随着2G/3G,甚至是4G时代的到来,以及随处可见的WIFI热点,标志着现今大数据时代的来临,用户一切的日常行为理论上可以借助各大运营商提供的移动数据网络构建的网络及WIFI这种无线局域网络,通过互联网技术实现各种数据处理。因此,网络环境在方便用户生活的方面比线下的真实世界有其优势,但是如何利用网络保障数据交互双方并降低风险,尚无有效解决方案。
以用户一个生活场景中的数据处理为例,用户申请贷款时,通常可以通过个体和个体之间直接借贷方式或者个体向银行借贷的方式进行申请。但是,个体和个体之间的借贷活动通常是第一参与方和第二参与方通过口头或书面的形式达成协议,在第二参与方向第一参与方提供了资产后,由于不存在强制还款约束,给第二参与方带来了很大的风险。因此,需要考虑如何利用网络实现借贷并降低风险。

具体地,第一参与方向第二参与方发出需要贷款的请求后,第二服务方向第一资金管理服务器申请开立电子承诺支付凭证,其中,电子承诺支付凭证为第二参与方以其账户资金或授信额度作为保证金向所述第一资金管理服务器申请并由第一资金管理服务器开立的。
其中,第一资金管理服务器是在确定第二参与方在其金融系统的账户资金或授信额度不小于第一参与方的贷款金额时,给第二参与方开出与所述贷款价值相等的电子承诺支付凭证。
第一资金管理服务器根据其开立的电子承诺支付凭证冻结第二参与方的至少部分资金,将电子承诺支付凭证发送至第二资金管理服务器,第二资金管理服务器向第一参与方发放贷款,并在发放贷款的同时通知第一参与方需在预定日期内归还上述贷款。
其中,第一资金管理服务器与第二金管理服务器为银行或其他金融机构,二者可以为同一家机构,也可以为分别为不同的机构,当第一资金管理服务器与第二金管理服务器为不同机构时,通过本实施例的方式实现贷款和借款过程。
如果第二资金管理服务器在预定日期内接收第一参与方归还的贷款,第二资金管理服务器会向第一资金管理服务器发送告知所述第一资金管理服务器所述第一参与方已归还贷款的通知。第一资金管理服务器根据上述通知解冻所述第二参与方的与所述贷款等额的资金。

另外,由于第一参与方未在预定日期内归还贷款,第二资金管理服务器降低所述第一参与方在所述银行诚信系统中的信用等级。

数据发起方接收所述通知后,为了影响自身的信誉度,数据发起方向所述第一服务方发送愿意代替所述数据请求方向所述第二服务方的数据单元增加第一数据值的通知。

在另一个实施方式中,由于数据发起方同意代替所述数据请求方向第二服务器的数据单元中增加第一数据值,属于诚信行为,为了增进第一服务方与数据发起方之间的数据交互,第一服务方还将数据发起方本次按时向第一服务单元增加第一数据值的记录纳入到诚信系统中,并提升所述数据发起方在诚信系统中的等级。
另外,数据发起方的数据单元中的部分数值虽然处于锁定状态,但数据发起方仍对其具有归属权,第一服务方解付需向所述数据发起方发放冻结的数据在冻结期间带来的增值数据。

  1. 一种还贷方法,其特征在于,包括:
    第一资金管理服务器确定第二资金管理服务器在预定日期内未接收到第一参与方归还的贷款时,向第二参与方发送询问所述第二参与方是否代替所述第一参与方归还所述贷款的通知,并保持所述第二参与方的至少部分资金的冻结状态;其中,所述贷款由所述第二资金管理服务器根据来自第一资金管理服务器的电子承诺支付凭证向所述第一参与方发放的,所述电子承诺支付凭证是由所述第一资金管理服务器根据第二参与方的申请,冻结所述第二参与方不小于所述贷款金额的资金后开立的;
    所述第二参与方接收所述通知,并向所述第一资金管理服务器回复同意代替所述第一参与方归还贷款的消息;
    所述第一资金管理服务器接收所述消息,并解付所述第二参与方的被冻结的资金到所第二资金管理服务器的金融系统中。
  2. 根据权利要求1所述的方法,其特征在于,所述第一资金管理服务器接收所述消息,并解付所述第二参与方的被冻结的资金到所第二资金管理服务器的金融系统中的步骤的同时或之后还包括:
    所述第一资金管理服务器向所述第二参与方发放被冻结的资金在被冻结期间内产生的存款利息;
    将所述第二参与方按期还款记录纳入银行诚信系统;
    提升所述第二参与方在所述银行诚信系统中的信用等级。
  3. 根据权利要求1所述的方法,其特征在于,所述第一资金管理服务器接收所述消息,并解付所述第二参与方的被冻结的资金到所第二资金管理服务器的金融系统中的步骤的同时或之后还包括:
    所述第二资金管理服务器降低所述第一参与方在所述银行诚信系统中的信用等级。
  4. 根据权利要求1-4任一项所述的还贷方法,其特征在于,所述方法还包括:当所述第二资金管理服务器在超过还贷期限后仍未收到还款时,所述第二资金管理服务器向所述第一参与方征收延期罚金,其中,所述延期罚金为延期滞纳金或/和延期还款期限内增加的贷款利息。
  5. 一种还贷方法,其特征在于,包括:
    第一资金管理服务器在第二资金管理服务器在预定日期内未接收到第一参与方归还的贷款时,向第二参与方发送询问所述第二参与方是否代替所述第一参与方归还所述贷款的通知,并保持所述第二参与方的至少部分资金的冻结状态;其中,所述贷款由所述第二资金管理服务器根据来自第一资金管理服务器的电子承诺支付凭证向所述第一参与方发放的,所述电子承诺支付凭证是由所述第一资金管理服务器根据第二参与方的申请,冻结所述第二参与方不小于所述贷款金额的资金后开立的;
    所述第一资金管理服务器接收第二参与方同意代替所述第一参与方归还的消息,并解付所述第二参与方的被冻结的资金到所第二资金管理服务器的金融系统中。
  6. 根据权利要求5所述的方法,其特征在于,所述第一资金管理服务器接收所述消息,并解付所述第二参与方的被冻结的资金到所第二资金管理服务器的金融系统中的步骤的同时或之后还包括:
    所述第一资金管理服务器向所述第二参与方发放被冻结的资金在被冻结期间内产生的存款利息;
    将所述第二参与方按期还款记录纳入银行诚信系统;
    提升所述第二参与方在所述银行诚信系统中的信用等级。
  7. 一种数据交互处理方法,其特征在于,所述方法包括:

    所述数据发起方接收所述通知,并向所述第一服务方回复同意代替所述数据请求方向所述第二服务方的数据单元增加第一数据值的消息;
    所述第一服务方接收所述消息,并解付所述数据发起方的被锁定的数据到所述第二服务方的数据单元中,其中,所述解付的数据的数值相当于所述第一数据值以及所述第一数据值的增值数据的数值。
  8. 根据权利要求7所述的方法,其特征在于,所述第一服务方接收所述消息,并解付所述数据发起方的被锁定的数据到所述第二服务方的数据单元中步骤的同时或之后还包括:
    所述第一服务方向所述数据发起方的数据单元中增加数值与所述第一数据值大小相等的数据在锁定期间产生的增值数据。
  9. 根据权利要求7所述的方法,其特征在于,所述第一服务方接收所述消息,并解付所述数据发起方的被锁定的数据到所述第二服务方的数据单元中步骤的同时或之后还包括:
    所述第二服务方降低所述数据请求方在其信用系统中的等级。

    当所述数据请求方未在预定日期内向所述第二服务方的数据单元增加第一数据值时,所述第二服务方向所述数据请求方征收由于超期而产生的第一数据值的滞纳数据。
  11. 一种数据交互处理方法,其特征在于,所述方法包括:
    第一服务方确定数据请求方未在预定日期前向第二服务方的数据单元增加第一数据值时,向数据发起方发送是否愿意代替所述数据请求方向所述第二服务方的数据单元增加第一数据值的通知,并保持数据发起方的数据单元内的至少部分数据的锁定状态;其中,所述第一数据值由所述第二服务方根据来自第一服务方的数据凭证向所述数据请求方发送的,所述数据凭证是由所述第一服务方根据数据发起方的申请,锁定所述数据发起方的数据单元内的数值不小于所述第一数据值大小的数据后开立的;
    所述第一服务方在接收到所述数据发起方发送的愿意代替所述数据请求方向所述第二服务方的数据单元增加第一数据值的通知,并解付所述数据发起方的被锁定的数据到所述第二服务方的数据单元中,其中,所述解付的数据的数值相当于所述第一数据值以及所述第一数据值的增值数据的数值。
  12. 根据权利要求11所述的方法,其特征在于,所述第一服务方在接收到所述数据发起方发送的愿意代替所述数据请求方向所述第二服务方的数据单元增加第一数据值的通知,并解付所述数据发起方的被锁定的数据到所述第二服务方的数据单元中,其中,所述解付的数据的数值相当于所述第一数据值以及所述第一数据值的增值数据的数值步骤的同时或之后还包括:
    所述第一服务方向所述数据发起方的数据单元中增加数值与所述第一数据值大小相等的数据在锁定期间产生的增值数据。
  13. 一种数据交互处理系统,其特征在于,所述系统包括:数据请求终端、数据发起终端、第一服务器以及第二服务器,
    所述第一服务器用于在确定数据请求终端未在预定日期前向第二服务器的数据单元增加第一数据值时,向所述数据发起终端发送是否愿意代替所述数据请求终端向所述第二服务器的数据单元增加第一数据值的通知,并保持数据发起终端的数据单元内的至少部分数据的锁定状态;其中,所述第一数据值由所述第二服务器根据来自第一服务器的数据凭证向所述数据请求方发送的,所述数据凭证是由所述第一服务器根据数据发起终端的申请,锁定所述数据发起终端的数据单元内的数值不小于所述第一数据值大小的数据后开立的;
    所述数据发起终端用于接收所述通知,并向所述第一服务器回复同意代替所述数据请求终端向所述第二服务器的数据单元增加第一数据值的消息;
    所述第一服务器还用于接收所述消息,并解付所述数据发起终端的被锁定的数据到所述第二服务器的数据单元中,其中,所述解付的数据的数值相当于所述第一数据值以及所述第一数据值的增值数据的数值。
  14. 根据权利要求13所述的数据交互处理系统,其特征在于,所述第一服务器还用于在解付所述数据发起终端的被锁定的数据到所述第二服务器的数据单元中后,向所述数据发起终端的数据单元中增加数值与所述第一数据值大小相等的数据在锁定期间产生的增值数据。
  15. 根据权利要求13所述的数据交互处理系统,其特征在于,所述第二服务方还用于在所述数据请求终端未在预定日期前向第二服务器的数据单元增加第一数据值时,降低所述数据请求终端在其信用系统中的等级。
  16. 根据权利要求13所述的数据交互处理系统,所述第二服务方还用于在在所述数据请求终端未在预定日期前向第二服务器的数据单元增加第一数据值时,向所述数据请求终端征收由于超期而产生的第一数据值的滞纳数据。
  17. 一种服务器,其特征在于,所述服务器包括:发送模块、锁定模块以及接收模块,
    所述发送模块用于在第一服务器确定数据请求终端未在预定日期前向第二服务终端的数据单元增加第一数据值时,向数据发起终端发送是否愿意代替所述数据请求方向所述第二服务器的数据单元增加第一数据值的通知,所述锁定模块用于保持数据发起终端的数据单元内的至少部分数据的锁定状态;其中,所述第一数据值由所述第二服务器根据来自第一服务器的数据凭证向所述数据请求终端发送的,所述数据凭证是由所述第一服务器根据数据发起终端的申请,锁定所述数据发起终端的数据单元内的数值不小于所述第一数据值大小的数据后开立的;
    所述接收模块用于接收到所述数据发起终端发送的愿意代替所述数据请求终端向所述第二服务器的数据单元增加第一数据值的通知;
    所述发送模块还用于解付所述数据发起终端的被锁定的数据到所述第二服务器的数据单元中,其中,所述解付的数据的数值相当于所述第一数据值以及所述第一数据值的增值数据的数值。
