Znak graficzny Przedmiotem wzoru przemyslowego jest znak graficzny odzwierciedlajacy zakres przedmiotowy i formy prowadzonej dzialalnosci w zakresie projektowania, wytwarzania i handlu pojazdami jednosladowymi, jak motocykle i skutery z napedem elektrycznym. Istota wzoru przemyslowego jest wykorzystanie kompozycji slowno- graficznej znaku graficznego, zawierajacego na powierzchni ekspozycyjnej kompozycje plastyczna i kolorystyczna, która w polaczeniu z zestawem slownym sugestywnie oddzialywuje na obserwatorów, czyniac z nich potencjalnych klientów korzystajacych z prowadzonej dzialalnosci projektowej, produkcyjnej oraz handlowej pojazdów jednosladowych z rodzaju motocykle, czy skutery z napedem elektrycznym. Przedmiot wzoru przemyslowego uwidoczniono na zalaczonym materiale ilustracyjnym, na którym numeracja odmian wzoru przemyslowego odpowiada numeracji figur. I tak na fig. 1 przedstawiona jest powierzchnia ekspozycyjna pierwszej odmiany znaku graficznego, fig. 2 - przedstawia powierzchnie drugiej odmiany znaku, zas fig. 3 - widok powierzchni ekspozycyjnej trzeciej odmiany znaku. Pierwsza odmiana znaku graficznego ma cechy istotne wzoru przemyslowego charakteryzujace sie tym, ze przedstawia graficzna stylizacje motocykla w widoku bocznym stojacego na podlozu o ksztalcie prostokatnym. Równolegle do krawedzi zewnetrznych motocykla zaznaczony jest obrys pojazdu obejmujacy równiez powierzchnie prostokatna podloza. Na tle powierzchni motocykla umieszczone sa dwie przecinajace sie wzajemnie zygzakowate strzaly zewnetrzna i wewnetrzna, o przeciwnie skierowanych kierunkach grotów, stylizujace przedstawianie luku elektrycznego. Na powierzchni zewnetrznej strzaly umieszczony jest wyraz „VOLTAGE: napisany prostymi, duzymi literami, linia sredniej grubosci. Na powierzchni wewnetrznej strzaly zaznaczony jest wyraz „HIGH" napisany prostymi, duzymi literami, sredniej grubosci linia. Na 1powierzchni podloza o ksztalcie prostokata znajduje sie wyraz „GARAGE" napisany na calej dlugosci prostymi, duzymi literami, gruba linia. Kompozycje graficzna podkresla kolorystyka znaku graficznego, w której powierzchnia liter wyrazu „GARAGE", linii graficznych stylizacji motocykla oraz linii obrysu znaku ma barwe czarna, powierzchnia zewnetrznej strzaly i liter wyrazu „HIGH" jest koloru czerwonego, powierzchnia wewnetrznej strzaly i liter wyrazu „VOLTAGE" jest barwy bialej, pozostala zewnetrzna powierzchnia znaku ma kolor szary, jak uwidoczniono na zalaczonym materiale ilustracyjnym fig. 1. Druga odmiana znaku graficznego ma cechy istotne wzoru przemyslowego charakteryzujace sie tym, ze podstawowa kompozycja slowno-graficzna i kolorystyczna znaku jest identyczna jak w pierwszej odmianie. Wyróznikiem jest umieszczenie na powierzchni podloza o ksztalcie prostokata pod wyrazem „GARAGE" zapisu „HVGARAGE.COM" napisanego prostymi, duzymi literami, sredniej grubosci linia, o mniejszych wymiarach liter jak w wyrazie „GARAGE", co uwidoczniono na zalaczonym materiale ilustracyjnym fig. 2. Trzecia odmiana znaku graficznego ma cechy istotne wzoru przemyslowego charakteryzujace sie tym, ze podstawowa kompozycja slowno-graficzna i kolorystyczna znaku jest identyczna jak w pierwszej i drugiej odmianie. Wyróznikiem jest usuniecie z powierzchni przecinajacych sie strzal wyrazów „VOLTAGE" i „HIGH" i w plaszczyznie przeciecia, umieszczenie zielonego liscia . Wyróznikiem jest równiez umieszczenie na powiekszonej powierzchni podloza o ksztalcie prostokata w ukladzie dwupoziomowym zestawu wyrazów, na poziomie górnym „GREEN BIKE", zas ponizej nazwy „FUNDACJA PRO ECO". Zwrot „GREEN BIKE" napisany jest duzymi prostymi literami, gruba zielona linia, zas nazwa „FUNDACJA PRO ECO" napisana jest prostymi duzymi literami sredniej grubosci zielona linia o wymiarach mniejszych od wymiarów liter górnego zestawu, jak uwidoczniono na zalaczonym materiale ilustracyjnym fig. 3.FIG. 1. PLThe subject of the industrial design is a graphic symbol reflecting the scope and forms of business activity in the design, manufacture, and sale of two-wheeled vehicles, such as motorcycles and electric scooters. The essence of the industrial design is the use of a word-and-graphic composition of the graphic symbol, containing a visual and color composition on the display area. This, combined with the word combination, has a suggestive effect on observers, turning them into potential customers for the design, manufacture, and sale of two-wheeled vehicles, such as motorcycles and electric scooters. The subject of the industrial design is shown in the attached illustrative material, in which the numbering of the industrial design variants corresponds to the numbering of the figures. For example, Fig. 1 shows the display area of the first variant of the graphic symbol, Fig. 2 shows the display area of the second variant of the symbol, and Fig. 3 shows the display area of the third variant of the symbol. The first variant of the graphic symbol possesses essential features of an industrial design, characterized by its graphic representation of a side view of a motorcycle standing on a rectangular surface. The vehicle's outline is marked parallel to the motorcycle's outer edges, encompassing the rectangular surface of the surface. Two intersecting zigzag arrows, one outer and one inner, with oppositely directed arrowheads, are placed against the motorcycle's surface, stylizing the representation of an electric arc. The word "VOLTAGE" is placed on the outer surface of the arrow, written in simple, capital letters, and a medium-thick line. The word "HIGH" is marked on the inner surface of the arrow, written in simple, capital letters, and a medium-thick line. On the first surface of the rectangular base there is the word "GARAGE" written along its entire length in simple, capital letters, in a thick line. The graphic composition is emphasized by the colors of the graphic mark, in which the surface of the letters of the word "GARAGE", the graphic lines of the motorcycle styling and the outline line of the mark are black, the surface of the outer arrow and the letters of the word "HIGH" are red, the surface of the inner arrow and the letters of the word "VOLTAGE" are white, and the remaining outer surface of the mark is gray, as shown in the attached illustration material Fig. 1. The second version of the graphic mark has essential features of an industrial design characterized by the fact that the basic word-graphic and color composition of the mark is identical to that of the first version. The distinguishing feature is the placement of the inscription "HVGARAGE.COM" on the surface of a rectangular base under the word "GARAGE", written in simple, capital letters, medium-thick lines, with smaller letter sizes as in the word "GARAGE", as shown in the attached illustration material Fig. 2. The third version of the graphic mark has essential features of an industrial design, characterized by the fact that the basic word-graphic and color composition of the mark is identical to that of the first and second versions. The distinguishing feature is the removal of the words "VOLTAGE" and "HIGH" from the surface of the intersecting arrows and the placement of a green leaf in the plane of intersection. Another distinguishing feature is the placement of a set of words on the enlarged surface of a rectangular base in a two-level arrangement, with "GREEN BIKE" on the top level and the name "FUNDACJA PRO ECO" below. The phrase "GREEN BIKE" is written in large, straight letters, thick green line, and the name "FUNDACJA PRO ECO" is written in large, straight letters, medium-thick green line, smaller than the letters of the upper set, as shown in the attached illustrative material Fig. 3.FIG. 1.
