KRAKÓW" logo as the chocolate wrapper shown in Fig. 1 and 5, and the difference between them is that this variant is purple in color and its shades, and on the white background of the rhomboid element topping the stripes there is the inscription "Plum in cream" in blue. The third variant of the chocolate wrapper shown in Figs. 4 and 8 has an identical external shape, blue and white stripes and a blue and white rhomboid element topping them with a blue and white bow and the "WAWEL KRAKÓW" logo as the chocolate wrapper shown in Figs. 1 and 5, and the difference between them is that this variant is brown in colour and its shades, and on the white background of the rhomboid element topping the stripes there is the inscription "Toffi" in blue. Essential features of the industrial design The chocolate and its packaging shown in fig. 1-8 are characterized by the following: - the chocolate has the shape of a truncated pyramid, having on its side surfaces and on the upper surface in their symmetry protrusions in the shape of isosceles trapezoids situated perpendicularly to the square base, topped with each other in the axis of symmetry of its upper surface, each of these identical chocolates being in a single package, closely adhering to the outer surface of the chocolate and reflecting its outer shape, the individual single packages differing only in their background color and the name of the chocolate marking, as shown in fig. 5-8; - the chocolate wrapper in the shape of a truncated pyramid with trapezoidal projections on its side surfaces is yellow and its shades, and along the trapezoidal projections on a yellow background it has decorative elements in the form of blue stripes with white edges and elements in the form of white squares arranged diagonally along these stripes on a blue background, which are topped with each other on the upper surface and partially covered by an element in the shape of a white parallelogram with a blue border and slightly concave sides, fitted with a blue and white bow, and on the white background of the parallelogram element there is the inscription "Adwokat" in blue, while on the blue strip on the front there is a drawing of a logo with the inscription "WAWEL KRAKÓW" made in gold, as shown in Fig. 1 and 5; - a variant of the chocolate packaging has an identical external shape, blue and white stripes and a blue and white rhomboid element topping them with a blue and white bow and the "WAWEL KRAKÓW" logo as the chocolate packaging shown in fig. 1 and 5, wherein this variant is green and its shades, and on the white background of the rhomboid element topping the stripes there is the inscription "Orzech w kremie kawowym" in blue, as shown in fig. 2 and 6;- a variant of the chocolate packaging has an identical external shape, blue and white stripes and a blue and white rhomboid element topping them with a blue and white bow and the "WAWEL KRAKÓW" logo as the chocolate packaging shown in fig. 1 and 5, wherein this variant is purple and its shades, and on the white background of the element topping the stripes there is the inscription "Orzech w kremie kawowym" in blue, as shown in fig. - the chocolate wrapping variation has an identical external shape, blue and white stripes and a blue and white rhomboid element with a blue and white bow and the "WAWEL KRAKÓW" logo as the chocolate wrapping shown in Fig. 1 and 5, while this variation is brown in color and its shades, and on the white background of the rhomboid element topping the stripes there is an inscription "Toffi" in blue, as shown in Fig. 4 and 8.
