Opis wzoru przemyslowego Przedmiotem wzoru przemyslowego jest etykieta opakowania slodyczy, znanych pod nazwa handlowa „Wawel TOFFLAIRS", wykonana z papieru, lub z folii tworzywowej. Nowa i oryginalna postac wzoru przemyslowego przejawia sie w jego ukladzie slowno- kolorystyczno-graficznym, zwlaszcza umieszczonych na tej etykiecie elementów slownych i graficznych. Przedmiot wzoru przemyslowego zostal przedstawiony w dwóch odmianach jego wykonania, na zalaczonym materiale ilustracyjnym fig. 1 i fig. 2 w widokach z przodu. Etykieta opakowania slodyczy wedlug pierwszej odmiany jego wykonania pokazanej na mate- riale ilustracyjnym fig. 1 ma ksztalt prostokatny z tlem w kolorze fioletowym, przy czym z lewej strony fioletowe tlo tej etykiety przyslania figura o pofalowanych nieregularnie jej bocznych scianach w kolo- rze z tlem pomaranczowym i czerwona boczna ich sciana. W srodkowej czesci etykiety na pomaran- czowym tle tej figury usytuowany jest lukowo napis „Tofflairs" wykonany drukowanymi bialymi, stylizo- wanymi literami z fioletowa ich obwódka, zas z lewej i z prawej strony tego slowa odpowiednio na pomaranczowym i fioletowym tle znajduja sie skierowane w dól slowa „Wawel, Wawel" wykonane bialymi stylizowanymi literami, z kolei nad tym slowem „Tofflairs" umieszczone sa napisy „carmel fil- ling", a pod nim napis „karmelowe nadzienie", wykonane malymi drukowanymi literami w kolorze bia- lym, przy czym slowa „nadzienie" i „carmel" umieszczone sa na fioletowym tle etykiety, a slowa „kar- melowe" i „filling" na pomaranczowym tle etykiety. Ponadto w dolnej czesci etykiety na jej fioletowym tle znajduje sie slowo „Tofflairs", wykonane bialymi pogrubionymi literami usytuowane takze lukowo, a w górnej czesci etykiety umieszczone sa napisy informacyjne o skladzie recepturowym produktu oraz wskazujace adres producenta, które nie podlegaja ochronie. Etykieta opakowania wedlug drugiej odmiany jej wykonania pokazana na materiale ilustracyj- nym fig. 2 ma ksztalt i uklad slowno-graficzny identyczny jak etykieta wedlug pierwszej odmiany jej wykonania, a róznica pomiedzy nimi polega tylko na tym, ze w etykiecie wedlug drugiej odmiany jej fioletowe tlo przeslania analogiczna figura o pofalowanych nieregularnie jej bocznych scianach lecz w kolorze brazowym z pomaranczowa ich obwódka, natomiast w miejscu slów „karmelowe nadzienie" umieszczone sa slowa „czekoladowo-kakaowy", a w miejscu slów „caramel filling" umieszczone sa slowa „chocolate cocoa". The new and original form of the industrial design is visible in its word, color and graphic arrangement, especially in the word and graphic elements placed on this label. The subject of the industrial design is presented in two versions, in the attached illustrations Fig. 1 and Fig. 2 in front views. The label for the package of sweets according to the first version of its implementation shown in illustrations Fig. 1 has a rectangular shape with a purple background, while on the left side the purple background of this label is obscured by a figure with irregularly wavy side walls in the color of the orange background and their side wall is red. In the central part of the label, on the orange background of this figure, there is an arc-shaped inscription "Tofflairs" written in white, stylised block letters with a purple border, and to the left and right of this word, on the orange and purple backgrounds, respectively, there are the words "Wawel, Wawel" written in white, stylised block letters, pointing downwards, and above the word "Tofflairs" there are the inscriptions "carmel filling", and below it the inscription "karmelowe nadzienie" written in small, white block letters, with the words "nadzienie" and "carmel" written on the purple background of the label, and the words "karmelowe" and "filling" on the orange background of the label. In addition, in the lower part of the label on its purple background there is the word "Tofflairs", written in bold white letters, also arranged in an arc, and in the upper part of the label there are inscriptions informing about the product's recipe composition and indicating the manufacturer's address, which are not subject to protection. The packaging label according to the second version of its design, shown in the illustration material Fig. 2, has the same shape and word-graphic arrangement as the label according to the first version of its design, and the difference between them is only that in the label according to the second version its purple background is obscured by an analogous figure with irregularly wavy side walls, but in brown color with an orange border, while in place of the words "caramel filling" there are the words "chocolate-cocoa", and in place of the words "caramel filling" there are the words "chocolate cocoa". Essential features of an industrial design A label for a confectionery package having a rectangular shape is characterised by the following: - the purple background of this label on the left side is obscured by a figure with irregularly wavy side walls in a colour with an orange background and a red side wall or in a colour with a brown background and an orange side wall; - in the central part of the label, on an orange or brown background of an irregularly shaped figure, there is an arc-shaped inscription "Tofflairs" written in white, stylized block letters with a purple or purple-orange border, and to the left and right of this word, on an orange and purple or brown and purple background, respectively, there are the words "Wawel, Wawel" written in white, stylized letters, pointing downwards, while above the word "Tofflairs" there are the inscriptions "carmel filling" or "chocolate cocoa", and below this word there is the inscription "caramel filling" or "chocolate cocoa", written in small, white block letters, with the words "filling" and "carmel" or "kakaowy" and "chocolate" written on a purple background of the label, and the words "caramel" and "filling" or "chocolate" and "cocoa" respectively on an orange or brown background of the label; - in the lower part of the label on its purple background there is an arc-shaped word "Tofflairs" in bold white letters or white letters with an orange border.PL 20253 3 Illustration of the patternPL 20253 4 Department of Publishing of the Polish Patent Office PL PL PL PL PL PL PL PL PL PL PL PL PL
