Abstract
A thermoplastic composition obtainable by the process of claim 15 comprising (a) a compatibilized polyphenylene ether-polyamide base resin, and (b) 1–7 parts by weight per 100 parts by weight of (a) of an electroconductive carbon black, wherein the composition has an Izod notched impact strength of more than 15 kJ/m2 (measured in accordance with ISO 180/1A) and a volume resistivity of less than 106 Ohm·cm (measured on the narrow parallel portion of multipurpose test specimen type A according to ISO 3167 with a length of about 70 mm obtained by breaking off both ends of the test specimen, molded as described in ISO 294 for dumb-bell bars, the fracture surface of both ends being coated with a silver paint and the resistivity being measured between the silver painted surfaces with an electrical multimeter).

Auf die Berufung der Beklagten wird das am 1. März 2005 verkündete Urteil des 3. Senats (Nichtigkeitssenats) des Bundespatentgerichts unter Zurückweisung des weitergehenden Rechtsmittels abgeändert und wie folgt neu gefasst:

Claims (1)
- A thermoplastic composition obtainable by the process of claim 15 comprising (a) a compatibilized polyphenylene ether-polyamide base resin, and (b) 1–7 parts by weight per 100 parts by weight of (a) of an electroconductive carbon black, wherein the composition has an Izod notched impact strength of more than 15 kJ/m2 (measured in accordance with ISO 180/1A) and a volume resistivity of less than 106 Ohm·cm (measured on the narrow parallel portion of multipurpose test specimen type A according to ISO 3167 with a length of about 70 mm obtained by breaking off both ends of the test specimen, molded as described in ISO 294 for dumb-bell bars, the fracture surface of both ends being coated with a silver paint and the resistivity being measured between the silver painted surfaces with an electrical multimeter).
