La présente invention concerne un instrument d'écriture ou de dessin constitué de deux éléments assortis et complémentaires, soit : l'instrument d'écriture lui-même dote d'une longueur constante et un capuchon amovible, destiné à coiffer la plume ou la pointe d'écriture ou de dessin de l'instrument pour la prot~ger, ledit instrument d'écriture et ledit capuchon etant agencés de fason à pouvoir être assemblés pour constituer, en position d'assemblage dans laquelle le capuchon recouvre l'extrémité opérante de l'instrument, un ensemble instrument-capuchon homogène et de longueur invariable, le capuchon étant muni d'une agrafe de fixation permettant de fixer momentanement ledit instrument d'écriture sur le bord supérieur d'une poche de vêtement ou d'une poche de sac, sacoche, porte-document, etc...
Dans le document US-A-1.720.559, est decrit un instrument d'écriture de ce type dont le capuchon est muni d'une agrafe de fixation dont la butée est disposée du côté de l'orifice ou extrémité ouverte dudit capuchon et dont l'extrémité libre est orientee du côté du fond de ce dernier.
De la sorte, le capuchon peut être accroché sur le bord supérieur de la poche avec son extrémité ouverte orientée vers le haut, ce qui permet de retirer l'instrument d'écriture proprement dit dudit capuchon, ou de le réintroduire dans ce dernier qui reste accroché à la poche pendant les périodes d'utilisation dudit instrument d'écriture. Un tel dispositif permet donc à l'usager d'extraire l'instrument d'écriture hors de son capuchon tout en laissant celui-ci fixé à son support. L'intégrite de l'ensemble composé de l'instrument et de son capuchon est alors rompue. Il FEUILLE ~',C!31FIEE

Pour ce faire, l'usager doit réintroduire l'extrémité de l'instrument munie de la plume ou pointe d'écriture, dans son capuchon resté accroché sur le bord de la poche. Ce dispositif permet donc de réduire les risques de perte des capuchons et des instruments d'écriture sur les lieux d'utilisation.
Selon le dispositif decrit dans le document US-A-1.720.559, l'instrument d'écriture se dresse au-dessus du bord supérieur du support (poche ou autre~
sur lequel il est fixé, par l'intermédiaire de son capuchon, sur une longueur relativement importante correspondant à la plus grande partie de la longueur dudit instrument, de sorte que ce dernier a une tendance naturelle à basculer hors du support, cette propension au basculement augmentant avec la souplesse dudit support.
Pour pallier à cet inconvénient, il est prevu, dans le document US-A-1.720.559, de lester le fond fermé du capuchon, au moyen d'une petite masse pesante.
Cela conduit immanquablement à fabrique-r des capuchons a partir d'une pluralite de materiaux differents, et, par conséquent, à une complication de fabrication et à
un prix de revient eleve. D'autre part, une augmentation du poids de l'ensemble instrument-capuchon peut favoriser la déformation permanente des poches des vêtements sur le bord desquelles ledit ensemble est accroché, tandis que le fait que ledit instrument se dresse hors de la poche sur la plus grande partie de sa longueur, est relativement inesthétique.

Document US-A-1,720,559 describes a writing instrument of this type with a cap fitted with a fastening clip, the stop of which is disposed on the side of the orifice or open end of said cap and the free end of which is oriented on the bottom side of the latter.
In this way, the cap can be hung on the top edge of pocket with open end oriented upwards, which allows to remove the writing instrument proper of said cap, or to reintroduce it in the latter which remains hung on the pocket during periods of use of said writing instrument. Such a device allows so the user to extract the writing instrument out of its cap while leaving it attached to its support. L'etat actuel de la technique nous apprend que des recherches incessantes sont effectuées pour améliorer la sécurité des utilisateurs de ce type d'instrument.
Ces recherches ont été matérialisées, entre autre, par la mise au point de divers dispositifs dont le but est de limiter le risque d'étouffement lié à une absorption accidentelLe du capuchon par un enfant, sans pour autant réduire ce risque d'absorption et les inconvénients qui en résultent : généralement extraction du capuchon par intervention chirurgicale (trachéotomie), cicatrisation, cicatrice, choc de la victime et de l'entourage, etc. Ce type d'accident est fréquent, et, en fonction des circonstances, l'issue en reste incertaine.
Il faut souligner que les dispositifs, issus de ces recherches, trouvent hélas leurs limites en cas d'absorption ; effectivement, les mucosités résidant dans la trachée se déposent a ce moment là dans le capuchon, et peuvent obstruer plus ou moins apidement les orifices destinés à assurer une ventilation. De plus, la présence d'un écoulement d'air à l'intérieur du capuchon limite le phénomène de rejet naturel, ainsi que l'efficacité d'une intervent;on ;mmédiate de secourisme telle que l'application de la méthode HEIMLICH. Il apparait donc urgent de réduire trés fortement les risques d'absorption eux-mêmes, et de proposer à l'utilisateur un ensemble instrument d'écriture-capuchon, bénéficiant d'une securité accrue.
Pour assurer une viabilité certaine ~ la securité

coherence et classicisme de l'ensemble.
- l'ensemble instrument d'écriture-capuchon doit pouvoir être industrialisé rap;dement : technologie connue et maitrisée.
- le surcoût de fabrication doit être minime.
- rendre l'ensemble instrument d'écriture-capuchon attractif en le dotant de nouveaux avantages permettant d'assurer sa promotion, et donc une plus large diffusion de cette securité.
- cette securité doit être accessible sans aucun détour, limitation ou contrainte dès la fabrication de l'ensemble.
On connait également (US-A-1.921.270 -US-A-2.553.346) des étuis de forme allongée destinés à
recevo;r des instruments d'écriture de longueur variable ou non et dont l'extrémité supérieure est munie d'une pince permettant leur accrochage sur le bord supérieur d'une poche de vêtements. Il s'agit toutefois d'etuis ou fourreaux spécifiques, commercialisés individuellement et dont l'utilisation ~- est facultative, de sorte que lorsque de tels étuis sont associés, par leurs utilisateurs, à des instruments d'écriture achetés séparément et qui peuvent avoir des conformat;ons et des longueurs variables, ils constituent des ensembles disparates dont la longueur peut varier en fonction de la longueur desdits instruments d'écriture. De tels étuis spécifiques sont de simples accessoires et ne peuvent donc pas être assimilés aux capuchons des instruments d'ecriture du genre comportant l'instrument d'écriture FEUILLE MO~IFIEE
- 5 - 2 ~ / 5 lui-meme et un capuchon destiné a etre assemblé audit instrument, en périodes d'inutilisation, de manière a former un ensemble homogène, le capuchon, constituant, en effet, dans ce cas, un composant indissociable et indispensable dudit ensemble.
L'invention se propose de remédier aux inconvénients majeurs précédemment soulignés et qui sont vraisemblablement la cause de l'absence, sur le marche, d'instrument du genre de celui décrit dans le document US-A-1.720.559, bien que celui-ci vise à
procurer des avantages substantiels par rapport aux instruments d'ecriture traditionnels.
Selon l'invention, ce but est atteint grace à un instrument d'ècriture du genre précité, remarquable par le fait que l'extremité ouverte du capuchon et la butée de l'agrafe de fixation sont disposées dans la demi-partie de l'ensemble instrument-capuchon incluant la partie terminale inopérante dudit instrument d'écriture.
Grace à cette disposition caracteristique, lorsque l'ensemble instrument-capuchon est accroché sur le bord supérieur d'un support tel que le bord superieur d'une poche, la plus grande partie de la hauteur de cet ensemble se trouve disposée au-dessous dudit bord, à
l'interieur de la poche, et n'a, de ce fait, aucune propension au basculement vers l'extérieur.
Par ailleurs, les proportions du capuchon de l'ensemble instrument d'écriture capuchon, rendent ledit capuchon très d;ffic;lement absorbable par un enfant, èliminant d'autant la totalité des inconvénients relatifs à ce type d'accident.
L'ensemble de ces avantages, tant pratiques que securitaires, est ainsi obtenu dès la fabrication de l'ensemble instrument d'écriture-capuchon, et évite toute démarche pouvant constituer une entrave ou une dissuasion à la sècuritè recherchée, ainsi que tout gaspillage résultant du rejet du capuchon initial.

connu de moulage, à partir d'un unique matériau tel que matière plastique riqide, par exemple, ou au moyen de deux matériaux différents seulement (un pour le corps du capuchon et un pour l'agrafe), et son poids n'est pas sensiblement augmenté par rapport à celui des capuchons usuels.

The invention proposes to remedy the major disadvantages previously highlighted and which are probably the cause of the absence, on the market, an instrument like the one described in the document US-A-1,720,559, although this is intended to provide substantial advantages over traditional writing instruments.
According to the invention, this object is achieved thanks to a writing instrument of the aforementioned genre, remarkable for the fact that the open end of the cap and the stopper of the fastening clip are arranged in the half part of the instrument-cap assembly including the inoperative end portion of said instrument writing.
Thanks to this characteristic arrangement, when the instrument-cap assembly is hung on the edge top of a support such as the top edge of a pocket, most of the height of this set is arranged below said edge, at inside the pocket, and therefore has no propensity to tilt outwards.
In addition, the proportions of the cap the cap writing instrument set, make said cap very easily; absorbable by a child, eliminating all the disadvantages relating to this type of accident.
All of these advantages, both practical and security, is thus obtained from the manufacturing of the writing instrument-cap assembly, and avoids any step which may constitute an obstacle or a deterrence to the security sought, as well as all waste resulting from rejection of the original cap.
