The essence of the industrial design is the new and original form of the label's surface, manifested in its colors, colorful, graphically realistic images, their arrangement, and the mutual graphic and textual informational layout. Through its surface colors, graphics, and text arrangement, the label possesses not only informational, functional, advertising, and marketing values, but also allows for the achievement of aesthetic goals. A label according to the industrial design, in variants of embodiment, is presented in the attached illustration, in which: Fig. 1 – shows the first variant of the label for packaging containing vinegar hair conditioner; Fig. 2 – shows the second variant of the label for packaging containing cactus hair conditioner; Fig. 3 – shows the third variant of the label for packaging containing rice hair conditioner; Fig. 4 – shows the fourth variant of the label for packaging containing yeast hair conditioner; Fig. 5 – shows the fifth variant of the label for packaging containing egg hair conditioner. The label, and all its variants, designed for placement on flattened oval tube-shaped packaging containing caring and nourishing cosmetics for various hair types, made with natural ingredients according to long-established recipes, takes the form of a wide, vertically elongated rectangle. The background of each label is a uniform color, referencing the conditioner contained within the package. The label is divided into two parts, resulting from the verbal and graphic layout on its surface: the front part presenting the product contained within the package, and the back part, which serves as a counter-label containing information about the product and its manufacturer. Each label has an identical layout of verbal and graphic elements. At the top of the front part of each label, the name of the applicant's product series is displayed in two lines: "Barwa naturalna" (Natural Color). On the solid color background of the front of each label is an image depicting the primary ingredient, thematically related to the name of the product contained within the packaging. Against the background of the image, which takes up almost the entire front of each label and refers to the product's primary ingredient, a multi-line inscription with the product's name and intended use in Polish is placed between two horizontal lines. Below the second horizontal line is the product's name and intended use in English. Below the realistic image depicting the package contents, along with the product name and type, is a round icon indicating the percentage of natural ingredients in the product. At the bottom of each front label is the applicant's logo, which also constitutes the registered word and figurative trademark R. 302835. The back of the label, located on the right side of the front label, serves as a counter-label. Each variant displays the product name and series at the top. Below, in small print, is the required, essential product information in Polish and foreign languages, separated by a circular image resembling a seal and three circular icons with informational images and captions. At the bottom of each counter-label, on the left, is information about the product's origin and manufacturer, followed by the weight of the package contents, and on the right, a barcode with an image referring to the product, located on its upper right side. The first variation of the label for a flattened tube containing vinegar hair conditioner, shown in Fig. 1 of the attached illustration, is rectangular in shape with longer vertical sides. The entire label has a uniform light green background. The graphic and textual layout of the label allows for the distinction of its two parts: the front, which graphically and textually presents the product contained within the package, and the back, which serves as a back label with information about the product and its manufacturer. The right-hand side of the front of the label features a picture of a plump, intensely green apple surrounded by dark green leaves and pink apple blossoms. At the bottom of the apple are sliced, natural-colored quarters. Against the background of the apple drawing, there are two horizontal lines between which there is a multi-level inscription containing the name and type of the product in Polish, written in large capital letters and italics in dark brown print: ACETATE CONDITIONER FOR NATURAL AND MATT HAIR, glossy. The word: "OCTOWA" is slightly larger than the others and is the dominant word in this inscription. Under the second horizontal line, between and against the background of quartered apples, there is an inscription with the name and type of the product in English: APPLE CIDER VINEGAR CONDITIONER, glossy, written in various font sizes and types. Below the inscriptions specifying the name and type of the product, there is a round icon with a dark green background, with the number 98 with a % sign in the center, below which, in three lines, there is the English inscription: Ingredients of natural origin. At the very bottom of the front part of the label, there is the applicant's logo, which is also its registered verbal and figurative trademark R. 302835. At the top of the back label, located on the right side of the front part of the label, there is the inscription: "ODZYWKA OCTOWA" in bold, dark brown capital letters, below which is the term "shining" in italics, smaller, regular font. The inscription with the name and type of the product is underlined with a small brown line. Below, in small print, there is the required, essential information about the product and instructions for use in Polish. Below this information, on the left, there is a circle imitating a seal with a drawing of a stylized parrot's head in the center, surrounded by the inscription in capital letters: "RECIPE KNOWN FOR GENERATIONS" and a decorative ornament and circle, behind which there are three round icons on a dark green background with white, thinly lined drawings of an apple with a stem, fancifully intertwined flattened circles, and a woman's head with a coiffure shown in profile. Under each icon, there are appropriate inscriptions in several lines: "NATURAL REGENERATING HAIR SMOOTH VINEGAR EXTRACT COMPLEX FULL OF APPLE SHINE" VITAMINS. Below, there is extensive information about the product and the product's ingredients in English and Spanish. The second label variant, shown in the attached illustration as Fig. 2, with a vibrant green background covering its entire surface, features a realistic image of a prickly pear cactus in color PL 28093—four different shades of green with different flowers and fruit, with dark, sharp colors and light bases—on its front. Against the background of a prickly pear cactus, in the middle there is a multi-level inscription giving the name and type of the product: CACTUS CONDITIONER FOR DRY AND NORMAL HAIR, moisturizing, below which there is an inscription with the same content in English: CACTUS CONDITIONER moisturizing, below there is a round dark green icon with the number 98% informing about the content of natural ingredients in the product. The adjacent back label has a two-level inscription at the top: "MOISTURIZING CACTUS CONDITIONER" and contains below all the required, useful, and essential information about the product in Polish and foreign languages, separated by a horizontal row of drawings depicting: a circle imitating a seal and three round dark green icons with drawings drawn in white lines, a cactus, a prickly pear, hemp leaves, and a profile of a woman's head with a hairstyle. Under each icon there is a two-line inscription: NATURAL ORGANIC EXTRACT, MOISTURIZED HAIR FROM Prickly Pear, HEMP OIL AND REBUILDED. The product barcode at the bottom of the back label features a stylized dark brown drawing of a prickly pear on the right side of its upper side. All text on the label is in white, while the remaining verbal and graphic elements are as shown in the introduction to the application and in Fig. 1 of the label. The third version of the label, shown in Fig. 3, with a uniform white background, has a realistic drawing on the front of a brown bowl filled with loosely cooked brown and beige rice grains, surrounded by green ears of rice with ripening brown grains and scattered yellow grains on the sides and at the bottom. Against the background of loosely cooked rice in a brown bowl, there is an inscription: RICE CONDITIONER FOR DRY AND WEAK HAIR, rejuvenating, under which there is an inscription with identical content in English: "RICE CONDITIONER anti-aging", below which there is a round dark green icon with the number 98% indicating the amount of natural ingredients in the product. On the back label adjacent to the front part of the label, at the top, there is an inscription: RICE CONDITIONER rejuvenating, below which there is all the required and necessary information about the product in Polish and foreign languages, separated by drawings of a circle imitating a seal and icons on a dark green background with white line drawings: ears of rice, a falling drop, the profile of a woman's head with a hairstyle. Under each icon are the appropriate informational text: NATURAL OIL VITALITY CONDITIONING EXTRACT AND SHINE FROM RICE PROTEIN DRY ENDS. The product barcode, located at the bottom on the upper horizontal side on the right, features an image of a scattered handful of rice. On the extreme vertical side of the PL 28093 5 back label, there's an image of a fragment of an ear of rice, which, when applied to the packaging, forms a single unit with the front of the label. All text on the label is dark brown. The remaining verbal and graphic elements are as in the introduction to the application description and Fig. 1 of the label. The fourth label variant, shown in the submitted illustration as Fig. 4, has an orange background, with a frontal image of an elaborate glass filled with beer and abundant beige foam pouring from it. At the bottom, on the sides of the glass, are dark beige barley ears. In the center of the glass with the poured beer is a multi-line inscription: ODZYWKA DROZDZOWA (BEER YEAST CONDITIONER FOR HAIR LOSS AND WEAKNESS) strengthening, and below that, an inscription in English with the same content: BREWER'S YEATS CONDITIONER strengtheing. At the bottom of the glass is a round, dark green icon with the white number 98 and the % symbol. At the top of the back label, there's the inscription: Yeast Conditioner Strengthening, while below it is all the required, essential information in Polish and foreign languages, separated by a series of horizontal drawings: a circular seal, dark green circular icons with white drawings of yeast cubes, plant leaves, and the profile of a woman's coiffed head. Under each icon are the appropriate captions: NATURAL EXTRACT PLANT EXTRACTS STRENGTHENED HAIR WITH BREWER'S YEAST SQUALANE, ARGININE, AND REGENERATED ARGAN OIL WITHOUT WEIGHT. The barcode at the bottom of the back label has an image of various-sized yeast cubes on the upper right side. All label text is dark brown. The remaining verbal and graphic elements are as described in the introduction to the application and Fig. 1 of the label. The fifth version of the label shown in Fig. 5, with an intensely yellow background, has on the front a drawing taking up almost the entire surface of the label, depicting a dish in the form of a "fried egg" with a light beige white and a yellow-orange yolk, on which and next to which are drawings of eggs with shells in shades of beige and speckled, and bird feathers in various shades of brown. Against the background of the fried egg and the whole meringue eggs, there is a multi-line inscription: ODZYWKA JAJECZNA DO WLOSÓW RBOWANYCH I ZNISZCZONYCH odbudowujaca (EGG CONDITIONER FOR DYED AND DAMAGED HAIR - rebuilding) and in English: EGG CONDITIONER reconstructing. Below, there is a dark green round icon with the number 98 and the % sign in white. On the right-hand back label, at the top, is the inscription: ODZYWKA JAJECZNA odbudowujaca (JAG REBUILDING CONDITIONER), below which are the required, mandatory, and useful information in Polish and English. Between these inscriptions is an image containing, in a horizontal row: a circle imitating a seal, round icons with a dark green background, and white drawings of eggs, a falling drop, and the profile of a woman's coiffed head. At the very bottom of the back label, on the top side of the product barcode, is an image of eggs and eggshells. All text is dark brown. The remaining label elements are as indicated in the introduction to the application description and as Fig. 1. The essential features of the industrial design are: 1. The label surface is rectangular in shape with vertically elongated sides and a uniform background in different surface colors for each label variant. 2. The layout of verbal and graphic elements is the same for each label variant and allows for the distinction of its two parts: the front presenting the product and the back – a counter-label containing all required product information. 3. Each front part of the label has a two-level inscription at the top, which is the name of the applicant's product series: Barwa Naturalna (Natural Color). 4. Each front part of the label features a color drawing, thematically related to the product contained in the packaging, on which is an inscription with the product name, its purpose, and type in Polish and English. On the front of each label, beneath the lower part of the image, there is a round icon with a dark background and a white digital-text inscription specifying the percentage of natural ingredients in the product. 6. On the front of each label, the applicant's logo, registered trademark R. 302835, is located at the very bottom. 7. Each backlabel has the name and intended use of the product at the top, along with comprehensive, required, and useful information about the product, its origin, with full manufacturer details, and weight. 8. Each backlabel has the product's barcode at the bottom, with an image on the upper, horizontal right-hand side that is associated with the product contained in the packaging.
