Przedmiotem wzoru przemyslowego jest opakowanie ozdobne wykonane z kartonu i przeznaczone do konfekcjonowania, eksponowania i sprzedazy wyrobów czekoladowych. Nowa i oryginalna postac wzoru przemyslowego przejawia sie w jego ksztalcie, kolorystyce, ukladzie linii i szacie graficznej umieszczonej na bocznych scianach tego opakowania. Przedmiot wzoru przemyslowego jest uwidoczniony na zalaczonych fotografiach, na których fig. 1 przedstawia opakowanie ozdobne w widoku perspektywicznym, a fig. 2 - to samo opakowanie w widoku z góry. Opakowanie ozdobne wedlug wzoru przemyslowego uwidocznione na zalaczonych fotografiach fig. 1 i 2 ma ksztalt prostopadlosciennej splaszczonej bryly o podstawie prostokatnej, zlozonej z pudelka zaopatrzonego we wklad z gniazdami o profilu czekoladek, zakryty pokrywa, oraz oslony tego pudelka w ksztalcie prostokatnej ramki z zaokraglonymi wewnetrznymi narozami i zagietymi prostopadle wewnetrznymi sciankami bocznymi przylegajacymi do górnej powierzchni pokrywy pudelka oraz posiadajacymi wybrania narozne, przy czym tlem calego opakowania jest kolor czerwony z odcieniami koloru rózowego i zóltego. Na górnej powierzchni pokrywy pudelka z tlem czerwono-rózowo-zóltym w górnym lewym narozu znajduje sie iysunek kwiatu rózy, a w dolnym prawym narozu rysunki czterech czekoladek w widoku perspektywicznym o ksztalcie zblizonym do stozka scietego, owalnym, ostroslupa scietego i serca w kolorze brazowym z jasnymi odcieniami, majacych na górnej ich powierzchni ozdobne ornamenty, natomiast pomiedzy rysunkami rózy i czekoladek na zóltym tle pokrywy znajduje sie galazka sztucznego kwiatu czerwonej rózy z zielonymi liscmi, przewiazana ozdobna zlota wstazka, usytuowana wzdluz pizekatnej tej pokrywy. Z kolei na czerwonym tle scian ramkowej oslony opakowania znajduja sie poprzecznie usytuowane pasma zólte o profilu falistym oraz kilka rysunków kwiatów róz, natomiast na krótszych scianach bocznych tej oslony znajduja sie dodatkowo napisy „Bombonierka z kwiatem" usytuowane w jednym wierszu i wykonane w kolorze zóltym, a pod nimi rysunki perspektywiczne czterech czekoladek w kolorze brazowym o róznym profilu z ozdobnymi ornamentami na ich powierzchni, zas na dluzszych scianach bocznych znajduja sie napisy„Bombonierk a z kwiatem" usytuowane w dwóch wierszach w kolorze zóltym, a obok nich rysunki perspektywiczne dwóch czekoladek o róznych profilach z ozdobnymi ornamentami na ich powierzchniach, przy czym na kazdej scianie bocznej znajduje sie dodatkowo grafika przedstawiajaca znak towarowy zlozony z rysunku zamku wawelskiego w kolorze zlotym, stylizowanego napisu „Wawel" w kolorze bialym ze zlota obwódka, oraz usytuowanego ponizej zlotego napisu „KRAKÓW" umieszczonego pomiedzy dwoma lukowymi liniami w kolorze zlotym. Cechy istotne wzoru przemyslowego Opakowanie ozdobne majace ksztalt prostopadlosciennej splaszczonej bryly zlozonej z pudelka zaopatrzonego we wklad z gniazdami o profilu czekoladek, zakrytego pokrywa, przedstawione na zlaczonych fotografiach fig. 1 i 2, charakteryzuje sie tym, ze: - pudelko z pokrywa osloniete jest oslona w ksztalcie prostokatnej ramki z zaokraglonymi wewnetrznymi narozami i zagietymi prostopadle wewnetrznymi sciankami przylegajacymi do górnej powierzchni pokrywy pudelka i posiadajacymi wybrania narozne, przy czym tlem calego opakowania jest kolor czerwony z odcieniami koloru zóltego i rózowego; - na górnej czesci pokrywy pudelka z czerwono-rózowo-zóltym tlem w górnym lewym narozu znajduje sie rysunek kwiatu rózy, a w dolnym prawym narozu rysunki czekoladek o zróznicowanych ksztaltach w kolorze brazowym z ozdobnymi ornamentami na ich górnej powierzchni, zas pomiedzy wspomnianymi rysunkami na zóltym tle pokrywy znajduje sie galazka sztucznego kwiatu czerwonej rózy z zielonymi liscmi przewiazana wstazka usytuowana wzdluz przekatnej tej pokrywy; - na czerwonym tle scian ramkowej oslony opakowania znajduja sie poprzecznie usytuowane faliste zólte pasma oraz kilka rysunków kwiatów rózy, natomiast na krótszych scianach bocznych tej oslony znajduja sie dodatkowo napisy „Bombonierka z kwiatem" w kolorze zóltym, rysunki perspektywiczne czekoladek o zróznicowanych profilach w kolorze brazowym z ornamentami na ich górnych powierzchniach.fig. 1 fig. 2fig. 1 fig. 2 PL PLThe industrial design is a decorative cardboard packaging intended for packaging, displaying, and selling chocolate products. The new and original nature of the industrial design is evident in its shape, colors, line layout, and graphic design on the side walls of the packaging. The industrial design is shown in the attached photographs, in which Fig. 1 shows the decorative packaging in perspective, and Fig. 2 shows the same packaging from above. The decorative packaging according to the industrial design shown in the attached photographs Fig. 1 and 2 has the shape of a flattened cuboid with a rectangular base, composed of a box provided with an insert with chocolate-shaped sockets, covered with a lid, and a cover of this box in the shape of a rectangular frame with rounded inner corners and perpendicularly bent inner side walls adjoining the upper surface of the box lid and having corner recesses, the background of the entire packaging being red with shades of pink and yellow. On the upper surface of the box lid with a red, pink and yellow background, in the upper left corner there is a drawing of a rose flower, and in the lower right corner there are drawings of four chocolates in a perspective view with a shape similar to a truncated cone, an oval, a truncated pyramid and a heart in brown with light shades, with decorative ornaments on their upper surface, while between the drawings of the rose and the chocolates on the yellow background of the lid there is a sprig of an artificial red rose flower with green leaves, tied with a decorative gold ribbon, situated along the spiky part of the lid. In turn, on the red background of the walls of the framed cover of the packaging there are transversely placed yellow bands with a wavy profile and several drawings of rose flowers, while on the shorter side walls of this cover there are additionally the inscriptions "Bombonierka z kwiatem" placed in one line and made in yellow, and below them perspective drawings of four chocolates in brown with different profiles and decorative ornaments on their surfaces, while on the longer side walls there are the inscriptions "Bombonierka z kwiatem" placed in two lines in yellow, and next to them perspective drawings of two chocolates with different profiles and decorative ornaments on their surfaces, while on each side wall there is additionally a graphic representing the trademark consisting of a drawing of the Wawel Castle in gold, a stylized inscription "Wawel" in white with a gold border, and situated below the golden inscription "KRAKÓW" placed between two arcuate golden lines. Essential features of the industrial design The decorative packaging in the shape of a flattened cuboid composed of a box provided with an insert with chocolate-shaped slots, covered with a lid, shown in the attached photographs Fig. 1 and 2, is characterized in that: - the box with the lid is covered with a cover in the shape of a rectangular frame with rounded inner corners and perpendicularly bent inner walls adjoining the upper surface of the box lid and having corner recesses, the background of the entire packaging being red with shades of yellow and pink; - on the upper part of the box lid with a red, pink and yellow background, in the upper left corner there is a drawing of a rose flower, and in the lower right corner there are drawings of chocolates of various shapes in brown with decorative ornaments on their upper surface, while between the aforementioned drawings on the yellow background of the lid there is a branch of an artificial red rose flower with green leaves tied with a ribbon situated diagonally along the cover; - on the red background of the walls of the framed cover of the packaging there are transversely situated wavy yellow bands and several drawings of rose flowers, while on the shorter side walls of this cover there are additionally the inscriptions "Chocolate box with flower" in yellow, perspective drawings of chocolates of various profiles in brown with ornaments on their upper surfaces.fig. 1 fig. 2fig. 1 fig. 2 PL PL
