Description

【発明の詳細な説明】 ［産業上の利用分野］ 本発明は、コンピュータネットワーク環境におけるソ
フトウェアアプリケーションの不正使用を防ぐ方法に関
する。
［従来技術］ コンピュータネットワークとは、一般にリンクやケー
ブルで相互に接続された複数のマシンまたは端末をい
う。コンピュータネットワークは、アクセスに対してオ
ープンであるという特徴を有するため、ソフトウェアを
許可なく複製することが可能である。このためソフトウ
ェア開発者のライセンシング収入が減少する結果となっ
ている。従来、ライセンスによってネットワーク全体の
実施の許諾を行なう（一般にサイトライセンスと呼ばれ
る）か、もしくはソフトウェアが実行される各ノードを
ライセンスする（一般にノードライセンスと呼ばれる）
必要があった。ノードとは、コンピュータネットワーク
内の各マシン、端末もしくはシステムを指す。ライセン
スとは、ソフトウェアの開発者が顧客に対して任意のソ
フトウェアアプリケーションを特定の様態で使用するこ
とを許諾することをいう。
サイトライセンスの場合、特定の場所すなわちネット
ワーク上の全ユーザに、各々のネットワーク上の位置に
関係なくソフトウェアアプリケーションの使用を許可す
る。均一の使用料を徴収するこの方法は、使用頻度の低
いソフトウェアアプリケーションの場合には行き過ぎと
なる。ノードライセンスの場合、ソフトウェアアプリケ
ーションをネットワーク上の特定のマシンに結びつけて
しまうことになり、またソフトウェアアプリケーション
の使用頻度が低ければ採算がとれない。これらの点につ
いては米国特許4,688,169に開示されている。またライ
センスを付与されたノードで新たなユーザがソフトウェ
アアプリケーションを使用しようとする場合、こうした
ユーザはライセンスの新規購入を求められることが多
い。
サイトライセンスやノードライセンスに代わる概念と
して並行使用ライセンスがある。並行使用ライセンスで
は、任意の時点でソフトウェアアプリケーションの使用
を許可されるユーザの員数を、ネットワーク上の位置に
係わりなく限定している。ビデオ愛好者がレンタルビデ
オ店から映画のビデオを借り出すように、ネットワーク
上のユーザはソフトウェアアプリケーションを端末から
先着順に借り出す。このように、並行使用ライセンスで
は、ソフトウェアアプリケーションの実際の使用度に比
例して使用料が徴収される。
ネットワーク環境でソフトウェアアプリケーションの
並行使用を許可するというライセンシング方法は、現在
ハイランド・ソフトウェア社とアポロ・コンピュータ社
で採用されている。これに関しては、「並行アクセスラ
イセンシング（Concurrent Access Licensin）」（1988
年９月、Vol.6,No.9、ユニックス・レビュー（Unix Rev
iew）、M.オルソン、P.ルヴァイン（M.Olson and P.Lev
ine）著）で述べられている。一般に、ソフトウェアア
プリケーションのライセンスは、ライセンスサーバの制
御するデータベースに記憶されている。ライセンスサー
バとは、ライセンスを記憶しているプログラムであり、
かつライセンスを貸出す前にユーザの資格を確認するプ
ログラムである。不正使用を防ぐために並行使用をライ
センスするこれらの方法は、公共／個人キー（公開鍵／
秘密鍵）暗号化方式などによって保護された通信手段に
依存している。かかる公共／個人キー暗号化方式によれ
ば、システムの各ユーザは２個のキーを有する。そのう
ち１個のキーは通常公共のキーであり、他の１個は個人
用のキーである。個人キーを使用した個人変換は、公共
キーを使用した公共変換に関連付けられているが、個人
キーは公共キーから計算によって求めることはできな
い。これらの点については、D.デニング（D.Denning）
著「暗号化技術とデータ保護（Cryptography and Data
Security）」（1982年、アディソンーウェスリー（Addi
son-Wesley）社刊）に述べられている。暗号キーはライ
センスサーバ内に隠されていて、ライセンスのデータベ
ースの暗号化に使用される。高度な技術で設計された公
共／個人キー暗号化方式を解読することは難しい。とく
にライセンスサーバが安全な環境内にあれば、かかる方
式の解読は至難の技である。安全な環境とは、そのアク
セスが資格を有するユーザのみに限定されている環境を
いう。しかしながら、ライセンスサーバは顧客のサイ
ト、すなわち危険な環境にに設置されることが多い。し
たがって、ライセンスサーバは熟練したハッカーの解読
にさらされることになる。いったん個人キーが解読され
ると、ライセンスサーバに関するあらゆる重要な情報
（ライセンス等）が無許可のまま公開されてしまう。
したがって、本発明の目的は、並行使用ライセンシン
グの環境におけるソフトウェアの不正使用を防ぐための
より安全性な方法を提供することにある。
［発明の概要］ 本発明は、通常ライセンスサーバが行なっていた確認
機能とライセンス貸出機能とをソフトウェアアプリケー
ションに与えるものである。本発明の好ましい実施例
は、少なくとも１個のライセンスサーバと少なくとも１
個のソフトウェアアプリケーションとを実行する複数の
端末を含むコンピュータネットワークからなる。ライセ
ンスサーバは、ソフトウェアアプリケーションのライセ
ンス情報を格納している端末のデータベースを制御す
る。ライセンス情報はライセンストークンに含まれてお
り、またライセンスサーバが制御するデータベースに記
憶されている。ライセンストークンは、特定のビットパ
ターンすなわちパケットであって、アプリケーションソ
フトウェアの販売業者によって暗号化されている。ソフ
トウェアアプリケーションは、ライセンシングライブラ
リを介してライセンスサーバと通信を行なう。ライセン
シングライブラリはライブラリルーチンの集合であっ
て、ソフトウェアアプリケーションがライセンスをライ
センスサーバから要求する場合か、もしくは該ライセン
スを更新する場合にこれらのライブラリルーチンを使用
する。ライセンスアクセスモジュールは、ソフトウェア
アプリケーションとライセンシングライブラリとに接続
しているプログラムであって、ライセンストークンを販
売業者に特定のフォーマットからライセンシングライブ
ラリのフォーマットへと復号化するプログラムである。
ユーザがソフトウェアアプリケーションの実行を希望
する場合、ライセンシングライブラリは、ライセンスト
ークンをライセンスサーバから要求するための呼出しを
行なう。従来、ライセンスサーバはユーザの資格を確認
したのち該要求を許可または却下していたが、本実施例
のライセンスサーバは、当該ソフトウェアアプリケーシ
ョンの正しいライセンストークンを検出してこれをライ
センシングライブラリに伝達する。ライセンシングライ
ブラリに接続されたライセンスアクセスモジュールは該
ライセンストークンを復号化する。ソフトウェアアプリ
ケーションに結合されたライセンシングライブラリ内の
ルーチンは、ライセンスを借り出してライセンストーク
ンを更新する前に、ライセンス情報を確認する。ライセ
ンスアクセスモジュールは、更新されたライセンストー
クンを符号化したのち、該トークンをライセンスサーバ
へと返送する。
ライセンストークンの確認機能と借り出し機能とがソ
フトウェアアプリケーションによって実行されるため、
ライセンスサーバに代わってソフトウェアアプリケーシ
ョンが無許可ユーザの解読の対象となる。ライセンスア
クセスモジュールにリバースエンジニアリングをかけて
も、ライセンスサーバの解読より実りが少ない。この理
由は、ライセンスアクセスモジュールはライセンスデー
タベースのごく一部の内容を開示するに過ぎないからで
ある。大部分のハッカーがライセンスアクセスモジュー
ルを解読する頃には、ソフトウェア販売業者は当該ソフ
トウェアアプリケーションの新バージョンと、これに対
応する新たなライセンスアクセスモジュールとを発表し
ているはずである。このように、本発明は、基本的なコ
ンピュータネットワークを変更することなく、コンピュ
ータネットワーク環境におけるソフトウェアアプリケー
ションの不正使用を防ぐためのより安全な方法を提供す
る。
［表記と名称］ 以下の詳細な説明では、データビットやコンピュータ
メモリ内のデータ構造に対して行なわれる演算のアルゴ
リズムや記号表記を主として使用する。アルゴリズムに
基づくこれらの記述や表記は、データ処理分野の有能な
技能者が、各々の作業の内容を他の同業者に最も効果的
に伝達するために使用する手段である。
以下でいうアルゴリズムとは、通常定義されるよう
に、所望の結果を得るための一貫性のある一連のステッ
プをいう。これらのステップは、物理量の物理的な操作
を必要とするステップである。これらの物理量は、必ず
しも限定されないが、電気的もしくは磁気的な信号の形
態をとることが普通であり、かかる信号に対しては記
憶、転送、組合せ、比較その他の操作を行なうことがで
きる。主として慣例上の理由で、これらの信号をビット
パターン、値、、要素、記号、文字、データパッケージ
等の名称で呼ぶことが便利であることが多い。しかしな
がら、これらの用語もしくはこれに準ずる用語は、適切
な物理量に対応していなければならず、かつ該用語はこ
れらの総量に付加された便利なラベルに過ぎないことを
承知しておく必要がある。
さらに、これらの物理量に対する操作は、加算や比較
といった用語で表現され、こうした用語は人間が自分自
身で行なう演算に通常関連付けられている。しかしなが
ら、以下で説明する本発明の一部をなす演算では、人間
のかかる能力はほとんどの場合不用であり、むしろ好ま
しくない。演算はマシンが実行するからである。本発明
は、汎用ディジタルコンピュータもしくは同様の装置に
適用して効果的である。いずれの場合でも、コンピュー
タを操作する方法と、計算自体の方法とを明確に区別す
る必要がある。本発明は、電気信号もしくは他の物理的
（機械的、化学的など）信号を処理するためにコンピュ
ータを操作することによって、他の所望の物理的信号を
生成するステップの方式に関する。
また本発明は、上記の操作を実行する装置に関する。
かかる装置は、所望の目的のためのみに形成されるか、
もしくは汎用コンピュータからなり、該コンピュータ内
に記憶されたコンピュータプログラムによって選択的に
起動され、再構成される。本明細書に含まれるアルゴリ
ズムは、特定のコンピュータやその他の装置に限定され
るものではない。また各種の汎用マシンを、本明細書記
載の命令に準じて記述されたプログラムとともに使用し
てもよい。所定のステップを実行するための専用の装置
を形成することが便利である場合もある。これらの各種
マシンの所定の構造は、以下の説明から明瞭になるであ
ろう。
［発明の実施例］ 以下の説明は複数の節に分割されている。最初の節で
は、ライセンスされたソフトウェアプログラムのデータ
ベースをアクセスするための汎用ネットワーク環境を説
明する。続く節では、ソフトウェアアプリケーションの
不正使用を防ぐ方法の詳細を説明する。
I.汎用ネットワーク環境 第１図において、コンピュータネットワーク環境は、
複数のデータ処理装置10-10n（図中では10、10′、1
0n）からなる。これらのデータ処理装置には、端末、パ
ソコン、ワークステーション、ミニコン、メインフレー
ムコンピュータ、スーパーコンピュータ等が含まれる。
本明細書では、本発明のネットワークに接続されたすべ
てのデータ処理装置を「端末」と称する。これらの端末
の製造元は異なるものであって差支えない。また該端末
の使用するオペレーティングシステムは、MS-DOS,UNIX,
OS/2,MAC OS等さまざまであって差支えない。好ましい
端末の例としては、サン・マイクロシステムズ（Sun Mi
crosystems）社（在カリフォルニア州マウンテンビュー
（Mountain View））の製造するマシンがある。各端末
は、キーボード11、11′、11nまたはマウス12、12′、1
2nなどの入力装置を有する。第１図に示されるように、
端末10-10n（図中では10、10′、10n）は共通ケーブル1
3によって接続され、相互にデータの転送を行なう。共
通ケーブル13は、同軸ケーブル、光ケーブル、無線チャ
ネルその他のいかなる共有メディアでもよいことは当業
者には明白であろう。さらにケーブル13と端末10-10
n（図中では10、11′、10n）からなるネットワークは、
環状結線、星形結線、バス結線など多数の形態のうちい
ずれをもとることができ、またゲートウェイやブリッジ
で結合された複数の小形のネットワークの集合を含んで
いてもよい。
再び第１図において、14はライセンスサービスを示
す。ライセンスサービス14は、ネットワークに接続され
たすべての端末が共有する資源である。本実施例では、
ライセンスサービス14にはライセンスサーバ15-15m（図
中では15、15′、15m）とデータベース17-17m（図中で
は17、17′、17m）が含まれる。ここで、ｍはｎ以下の
値である。ライセンスサーバは、メモリ型記憶機能を有
する端末上で実行されるプログラムである。各ライセン
スサーバ15（図中では15、15′、15m）は、インタフェ
ース16（図中では16、16′、16m）を介して、端末のメ
モリに記憶されたデータベース17と通信を行なう。以下
で詳しく説明するように、データベース17は、各種のソ
フトウェアアプリケーションのライセンシング情報を記
憶している。これらのソフトウェアアプリケーション
は、購入後、コンピュータネットワーク環境で実行する
ための許可を付与される。ライセンスサーバは、特定の
端末での実行に限定されるわけではなく、いずれの端末
でも実行可能であり、ユーザがアプリケーションを使用
する端末でも実行できる。このように、ネットワークに
接続された端末であれば、ユーザがアプリケーションソ
フトウェアを実行する端末としてだけでなく、ライセン
スサーバとしても機能できる。以下で詳しく説明するよ
うに、ライセンスサーバはアプリケーションソフトウェ
アのライセンスの確認を行なわない。ライセンスサーバ
の作動形態は受動的であって、記憶機能、ロック機能、
ログ機能およびクラッシュ回復機能をアプリケーション
ソフトウェアに提供している。
第２図は、本発明に基づくネットワークライセンシン
グ方式の構造を示す。この構造には、データベース18、
データベースインタフェース19、ライセンスサーバ20、
ライセンシングライブラリ24、ライセンスアクセスモジ
ュール27、ライセンス管理ツール21、ライセンスサービ
スバインダ29、ライセンス生成ツール34が含まれる。
データベース18は、ライセンシング情報とアプリケー
ション使用データを記憶している。データベース18に
は、以下の情報を含む複数のレコードが格納されている
ことが望ましい。
データベースインタフェース19は、ライセンスサーバ
20とデータベース18との間の通信を提供する。これによ
って複数のユーザがデータベース内の同一のレコードに
同時にアクセスすることを防いでいる。かかる同時アク
セスが行なわれると、該レコード内のデータが破壊され
ることがある。このように、アプリケーションの使用時
にはロックの所有者のみがロックされたレコードからデ
ータを読み出し、書込むことができる。
ライセンスサーバ20は端末上で作動し、データベース
18と、ライセンス管理ツール21、ライセンシングライブ
ラリ24およびライセンスサービスバインダ29とのインタ
フェースをとる。ライセンスサーバ20は、インタフェー
ス23を介して、ライセンス管理ツール21、ライセンシン
グライブラリ24およびライセンスサービスバインダ29と
通信を行なう。インタフェース23は、遠隔手順呼出し機
構であることが望ましい。遠隔手順呼出し機構によれ
ば、ネットワークに接続された１個の装置または端末上
で作動するプロセスは、該ネットワークに接続された遠
隔装置または遠隔端末から資源またはサービスを要求で
きる。この点に関しては、A.ビレル、B.ネルソン（A.Bi
rrell and B.Nelson）著「遠隔手順呼出しの実施（Impl
ementing Remote Procedure Calls）」（1984年Vol.2、
No.1、エーシーエム・トランザクション・オン・コンピ
ュータ・システムズ（ACM Transaction on Computer Sy
stems）記載）に述べられている。
複数のライセンスサーバが複数の端末に常駐すること
ができる。ライセンスサーバ20は、端末のバックグラウ
ンドモードで作動することによって、該端末を使用する
ユーザからみて透過的であることが望ましい。また以下
で説明するように、ライセンスサーバ20は次のような機
能を提供する。
（１） ライセンシングライブラリからなされるライセ
ンストークンの要求を処理する機能 （２） いずれのライセンシング単位も使用できない
時、データベース18への要求で構成される待ち行列を管
理する機能 （３） データベース18への排他的アクセスのロックを
生成する機能 （４） データベース18内の情報にアクセスする機能 ライセンシングライブラリ24は、ライブラリルーチン
の集合であり、アプリケーション26はこれらのルーチン
によってライセンスサーバ26にライセンシングサービス
を要求する。ライセンスサーバ20は、ライセンシングラ
イブラリ24からサービスの要求を受信すると、データベ
ース18からライセンストークンを検索して該トークンを
ライセンシングライブラリ24へと送信する。ライセンシ
ングライブラリ24はアプリケーション26と接続してお
り、経路28を介してライセンスサーバ20と通信を行な
う。かかる通信は、遠隔手順呼出し方式で行なわれるこ
とが望ましい。ライセンシングライブラリ24における主
要なライブラリ呼出しには、アプリケーションがライセ
ンスサーバ20に対して行なうライセンスの要求が含まれ
る。その他、ライセンスの更新要求と解除要求が重要な
ライブラリ呼出しの一部である。ライセンストークンを
使用して各種のライセンシングサービスの要求を行なう
方法を以下に説明する。
ライセンスアクセスモジュール（LAM）37は、ソフト
ウェアの販売業者が用意するものであって、ライセンス
トークンの復合化を目的としている。アプリケーション
26は、復合化されると、ライセンシングライブラリ内の
ルーチンを使用してライセンストークン内のライセンシ
ング情報を確認し、ライセンスが貸出されてよいか否か
を決定する。またライセンスアクセスモジュール（LA
M）27は、アプリケーションがライセンスサーバ20を介
してライセンストークンをデータベース18に戻す前に、
該ライセンストークンを符号化している。以下ではライ
センスアクセスモジュール27をさらに詳細に説明する。
ライセンス管理ツール21は、ネットワーク管理者がソ
フトウェアアプリケーションの並行使用に関する管理機
能を遂行する場合に使用する。ライセンス管理ツール21
は、コンピュータネットワークに接続された端末であれ
ばいずれの端末でも実行可能である。ライセンス管理ツ
ール21は、ライセンストークンをライセンスサーバ20を
介してデータベース18にインストールする場合に主とし
て使用される。ライセンス管理ツール21には次の機能が
含まれる。
（１） ライセンスサーバを起動、停止する機能 （２） ライセンスサーバの制御するデータベースにア
クセスする機能 （３） ライセンスの使用に関する報告を生成し、印字
する機能 アプリケーション26はデータベース18を直接アクセス
することはできない。このアクセスを達成するために
は、アプリケーションはライセンシングライブラリ24か
ら経路28を介してライセンスサーバ20宛てにライセンス
の要求を行なう。大部分のネットワークライセンシング
方式では、ライセンシングライブラリ24とライセンスサ
ーバ20との間に機密保護された伝送路を採用している。
しかしながら本発明では、ライセンスアクセスモジュー
ル（LAM）27、ライセンスライブラリ24および複数のラ
イセンストークンを使用してコンピュータネットワーク
におけるソフトウェアアプリケーションの不正使用を防
いでいる。
再び第２図において、ライセンスサービスバインダ29
は経路30を介してライセンスサーバ20と接続されてい
る。このライセンスサービスバインダ29は、ネットワー
クサービスプログラム等の本分野の公知技術によって呼
出される。ライセンスサービスバインダ29は、ネットワ
ーク上でサーバとして指定されたすべての端末の位置を
検出し、いずれのサーバがいずれのアプリケーションの
処理を行なっているかを記録し続ける。ライセンスサー
ビスバインダ29は、自己の保有する可用サーバテーブル
を参照して各サーバと連絡をとり、サーバの処理してい
る製品のリストを各サーバに要求する。最後に、ライセ
ンスサービスバインダ29は、可用ライセンスサーバテー
ブルの内容と製品リストを、経路32を介して結合づけフ
ァイル32に書込む。第２図において、結合づけファイル
32は経路33を介してライセンシングライブラリ24に接続
されている。アプリケーション26は結合づけファイル32
に問い合せを行ない、いずれのライセンスサーバが該ア
プリケーションのライセンスの要求を処理できるかを確
認する。ライセンス生成ツール34は、ネットワーク管理
者に伝送されるライセンストークンを生成するためにソ
フトウェア販売業者が使用する。ネットワーク管理者
は、ライセンストークンを受信すると、ライセンスサー
バ20を介してライセンス管理ツール21によって該トーク
ンをデータベース18へとインストールする。
II.ライセンストークン 本発明の好ましい実施例を使用してコンピュータネッ
トワークでライセンストークンを生成する方法を第３図
を参照しながら説明する。第３図において、コンピュー
タネットワーク38は、ライセンス管理ツール39と１個の
ライセンスサーバ44とに接続されている。ライセンスサ
ーバ44はデータベース45と通信を行なう。アプリケーシ
ョン41、42、43はライセンスサーバ44からライセンシン
グサービスを要求している。顧客が任意のアプリケーシ
ョン（例：研究開発部門用のCAD/CAMプログラム）のラ
イセンスを購入すると、ソフトウェア販売業者はライセ
ンス生成ツールによってライセンストークンを生成し
て、該トークンを顧客のネットワーク管理者に渡す。ラ
イセンストークンは、ソフトウェアアプリケーションを
使用するためのライセンスを表現する特定のビットパタ
ーンすなわちパケットである。ネットワーク管理者は、
ライセンストークン46を、ライセンス管理ツール39を使
用してライセンスサーバのデータベースへとインストー
ルする。トークンリング方式で端末から端末へと転送さ
れるトークンと異なり、本実施例のライセンストークン
は、一定の時間中ライセンスサーバとライセンシングラ
イブラリとの間でのみ転送される。かかる一定期間は、
ライセンストークンがライセンスサーバから貸出される
時間の長さに相当する。現在、ライセンストークンはア
プリケーションに対して10秒以内に転送され、該トーク
ンはこれを貸出したライセンスサーバへと最短時間で返
送される。ライセンストークン46は、販売業者独自のフ
ォーマットで暗号化された情報を含んでいる。かかる情
報には、販売業者の識別記号、製品番号、バージョン番
号、ライセンストークンに対して購入されたライセンス
単位の数などが含まれる。ライセンス単位は、コンピュ
ータネットワークに接続された端末に加重されたライセ
ンスに対応している。たとえば、任意のソフトウェアア
プリケーションを使用する場合、強力なワークステーシ
ョンは平均的なパソコンより多くのライセンス単位を必
要とすることになる。
ソフトウェア販売業者は、ライセンス生成ツール40を
使用してライセンストークンを生成する。経路47は、顧
客のサイトでライセンストークン46′がどのようにライ
センス管理ツール39へと送られるかを示している。ここ
では、システム管理者はライセンストークン46′をライ
センストークン46としてライセンスサーバ44のライセン
スデータベース45へとインストールする。経路48は、ラ
イセンストークン46′がライセンストークン46としてラ
イセンス管理ツール39からライセンスサーバ44へと転送
される様子を示している。これにより、ライセンスサー
バ44においては、トークン46に該当するアプリケーショ
ンを使用するライセンスの要求や、データベース45で示
される他のアプリケーションを使用するライセンスの要
求を、アプリケーション41、42、43から受け付ける用意
が完了する。
各ネットワークは複数のライセンスサーバを保有可能
であり、また各ライセンスサーバはそのデータベース内
に複数のソフトウェアアプリケーションに対応する複数
のライセンストークンを含んでいてよいことは明らかで
ある。再び第３図において、アプリケーションA41が10
秒未満でライセンストークン46を要求してこれを借り出
すと、アプリケーションA41がライセンスをライセンス
トークン46から借り出している期間中にアプリケーショ
ンB42、C43がこれに対する要求を行なっても、ライセン
ストークン46を借り出すことが出来ない。これはデータ
ベースインタフェース19がロック機構を提供しているた
めである。このように、ネットワーク38でライセンスの
並行使用を達成するためには、ネットワーク管理者が２
個以上のライセンスサーバをインストールすることが望
ましい。ライセンスサーバのクラッシュから回復するた
めの労力を軽減するためには、システム管理者が各アプ
リケーションのライセンス単位を戦略的に配置された複
数のライセンスサーバに分散しておくことが望ましい。
たとえば、ネットワークに４個のライセンスサーバがあ
る場合、使用頻度の高いあるアプリケーションに対して
20個のライセンス単位があるとすれば、ネットワーク管
理者は４個のライセンストークンの各々に５個のライセ
ンス単位を配分することが好ましい。１個のライセンス
サーバがクラッシュした場合、もしくは該サーバのライ
センストークンが貸出されている場合、他の３個のライ
センスサーバが他のアプリケーションに対してライセン
シング処理を行なうことができる。
第4a図は、ライセンストークンを使用してライセンス
を要求する方法を示している。第4a図において、ネット
ワーク50がアプリケーション52、54、56にそれぞれ結合
されている。アプリケーション56は、ステップ59におい
てライセンスサーバ58からライセンストークンを要求
し、該要求は受け付けられる。ステップ60において、ラ
イセンストークンはアプリケーション56へと伝達され
る。続いてアプリケーション56は、ステップ61において
ライセンストークンをライセンスサーバ58に送り返す。
第4a図に示されるようなライセンストークンによるライ
センス要求機能に加えて、ライセンシング処理の他の重
要な段階でもライセンストークンが使用される。たとえ
ば、ユーザが当初割当てられた時間を超過してアプリケ
ーションを使用したい場合がある。この場合、第4b図に
示されるように、アプリケーション68は、ライセンスト
ークン72を使用してライセンスサーバ70に対してライセ
ンス更新要求を発行する。同様に、第4c図に示されるよ
うに、ユーザはアプリケーションがライセンス単位を必
要としなくなった時点でライセンス解除要求83を発行す
る。このように、ユーザはステップ85において、更新さ
れたライセンストークンをライセンスサーバ82に戻すこ
とによってライセンストークン84を更新する。
III.ライセンスアクセスモジュール 第２図において、ライセンスアクセスモジュール（LA
M）27は、アプリケーション26とライセンシングライブ
ラリ24とに結合された実行可能コードを形成する。該コ
ードは、ソフトウェア販売業者が顧客に出荷するコード
である。ライセンスアクセスモジュール27は、暗号化さ
れたライセンストークンがライセンスサーバとライセン
シングライブラリ24との間で転送される時点でその復合
化と符号化を行なう。このように、アプリケーションの
不正使用に対する機密保護のレベルは、ライセンスアク
セスモジュールの機密保護の度合いに大きく依存する。
従来のネットワークライセンシングの方法では、公共
／個人キー暗号化方式を使用して重要な情報を符号化し
ている。この方式は、ライセンスサーバが安全な環境内
にある場合には効果的である。しかしながら、顧客はラ
イセンスサーバも含めたネットワークの全端末に同じよ
うにアクセスすることができる。ユーザがライセンスサ
ーバの個人キーを解読すれば、ライセンシング方式の機
密保護は破られてしまう。無資格のユーザがサーバの個
人キーをいったん特定すれば、ライセンスサーバに関す
る他のすべての重要な情報が解読されてしまう。仮にす
べてのライセンスサーバが同一のキーを使用している
（こればしばしば行なわれている）とすれば、すべての
ライセンスサーバの扱うアプリケーションのすべての機
密保護が破られてしまう。
ライセンスアクセスモジュール27は、ライセンストー
クンを販売業者指定のフォーマットからライセンシング
ライブラリ24で使用可能なフォーマットへとまず変換す
る。ライセンスアクセスモジュールによるこの変換は２
個のモジュールによって行なわれる。第一のモジュール
は、ライセンストークンを販売業者指定のフォーマット
からライセンシングライブラリのフォーマットへと変換
すなわち復号化する。第二のモジュールは、更新された
ライセンストークンをライセンシングライブラリのフォ
ーマットから販売業者指定のフォーマットへと変換すな
わち符号化する。第二のモジュールは、ライセンシング
ライブラリがライセンストークン内の情報を更新するた
びごとに呼出される。
ライセンシングライブラリフォーマットに変換された
ライセンストークンの受信後、ライセンシングライブラ
リはライセンスの正当性を確認するためのルーチンを呼
出す。該確認はトークン内に格納された次のようなライ
センス情報を検討することによって行なわれる。
（１） フラグ （２） 保守契約の日付 （３） ホストの名称と定義域 （４） 製品名 （５） ホストの識別番号 （６） ライセンスの通し番号 （７） ライセンスの失効の日付 以上の情報がアプリケーションの保有する情報と比較
される。これらの情報が合致すれば、ライセンスの確認
が完了する。確認過程の終了後、ライセンシングライブ
ラリ内でルーチンが起動される。このルーチンは、ライ
センストークン内のライセンス単位数から貸出中のライ
センス単位の数を減算してライセンスを貸出す。
復号化ルーチンと符号化ルーチンとによって、ソフト
ウェア販売業者は、顧客のサイトに常駐するライセンス
を不正使用から守るための独自の機密保護機構を構築す
ることができる。
以下に、ライセンシングライブラリとライセンスアク
セスモジュールを使用するアプリケーションであって、
Ｃ言語で記述されたアプリケーションの例を示す。
上記のアプリケーションの例では、コードの右端に自
明の説明が付けられている。特に注目すべきコードは、
code func.encode pとcode func.decode pである。enco
de pとdecode pは、ソフトウェア販売業者の符号化ルー
チンと復号化ルーチンにそれぞれ該当するポインタであ
る。code func変数のポインタを例にとると、ライセン
シングライブラリは該ポインタを使用してライセンスア
クセスモジュール内の復号化ルーチンと符号化ルーチン
を呼出している。３個の主要なライセンシングライブラ
リルーチン、すなわちライセンス要求ルーチン（NL req
uest）、ライセンス解除ルーチン（NL release）および
ライセンス更新ルーチン（NL confirm）は、上記の復号
化ルーチンと符号化ルーチンを呼出す。ライセンスアク
セスモジュールの例については付録１を参照されたい。
ライセンスアクセスモジュールの実施において、ライ
センスサーバはライセンストークンの受け皿となるに過
ぎない。ライセンスの付与に基づくアプリケーションの
実行に先立って、アプリケーションと結合されたライセ
ンシングライブラリによってライセンストークンの確認
手順が実行される。
システムの機密保護のレベルはライセンスアクセスモ
ジュールによって決定されるため、ソフトウェア販売業
者は該モジュールを任意の難易度で生成することができ
る。とりわけ、ソフトウェア販売業者は、暗号ルーチン
の一部としていずれの暗号方式でも採用することができ
る。機密保持機構が解読された暗号が知られてしまった
場合、ソフトウェア販売業者は、新しいライセンスアク
セスモジュールを使用して製品の新しいバージョンをリ
リースするだけで状況を改善することができる。
本発明は、前述のように第１−４図と付表を参照しな
がら具体的に説明され、とりわけコンピュータネットワ
ーク環境におけるソフトウェアアプリケーションの不正
使用を防ぐ方法の実施について具体的に説明されたが、
かかる説明は例であって本発明を限定するものではな
い。また本発明による方法は、コンピュータネットワー
ク環境で実行されるいかなるアプリケーションに用いて
も効果的であることは明白である。さらに、以上の説明
から本発明の精神と範囲とにそむくことなくさまざまな
変更や修正を実行できることは当該分野の有能な技能者
によって了承されよう。

  1. 【請求項１】少なくとも１つのアプリケーション・プロ
    グラムを実行する少なくとも１つのコンピュータを含む
    コンピュータ・ネットワークにおいて、前記アプリケー
    ション・プログラムの無許可の実行に対するネットワー
    ク全範囲にわたる保護を強化した、アプリケーション・
    プログラムをライセンスするための方法であって、 前記アプリケーション・プログラムのライセンシング情
    報を含み、暗号化された書式で記憶される第１ライセン
    ス・トークンを、第１ライセンス・サーバによって第１
    データベースに記憶するステップと、 前記アプリケーション・プログラムを実行のためにライ
    センスするため、ライセンシング・ライブラリのライセ
    ンシング・ルーチンによって前記第１ラインセンス・サ
    ーバに要求されるのに応じて、第１ライセンス・サーバ
    によって前記アプリケーション・プログラム用の前記の
    記憶された第１ライセンス・トークンを検索するステッ
    プと、 検索された前記第１ライセンス・トークンが前記アプリ
    ケーション・プログラムと統合されたアプリケーション
    ・プログラム特有のライセンス・アクセス・モジュール
    によって暗号解読された後に、検索された前記第１ライ

  2. 【請求項２】前記第１ライセンス・トークンを前記アプ
    リケーション・プログラムの販売者から受け取り、前記
    第１ライセンス・トークンを前記第１データベースに記
    憶するため前記第１ライセンス・サーバに供給するステ
    ップをさらに含み、 前記第１ライセンス・トークンは、前記アプリケーショ
    ン・プログラムの配布媒体から受信され、暗号化された
    書式でライセンス管理ツールによって前記第１ライセン
    ス・サーバに供給されることを特徴とする、 請求項１に記載の方法。

    媒体からの、前記アプリケーション・プログラム特有の
    ライセンス・アクセス・モジュールと統合され、前記コ

    ン・プログラムを受信するステップをさらに含み、 前記アプリケーション・プログラム特有のライセンス・
    アクセス・モジュールが、前記アプリケーション・プロ
    グラムと統合され、前記アプリケーション・プログラム
    の販売者によって前記配布媒体に置かれていることを特
    徴とする、 請求項１に記載の方法。
  4. 【請求項４】前記アプリケーション・プログラムを実行
    のためのライセンス不許可にするため、ライセンシング
    ・ライブラリのライセンス不許可ルーチンによって前記
    第１ライセンス・サーバに要求されるのに応じて、前記
    アプリケーション・プログラム用の前記の記憶された第
    １ライセンス・トークンを前記第１ライセンス・サーバ
    によって検索するステップと、 検索された前記第１ライセンス・トークンが前記アプリ
    ケーション・プログラムと統合されたアプリケーション
    ・プログラム特有のライセンス・アクセス・モジュール
    によって暗号解読された後に、検索された前記第１ライ
    センス・トークンに記憶されている前記ライセンシング
    情報を、前記ライセンス不許可ルーチンによって、前記
    アプリケーション・プログラムの維持するライセンシン
    グ情報と突き合わせて確認するステップと、 前記ライセンス不許可ルーチンによる前記確認に応じ
    て、実行のため前記アプリケーション・プログラムをラ
    イセンス不許可にするステップと、 前記ライセンス不許可ルーチンによる前記ライセンス不
    許可に応じて、検索された前記第１ライセンス・トーク
    ンを更新するステップと、 更新済みの前記第１ライセンス・トークンが前記アプリ
    ケーション・プログラムと統合された前記アプリケーシ
    ョン・プログラム特有のライセンス・アクセス・モジュ
    ールによって再暗号化された後に、更新済みの前記第１
    ライセンス・トークンを、前記第１データベースに記憶
    するために前記ライセンス不許可ルーチンによって前記
    第１ライセンス・サーバに戻すステップと をさらに含む請求項１に記載の方法。

    センシング情報を含み、暗号化された書式で記憶される
    第２ライセンス・トークンを、第２ライセンス・サーバ
    によって第２データベースに記憶するステップと、 前記第１ライセンス・サーバおよび第２ライセンス・サ
    ーバを、第１ライセンス・サーバ識別子および第２ライ
    センス・サーバ識別子で識別するステップと、 前記第１ライセンス・サーバ識別子および第２ライセン
    ス・サーバ識別子をライセンス・サービス・バインダに
    よって前記結合づけファイルに記憶するステップと を含み、前記ライセンシング・ライブラリは前記結合づ
    けファイルにアクセスすることにより前記第１ライセン
    ス・トークンの検索のために前記第１ライセンス・サー
    バを選択できる、請求項１に記載の方法。
  6. 【請求項６】少なくとも１つのアプリケーション・プロ
    グラムを実行する少なくとも１つのコンピュータを含む
    コンピュータ・ネットワークにおいて、前記アプリケー
    ション・プログラムの無許可の実行に対するネットワー
    ク全範囲にわたる保護をさらに強化した、アプリケーシ
    ョン・プログラムをライセンスするための装置であっ
    て、 前記アプリケーション・プログラムのライセンシング情
    報を含み、暗号化された書式で記憶される第１ライセン
    ス・トークンを記憶するための第１データベースを含む
    第１データベース手段と、 前記第１ライセンス・トークンを前記第１データベース
    に記憶し、かつ記憶された前記第１ライセンス・トーク
    ンを前記第１データベースから検索するための第１ライ
    センス・サーバを含む、第１のコンピュータと前記第１
    データベース手段とに結合された第１ライセンス・サー
    バ手段と、 前記アプリケーション・プログラム用の前記第１ライセ
    ンス・トークンを検索するよう前記第１ライセンス・サ
    ーバに要求し、検索された前記第１ライセンス・トーク
    ンが前記アプリケーション・プログラムによって暗号解
    読された後に、検索された前記第１ライセンス・トーク
    ンに記憶されている前記ライセンシング情報を、前記ア
    プリケーション・プログラムの維持するライセンシング
    情報と突き合わせて確認し、前記確認に応じて前記アプ
    リケーション・プログラムを実行のためにライセンス
    し、前記ライセンシングに応じて、検索された前記第１
    ライセンス・トークンを更新し、かつ更新済みの前記第
    １ライセンス・トークンが前記アプリケーション・プロ
    グラムによって再暗号化された後に、更新済みの前記第
    １ライセンス・トークンを前記第１データベースに記憶
    するために前記第１ライセンス・サーバに戻すための、
    前記コンピュータによって実行されるライセンシング・
    ルーチンを含むライセンシング・ライブラリと、 前記アプリケーション・プログラム特有の、前記アプリ
    ケーション・プログラムと統合されているライセンス・
    アクセス・モジュールであって、検索された前記第１ラ
    イセンス・トークンを暗号解読し、かつ更新済みの前記
    第１ライセンス・トークンを再暗号化するための、コン
    ピュータによって実行されるライセンス・アクセス・モ
    ジュールと を備える装置。
  7. 【請求項７】前記アプリケーション・プログラムの配布
    媒体から前記第１ライセンス・トークンを最初に受け取
    り、前記第１ライセンス・トークンを前記第１データベ
    ースに記憶するため前記第１ライセンス・サーバに供給
    するための、前記第１ライセンス・サーバ手段に結合さ
    れたライセンス管理ツール手段を含み、前記第１ライセ
    ンス・トークンが前記ライセンス管理ツールによって受
    信され、暗号化された書式で前記第１ライセンス・サー
    バに供給されることを特徴とする、請求項６に記載の装
    置。
  8. 【請求項８】前記アプリケーション・プログラムのライ
    センシング情報を含み、暗号化された書式で記憶されて
    いる、第２ライセンス・トークンを記憶するための第２
    データベースを含む第２データベース手段と、 前記第２ライセンス・トークンを前記第２データベース
    に記憶し、かつ記憶された前記第２ライセンス・トーク
    ンを前記第２データベースから検索するための第２ライ
    センス・サーバを含む、第２のコンピュータと前記第２
    データベース手段とに結合された第２ライセンス・サー
    バ手段と、 前記の第１ライセンス・サーバおよび第２ライセンス・
    サーバを識別する第１ライセンス・サーバ識別子および
    第２ライセンス・サーバ識別子を格納する結合づけファ
    イルを有していて、前記コンピュータに結合された結合
    づけファイル手段であって、前記ライセンシング・ライ
