Istote wzoru przemyslowego stanowi nowa i posiadajaca indywidualny charakter postac wytworu, nadana mu przez cechy linii, konturów, ksztaltów i oryginalna game kolorystyczna. Efekt estetyczny zapewnia subtelne skomponowanie rysunków imitujacych pek swiezych ziól, nadajac tym swoisty i oryginalny wyglad opakowania. Przedmiot wzoru przemyslowego zostal przedstawiony na zalaczonych fotografiach w widoku ogólnym, na których : Fig.l ilustruje opakowanie kropli walerianowych, Fig.2 ilustruje opakowanie kropli zoladkowych, Fig.3 ilustruje opakowanie kropli mietowych, Fig.4 ilustruje opakowanie plynnego koncentratu do sporzadzania roztworu do plukania gardla. Opakowanie kropli farmaceutycznych charakteryzuje sie tym, ze ma postac kartonika prostopadlosciennego, gdzie przy górnej krawedzi scianki czolowej tego opakowania umieszczony jest na obszarze wielokata fantazyjny zarys listka, na którym umieszczony jest napis skladajacy sie z kolejno nastepujacych po sobie stylizowanych liter „Herbapol ESENCJA NATURY", a na górnej sciance opakowania utworzone jest pasmo oszerokosci odpowiedniej do krawedzi obszaru wielokata z logo) przy czym obszar wielokata, obrys fantazyjnego listka, pasma jak równiez napisów maja cieniowany kolor zielony. Nieco ponizej obszaru wielokata utworzony jest zespól obwodowych pasm skladajacy sie w górnej czesci z szerokiego pasma w ciemniejszym kolorze oraz z pasma waskiego w niekontrastowej tonacji barwy, ale zdecydowanie jasniejszym kolorze niz pasmo górne. Na obu pasmach umieszczone sa napisy o tle liter w bialym kolorze. Natomiast w dolnej czesci scianki czolowej opakowania umieszczony jest rysunek imitujacy pek swiezych ziól skladajacy sie z kilku co najwyzej galazek, których konce skierowane sa w kierunku prawego naroza. Wzór przemyslowy uwidoczniony na Fig. 1 ma obwodowe pasma w kolorze morskim, a na szerokim pasmie obwodowym widnieje napis: WALERIANOWE, zas na waskim pasmie napis: KROPLE, natomiast pek swiezych ziól utworzony jest z kwiatostanu kozika lekarskiego i galazek miety. Odmiana wzoru przemyslowego uwidoczniona na Fig.2 ma obwodowe pasma w kolorze czerwonym, a na szerokim pasmie obwodowym widnieje napis: ZOLADKOWE, zas na waskim pasmie obwodowym widnieje napis: KROPLE FORTE, natomiast pek swiezych ziól utworzony jest z kwiatostanu kozlka lekarskiego i dziurawca oraz galazek miety. Druga odmiana wzoru przemyslowego uwidoczniona na Fig.3 ma obwodowe pasma w kolorze zielonym, a na szerokim pasmie obwodowym widnieje napis: MIETOWE, zas na waskim pasmie obwodowym widnieje napis: KROPLE,, natomiast pek swiezych ziól utworzony jest z galazek miety, gdzie najwyzsza z galazek posiada kwiat tej rosliny. Trzecia odmiana wzoru przemyslowego uwidoczniona na Fig.4 ma obwodowe pasma w kolorze niebieskim, a na szerokim pasmie obwodowymwidnieje napis: SALVIASEPT, zas na waskim pasmie obwodowym widnieje napis: „Koncentrat do sporzadzania roztworu do plukania gardla", natomiast pek swiezych ziól utworzony jest z galazki szalwi, galazki tymianku, galazki rumianku i miety. Istotne cechy wzoru przemyslowego: - opakowanie kropli farmaceutycznych posiada zespól obwodowych pasm o barwie w niekontrastowej tonacji wzgledem siebie, przy czym pasmo waskie, usytuowane ponizej pasma szerokiego ma zdecydowanie jasniejszy kolor od pasma szerokiego, - zespól obwodowych pasm usytuowany jest nieco powyzej srodkowego obszaru opakowania, - przy górnej krawedzi scianki czolowej tego opakowania umieszczony jest na obszarze wielokata fantazyjny zaiys listka, na którym umieszczony jest napis skladajacy sie z kolejno nastepujacych po sobie stylizowanych liter „Herbapol ESENCJA NATURY", - na górnej sciance opakowania utworzone jest pasmo o szerokosci odpowiedniej do krawedzi obszaru wielokata z logo, przy czym obszar wielokata, obrys fantazyjnego listka, pasma jak równiez napisów maja cieniowany kolor zielony. - na sciance czolowej opakowania umieszczony jest rysunek imitujacy pek swiezych ziól skladajacy sie z kilku co najwyzej galazek, których konce skierowane sa w kierunku prawego naroza tej scianki. The essence of the industrial design is the product's new and unique form, imbued with lines, contours, shapes, and an original color palette. The aesthetic effect is achieved through a subtle arrangement of drawings imitating a bunch of fresh herbs, giving the packaging a distinctive and original appearance. The industrial design is presented in the attached photographs from a general view, in which: Fig. 1 illustrates the valerian drops packaging; Fig. 2 illustrates the stomach drops packaging; Fig. 3 illustrates the peppermint drops packaging; Fig. 4 illustrates the liquid concentrate for gargling solution packaging. The pharmaceutical drops packaging is characterized by its rectangular shape, where at the top edge of the front wall of the packaging there is a fanciful outline of a leaf placed on a polygon, on which is an inscription consisting of successive stylized letters "Herbapol ESSENCE OF NATURE." On the top wall of the packaging there is a band of a width corresponding to the edge of the polygon area with the logo. The polygon area, the outline of the fanciful leaf, the band, and the inscriptions are shaded green. Slightly below the polygon area there is a set of peripheral bands consisting of a wide band in a darker color in the upper part and a narrow band in a non-contrasting color tone, but significantly lighter than the upper band. Both bands contain inscriptions with a white background of the letters. The lower part of the front wall of the packaging features a design imitating a bunch of fresh herbs, consisting of at most a few sprigs, the ends of which point towards the right corner. The industrial design shown in Fig. 1 has teal-colored peripheral bands, and the wide peripheral band bears the inscription: VALERIANOWE (VALERIANOWE), while the narrow peripheral band bears the inscription: KROPLE (DROPS), while the bunch of fresh herbs is composed of a valerian inflorescence and mint sprigs. The industrial design variation shown in Fig. 2 has red peripheral bands, and the wide peripheral band bears the inscription: ZOLADKOWE (STOPPER), while the narrow peripheral band bears the inscription: KROPLE FORTE (DROPS FORTE), while the bunch of fresh herbs is composed of a valerian and St. John's wort inflorescence and mint sprigs. The second variation of the industrial design shown in Fig. 3 has green peripheral bands, and the wide peripheral band bears the inscription: MINT, while the narrow peripheral band bears the inscription: KROPLE, while the bunch of fresh herbs is made of mint sprigs, with the tallest sprig bearing a mint flower. The third variation of the industrial design shown in Fig. 4 has blue peripheral bands, and the wide peripheral band bears the inscription: SALVIASEPT, while the narrow peripheral band bears the inscription: "Concentrate for preparing a gargle solution," while the bunch of fresh herbs is made of a sprig of sage, a sprig of thyme, a sprig of chamomile, and mint. Essential features of the industrial design: - the packaging of pharmaceutical drops has a set of peripheral bands in a non-contrasting colour tone with respect to each other, wherein the narrow band, situated below the wide band, is significantly lighter in colour than the wide band, - the set of peripheral bands is situated slightly above the central area of the packaging, - at the upper edge of the front wall of this packaging, in the area of the polygon there is a fancy leaf pattern, on which there is an inscription consisting of successive stylised letters "Herbapol ESSENCE OF NATURE", - on the upper wall of the packaging there is a band with a width corresponding to the edge of the area of the polygon with the logo, wherein the area of the polygon, the outline of the fancy leaf, the band and the inscriptions are of a shaded green colour. - on the front wall of the packaging there is a drawing imitating a bunch of fresh herbs consisting of at most a few sprigs, the ends of which point towards the right corner of this wall.
