2. Statement motivated according to articles 29.6 and 29.7 of the Regulations for the execution of Law 11/1986, of March 20, on Patents on novelty and inventive activity; quotes and explanations in support of this statement

The object of the invention is a cover for containers of approximately circular section intended to contain liquids and, therefore, must ensure the tightness of the container when it is closed. This lid consists of an upper element that is joined by a hinge to a lower ring that is fixed to the container. The request contains eleven claims of which only the first is independent while all others depend on it directly or indirectly. The first claim characterizes the invention because the lower ring of the lid has the following elements: a) A plurality of flanges each provided with a section of engagement to the upper flange of the container and a projection that can be fitted in complementary grooves of the upper element of the lid b) Two extensions in diametral opposition and both wedge-shaped After the relevant search, no cover was found with the configuration of the flanges of the lower ring as characterized in the first claim. The first document cited, D1 (Kratzer) is considered the closest to the invention in the state of the art and although coming from the technique of paints for paints, it has a certain formal similarity, despite which the closing function and tightness is achieved therein by means of a system different from that of the tabs with lower engagement and upper projection of the invention. The rest of the aforementioned documents, further from the invention than D1 disclose closure systems by hinged covers with lower ring and upper closure element but with different characteristics, for which reason they are simply considered as representative of the state of the art. Thus, taking into account the foregoing considerations and in the opinion of the examiner, the attributes of novelty, within the meaning of article 6 of the current Patent Law 11/1986 and of inventive activity, within the meaning of article 8 of said law to the first to eleventh claims of the application.
