본 발명은 특허 문서 검색 서버 및 방법에 관한 것으로서, 보다 상세하게는 특허 문서 다운로드시 사용자의 설정에 따라 맞춤형으로 파일명을 생성할 수 있는 특허 문서 검색 서버 및 방법에 관한 것이다.
무형자산이 특허가 중요해지면서 특허 검색 서비스의 이용율도 증가하고 있다. 특허 문서는 특허 출원된 문서가 일정 기간 후 공개된 공개 공보나 등록된 후에 공개되는 등록 공보를 의미한다.
종래의 특허 문서 검색 서비스는 사용자가 특허 검색용 사이트에 접속하고 세부 검색 항목을 입력하면 그에 대응되는 특허 문서가 검색되는 방식으로 제공되었다. 하지만 이러한 종래의 서비스의 경우 검색된 특허 문서 중 하나 또는 그 이상의 문서를 선택하여 다운로드 하는 경우 해당 파일의 이름은 특허 검색 서버에 저장된 특허출원번호와 같은 숫자로만 저장되어 사용자가 복수개의 특허 문서에 대하여 직관적으로 정보를 파악하기에는 한계가 있었다.
따라서, 검색을 이용하는 이용자가 자신 또는 타인의 식별을 용이하게 하기 위하여 파일의 이름에 '발명의 명칭'이나 '출원인' 등을 포함하도록 일일이 수작업으로 파일의 명칭을 수정해야 하는 번거로움이 있었다.

본 발명은 특허 검색 시스템을 이용할 때 특허 문서 다운로드시 사용자의 설정에 따라 맞춤형으로 파일명을 자동으로 생성할 수 있도록 함으로써 특허 분석 업무의 효율성을 극대화시킬 수 있는 효과를 가진다.
본 발명에 따른 효과는 이상에서 예시된 내용에 의해 제한되지 않으며, 더욱 다양한 효과들이 본 명세서 내에 포함되어 있다.

본 발명의 이점 및 특징, 그리고 그것들을 달성하는 방법은 첨부되는 도면과 함께 상세하게 후술되어 있는 실시예들을 참조하면 명확해질 것이다. 그러나 본 발명은 이하에서 개시되는 실시예들에 한정되는 것이 아니라 서로 다른 다양한 형태로 구현될 수 있으며, 단지 본 실시예들은 본 발명의 개시가 완전하도록 하고, 본 발명이 속하는 기술분야에서 통상의 지식을 가진 자에게 발명의 범주를 완전하게 알려주기 위해 제공되는 것이며, 본 발명은 청구항의 범주에 의해 정의될 뿐이다. 명세서 전체에 걸쳐 동일 참조 부호는 동일 구성 요소를 지칭한다.
이하, 본 발명의 실시예들에 따른 특허 문서 검색 서버 및 이를 이용한 특허 문서 검색 방법에 대하여 도면을 참고하여 설명하기로 한다.
도 1은 본 발명의 일실시예에 따른 특허 문서 검색 서버의 개략 구성도이다.
도 1을 참조하면 본 발명의 일실시예에 따른 특허 문서 검색 서버(100)는 유선 또는 무선의 인터넷망을 통하여 복수의 사용자 단말기(200)에 연결될 수 있다.
본 명세서에서 본 발명의 특허 문서 검색 서버(100)는 하나 또는 복수의 서버에 의하여 구성될 수 있으며, 이하에서는 하나의 서버로 구성된 것을 예로 들어 설명한다.
하지만, 특허 문서 검색 서버(100)는 하나의 컴퓨터로 이루어지는 것에 한정되는 것은 아니며 하위 구성요소가 별도의 서버로 이루어지는 실시예도 가능하다.
특허 문서 검색 서버(100)는 네트워크를 통하여 복수의 사용자 단말기(200)에 특허 문서 검색 서비스 제공을 위한 웹사이트 또는 애플리케이션 등을 제공하는 서버 컴퓨터 등을 의미하며, 사용자 단말기(200)는 특허 문서 검색을 위하여 사용자가 사용하는 스마트폰, 태블릿, 노트북, 컴퓨터 등의 단말기를 의미한다.
특허 문서 검색 서버(100)가 사용자 단말기(200)에 제공하는 웹사이트 또는 애플리케이션은 다양한 컴퓨터 수단을 통하여 수행될 수 있는 프로그램 명령 형태로 구현되어 컴퓨터 판독가능 매체에 기록될 수 있다. 상기 컴퓨터 판독가능매체는 프로그램 명령, 데이터 파일, 데이터 구조 등이 단독으로 또는 조합으로 구성될 숴 있다. 상기 매체에 기록되는 프로그램 명령은 본 발명을 위하여 특별히 설계되고 구성된 것들이거나 컴퓨터 소프트웨어 당업자에게 공지되어 사용 가능한 것일 수 있다.
특허 문서 검색 서버(100)는 저장부(110), 검색부(120), 출력부(130), 다운로드 설정값 관리부(140) 및 다운로드 처리부(150)를 포함하여 구성될 수 있다.
저장부(110)는 검색 대상이 되는 복수의 특허 문서의 복수의 필드에 대응되는 텍스트 정보를 포함하는 특허 문서 데이터를 저장하는 역할을 한다.
기본적으로 저장부(100)가 저장하는 특허 문서는 각 국가별 특허청이 제공하는 공개특허공보 또는 등록특허정보이며, 이러한 정보는 각국 특허청이 제공하는 사이트에서 워드, PDF 등의 다양한 포맷으로 수집될 수 있다.
특허 문서 검색 서버(100)는 사용자가 특허 문서의 내용 및 각종 필드의 내용 기반으로 검색이 가능하도록 하기 위하여 모든 내용에 대응되는 텍스트 정보를 추출하여 데이터베이스화하여 저장할 수 있다.
도 3은 한국 특허청이 제공하는 등록특허공보의 표지 화면의 예시이다.
도 3에서와 같이 등록특허공보는 '공고일자', '등록번호', '등록일자', '국제특허분류', 'CPC특허분류', '출원번호', '출원일자', '심사청구일자', '특허권자', '발명자', '대리인', '발명의 명칭' 등의 필드 정보를 포함한다.
도 3에 나타나지 않았지만 필드 정보에는 '특허청구범위', '청구항 1' 등 다양한 필드 정보가 포함될 수 있다.
본 명세서에서 특허 문서의 복수의 필드는 상기와 같은 필드 정보를 의미한다.
또한, 저장부(110)는 각 특허 문서에 대응되는 '심사처리 현황정보' 및 '권리 현황정보' 등을 저장할 수 있다.
예를 들어, 특허출원이 공개되었지만 아직 등록되기 전이어서 심사중인 상태인 경우에는 '심사처리 현황정보'에는 'OA발행전', '1차 OA발행', '1차 OA대응후 심사중', '2차 OA발행', '2차 OA발행' 등이 포함될 수 있으며, '권리 현황정보'에는 '등록', '소멸(등록료불납)', '소멸(년차료불납)', '소멸(존속기간만료)', 무효(무효심판)' 등이 포함될 수 있다.
상기 '심사처리 현황정보' 및 '권리 현황정보'의 예시들은 일부 예시적인 것들 것 나열한 것일 뿐 해당 특허 문서에 연관되는 기타 심사처리 현황 및 권리 현황이라면 다른 항목들도 포함될 수 있음은 물론이다.
또한, 저장부(110)는 상기의 정보 외에도 각 특허 문서에 대응되는 해외 특허 출원 현황(패밀리 특허 현황), 연관되는 심판 및 소송 등 연관되는 정보를 병렬적으로 저장시킬 수 있다.
즉, 저장부(110)는 현재 각국 특허청 또는 사기업이 제공하는 특허 검색 서비스(예를 들어, 키프리스, 윕스, 키워트 등)가 제공하는 각종 정보를 모두 저장할 수 있다.
검색부(120)는 사용자 단말기(200)로부터 수신된 검색 조건에 따라 저장부(110)에 저장된 특허 문서 데이터 중 상기 검색 조건에 대응되는 특허 문서를 검색하는 역할을 한다.
출력부(130)는 검색부(120)에서 검색된 특허 문서를 사용자 단말기(200)에 출력하는 역할을 한다.
다운로드 설정값 관리부(140)는 특허 문서의 필드 정보, 특허 문서 각각에 대응되는 심사처리 현황정보 또는 권리 현황정보 및 사용자 입력 필드 정보를 포함하여 다운로드 문서의 이름을 설정할 수 있는 사용자 인터페이스를 사용자 단말기(200)에 제공하고, 사용자 단말기(200)로부터 입력된 다운로드 설정값을 저장하는 역할을 한다.
이때, 특허 문서의 필드 정보는 상기 설명한 바와 같이 특허 문서에 포함된 복수의 필드 정보를 의미하며, 심사처리 현황 정보 및 권리 현황정보는 각각의 특허 문서에 연관되는 심사처리 상태 및 권리 상태 정보를 의미한다.
사용자 입력 필드 정보는 특허 문서와 별개로 사용자가 직접 입력하는 필드를 의미한다.
또한, 다운로드 설정값 관리부(140)는 사용자 단말기(200)의 사용자가 기설정한 다운로드 설정값 리스트를 포함하는 템플릿 정보를 사용자 단말기(200)에 제공할 수 있다.
다운로드 처리부(150)는 상기 다운로드 설정값에 따라 특허 문서의 필드 정보, 심사처리 현황정보, 권리 현황정보 및 사용자 입력 필드 정보 중 적어도 하나의 정보에 대응되는 텍스트를 포함하여 다운로드 문서의 이름을 자동으로 생성하는 역할을 한다.
이때, 다운로드 처리부(150)가 다운로드 문서의 이름을 자동으로 생성하는 방법은 각 사용자가 설정한 다운로드 설정값을 호출하여 그에 대응되는 필드 항목의 데이터를 저장부(100)에 저장되어 있는 데이터에서 호출하는 방식을 사용할 수 있다.
또한, 다운로드 처리부(150)는 사용자 단말기(200)로 다운로드 완료된 특허 문서 및 다운로드 완료된 특허 문서에 대응되는 생성된 이름 정보를 미리 설정된 기간 동안 저장부(110)에 저장시킬 수 있다.
도 2는 본 발명의 일실시예에 따른 특허 문서 검색 서버를 이용한 특허 문서 검색 방법을 설명하는 순서도이다.
도 2를 참조하면, 본 발명의 일실시예에 따른 특허 문서 검색 방법은, 특허 문서 검색 서버(100)가 다운로드 문서 이름을 설정하기 위한 사용자 인터페이스를 사용자 단말기(200)에 제공하는 단계(S310)를 포함한다.
사용자가 사용자 단말기(200)의 화면에 표시된 사용자 인터페이스를 이용하여 다운로드 설정값을 설정하면, 특허 문서 검색 서버(100)는 사용자 단말기(200)로부터 다운로드 설정값 정보를 수신 및 저장한다(S320).
다음으로 특허 문서 검색 서버(100)가 사용자 단말기(200)로부터 선택된 문서의 다운로드 요청 정보를 수신하고(S330), 상기 저장된 다운로드 설정값에 따라 다운로드시 다운로드 문서 이름을 자동으로 생성하고(S340), 사용자 단말기(200)로 문서 다운로드를 완료시킨다(S350).
이하 도 4 내지 도 14를 참조하여 본 발명의 일실시예에 따른 특허 문서 검색 서버(100)가 제공하는 특허 문서 검색 방법을 설명한다.
도 4 내지 도 13은 본 발명의 일실시예에 따른 특허 문서 검색 서버가 사용자 단말기의 화면에 제공하는 다운로드 문서의 이름을 설정할 수 있는 사용자 인터페이스의 예시이다.
도 4에는 특허 문서 검색 서버(100)가 사용자 단말기(200)의 화면에 표시한 다운로드 문서의 이름을 설정할 수 있도록 하는 사용자 인터페이스 화면이다.
사용자 인터페이스 화면을 팝업창 형식으로 제공될 수 있으며, 다운로드 문서의 이름에 포함되어야 하는 항목을 순서대로 선택할 수 있도록 복수개의 열이 제공된다.
각 열에는 '대분류', '소분류' 및 '사용자 입력 문자'를 선택할 수 있는 필드가 배치된다.
도 5를 참조하면, 사용자가 제1열의 '대분류 선택' 필드를 선택한 경우에 '특문서 필드', '사용자 필드' 및 '현황정보 필드'를 선택할 수 있도록 하는 리스트가 펼쳐진 화면이 도시되어 있다.
도 5에서 사용자가 '특허문서 필드'를 선택하고 나서 사용자가 '소분류 선택' 필드를 선택하면 도 6과 같이 소분류로 '출원인', '출원일', '출원번호', '공개일', '공개번호', '등록일', '등록번호', '발명의 명칭' 등을 선택할 수 있도록 하는 리스트가 펼쳐진다.
도 7에는 도 6에서 사용자가 소분류로 '등록번호(공개번호)'를 선택한 경우의 팝업 화면이 나타나 있다. 이때, 괄호 안네 '공개번호'가 포함된 것은 등록번호가 없는 경우에는 공개번호를 입력시키는 것을 의미한다. 즉, 괄호안에 있는 내용은 후순위로 표시될 수 있는 정보를 의미한다.
이와 같은 방식으로 하나 또는 두 개 이상의 단계를 적용하여 우선순위를 적용하는 방식으로 각각의 필드를 입력하는 방식이 가능하다.
도 7과 같이 소분류가 선택된 상태에서 사용자가 '사용자 입력 문자 선택' 필드를 선택하면 도 8과 같이 '등록번호(공개번호)' 전후에 입력되는 문자를 사용자가 직접 입력할 수 있도록 하는 리스트가 펼쳐진다.
도 9에서는 '등록번호(공개번호)'의 앞에 '제'의 문자를, 뒤에는 '호_'의 문자를 입력한 상태가 표시되어 있다.
도 10에서는 위와 같은 방식으로 제2열 및 제3열을 '특허문서 필드'로 선택한 결과를 확인할 수 있다.
제2열에는 '특허문서 필드'의 소분류로 '발명의 명칭'을 선택하였고, '발명의 명칭'의 뒤에 사용자 입력 문자인 '_'가 입력되었다.
제3열에는 '특허문서 필드'의 소분류로 '출원인'을 선택하였고, '출원인'의 뒤에 사용자 입력 문자인 '_'가 입력되었다.
도 11에는 제4열에 사용자가 대분류로 '현황정보 필드'를 선택하고, 소분류 필드를 선택하면 '심사 현황정보', '권리 현황정보' 등을 선택할 수 있는 리스트가 출력된 화면이 나타나 있다.
도 11에서 사용자가 소분류로 '권리 현황정보(심사 현황정보)'를 선택하고, 사용자 입력 문자인 '-'를 선택하면 도 12와 같이 표시된다.
도 13에는 사용자가 제5열에서 대분류로 '사용자 필드'를 선택하고, 소분류로 '관리번호' 이름을 설정한 후에, 사용자 입력 문자에 “DP220411'을 입력한 결과가 나타나 있다.
이때, 소분류인 '관리번호'는 사용자가 임의로 설정한 필드의 이름이다.
도 14는 본 발명의 일실시예에 따른 특허 문서 검색 서버가 다운로드 설정값에 따라 사용자 단말기에 문서 다운로드시 자동 생성된 문서의 이름을 나타내는 도면이다.
도 4 내지 도 13과 같은 방식으로 사용자가 다운로드 설정값을 설정한 후 저장시킨 후에 사용자가 선택된 특허 문서를 다운로드를 요청하면, 특허 문서 검색 서버(100)는 사용자 단말기(200)의 화면에 도 14와 같은 다운로드시 이름 설정화면이 나타난다.
도 14와 같은 화면에서 원하는 경우 사용자는 '파일 이름'의 이름을 자신이 원하는 대로 수정할 수 있는데, '파일 이름'은 특허 문서 검색 서버(100)가 상기 다운로드 설정값에 의하여 설정된 대로 자동으로 생성된다.
도 14에는 도 3에 표시된 특허 문서를 기초로 도 13에 설정된 다운로드 설정값을 기초로 파일 이름이 '제10-1234567호_특허 문서 검색 서버 및 이를 이용한 특허 문서 검색 방법_홍길동_등록_DP220411'로 자동으로 생성된 것이 나타나 있다.
따라서, 사용자는 다운로드 설정값에 따라 자동으로 원하는 방식으로 이름이 생성되므로 별도의 이름 변경 없이 '저장' 아이콘을 누르는 것만으로 원하는 이름으로 특허 문서를 저장시킬 수 있게 된다.
도 14에는 하나의 문서를 다운로드하는 것을 예로 들었지만 복수의 특허 문서를 선택하여 다운로드 하는 경우에도 동일한 방식으로 다운로드 설정값에 따라 복수의 특허 문서들의 이름이 각각 생성되어 다운로드 될 수 있다.
물론, 위와 같이 복수의 문서를 다운로드 하는 경우에는 도 14와 같이 각각의 문서에 대한 이름을 변경하거나 저장 폴더를 저장하는 팝업창은 생략될 수도 있을 것이다.
본 발명의 특허 문서 검색 서버 및 이를 이용한 특허 문서 검색 방법은 위와 같은 방식으로 다운로드시에 파일의 명칭을 사용자가 원하는 방식으로 미리 설정하고, 설정된 값에 따라서 하나 또는 복수의 특허 문서들의 명칭이 자동으로 생성되어 저장됨으로써 업무의 효율성을 극대화시킬 수 있다.
또한, 본 발명의 특허 문서 검색 서버(100)는 사용자가 설정한 다운로드 설정값들을 템플릿으로 서버(100)에 저장시킨 후 필요시 자신이 설정한 템플릿을 호출하여 사용할 수 있게 함으로써 업무의 효율성을 극대화시킬 수 있다.
또한, 본 발명의 특허 문서 검색 서버(100)는 상기와 같은 방식으로 다운로드 설정값에 따라서 특허 문서를 다운로드한 경우 다운로드 항목들의 특허 문서 정보 및 대응되는 문서 이름 정보 들을 매칭하여 미리 설정된 기간 동안 서버(100)에 저장시킴으로써 추후 업무에 다시 호출하여 사용할 수 있게 함으로써 업무의 효율성을 극대화시킬 수 있다.
위에서 본 발명의 특허 문서 검색 서버 및 이를 이용한 특허 문서 검색 방법에 대하여 DB화된 특허 문서를 검색 및 다운로드하는 경우를 예로 들어 설명하였지만, 위에서 설명한 바와 같이 문서 내부에 필드가 있는 경우이면 특허 문서가 아닌 경우에도 동일한 방식으로 문서 다운로드시 명칭을 설정하여 자동으로 다운로드하는 것도 가능할 것이다.
본 발명이 속하는 기술분야의 통상의 지식을 가진 자는 본 발명이 그 기술적 사상이나 필수적인 특징을 변경하지 않고서 다른 구체적인 형태로 실시될 수 있다는 것을 이해할 수 있을 것이다. 그러므로 이상에서 기술한 실시예들은 모든 면에서 예시적인 것이며 한정적이 아닌 것으로 이해해야만 한다. 본 발명의 범위는 상기 상세한 설명보다는 후술하는 특허청구범위에 의하여 나타내어지며, 특허청구범위의 의미 및 범위 그리고 그 균등 개념으로부터 도출되는 모든 변경 또는 변형된 형태가 본 발명의 범위에 포함되는 것으로 해석되어야 한다.

Claims (10)

  1. 복수의 사용자 단말기에 네트워크로 연결되어 특허 문서 검색 서비스를 제공하는 특허 문서 검색 서버에 있어서,
    검색 대상이 되는 복수의 특허 문서의 복수의 필드에 대응되는 텍스트 정보를 포함하는 특허 문서 데이터를 저장하는 저장부;
    상기 사용자 단말기로부터 수신된 검색 조건에 따라 상기 저장부에 저장된 특허 문서 데이터 중 상기 검색 조건에 대응되는 특허 문서를 검색하는 검색부;
    상기 검색부에서 검색된 특허 문서를 상기 사용자 단말기에 출력하는 출력부;
    상기 사용자 단말기에 특허 문서의 필드 정보를 포함하여 다운로드 문서의 이름을 설정할 수 있는 사용자 인터페이스를 제공하고, 상기 사용자 단말기로부터 입력된 다운로드 설정값을 저장하는 다운로드 설정값 관리부; 및
    상기 사용자 단말기로부터 수신된 선택된 문서의 다운로드 요청에 따라 대응되는 문서를 상기 사용자 단말기로 다운로드 가능하게 하는 다운로드 처리부를 포함하고,
    상기 다운로드 처리부는 상기 다운로드 설정값에 따라 상기 필드 정보에 대응되는 텍스트를 포함하여 다운로드 되는 문서의 이름을 자동으로 생성하는 특허 문서 검색 서버.
  2. 제1항에 있어서,
    상기 다운로드 설정값 관리부는 상기 사용자 단말기에 사용자 입력 필드 정보를 포함하여 다운로드 문서의 이름을 설정할 수 있는 사용자 인터페이스를 제공하고,
    상기 다운로드 처리부는 상기 사용자 입력 필드 정보를 더 포함하여 다운로드 되는 문서의 이름을 자동으로 생성하는 특허 문서 검색 서버.
  3. 제2항에 있어서,
    상기 다운로드 설정값 관리부는 상기 사용자 단말기에 특허 문서 각각에 대응되는 심사처리 현황정보 또는 권리 현황정보를 더 포함하여 다운로드 문서의 이름을 설정할 수 있는 사용자 인터페이스를 제공하고,
    상기 다운로드 처리부는 상기 심사처리 현황정보 또는 상기 권리 현황정보를 더 포함하여 다운로드 되는 문서의 이름을 자동으로 생성하는 특허 문서 검색 서버.

    상기 다운로드 설정값 관리부는 상기 사용자 단말기의 사용자가 기설정한 다운로드 설정값 리스트를 포함하는 템플릿 정보를 상기 사용자 단말기에 제공하는 특허 문서 검색 서버.

    상기 다운로드 처리부는 사용자 단말기로 다운로드 완료된 특허 문서 및 상기 다운로드 완료된 특허 문서에 대응되는 생성된 이름 정보를 미리 설정된 기간 동안 상기 저장부에 저장시키는 특허 문서 검색 서버.
  6. 복수의 사용자 단말기에 네트워크로 연결되어 특허 문서 검색 서비스를 제공하는 특허 문서 검색 서버를 이용한 특허 문서 검색 방법에 있어서,
    (a) 상기 특허 문서 검색 서버가 상기 사용자 단말기에 특허 문서의 필드 정보를 포함하여 다운로드 문서의 이름을 설정할 수 있는 사용자 인터페이스를 제공하는 단계;
    (b) 상기 특허 문서 검색 서버가 상기 사용자 단말기로부터 입력된 다운로드 설정값을 저장하는 단계;
    (c) 상기 특허 문서 검색 서버가 상기 사용자 단말기로부터 선택된 문서의 다운로드 요청을 수신하는 단계; 및
    (d) 상기 특허 문서 검색 서버가 상기 다운로드 설정값에 따라 상기 필드 정보에 대응되는 텍스트를 포함하여 다운로드 되는 문서의 이름을 자동으로 생성하여 상기 사용자 단말기로 다운로드시키는 단계를 포함하는 특허 문서 검색 방법.
  7. 제6항에 있어서,
    상기 (a) 단계는, 상기 특허 문서 검색 서버가 상기 사용자 단말기에 사용자 입력 필드 정보를 포함하여 다운로드 문서의 이름을 설정할 수 있는 사용자 인터페이스를 제공하는 단계를 포함하고,
    상기 (d) 단계는, 상기 특허 문서 검색 서버가 상기 사용자 입력 필드 정보를 더 포함하여 다운로드 되는 문서의 이름을 자동으로 생성하는 단계를 포함하는 특허 문서 검색 방법.
