Statement motivated according to articles 29.6 and 29.7 of the Regulations for the execution of Law 11/1986, of March 20, on Patents on novelty and inventive activity; quotes and explanations in support of this statement La invención reivindica en su número 1 una disposición de sujeción de envases extraíbles, que comprende un cuerpo central en el que los envases se disponen en forma matricial en ambos lados del cuerpo central, habiendo provisto unos medios de fijación independientes entre el cuerpo central y cada uno de los envases, comprendiendo una pestaña que sobresale lateralmente del cuerpo central que presenta un perfil sensiblemente en forma de “U” acoplable por una relación de encaje a presión a una bisagra que forma parte de un conjunto de tapa superior-anillo inferior provisto del envase. Se considera el documento D01 el estado de la técnica más cercano a la invención y divulga en su memoria una disposición de sujeción para envases extraíbles del cuerpo central en el que los envases se disponen a ambos lados del cuerpo central, con unos medios de fijación que comprenden unas pestañas que sobresalen del cuerpo central, con un perfil en “U” acoplables por una relación de encaje a presión. El documento D01 difiere del documento presentado en que los envases se disponen alrededor del dispositivo y no en la forma matricial reivindicada por el solicitante la cual es más conocida por un experto en la materia. Por otro lado difiere de la solicitud que el encaje en ésta no es una bisagra del conjunto que forma parte de un conjunto de tapa superior-anillo inferior, que se encuentra provisto en el envase. No se han encontrado documentos que reflejen dichas diferencias. Por lo tanto la invención en su primera reivindicación es nueva (Art 6.1 de la ley 11/1986 de patentes) y posee actividad inventiva (Art 8.1 de la ley11/1986 de patentes). La reivindicación 2 reivindica que la porción de bisagra presenta un reborde que sobresale de tal modo que en una condición de embalaje de los envases, hace tope con un tramo interior de la pestaña tal que impide un movimiento de giro de la tapa superior respecto al anillo inferior. No se han encontrado documentos con dichas características técnicas. Por lo tanto la invención en su segunda reivindicación es nueva (Art 6.1 de la ley 11/1986 de patentes) y posee actividad inventiva (Art 8.1 de la ley11/1986 de patentes). Las reivindicaciones tercera y cuarta reivindican que el cuerpo central está hecho de un material plástico moldeables semirrígido y biodegradables, es una reivindicación de material, lo cual es conocido para un experto en la materia. Por lo tanto la invención en sus reivindicaciones 3 y 4 son nuevas (Art 6.1 de la ley 11/1986 de patentes) y poseen actividad inventiva (Art 8.1 de la ley11/1986 de patentes) pues son dependientes de la primera. La invención reivindica en el resto de reivindicaciones que el cuerpo central posee unos nervios dispuestos en forma perpendicular y longitudinalmente respecto al eje alargado del cuerpo (reivindicación 5) con unos ensanchamientos que presentan orificios pasantes (reivindicación 6) y en sus extremos opuestos unos medios de enganche para acoplarse tales extremos entre sí (reivindicación 7) . Ninguno se dichos documentos muestra una disposición como la descrita en las reivindicaciones 1 a 7 y en consecuencia no resulta obvio que, a partir de dichos documentos, un experto en la materia pudiera concebir una disposición similar, con las características mencionadas en dichas reivindicaciones. La invención reivindicada a través del contenido de las reivindicaciones 1 a 7 parece aportar mejoras evidentes sobre lo ya conocido en dicho campo por tanto se puede considerar que es nueva e implica actividad inventiva. Document D01 differs from the document presented in that the packages are arranged around the device and not in the matrix form claimed by the applicant which is best known by a person skilled in the art. On the other hand, it differs from the request that the fit in this is not a hinge of the assembly that is part of a top-bottom ring assembly, which is provided in the package. No documents were found that reflect these differences. Therefore, the invention in its first claim is new (Art 6.1 of patent law 11/1986) and has inventive activity (Art 8.1 of patent law 11/1986). Claim 2 claims that the hinge portion has a flange that protrudes in such a way that in a packaging condition of the containers, it abuts an inner section of the flange such that it prevents a rotation movement of the upper cover with respect to the ring lower. No documents were found with these technical characteristics. Therefore, the invention in its second claim is new (Art 6.1 of patent law 11/1986) and has inventive activity (Art 8.1 of patent law 11/1986). The third and fourth claims claim that the central body is made of a semi-rigid and biodegradable moldable plastic material, is a material claim, which is known to a person skilled in the art. Therefore the invention in its claims 3 and 4 are new (Art 6.1 of patent law 11/1986) and have inventive activity (Art 8.1 of patent law 11/1986) as they are dependent on the former. The invention claims in the rest of the claims that the central body has ribs arranged perpendicularly and longitudinally with respect to the elongated axis of the body (claim 5) with widenings having through holes (claim 6) and at their opposite ends means of hook to engage such ends with each other (claim 7). None of said documents shows an arrangement as described in claims 1 to 7 and consequently it is not obvious that, from said documents, a person skilled in the art could devise a similar arrangement, with the characteristics mentioned in said claims. The invention claimed through the content of claims 1 to 7 seems to bring obvious improvements over what is already known in said field, therefore it can be considered to be new and involves inventive activity.
