Description

【発明の詳細な説明】 発明の背景 一般的に、パーソナルコンピュータあるいはそれに類似
した装置の使用者の大部分は、それら装置で実行するソ
フトウェアを様々な小売店からあるいは通信販売を通じ
て入手する。いずれの場合も、ソフトウェア製品はいわ
ゆる「収縮包装」材で包装されており、その収縮包装材
を破った時点でそのソフトウェア製品に対する使用許可
契約が成立して、その製品の使用許諾者を被使用許諾者
／購入者による未許可複製あるいは使用から保護するよ
うになっている。この方法による商行為は、許諾者と被
許諾者の双方にとって満足すべきものではないことが分
かっている。たとえば、被許諾者にとっては、ソフトウ
ェアプログラムを動作させてみてからそれが被許諾者が
必要としているものかどうかを判断する機会が与えられ
ない。さらに、許諾者の側からみると、この方法では被
許諾者の識別ができないうえ、許諾者によるプログラム
使用の制御あるいは監視を行なうことができない。
ソフトウェアプログラム保護方式は、Thomasの米国特許
第4,446,519号に複数開示されており、プログラミング
された「はい／いいえ」で答える設問がプログラムに組
み込まれており、そのソフトウェアが使用許可されるコ
ンピュータに設置されているハードウェアあるいはファ
ームウェア保護装置の存在を確認するようになってい
る。この技法の意図は、プログラムが物理的な保護装置
なしでは使用できないようにすることであり、これはソ
フトウェアよりも複製することがはるかに困難である。
しかし、このような技法は、正しい符号化応答が見破ら
れ、そしてそれをわずかに変更してプログラムに書き込
まれてしまえば、簡単に打ち破られてしまう。ひとたび
打ち破られると、無制限の違法コピーが作成され配布さ
れる可能性がある。
Williamの米国特許第4,740,890号は、中央（遠隔）コン
ピュータを使用して、正しい符号の入手を試みる悪意の
プログラマがアクセスできないマスターリストあるいは
アルゴリズムから得られたロック解除コードあるいは有
効化コードを提供することを開示している。しかし、こ
の方法は、伝送中のコードを傍受することにより、ある
いは保護の周囲をプログラミングすることにより、もし
くはデバッガープログラムによりプログラムを分析して
プログラムの実行を可能にするコードの存在を見つけ出
すことにより、簡単に見破られてしまう。ひとたびにこ
の保護が打ち破られると、動作可能なプログラムの無制
限のコピーが作成され配布される可能性がある。
さらに、Schmidtの米国特許第4,649,510号に開示されて
いる方法では、最も価値のあるアルゴリズムを無効化
し、無効化されたプログラムを処理装置内で実行すると
同時に、回復アルゴリズムを別の物理的に分離し保護さ
れた処理装置で実行することにより回復し、有効結果を
２つの処理間の相互通信によって獲得するようになって
いる。このような技法は、回復アルゴリズムの物理的保
護に依存しており、この物理的保護が侵害された場合、
悪意のプログラマによって簡単に打ち破られる可能性が
ある。したがって、そのような方式は、回復記憶媒体の
物理的保護が維持できない大量市場においては、実用的
ではない。
そのため、ソフトウェアを未許可使用から保護しつつソ
フトウェアを大量市場に配布するための経済的な方法が
求められる。さらに、見込み購入者／被許諾者がソフト
ウェア製品を購入前に試してみることができような方法
とシステムも必要である。また、ソフトウェア製品の改
良および更新部分を登録使用者に配布するための方法も
必要である。
発明の簡単な説明 本発明は、パーソナルコンピュータのソフトウェアプロ
グラムあるいは他の種類のプログラムを、使用許可を管
理した方法で配布する方法とシステムに関する。動作可
能プログラムは、購入者／被許諾者と販売者／許諾者と
の間の特定の契約において入手可能になる。販売者と購
入者との関係は、本発明の目的に関しては、許諾者／被
許諾者契約の関係である必要はないが、以下では販売者
を許諾者、購入者を被許諾者もしくは使用者と呼ぶ。ひ
とたび被許諾者が特定の契約条件に合意すると、被許諾
者識別データが登録用コンピュータに与えられる。登録
用コンピュータはその契約を記録し、使用許可されたプ
ログラムの可動部分を提供する。これらの部分は不正変
更防止が施されていると同時に、識別された被許諾者に
とって独自のものとなっている。この情報の交換に基づ
き、可動コンピュータプログラムが登録済み被許諾者の
コンピュータに不正変更防止ファイルに収納されて配布
される。同時に、このファイルには被許諾者独自の情報
が含まれている。本発明の実施例としては様々なものが
考えられるが、いずれの実施例も被許諾者を識別する独
自のデータと保護されているソフトウェアプログラムに
関する指示とが含まれている暗号化パッケージの構築を
伴っている。したがって、被許諾者は匿名ではなく、そ
して保護されたソフトウェアは使用許諾契約に遡及でき
る情報で符号化される。さらに、使用許可制御データを
暗合化パッケージに含めることにより、様々な制限を課
して使用許可契約の条件を遵守させることができる。
一般的に、様々な実施例は、ソフトウェアのデモンスト
レーション版を有する可能性のあるマーケティングシェ
ルプログラムの最初の配布が伴う。このシェルプログラ
ムは、見本表示と宣伝記述だけを有しているか、あるい
は完全なプログラムの動作不能版を有している。しか
し、大部分の実施例は、登録プログラムと、ローダーセ
グメントと呼ばれる特別のプログラムモジュールを含む
ような構成になっている。
マーケティングシェルは適正な方法で自由に配布される
であろう。マーケティングシェルがプログラムのデモン
ストレーション版を有している場合、エグゼクティブ制
御ループが保護されたプログラムの限定版になる。マー
ケティングシェルは見込み使用者に登録を促す。マーケ
ティングシェル内の登録プログラムは、登録データを登
録データベースコンピュータに中断する。暗号化ファイ
ル内で結合された被許諾使用者独自のデータと動作可能
版のプログラムとを有する独自の暗号化パッケージが組
み立てられる。独自の暗号解読キーが、暗号化ファイル
および保護されていないプログラムファイルと共に使用
者のコンピュータに伝送されるが、これらはマーケット
シェルを増大させる。解読キー、暗号化ファイル、そし
て保護されていないファイルの到着と同時に、マーケッ
トシェルはこれらの各々を使用者のコンピュータに導入
する。
したがって、使用者がプログラムを実行する毎に、ロー
タセグメントが提供された解読キーを使用して、暗号化
ファイルを保護されていないファイルに対するオーバー
レイとしてロードして解読する。このプログラムは保護
されていないソフトウェアプログラムの設計にしたがっ
て実行され、独自の使用許諾データもプログラム実行中
にロードされる。プログラムが実行されていないとき
は、保護されているプログラムはその暗号化形態に留ま
って、保護されていないプログラムファイルと共にコン
ピュータの大容量記憶装置に格納されている。保護され
ているプログラムは実行のためにロードされたときだけ
解読され、正しい暗号化キーにアクセスしなければ変更
され得ない。
図面の簡単な説明 図１は本発明による登録過程を示す流れ図である。
図２は本発明によるプログラム実行過程を示す流れ図で
ある。
図３は、本発明の知見による代表的なパーソナルコンピ
ュータと登録用コンピュータの概略図である。
図４は、本発明の知見による代表的なパーソナルコンピ
ュータと登録用コンピュータに代る実施例を示す概略図
である。
発明の詳細な説明 本発明の目的は、許諾者がそのプログラムの費用対効果
に関する責務を従来使用されている方法よりはるかに効
率的な方法で維持することを可能にすることである。さ
らに、本発明の第二の目的は、被許諾者あるいは使用者
が特定のプログラムの購入あるいは使用許諾を得る前に
試用することを可能にすることである。さらに、本発明
の更なる目的は、特定のプログラムの使用許諾保護され
たアップグレイド版を登録被許諾者に配布する手段を提
供することである。したがって、本発明の知見は包括的
なものと考えられ、そしてどのようなソフトウェアプロ
グラムも本方法によって配布できるものと意図されてい
る。
一実施例において、動作可能なエグゼクティブ制御ルー
プを除いて完全な特定プログラムが、パーソナルコンピ
ュータあるいは他の装置において、磁気ディスク、ファ
ームウェア、ハードウェアあるいは他の手段で最初に提
供される。さらに、この特定プログラムには登録シェル
プログラムも含まれる。ただし、小さいプログラムもし
くは著しく価値のあるプログラムの場合、プログラム自
体は存在せず、シェルだけが提供される。エグゼクティ
ブ制御ループが除外されているため、このプログラムは
正しい登録過程を実現しなければ動作しない。図１およ
び図３に示されているように、この登録過程は、パーソ
ナルコンピュータ（PC）10内部の登録シェルプログラム
11と登録用コンピュータ12内部に提供されている登録プ
ログラム40とを使用して開始される。登録システムプロ
グラムが登録用コンピュータ12内に提供され、電子デー
タリンク30を介して登録シェルプログラムがアクセスで
きる。この電子データリンクは、ローカルエリアネット
ワークでもよく、電話モデムリンクでもよく、あるいは
その他のいかなる種類であってもよい。ただし、第二の
実施例においては、登録シェルおよび登録システムプロ
グラムは同一の媒体上に存在してもよいが、その媒体は
製品応用プログラムとは別でなければならない。この場
合、登録シェルおよび登録システムプログラムが入って
いる移植可能な媒体は、許諾された導入プログラムによ
って使用者パーソナルコンピュータ10へ個人的に移植さ
れ、電子データリンクは必要ではない。
登録シェルプログラムは、使用者がPCオペレーティング
システム14のメインプログラムファイル内に提供されて
いる製品応用プログラムの実行を最初に試行すると実行
される。登録シェルは、製品応用プログラムに関する記
述情報を提供しそれをPC表示装置に表示すると同時に、
見込み被許諾者を促して使用者として登録する。使用許
諾は、特定の使用場所における特定の被許諾者に対して
譲渡され、その期間は様々な長さもしくは一時的でよ
く、そのための費用は被許諾者に対して課せられない。
ただし、登録シェルは、不正変更防止オーバーレイファ
イルが存在しないかぎり、メインプログラムを実行しな
い。登録シェルプログラム11は、被許諾者のPCに表示さ
れるデータ入力形式を提供し、被許諾者に対して、請求
書送付先、口座番号、使用許諾条件などの識別情報の提
供を要求する。この情報は、被許諾者が再確認する登録
要求ファイル25に入力される。そして、登録シェルプロ
グラムは、被許諾者が指定キーを押して登録を開始する
のを待つ。このキーが押されると、登録ファイルが閉
じ、そして登録シェルファイル転送プログラム26が登録
システムファイル転送プログラムとのデータリンクを確
立する。登録用コンピュータ内の登録プログラム40は、
データリンクが正当な登録シェルで確立されていること
を確認する機密保護チェックを実行する有効化手段42に
よって保護される。つぎに、登録シェルは登録要求ファ
イル25を、そのファイルを受信する登録システムに転送
し、必要なエラーチェックと、結合されたファイル転送
プログラム26および32間のハンドシェーク動作を実行す
る。完全な登録要求ファイルが中央登録用コンピュータ
で受信されると、登録要求が登録済み使用者34のデータ
ベースに対して確認される。確認は、その要求に答える
べきかどうかを判断する様々なチェックが含まれる。た
とえば、一時的使用許諾に対する要求が特定の被許諾者
から再度送られてきた場合、その被許諾者には使用許可
が与えられず、そしてそのプログラムのエグゼクティブ
制御ループは送出されない。そのような状態が発生した
場合、適切なメッセージが登録シェルに転送され、見込
み被許諾者に対して表示される。しかし、要求が確認さ
れると、登録済み使用者データベースへの記録が作成さ
れるが、この過程全体が完了するまで、そのデータベー
スには入力されない。
登録用コンピュータ12の内部では、つぎに使用者識別デ
ータが使用されて、使用者識別データとエグゼクティブ
制御ループプログラム命令36とを併合することにより作
成された独自の不正変更防止オーバーレイファイルが構
築される。併合されたデータとプログラムファイルに独
自で、不正変更防止オーバーレイファイル37内に含まれ
る巡回冗長検査（CRC）値が計算される。一式の独自の
暗号化キーと解読キーが作成され、不正変更防止オーバ
ーレイファイルの内容全体が暗号化キーを使用して暗号
化される。この暗号化キーに基づき、不正変更防止オー
バーレイファイルと共に転送される解読キーが提供され
る。暗号化アルゴリズムは、公開鍵暗号化システムのよ
うに、暗号化と解読にそれぞれ異なるキーを使用する技
法であればなんでもよい。登録システムが、不正変更防
止オーバーレイファイルと解読キーを、パーソナルコン
ピュータ登録シェルに伝送される１個の出荷ファイル38
に組み込む。また、更新されたメインプログラムファイ
ルもこの出荷ファイルに組み込まれ、ファイル転送プロ
グラムとすでに確立されているデータリンクとを通じて
PCの登録システムに伝送される。
出荷ファイル一式の受信と同時に、登録シェルプログラ
ム内の開梱−導入プログラム28が出荷ファイルを開き、
エグゼクティブ制御ループセグメント24、CRC値22なら
びに解読キー20および、含まれている場合は、更新メイ
ンプログラムファイルを含む不正変更防止オーバーレイ
ファイル40を導入する。これで登録過程が完了したの
で、電子データリンクを切断する。登録データベースレ
コードが入力され、そして被許諾者の要求に対する請求
が、中央登録用コンピュータ12における別のプログラム
によって実行される。
登録が終了すると、被許諾者のパーソナルコンピュータ
に導入された配布済み製品応用プログラムを起動して、
不正変更防止オーバーレイファイルと解読キーを使用し
て製品応用プログラムを実行するたびに実行する製品応
用プログラム一式をロードするためのプロセスが開始さ
れる。
このプログラム実行過程を図２に示す。図示されている
ように、パーソナルコンピュータの使用者が製品応用プ
ログラムの実行をオペレーティングシステムに命令する
と、オペレーティングシステムはメインプログラムとロ
ーダーセグメントをロードする。ローダーセグメントは
他のすべてのプログラム命令に先立って実行される。つ
ぎに、ローダーセグメントは製品応用プログラムの起動
を実行し、不正変更防止オーバーレイの存在をチェック
する。不正変更防止オーバーレイが導入されていなけれ
ば、ローダーセグメントは終了してオペレーティングシ
ステムに戻るので、メインプログラムファイルの実行が
事前に防止される。不正変更防止オーバーレイが導入さ
れていれば、ローダーセグメントは解読キーを見つけて
不正変更防止オーバーレイの解読とロードを行ない、メ
インプログラムファイルに対して存在しないエグゼクテ
ィブ制御ループプログラム命令ならびに独自の識別およ
び使用許諾制御データを重ね合せる。解読およびロード
過程において巡回冗長検査が実行され、それが完了する
と、不正変更防止オーバーレイが登録用コンピュータか
らパーソナルコンピュータに伝送されたときに作成され
た不正変更防止オーバーレイに記憶された巡回冗長検査
値と比較される。巡回冗長検査が失敗に終わると、その
オーバーレイは何らかの方法によって変更が加えられた
ものとみなされ、したがって無効とされる。この時点
で、ローダーセグメントはそのオーバレイを取り外し、
終了してオペレーティングシステムに戻る。したがっ
て、不正変更防止オーバーレイが含まれていない場合と
同様に、メインプログラムファイルの実行は、不正変更
防止オーバーレイのどの部分が変更されていても、事前
に防止される。巡回冗長検査の結果、オーバーレイが変
更されていないことが確認されると、ローダーセグメン
トはオーバレイを含めたメインプログラムファイルの実
行を開始し、そして製品応用プログラムが最後まで実行
される。
不正変更防止オーバーレイを動作可能形態の製品応用プ
ログラムに含めることを要求することにより、被許諾者
識別と使用許諾制御データはそれ以降動作可能プログラ
ムに常に含められることになる。このようにして、許諾
者は不正使用を防止するとともに監視することができ
る。
図１および図２を参照しながら説明したように、本発明
によると、登録過程によって、メインプログラムファイ
ルのエグゼクティブ制御ループセグメントと使用許諾制
御データとを含む不正変更防止オーバーレイファイルが
作成される。登録過程が完了すると、この不正変更防止
オーバーレイは登録用コンピュータからパーソナルコン
ピュータに転送される。この不正変更防止オーバーレイ
は、起動後に不正使用を防止するキー装置である。なぜ
なら、エグゼクティブ制御ループプログラム命令は、発
覚なしには独自の使用許諾識別データと使用許諾制御デ
ータから分離することもできなければ、被許諾者識別と
使用許諾制御データも発覚なしには変更できないからで
ある。
この不正変更防止オーバーレイファイルは、オーバーレ
イファイルが作成されるときに最初に巡回冗長検査値を
オーバーレイファイルに記憶させるとで不正変更防止に
なるとみなされる。巡回冗長検査値は、プログラム命令
と使用許諾データを含むオーバーレイファイルの内容全
体に対して計算される。被許諾者データは独自であるの
で、各々のCRCは独自なものになる。記憶されているCRC
値が、オーバーレイがロードされるたびにローダーセグ
メントによって計算された巡回冗長検査値と比較され
る。これらの巡回冗長検査値が一致しなければ、ローダ
ーセグメントは終了してオペレーティングシステムに戻
る。したがって、オーバーレイファイルの内容になんら
かの変更が加えられていれば、記憶されている巡回冗長
検査値に対応する変更が行われないかぎり、そのオーバ
ーレイファイルは無効になる。つぎに、不正変更防止オ
ーバーレイの内容全体が、巡回冗長検査値の位置が不明
になるような方法で暗号化されるので、この値の所在を
つきとめてそれを変更することが困難になる。
また、暗号化により、不正変更防止オーバーレイに含ま
れる特定のプログラム命令ならびに独自の使用者識別お
よび使用許諾制御データがはっきりしなくなる。暗号化
は、公開鍵暗号化システムのように暗号化と解読に別々
のキーを使用する技法によって達成される。暗号化なら
びに独自の暗号化キーおよび解読キー発生のためのアル
ゴリジムは登録システム内に常駐し、したがって被許諾
者にはアクセスが不可能である。解読キーは、登録シス
テムと登録プログラムシェルを通じて被許諾者のコンピ
ュータに伝送される。オーバーレイファイルを解読する
ためのアルゴリズムはローダーセグメント内にあるの
で、解読キーと解読アルゴリズムを使用してオーバーレ
イファイルを解読しその内容を検査することは、困難で
はあるが可能である。しかし、内容を変更して、新しい
変更されたオーバーレイファイルを暗号化する試みは、
暗号化キーに対するアクセスができないために阻止され
る。私的暗号化キーで暗号化されたオーバーレイファイ
ルだけしか公共相補解読キーで解読できず、私的キーは
公共キーから容易には得られないというのが、公共鍵暗
号システムの一特徴である。
不正変更防止オーバーレイファイルは、プログラム命令
のエグゼクティブ制御ループセグメントと、使用許諾の
方法と制御に適切な独自の使用者識別データとを有して
いる。このデータには、使用許諾の期限、コンピュータ
の製造番号、コンピュータのモデムの電話番号、そして
その他の情報が含まれる。
ローダーセグメント18は特殊目的のサブプログラムであ
り、これは、ローダープログラムが取り除かれたり迂回
された場合、メインプログラムファイルを動作不能にす
る技法によって製品応用プログラムのメインプログラム
ファイルに結合される。この結合技法は、特定のプログ
ラム命令を製品応用プログラムのメインプログラムファ
イル内部に内蔵するプロセスである。これらの内蔵され
た命令は、使用者にとっては未知の記憶位置にある特定
の値を検査する。ローダープログラムセグメントを実行
すると、特定の値がメインプログラムファイルの動作を
可能にするのに必要な特定の記憶アドレス位置に記憶さ
れる。ローダープログラムセグメントは、その他の機能
の他にこの動作を実行する。したがって、ローダーセグ
メントを取り外したり迂回したりすると、メインプログ
ラムファイルには特定の位置における特定の値が含まれ
ないことになり、そのため動作不能になる。
別の実施例において、登録シェルは、製品応用プログラ
ムの動作可能なデモンストレーション版を含んでいる可
能性があるマーケティングパッケージの一部として配布
される。デモンストレーション版のプログラムは、ロー
ダーセグメント、デモンストレーション版の解読キー、
そしてデモンストレーション版の不正変更防止オーバー
レイを含むように設計されている。この場合、不正変更
防止オーバーレイには独自の使用許諾データは含まれな
いが、登録版の製品の機能と表示のデモンストレーショ
ンだけを行なうメインプログラムエグゼクティブ制御ル

グゼクティブ制御ループは、エグゼクティブ制御ループ
の論理設計によって締め出されたプログラムの様々な機
能を有している。たとえば、選択肢を提供するデモンス
トレーションメニューをプログラミングして選択肢を表
示することができるが、デモンストレーション版のエグ
ゼクティブ制御ループをプログラミングして選択項目を
製品登録依頼として解釈して、製品を動作させる前に登
録することを要求できる。
登録を開始する前に、見込み被許諾者はプログラムを実
行し、デモンストレーション版が実行されであろう。前
述しそして図２に示したように、デモンストレーション
版の解読キーが使用され、デモンストレーション版のエ
グゼクティブ制御ループがロード、解読、そして実行さ
れる。デモンストレーションが終了すると、見込み使用
者は、使用者として登録し登録版のプログラムを試行す
るための一時的使用許諾を得るように促される。そし
て、使用者は前述のようにして登録を行い、図４に示さ
れているプロセスを開始することができる。登録要求に
応答して、新しいオーバーレイファイル40′と独自の解
読キー20′が含まれている出荷ファイルが登録用コンピ
ュータから送られる。追加プログラムファイルと更新版
のプログラムファイルも、出荷ファイルと共に受信され
る。登録プログラムはデモンストレーション版の不正変
更防止オーバーレイ40と解読キー20をそれぞれの登録版
40′と20′で重ね書きする。
登録に続き、使用者がプログラムを実行すると、プログ
ラム実行過程で登録済み版の不正変更防止オーバーレイ
40′が検出されてロードされ、独自の解読キー20′を使
用することにより、登録済み版のエグゼクティブ制御ル
ープが解読され実行される。このようにして、デモンス
トレーション版は完全に動作する登録版に変換される。
プログラムの機能向上版が利用できる場合、使用者は同
一のプロセスを起動してさらに別の解読キーと、より強
化されたエグゼクティブ制御ループと追加プログラムフ
ァイルを有する別の不正変更防止オーバーレイとを受信
して、より強化された版の製品に更新することができ
る。
様々な実施例が、小さな不正変更防止オーバーレイを使
用して大きなプログラムの制御を行なうための適切で独
創的な技法を使用することができる。このような技法
は、ここにも含まれているように、プログラムの部分あ
るいはプログラム全体を使用許諾契約と結合する形式で
配布するための、ここに開示されている方法がもたらす
商業的利益の可能性の単なる例である。
上記の知見に照らし合わせ、本発明は様々な変形例が可
能なことは明らかである。たとえば、本発明は、使用者
のコンピュータがその地域の登録用コンピュータに接続
され、さらにその登録用コンピュータがそれより広い地
域の登録用コンピュータに接続され、というように階層
構造的に実現することも可能である。その地域の登録用
コンピュータの登録権限は、その地域の登録用コンピュ
ータとそれより広い地域の登録用コンピュータとの契約
に含まれる使用許諾制御データによって制御できるであ
ろう。したがって、下記の特許請求の範囲内であれば、
本発明を上記明細書に説明されている以外の方法で実施
することができる。

Claims (31)

    【特許請求の範囲】
  1. 【請求項１】プログラムファイルを起動する方法であっ
    て、 表示装置を有する遠隔コンピュータに対して、ローダー
    セグメントと登録シェル部分を含むプログラムファイル
    を提供し、上記プログラムファイルは主要部分を欠いて
    い、上記プログラムファイルを正しく実行することを防
    止する工程、 使用者識別情報を上記登録シェル部分に入力する工程、 上記使用者識別情報を、上記登録シェルから登録用コン
    ピュータ内にある独立した登録プログラムに伝送し、上
    記登録プログラムは使用者識別データと上記主要部分と
    を併合して独自のオーバーレイファイルを作成する工
    程、 上記の独自のオーバーレイファイルを上記登録プログラ
    ムから上記登録シェルに伝送する工程、上記オーバーレ
    イファイルには上記プログラムファイルには当初欠けて
    いる主要部分が含まれ、そして 上記オーバーレイファイルを上記メインプログラムファ
    イルに導入する工程を有し、上記オーバーレイファイル
    に入っている使用者識別が導入されたときだけ上記プロ
    グラムファイルの動作を可能とすることを特徴とする前
    記のプログラムファイル起動方法。
  2. 【請求項２】上記オーバーレイファイルを上記登録用コ
    ンピュータから上記遠隔コンピュータに伝送する前に、
    上記使用者識別情報を利用可能にする工程を有する請求
    の範囲第１項に記載の方法。
  3. 【請求項３】不正変更防止のオーバーレイファイルを作
    成する工程を有する請求の範囲第１項に記載の方法。
  4. 【請求項４】上記不正変更防止オーバーレイファイルが
    上記オーバレイファイルを暗号化することにより作成さ
    れ、巡回冗長検査値が上記暗号化オーバーレイファイル
    内にあるとともに、解読キーを上記オーバーレイファイ
    ルに提する請求の範囲第３項に記載の方法。
  5. 【請求項５】上記オーバーレイが実行のためにロードさ
    れるたびに巡回冗長検査値が計算され、上記不正変更防
    止オーバーレイファイル内に伝送された巡回冗長検査値
    と比較され、上記オーバーレイファイルが作成以後変更
    されているかどうかを判断することを特徴とする請求の
    範囲第４項に記載の方法。
  6. 【請求項６】上記使用者識別情報と上記オーバーレイフ
    ァイルとが、電子データリンクを介して上記登録シェル
    と上記登録プログラムとの間を伝送されることを特徴と
    する請求の範囲第１項に記載の方法。
  7. 【請求項７】上記登録シェルプログラムが、上記の独立
    した登録用コンピュータを備えた第二の遠隔コンピュー
    タから離れた、第一のコンピュータ内に提されているこ
    とを特徴とする請求の範囲第１項に記載の方法。
  8. 【請求項８】上記利用可能工程によって上記使用者識別
    情報が正式の登録シェルを確保することを特徴とする請
    求の範囲第２項に記載の方法。
  9. 【請求項９】上記使用者識別と上記オーバーレイファイ
    ルが、一台のコンピュータに入力され備えられることを
    特徴とする請求の範囲第１項に記載の方法。
  10. 【請求項１０】プログラムファイルを制限されたもしく
    は制限されない期間起動するためのシステムにおいて、 オーバーレイローダー部分が含まれているが少なくとも
    一つの主要プログラム部分が欠けているプログラムファ
    イルが当初備わっていて、このプログラムファイルが動
    作することを防止し、上記オーバーレイローダー部分は
    本物のオーバーレイファイルが現在導入されているとき
    だけこのプログラムファイルを起動することができ、上
    記遠隔コンピュータには登録シェルプログラムが備えら
    れ、上記登録シェルプログラムは使用者が様々な使用者
    識別情報を入力することを可能にするような少なくとも
    一台の遠隔コンピュータと、 登録プログラムと、上記使用者識別情報を受信し処理す
    るための手段と、上記プログラムファイルに欠けている
    上記主要プログラム部分と使用者識別情報の全部あるい
    は一部を含む独自のオーバーレイファイルを作成するた
    めの手段と、上記オーバーレイファイルを上記遠隔コン
    ピュータに伝送する手段とを備えた登録用コンピュータ
    とを有し、 上記オーバーレイファイルを上記遠隔コンピュータに伝
    送することで、上記オーバーレイファイルに入っている
    使用者識別が現在導入されているときだけ上記プログラ
    ムファイルの動作が可能になることを特徴とする上記プ
    ログラムファイル起動システム。
  11. 【請求項１１】上記遠隔コンピュータと上記登録用コン
    ピュータとの間を結合する電子データリンクと、上記登
    録用コンピュータと上記遠隔コンピュータの両方に備え
    られているファイル転送処理とを含むことを特徴とする
    請求の範囲第10項に記載のプログラムファイル起動シス
    テム。
  12. 【請求項１２】上記登録用コンピュータが、すべての登
    録済み使用者が含まれている中央データベースと上記使
    用者識別情報を有効化するための手段とを備えているこ
    とを特徴とする請求の範囲第10項に記載のプログラムフ
    ァイル起動システム。
  13. 【請求項１３】オーバーレイファイルを作成するための
    上記手段が、巡回冗長検査値を備える不正変更防止オー
    バーレイファイルを作成するための暗号化装置と解読キ
    ーを備えており、上記解読キーは上記オーバーレイファ
    イルと共に上記遠隔コンピュータに伝送されることを特
    徴とする請求の範囲第10項に記載のプログラムファイル
    起動システム。
  14. 【請求項１４】上記遠隔コンピュータが、上記オーバー
    レイファイルを解読し、上記オーバーレイファイルが実
    行のためにロードされるたびに巡回冗長検査値を計算
    し、そしてこの検査値を上記登録用コンピュータによっ
    て上記オーバーレイファイルと共に伝送された巡回冗長
    検査値と比較するための手段を備えていることを特徴と
    する請求の範囲第13項に記載のプログラムファイル起動
    システム。
  15. 【請求項１５】上記主要部分がエグゼクティブ制御部分
    であり、そして上記使用者識別情報が使用許諾契約情報
    であることを特徴とする請求の範囲第１項に記載の方
    法。
  16. 【請求項１６】上記主要プログラム部分がエグゼクティ
    ブ制御プログラムであり、そして上記使用者識別情報が
    使用許諾契約情報であることを特徴とする請求の範囲第
    10項に記載のプログラムファイル制御システム。
  17. 【請求項１７】上記主要エグゼクティブ制御プログラム
    部分がプログラムファイル全体を有することを特徴とす
    る請求の範囲第16項に記載のプログラムファイル制御シ
    ステム。
  18. 【請求項１８】プログラムファイルの使用を制御する方
    法において、 表示装置を有するコンピュータに対してローダー部分と
    登録シェル部分を含むプログラムファイルを提供し、上
    記プログラムファイルは第一レベルの制御機能を有する
    エグゼクティブ制御プログラムを有しており、 情報を上記登録シェル部分に入力し、 上記使用許諾契約情報を上記登録シェルから独立登録プ
    ログラムに伝送し、上記登録プログラムは使用許諾契約
    データを第二レベルの制御機能を有するエグゼクティブ
    制御プログラムに併合して独自のオーバーレイファイル
    を発生し、 上記独自のオーバーレイファイルを上記登録プログラム
    から上記登録シェルに伝送し、上記オーバーレイファイ
    ルには上記第二レベルのエグゼクティブ制御プログラム
    が含まれており、そして 上記独自オーバーレイファイルを上記主要プログラムフ
    ァイルに導入し、上記プログラムファイルの第二レベル
    の機能の動作が上記オーバーレイファイル内の使用許諾
    契約情報が現在導入されているときだけ可能になること
    を特徴とする上記のプログラムファイル使用の制御方
    法。
  19. 【請求項１９】上記オーバーレイファイルを上記登録用
    コンピュータから上記遠隔コンピュータに伝送する以前
    に、上記使用許諾契約情報を有効化する工程を有する請
    求の範囲第18項に記載の方法。
  20. 【請求項２０】不正変更防止になっているオーバーレイ
    ファイルを作成する工程を有する請求の範囲第18項に記
    載の方法。
  21. 【請求項２１】上記不正変更防止オーバーレイファイル
    が上記不正変更防止オーバーレイファイルを暗号化キー
    で暗号化することにより作成され、巡回冗長検査値を上
    記暗号化不正変更防止オーバーレイファイル内に提供す
    るとともに解読キーを上記不正変更防止オーバーレイフ
    ァイルに提供し、上記暗号化および解読キーは上記オー
    バーレイファイルの独自の内容によって独自に決定され
    ることを特徴とする請求の範囲第20項に記載の方法。
  22. 【請求項２２】新しい巡回冗長検査値が、上記オーバー
    レイが実行のためにロードされるたびに計算されて、上
    記オーバーレイファイルと共に伝送された巡回冗長検査
    値と比較され、上記オーバーレイファイルが作成以降変
    更されているかどうかを判断することを特徴とする請求
    の範囲第21項に記載の方法。
  23. 【請求項２３】上記使用許諾契約情報と上記オーバーレ
    イファイルが、上記登録シェルと上記登録プログラムと
    の間を電子データリンクを介して伝送されることを特徴
    とした請求の範囲第18項に記載の方法。
  24. 【請求項２４】上記登録シェルプログラムが、上記独立
    登録プログラムを備えた第二のコンピュータから離れて
    いる第一のコンピュータに備えられていることを特徴と
    する請求の範囲第18項に記載の方法。
  25. 【請求項２５】上記有効化により上記使用許諾契約情報
    が正式の登録シェルを介して確保することを特徴とする
    請求の範囲第19項に記載の方法。
  26. 【請求項２６】上記使用許諾契約情報と上記オーバーレ
    イファイルが一台のコンピュータに入力され、備えられ
    ることを特徴とする請求の範囲第18項に記載の方法。
  27. 【請求項２７】制限されたあるいは制限されない期間、
    プログラムファイルをアップグレイドするシステムにお
    いて、 第一レベルの機能を有するプログラムを含むオーバーレ
    イローダー部分を含むプログラムファイルが当初備わっ
    て、上記オーバーレイローダー部分は本物のオーバーレ
    イファイルが現在導入されているときだけこのプログラ
    ムファイルを起動することができる、上記遠隔コンピュ
    ータには登録シェルプログラムが備えられ、上記登録シ
    ェルプログラムは使用者が様々な作用許諾契約情報を入
    力することを可能にするような少なくとも一台の遠隔コ
    ンピュータと、 登録プログラムと、上記使用許諾契約情報を受信し処理
    するための手段と、第二レベルの機能を有するプログラ
    ムモジュールと使用許諾契約情報の全部あるいは一部を
    含む独自のオーバーレイファイルを作成するための手段
    と、上記オーバーレイファイルを上記遠隔コンピュータ
    に伝送する手段とを備えた登録用コンピュータとを有
    し、 上記オーバーレイファイルを上記遠隔コンピュータに伝
    送することで、上記オーバーレイファイルに入っている
    使用許諾契約情報が現在備わっているときだけ、上記プ
    ログラムファイルの第二レベルの機能動作が可能なるこ
    とを特徴とする上記システム。
  28. 【請求項２８】上記遠隔コンピュータと上記登録用コン
    ピュータとの間に電子データリンクを有し、ファイル転
    送過程が上記登録用コンピュータと上記遠隔コンピュー
    タの両方に備えられていることを特徴とする請求の範囲
    第27項に記載のシステム。
  29. 【請求項２９】上記登録用コンピュータが、すべての登
    録済み使用者が含まれる中央データベースと上記使用許
    諾契約情報を有効化する手段とを備えていることを特徴
    とする請求の範囲第27項に記載のシステム。
  30. 【請求項３０】オーバーレイファイルを作成するための
    上記手段が、巡回冗長検査値が記憶されている不正変更
    防止オーバーレイファイル作成するための暗号化キーと
    解読キーとを備えており、上記解読キーは上記オーバー
    レイファイルと共に上記遠隔コンピュータに伝送され、
    上記暗号化および解読キーはファイルの内容によって独
    自に決定されることを特徴とする請求の範囲第27項に記
    載のシステム。
  31. 【請求項３１】上記遠隔コンピュータが、上記オーバー
    レイファイルを解読し、上記オーバーレイファイルが実
    行のためのロードされるたびに新しい巡回冗長検査値を
    計算し、そしてこの検査値を上記登録用コンピュータに
    より上記オーバーレイファイルと共に伝送された巡回冗
    長検査値と比較するための手段を備えていることを特徴
    とする請求の範囲第30項に記載のシステム。
