Abstract
A mobile station apparatus (200) in a mobile communication system in which said mobile station apparatus (200) transmits, to a base station apparatus (100), uplink data using a physical uplink shared channel assigned by an uplink data transmission permission signal, said mobile station apparatus (200) characterized by comprising:means for receiving (206-209) a radio resource control signal including a transmission instruction of reception quality information from said base station apparatus (100);means for receiving (206-209) said uplink data transmission permission signal from said base station apparatus (100);means for periodically transmitting (201-205, 210) first reception quality information using a physical uplink control channel to said base station apparatus (100) according to said transmission instruction of reception quality information included in said radio resource control signal;means for transmitting (201-205, 210) second reception quality information using said physical uplink shared channel to said base station apparatus (100) in case that a transmission instruction of reception quality information is included in said uplink data transmission permission signal; andmeans for transmitting (201-205, 210), at a slot which said base station apparatus (100) set by said radio resource control signal for said mobile station apparatus (200) so as to periodically transmit said first reception quality information using said physical uplink control channel, said first reception quality information simultaneously with said uplink data using said physical uplink shared channel instead of said physical uplink control channel to said base station apparatus (100) in case that said physical uplink shared channel is assigned by said uplink data transmission permission signal which does not include said transmission instruction of reception quality information in transmitting said first reception quality information.

2 129 181 (DE 60 2008 017 325 ) hat der 6. Senat (Nichtigkeitssenat) des Bundespatentgerichts auf die mündliche Verhandlung vom 3. Dezember 2021.
für Recht erkannt: - I. Das europäische Patent
2 129 181 wird mit Wirkung für das Hoheitsgebiet der Bundesrepublik Deutschland hinsichtlich der angegriffenen Patentansprüche 3 bis 6 teilweise für nichtig erklärt, soweit es über folgende Fassung hinausgeht:
Claims (4)
- A mobile station apparatus (200) in a mobile communication system in which said mobile station apparatus (200) transmits, to a base station apparatus (100), uplink data using a physical uplink shared channel assigned by an uplink data transmission permission signal, said mobile station apparatus (200) characterized by comprising: means for receiving (206-209) a radio resource control signal including a transmission instruction of reception quality information from said base station apparatus (100); means for receiving (206-209) said uplink data transmission permission signal from said base station apparatus (100); means for periodically transmitting (201-205, 210) first reception quality information using a physical uplink control channel to said base station apparatus (100) according to said transmission instruction of reception quality information included in said radio resource control signal; means for transmitting (201-205, 210) second reception quality information using said physical uplink shared channel to said base station apparatus (100) in case that a transmission instruction of reception quality information is included in said uplink data transmission permission signal; and means for transmitting (201-205, 210), at a slot which said base station apparatus (100) set by said radio resource control signal for said mobile station apparatus (200) so as to periodically transmit said first reception quality information using said physical uplink control channel, said first reception quality information simultaneously with said uplink data using said physical uplink shared channel instead of said physical uplink control channel to said base station apparatus (100) in case that said physical uplink shared channel is assigned by said uplink data transmission permission signal which does not include said transmission instruction of reception quality information in transmitting said first reception quality information.
- The mobile station apparatus (200) according to claim 3, wherein said first reception quality information transmitted using said physical uplink shared channel has a form in which said first reception quality information is transmitted using said physical uplink control channel.
- A communication method of a mobile station apparatus (200) in a mobile communication system in which said mobile station apparatus (200) transmits, to a base station apparatus (100), uplink data using a physical uplink shared channel assigned by an uplink data transmission permission signal, said communication method characterized by comprising the steps of: receiving a radio resource control signal including a transmission instruction of reception quality information from said base station apparatus (100); receiving said uplink data transmission permission signal from said base station apparatus (100); transmitting first reception quality information using a physical uplink control channel periodically to said base station apparatus (100) according to said transmission instruction of reception quality information included in said radio resource control signal; transmitting second reception quality information using said physical uplink shared channel to said base station apparatus (100) in case that a transmission instruction of reception quality information is included In said uplink data transmission permission signal; and transmitting, at a slot which said base station apparatus (100) set by said radio resource control signal for said mobile station apparatus (200) so as to periodically transmit said first reception quality information using said physical uplink control channel, said first reception quality information simultaneously with said uplink data using said physical uplink shared channel instead of said physical uplink control channel to said base station apparatus (100) in case that said physical uplink shared channel is assigned by said uplink data transmission permission signal which does not include said transmission instruction of reception quality information in transmitting said first reception quality information.
- The communication method according to claim 5, wherein said first reception quality information transmitted using said physical uplink shared channel has a form in which said first reception quality information is transmitted using said physical uplink control channel.
