Description

暗号メカニズムは、一般には、公的に配信され格納され、及び最終的に許可されたユーザによって非公開で解読される文書を暗号化（又は「暗号文にする」）ために使用される。このことは、パブリック・ネットワーク上で、パブリック・ネットワークにわたって文書配給者から対象とするユーザに文書を配信する際に、さらに不安定な媒体上に文書を格納する際に、基本形式の保護を与える。
「信頼できるシステム」方式において、システム全体は、文書の未許可の使用、及び配信を防止する責任を有する。信頼できるシステムを構築することは、通常、安全なプロセッサ、安全な格納装置、及び安全な描画装置のような新しいハードウェアを導入することを必要とする。このことはまた、信頼できるシステム上で作動するすべてのソフトウェアアプリケーションが信頼されるように保証されることを必要とする。改ざん防止機能の付いた信頼できるシステムを構築することは、既存の技術に対する実質的なチャレンジである一方、現在の市場動向では、ウェブにアクセスするためにブラウザを使用するＰＣ及びワークステーションなどのオープンの信頼できないシステムが、ディジタルワークにアクセスするために使用される主要なシステムであることを示唆している。その意味では、よく知られているオペレーティング・システム（例えば、Ｗｉｎｄｏｗｓ（登録商標）、Ｌｉｎｕｘ（登録商標）、及びＵＮＩＸ（登録商標））及びブラウザなどの描画アプリケーションを備えたＰＣ及びワークスステーションのような既存するコンピュータ環境は、信頼できるシステムではなく、それらのアーキテクチャを大幅に変更しなければ信頼されるものにはならない。当然ながら、アーキテクチャの変更は、ウェブの主要な目的、即ち、適応性及び互換性を無効にする。

従来のＤＲＭ技術において、コンテンツの所有者又は他の許可された関係者は、コンテンツが作成された後で権利を指定し、同時にコンテンツを保護、即ち、暗号化する。私有鍵はコンテンツを暗号化するために使用され、その使用権を特定するラベルが生成される。権利ラベル及び保護されたコンテンツは対応付けられ、格納される。コンテンツに対するライセンスはその後、ユーザがコンテンツを使用又はアクセスすることを可能にするためにユーザに対して生成されることもできる。このライセンスは、公開鍵を周知の方法で使用して暗号化されている私有鍵を含む。
コンテンツにアクセスするために、暗号化された公開鍵を解読するために私有鍵を使用することができ、ユーザがコンテンツを解読することを可能にする。コンテンツが権利の指定時に利用できる場合、この技術は功を奏する。しかしながら、この技術は、コンテンツに対する権利を指定し、コンテンツが利用可能となる前にコンテンツに対するライセンスを発行しようとする場合、失敗する。たとえば、将来のライブ・イベントに対するストリーミング・ビデオ、又は、将来のイベントに対する写真の配給者が、イベントの前にコンテンツに対するライセンスの売却を開始しようとすることがある。従来のＤＲＭシステムは、特にまだ存在していないそのようなワークに対して、ＤＲＭシステムの安全性、ユーザ・インタフェース、組織、構造、及び正確さを改良するためのプロセスを付与するには達していない。

本発明の第１の態様は、コンテンツ及び該コンテンツに関する使用権を作成するための方法である。この方法は、コンテンツが作成される前にディジタルワークのコンテンツと関連付けられるラベルを生成し、このラベルとコンテンツを関連付け、さらに、このコンテンツとラベルを保護することを有する。

図１は、コンテンツが作成される前にディジタルワークのコンテンツに対する使用権を付与するための方法の一実施の形態を示す。この図において各ステップに対し、コンテンツ、ライセンス、ラベル、鍵、又は他の使用されるデータが更なる安全性のために暗号化されることが可能である。ステップ１００において、まだ作成されていないディジタル・コンテンツと関連付けられる、使用権を特定するラベルが生成される。使用権ラベルは、ディジタルワークを印刷し、コピーし、変更し、編集し、若しくは表示するための権利などの使用権やその他の権利、承認、又は制約、例えばＸｒＭＬ（登録商標）言語に含まれるものや他の使用権グラマーなどを含むことができる。あるいはまた、使用権ラベルは単にワーク及びその他の記述データを含み得るだけであり、特定の付与された使用権は、後述されるライセンスに含まれることができる。ＸｒＭＬ(登録商標)言語を使用する場合、ラベルは、使用権を特定する拡張可能マークアップ言語（ＸＭＬ）文書である可能性がある。さらに、将来のコンテンツは使用権の多くの異なるバージョンを有することもあり、このように、ラベルは各バージョンに対して生成されることができる。ステップ１１０において、鍵（例えば従来の公開鍵）は、周知の方法で生成され、ラベルと関連付けられる。

ステップ１６０において、プロセスは、保護されたディジタル・コンテンツへのアクセスの要求があるか否かを判断する。要求がない場合、プロセスは要求を待つ。しかしながら、アクセスへの要求がある場合、プロセスはステップ１７０に進み、ディジタル・コンテンツに関連付けられる使用権及び／又はライセンスが検査され、使用権に関連付けられるすべての条件、例えば支払いなどが満たされているか否かを判断する。すべての条件が満たされた場合、プロセスはステップ１８０に進み、コンテンツへのアクセスが付与される。即ち、コンテンツがダウンロードされストリーミングされ、あるいはまた、ユーザに転送される。ステップ１９０において、ユーザの私有鍵は、周知の方法でコンテンツを暗号解読するために使用される。
使用権のコンテンツとの関連付けは、種々の方法が存在する。たとえば、使用権がディジタルワークのコンテンツ全体に対して同一である場合、ディジタルワークが他の装置の配給サーバに預けられて処理されるときに使用権を添付することができる。しかしながら、ディジタルワークのコンテンツが種々の構成要素に対して種々の異なる使用権を有する場合、ワークの作成中に使用権を添付することができる。種々のオーサリング・ツール及び／又はディジタルワーク組立てツールは、使用権を添付する自動プロセスを行なうために利用されることがある。ディジタルワークの各部分自体が使用権を有することができるので、ディジタルワークの１つの「部分」の使用権がその元のディジタルワークの使用権と異なっている、というインスタンスもいくつかあり得る。したがって、コンフリクト・ルールが、いつどのように権利が行使され得るかを指示するために確立されることができる。
図２は、本発明の好ましい一実施の形態による、コンテンツ作成装置、ビデオレコーダを示す。コンテンツ作成装置３００は、コントローラ３０２、液晶ディスプレイ３０４、スマートカード・リーダ３０６、メモリ３０７、キーパッド３０８、権利割り当てエンジン３１０、眼球／虹彩認識センサ３１２、ケーブル接続３１３、ハンドル３１４、及び対称性指紋認識センサ３１６，３１８を有する。さらに、レンズシステム３２０は、ビデオ画像の記録を可能にする。好ましい実施の形態のコントローラ３０２及び権利割り当てエンジン３１０は、所望の方法でプログラム化されたマイクロプロセッサベースの装置によって実現される。
図２がコントローラ３０２及び権利割り当てエンジン３１０を別個の装置として示す一方、これらのユニットによって実行される機能は、１つのプロセッサに結合されることもあり、又は、さらにディジタル信号プロセッサなどの複数のプロセッサ間で分割され、さらに／あるいは特定用途向け集積回路（ＡＳＩＣ）、例えば、配線接続された電子回路や論理回路、プログラマブル論理装置などの専用ハードウェア、若しくはその他のハードウェアやソフトウェアのインプリメンテーションによって実行することもできる。
スマートカード・リーダ３０６は、そこに挿入されるカードを読み取るために使用することができる。たとえば、ライセンス、使用権、又は識別は、カードに埋め込まれ、コントローラ３０２及び／若しくは権利割り当てエンジン３１０に伝達されることができる。ＬＣＤディスプレイ３０４、スマートカード・リーダ３０６、キーパッド３０８、及びソフトウェアインタフェースは、作成サーバ３００のユーザ・インタフェースを構成する。このユーザ・インタフェースは、ユーザに識別データなどの情報を入力させ、アクセス要求を許可し、作成装置の３００の動作に関するフィードバックを提供することができる。好ましい実施の形態のコンテンツ作成装置３００は、ビデオレコーダであるが、これは、任意のタイプの記録装置、例えば、静止画像カメラ、動画ジェネレータ、又は録音機であってもよい。
権利割り当てエンジン３１０は、ケーブル接続３１３を介してアクセスされることができる。例えば、権利割り当てコンピュータ（図示せず）、例えばＸｒＭＬを実行する任意のコンピュータ及び関連ツールは、ケーブル接続３１３を介して権利割り当てエンジン３１０に結合され、上記のラベルと同様の使用権ラベル若しくはテンプレートをダウンロードすることができる。使用権ラベル若しくはテンプレートは、将来コンテンツ作成装置３００によって作成すべきコンテンツに対する使用権を示している。コンテンツ作成装置３００によって作成される任意のコンテンツは、権利割り当てエンジン３１０に格納される使用権ラベル又は複数のラベルと自動的に関連付けられることになる。あるいはまた、使用権ラベルは、作成装置３００のユーザ・インタフェースを使用することによって構成され得る。いずれにしても、１つ以上のラベルは、作成装置３００によって記録されたコンテンツにラベルがどのようにして割り当てられることになるかを指示する命令とともに、権利割り当てエンジン３１０で生成され格納される対応する鍵である。
上記命令により、使用権ラベルは任意の方法で割り当てられることができ、任意の承認及び／又は制約を含むことができる。たとえば、ビデオレコーダの場合、ビデオ・シーケンス又はフレームの各パートには、異なる権利が選択的に割り当てられることができる。これにより、権利割り当てプロセスを極めてフレキシブル且つ動的にするとともに、コンテンツが作成されるとき、若しくは作成前にリアルタイムで権利の割り当てを行なうことを可能にする。
コンテンツ作成装置３００は、ユーザのＩＤ、記録装置そのもの、スマートカードに関するデータなどに基づいて権利を割り当てするために、固有のデバイスＩＤ、ユーザのスマートカード、暗号化（例えば、ＰＫＩ）技術、ＰＩＮ、又は任意のバイオメトリクス・システムを利用することができる。たとえば、指紋認識センサ３１６、３１８、又は、虹彩認識センサ３１２が、ユーザの認識、又は、ユーザのＩＤの認証に使用でき、権利割り当てエンジン３１０がユーザに関連付けられる権利の対応するセットを使用することを可能にする。たとえば、人Ａによって記録されるすべてのコンテンツは一組の権利を有し、人Ｂによって記録されるすべてのコンテンツは異なる組の権利を有することになる。
コンテンツ作成装置３００は、従来の方法でコンテンツを記録する。しかしながら、上述のステップ１００及び１１０において生成されるラベル及び鍵は、格納され、記録中に若しくは記録直後にコンテンツ・レコーダ３００によって記録されるコンテンツと関連付けられる。したがって、上述のステップ１４０及び１５０はまた、コンテンツ作成装置３００によって実行される。安全性のために、商品券やプリペイド・カード（又は、磁気カード及びスマートカード、あるいはそれらのバリエーション、例えばメモリータイプ・カードや同期通信カード、ＩＳＯ７８１６対応カード、ＥＭＶ型カード）が、料金の保管及びマイクロペイメント、あるいは関連付けられた権利を伴なう料金の記録を取るために使用されることができる。このようなカードは、スマートカード・リーダ３０６を使用して読み取られることができる。
本発明により、ワークに対する使用権が作成され、コンテンツの作成前にコンテンツと関連付けられることを可能にすることが理解できる。この使用権は、将来のディジタルワークがどのように使用され配給されるかを定義する。こうした事前に設定された使用権は、将来のディジタルワークの一部になり、このようなワークのコンテンツの使用法及び配給を制御する。
好ましい実施の形態において、権利が将来のコンテンツに対して設定された後で、将来のコンテンツと関連付けられる私有鍵が割り当てられ、権利ラベルが生成される。この私有鍵は、権利ラベルととともに格納される。ラベルがメインサーバ又は他の装置に挿入された後で、ユーザはコンテンツ（現在又は将来の）を購入することができる。コンテンツが購入された後で、コンテンツ・オーナーは私有鍵によって暗号化される公開鍵を含む暗号化についてのライセンスを得ることができる。あるいはまた、単一の対称鍵を使用することもできる。
図１のステップ１００で述べられたラベルは、別のワークへの参照としての働きをすることがある。この場合のラベルは、将来のコンテンツへの代替物としての働きをする。ラベルは、空ファイルであってもよく、又は、後で将来のディジタル・コンテンツと関連付けるために使用され得るコンピュータ解釈可能なデータ若しくは人間に解釈可能なデータを含んでいることもある。ラベルが作成されるとき、該ラベルは使用権情報を含むこともあるが、含まなくてもよい。使用権情報は後で供給することができる。図１のステップ１３０で述べられたように、使用権が生成されるときは、使用権によって参照されるコンテンツがラベルであることもあり、実際のディジタル・コンテンツである必要はない。このラベルは、次に、ユーザがアクセスを要求しているのはどのディジタル・コンテンツであるかを判断するために参照されることもある。ラベルを実際のコンテンツと関連付ける手段は、人間に解釈可能なテキスト、数値基準、ポインタ、ＨＴＭＬ及びＸＭＬなどのマークアップ言語、プログラマブル・スクリプト、偶数ＳＱＬ照会を含む種々の方法で実行してもよい。
図３は、この実施の形態を示す。図３において、使用権を含むライセンス２２０はユーザに対し発行される。ライセンスのためのディジタル・コンテンツ２６０がまだ存在していないので、ラベル２４０は将来のコンテンツへの代替物の働きをするように作成される。ラベルは、将来作成されるディジタル・コンテンツとの関係を含むか、又は意味することになる。この関係は後でディジタル・コンテンツと関連付けられることができる製品ＩＤ若しくは他の参照を使用するラベルの指名などが示されることもあり、又は、将来のコンテンツ、若しくは実際のディジタル・コンテンツを導き出すために後で使用できるコンテンツを含む人間に解釈可能なテキストなどの実際の基準であってもよい。ライセンスと結びつけられたラベルは、該ラベルに関連付けられる実際のディジタル・コンテンツを決定するために、適切な方法で使用される。権利及び使用権において特定される任意の条件は、実際のコンテンツを表すラベルではなく、そのコンテンツに適用される。上記で論じられたステップが、図に示される順序で必ずしも実行される必要はない。たとえば、ラベルは、ライセンスの前後及びコンテンツの前後に作成することができる。
将来のディジタル・コンテンツと関連付けられる使用権は、ライセンス、ラベル、又はコンテンツそのものの内部に特定されてもよい。これらの使用権は、それらの格納場所、及び保管のために使用される方法に関係なく、ラベルによって指示されたディジタル・コンテンツに適用する。
図５は、ユーザが要求するときに動的に作成されるディジタルワークのコンテンツのための使用権を付与するための方法の実施の形態を示す。図５に示されるステップは、図に示される順序で必ずしも実行される必要はない。たとえば、ラベルは、ライセンスの前後及びコンテンツの前後に作成されることができる。ステップ５００において、まだ作成されてないディジタル・コンテンツを表すラベルが生成される。ラベルは、使用権、例えば、ディジタルワークを印刷し、コピーし、変更し、編集し、又は見る権利やその他の権利、承認、条件や制約、例えば、ＩＳＯ ＭＰＥＧ ＲＥＬ、ＸｒＭＬ、ＯＤＲＬ、Ｏｐｅｎ Ｍｏｂｉｌｅ Ａｌｌｉａｎｃｅ ＲＥＬ、若しくは他の任意の使用権グラマーを含むことができる。あるいはまた、使用権ラベルはワーク及びその他の記述データを単に含むこともあり、特定の許可された使用権は後述されるライセンスに含まれることができる。たとえば、ＩＳＯ ＭＰＥＧ ＲＥＬを使用する場合、ラベルは、使用権を特定する拡張可能なマークアップ言語(ＸＭＬ)文書であってもよい。さらに、将来のコンテンツは使用権の多くの異なるバージョンを有することができ、このように、ラベルはバージョンごとに生成されることができる。ステップ５１０において、ラベルは、周知の暗号化技術を用いて保護されることもある。
ステップ５２０において、コンテンツの配給者、又は別の許可された関係者は、ユーザに対しライセンスを利用可能にする。ライセンスは、ステップ１１０において生成される公開鍵に対応するような私有鍵を使用して保護されることができ、使用権又はその他の記述データを含むこともできる。さらにまた、コンテンツそのものがまだ存在している必要がないことを留意されたい。したがって、たとえば、配給者は、イベントの発生前にイベントを見るためのライセンスを提供することができる。
ステップ５３０において、ユーザは、作成されるコンテンツに対するライセンスを得る（即ち、コンテンツを使用に対する権利を受ける）。ユーザは、ライセンスを要求したり、又は、要求せずにライセンスを受け取ることもある。コンテンツそのものがまだ存在している必要がないことを留意されたい。たとえば、コンテンツは、将来発生するスポーツ大会の録画又はストリームでもよい。
ステップ５４０では、コンテンツが作成される。当然ながら、このステップは、別の関係者によって実現することができる。しかしながら、コンテンツは作成され、重要なポイントは、権利が割り当てられた後で、コンテンツが何らかの形で存在するということである。この実施の形態において、コンテンツは、ステップ５３０において以前に実行されたコンテンツの要求に応答して作成される。コンテンツが作成された後で、ラベルはステップ５５０においてコンテンツと関連付けられる。ラベルは、コンテンツでカプセル化され又はコンテンツに添付されることもでき、それによって、ディジタルワークのコピーもまたラベルを装着することになる。あるいはまた、ラベルは、コンテンツから離れて格納されることができるが、フラグや呼び出しなどによって関連付けられることもある。したがって、本明細書中で使用される用語「関連付けられた」は、コンテンツとラベルとの対応を作成することに広く言及するので、ラベルはコンテンツを表すために適用されることになる。いったん使用権ラベルがコンテンツと関連付けられると、コンテンツは、ステップ５１０において生成される鍵を使用して保護されたり、又は保護されなかったりすることがある。ディジタル・コンテンツは、暗号化の任意の形式、又は他の周知技術によって保護されることができる。たとえば、電子メール暗号／認証アプリケーション(ＰＧＰ)暗号化手段が使用できる。
ステップ５６０において、ディジタルワーク及び／又はライセンスと関連付けられる使用権は、ディジタルワークの使用が使用権によって許可されるか否か、及び使用に対する条件があるか否か、使用権に関連付けられる支払いなどの条件のすべてが満たされているか否かを判断するために検査される。ユーザによって試みられる使用が許可され、もしあれば、条件のすべてが満たされている場合、プロセスはステップ５７０へ進み、コンテンツへのアクセスが許可される（例えば、コンテンツがダウンロードされ、ストリーミングされ、あるいはユーザへ転送され、又は、ユーザがコンテンツを描画し、そうでなければ、許可された方法でコンテンツを使用することが許可される）。ステップ５８０において、コンテンツが暗号化されると、ユーザの私有鍵は周知の方法でコンテンツを解読するために使用される。
本発明は、コンテンツの将来の発行が公開されなかった予約購読モデル（例えば、雑誌や市場報告のため）において使用されることができるが、こうした発行に対する権利は既に割り当てられ格納されている。適当な将来の時点で、権利は、対応するコンテンツに関連付けられる。たとえば、実際のイベントの前にウェブサイト上の将来のイベントのコンテンツを販売することによって、ウェブサイトのトラフィックは大幅に軽減され、より長い時間をかけて配給され、サーバ及びウェブサイトへの要件をより簡単に満たし、操作する費用を低減する。しかしながら、権利やチケット、即ち、ライセンスを販売するウェブサイトがその後にコンテンツを付与するウェブサイトと異なる可能性があることに留意されたい。
本発明は、さらに、定期刊行物の複数の発行を識別するような適応性のある予約購読モデルで使用されることもある。この場合、ラベルは、離れたライセンスで特定されるコンテンツに対する使用権を備えた「ニューズウィーク・オンラインの第３４版から第５６版」などの可読テキストを含むことがある。この場合においてラベルは、単一のラベルを有する複数のディジタルワークを表すこともできる。
本発明は、サービスの領域についても使用可能である。一部のサービスは命令を受け、そして戻り値としてコンテンツを生成する。たとえば、ユーザは、それらのオペレーティングシステム、プラットホーム、又は環境に関する一部の情報を含むサービスに要求を送信することもできる。サービスは、この情報を利用して、コンテンツの複数の例からユーザに適切なコンテンツを生成し、若しくは選択し、コンテンツと、ユーザにこのコンテンツを利用させ得ることになる使用権の両方を戻すこともできる。言い換えれば、サービスは、ユーザのＩＤ選択やコンピュータシステムなどのユーザ・サービス４００受信者環境にカスタマイズされる保護されたディジタル・コンテンツを生成することもできる。
図４はこの実施の形態を示す。クライアント要求４０２は、クライアント環境に関する情報とともに、一組の使用権から構成される。要求又は使用権は、サービス内に存在するラベルにバインドされる。サービスが要求を受信するとき、指示されたラベルを参照し、例えばウィンドウズ（登録商標）（Ｗｉｎｄｏｗｓ（登録商標））コンテンツ４０６又はリナックス（登録商標）（Ｌｉｎｕｘ（登録商標））コンテンツ４０７などのどのコンテンツがユーザに最適であるかを判断するためにクライアント環境情報と結合される。上述の実施の形態のように、使用権及びラベルは、ディジタル・コンテンツが存在する前に作成された。簡単に表現すると、この実施の形態は保護されたディジタル・コンテンツの事前販売及びライセンス許可を可能にする。
本発明は、さらに、ディジタル・コンテンツが何らかの方法で調整され制限される限定配給を管理するのに役立つように使用されることもある。特定の配給者が販売することができるコピーの数を制限しようとするコンテンツ・クリエイターを想像されたい。このようなビジネス・モデルは、クリエイターが配給者に供与するディジタル・コンテンツの各コピー上に固有の識別子を設置することによって作成される可能性がある。この識別子は、固有の連続番号、又は、単に日時スタンプでもよい。配給者には、彼らが毎月販売することが許可されているディジタル・コンテンツの個々のコピー数のみが付与される。取引先を締め出すのではなく、その数だけ配給してしまえば、配給者は、翌月に受信するコンテンツを表すためにラベルを使用することを選択することができる。これにより、カスタマーにより良く奉仕し、コンテンツの配給を持続させ、同時に毎月限られた量を配給するだけによりコンテンツ・クリエイターの要望を引き受けることを可能にする。
さらに、本発明は、新聞の編集者が、例えば、何らかの方法で（例えば、変更、編集、許可されていない要員、あるいは隠して単独で別の新聞組織に売ること）漏洩されている画像について心配することなくコンテンツを記録するためにカメラ班に送信することを可能にする。実際に、カメラ班は、コンテンツが記録された途端に、コンテンツにおけるどのような権利も有する可能性はない。
あるいはまた、編集者は、例えば、最初の１０個の画像が新聞（ワーク関連の）に帰属し、次の５個の画像がカメラマン（個人的使用）に帰属することになるようにして権利を設定することができる。この例は、当事者（この例ではカメラマンと編集者）間で取り決められる適応性、安全性、信頼性、確実性、及び多数の関係を示している。
すべての将来のコンテンツには、コンテンツが存在する前にコンテンツＩＤが割り当てられることもできる。コンテンツＩＤ情報及び暗号化のためのライセンスを考えると、コンテンツは、ライセンスを購入したユーザによって使用されるように利用可能な方法で、作成後に暗号化することができる。コンテンツＩＤ情報及び暗号化のためのライセンスが利用可能でない場合、コンテンツへのアクセスは拒絶されるであろう。
さらに、所定の対称鍵は、コンテンツの作成に先立って生成されることができ、権利ラベルと共に格納されることができる。その後、同じ鍵が、いったんコンテンツが作成されるとコンテンツを暗号化するために使用できる。しかしながら、上述したように、ユーザごとに、異なる鍵を受け取ることができる。別の代替方法において、ユーザには許可トークンが付与されることがあり、そのユーザは、後でライセンスと交換することができる。
コントローラ３０２は、安全性パラメータ及び権利管理ステップを処理することができる。紛失カードの確認、紛失カード・レポート、カード使用レポート、安全性警告レポート、及び追跡レポートは、例えば、無効にされた権利のためのレポート、拒絶された権利、回復した権利、使用パターン、及びマイクロペイメントなどの権利管理レポートと関連付けられ、又は結合されることができる。
好ましい実施の形態において、ラベルは代替物である。ラベルは、特定のコンテンツ又は使用権を有する必要はない。ラベルは、使用権及びコンテンツの両方の代替物でもよい。あるいはまた、これら２つのうちの一方のみでもよい。たとえば、ラベルは、３つの事柄、即ち、コンテンツ、使用権、関連手段に対するポインタ（又は空データ部分）を備えたファイルである可能性がある。関連手段は、最初に供給されることができる。その他の２つの情報の要素は、続いていかなる順序で供給することができる。従来、コンテンツは最初に作成され、次に、権利がそのコンテンツに関連付けられる。本発明では、コンテンツの権利への関連付けは、コンテンツがさらに作成される前に作成されることができる。
本発明は、種々のコンピュータ・ハードウェア・プラットホーム上で使用できるポータブル・ソースコードを付与するオブジェクト若しくはオブジェクト対象のソフトウェア環境を使用するソフトウェアにおいて容易に実施されることもできる。たとえば、ソフトウェアは、ＪＡＶＡ（登録商標）で記述され、ＪＡＶＡ（登録商標）仮想マシンで動作することができる。あるいはまた、開示された動作は、標準の論理回路又はＶＬＳＩデザインを使用するハードウェアにおいて、部分的又は完全に実施されることもできる。ハードウェアは、汎用コンピュータ、専用コンピュータ、又はその他の装置の任意のタイプを含むことができる。
配給、課金処理、及び配給者及び情報センタのその他の機能は、いかなる装置のいかなる関係者によっても実現されることができる。たとえば、コンテンツは、コードのエントリ又はスマートカードのリーダへの挿入に応答してｅブック・リーダ若しくはＰＤＡ上に描画され、ディジタルワーク又は精算データが特定のソースに戻されたときに課金処理が実現できる。本明細書中に開示されるタスクの分割は一例にすぎない。使用権及び課金処理データは、ディジタルワークに封入され、又は個別に格納されることができる。レンダリング、暗号解読、あるいはコンテンツの許可若しくは使用制限はいかなる装置にも格納され、又はディジタルワークでカプセル化されることができる。いかなる配給割付けも本発明で使用することができ、このような割付けは、所望の情報を転送するのに必要であるようにどんな方法でも互いに伝達しあうパソコン、サーバ、ＰＤＡなどの装置の組み合わせのすべてを含むことができる。
本発明は、上述した実施の形態と関連して記載されている。しかしながら、多数の代替例、変形例及び変更は、添付された請求の範囲及び正当な均等物によって記載された本発明の範囲から逸脱することなく本発明の実施の形態に対して実行され得ることを認識されたい。

  1. コンテンツと使用権とを有し、コンテンツに対する使用法を特定したディジタルワークであって、使用権を行使するためのリポジトリのシステム内で使用されるように適合されることで、コンテンツが使用権によって特定される使用法に従ってのみ使用可能であるディジタルワークを作成するための方法であって、
    コンテンツが作成される前にディジタルワークのコンテンツを表すラベルを生成し、
    コンテンツが作成される前にラベルに関連付けられた使用権を生成し、
    コンテンツがラベルと関連付けられる使用権によって特定される使用法にしたがってのみ使用できることを指示するためにコンテンツ及びラベルを関連付ける、
    ディジタルワーク作成方法。

  17. コンテンツと使用権とを有し、コンテンツに対する使用法を特定したディジタルワークであって、使用権を行使するためのリポジトリのシステム内で使用されるように適合されることで、コンテンツが使用権によって特定される使用法に従ってのみ使用可能であるディジタルワークを作成するための装置であって、
    コンテンツが作成される前にディジタルワークのコンテンツを表すラベルを生成するための手段と、
    コンテンツが作成される前にラベルと関連付けられる使用権を生成するための手段と、
    コンテンツがラベルと関連付けられる使用権によって特定される使用法にしたがってのみ使用できることを指示するためにコンテンツ及びラベルを関連付ける手段と、
    を含む、ディジタルワーク作成装置。
  18. 前記生成ステップの後でコンテンツを作成するための手段をさらに含む、請求項１７に記載の装置。
  19. コンテンツ及びラベルを暗号化して格納するための手段をさらに含む、請求項１８に記載の装置。
  20. 使用権に従ってコンテンツへのアクセスを許可するように設定されたリポジトリをさらに含む、請求項１８に記載の装置。
  21. 前記関連付けるための手段が、ラベルにコンテンツ・インジケータを生成するための手段を含む、請求項１７に記載の装置。
  22. 前記コンテンツ・インジケータがコンテンツに対するポインタである、請求項２１に記載の装置。
  23. 前記使用権を生成するための手段が、ラベルによって示されるコンテンツを変更、編集、コピー、印刷、さらに表示の少なくとも１つを実行するためのユーザの権利を特定する使用権を生成するための手段を含む、請求項１７に記載の装置。
  24. 前記作成するための手段が、使用権を生成するための補助手段によって前記使用権が生成された後で、書き込み、聞き取り、図式、音声、画像、及びビデオベースの少なくとも１つのエレメントをコンテンツとして作成するための手段を含む、請求項１８に記載の装置。
  25. コンテンツ及びラベルを保護するための手段をさらに含む、請求項１８に記載の装置。
