Abstract

An adjustment structure for footwear includes an upper part, a lower part and an adjustment device. The upper part and the lower part are rotatably connected to each other and the adjustment device is connected between the upper and lower part to regulate the desired angular distance between the upper and lower parts. The necessary space for the structure can be adjusted for the display of the footwear.

Statement motivated according to articles 29.6 and 29.7 of the Regulations for the execution of Law 11/1986, of March 20, on Patents on novelty and inventive activity; quotes and explanations in support of this statement The present invention relates to an adjustable support structure for footwear with an upper part rotatably connected with a lower part. Document D01 is considered the closest in the state of the art to the object of the invention claimed in claims 1, 2, 5 and 6 (references and comments in brackets correspond to this document). Thus, with respect to the features described in claim 1, document D01 discloses a structure for footwear comprising an upper part having a first surface (21) and a first rotating part (22), extending a stop plate (23) from the first surface, the first rotating part having a hole (221) defined therethrough, and a lower part having a second surface (11) and a second rotating part (12), the second rotating part having a projection (121) which is rotatably coupled to the opening of the first rotating part. With respect to the features described in claim 2, document D01 discloses that an adjustment device (13) is connected between the top and bottom. Therefore, the invention defined in claims 1 and 2 do not differ from the known technique described in document D01 in any essential way. Therefore, the invention according to these claims is not considered to be new or imply inventive activity and does not meet the criteria set forth in articles 6.1 and 8.1 of Law 11/86 of March 20 of Patents. Claim 5 describes that the features previously disclosed in claim 1, has multiple holes around the hole defined in the first rotating part, and multiple bushings located around the projection of the second rotating part. This second embodiment is considered a mere obvious particular execution for a person skilled in the art. Claim 6 discloses that an adjustment device is connected between the upper and lower part of the structure described in claim 5, which is found in document D01. Therefore the invention defined in claims 5 and 6 do not differ from the known technique described in document D01 in any essential way. Therefore, the invention according to these claims is not considered to imply inventive activity and does not meet the criteria set forth in article 8.1 of Law 11/86 of March 20 of Patents. Claim 3 describes that the structure adjustment device includes an adjustment bar. Document D03 describes an adjustment bar (6). This feature provides the same advantages as the present application. The person skilled in the art could therefore consider as a normal design option to include this characteristic in that described in document D01 to solve the problem, so that the object of claim 3 does not imply inventive activity and does not meet the criteria established in article 8.1 of Law 11/86 of March 20 on Patents. With respect to the features described in claim 4, document D03 discloses that the upper part (1) includes on one side thereof a bolt (5), and that the lower part (2) has a pivot (8) on one side thereof, connected to an opening of the adjustment bar (6). The claimed invention differs from the cited document in that the upper part has a cavity where the bolt is housed and that the lower part has a pin with an opening where the pivot of the adjustment bar is housed. These differences with respect to document D01 are mere constructive options and are not considered to have inventive activity, since in addition, in both cases, they provide the same advantages. The same argument made for claims 3 and 4 is made for claims 7 and 8. Therefore, it is considered that one skilled in the art would attempt to combine the main parts of document D01 with document D03 to obtain the characteristics of claims 3, 4, 7 and 8 and have a reasonable expectation of success. Therefore, the invention according to these claims is not considered to imply inventive activity and does not meet the criteria set forth in article 8.1 of Law 11/86 of March 20 of Patents. With respect to the features described in claim 9, document D02 discloses an object support structure comprising an upper part (10) having a first surface (see figures) and a first rotating part (31), extending a stop plate (11) from the first surface, the first rotating part having a hole (see figures) defined therethrough, and a lower part (20) having a second surface and a second rotating part (32), the second rotating part presenting a hole (see figures) presenting threads (322) on the inner periphery thereof. It also has a cover that has a tubular part (33) with a duct (333) defined through it and some projections (332) formed on the outer periphery of the tubular part, and another outer cover (34) that has with a grooved part and whose tubular part is coupled to the inner lid and where a spring (35) is coupled between both parts. The difference we find with respect to the application document is that in document D02 both covers interact with the rotating part of the plates through threads, with the assembly of the covers and the rotating parts exerting the adjustment to achieve the desired position. This difference is not considered to imply inventive activity since the solution proposed by document D02 is the same as that of the request, the adjustment is made by pushing the lid (33) to rotate the top cover to the desired position, and said cover is released to adjust the relative positions of the upper and lower part.  WRITTEN OPINION Claim 10 describes that an adjustment device is connected between the top and bottom of the structure of claim 9, said adjustment device is disclosed in the summary of document D02. Similarly, the features described in claims 14, 15 and 16, disclose some of the possible embodiments of the invention that include constructive details that constitute an obvious design alternative as disclosed in document D02; A person skilled in the art could therefore consider it as a slight constructive variant of claim 9, being considered within the scope of the usual practice followed by it, especially since the advantages achieved are readily anticipated. Therefore, the invention defined in claims 9, 10, 14, 15 and 16 do not differ from the known technique described in document D02 in any essential way. Therefore, the invention according to these claims is not considered to imply inventive activity and does not meet the criteria set forth in article 8.1 of Law 11/86 of March 20 of Patents. Claims No. 11 and No. 17 describe that the structure adjustment device includes an adjustment bar. Document D03 describes an adjustment bar (6). In addition, claims 12, 13 and 18 disclose the same adjustment device as disclosed in claim 4 and therefore the same argument used above is used: These features provide the same advantages as the present application. The person skilled in the art could therefore consider as a normal design option to include these characteristics disclosed in document D03 in those described in document D02 to solve the problem raised, so that the object of claims 11 to No. 13 and No. 17 to No. 18 does not imply inventive activity and does not meet the criteria established in Article 8.1 of Law 11/86 of March 20, Patent
