2. Statement motivated according to articles 29.6 and 29.7 of the Regulations for the execution of Law 11/1986, of March 20, on Patents on novelty and inventive activity; quotes and explanations in support of this statement

The purpose of the application is the lid of a container for collecting waste from which they are buried, so that the lid is exactly at ground level and should form a continuous surface with the pavement of the sidewalk.

The application contains four claims, of which only the first one is independent and the others depend directly or indirectly. The application raises the technical problem of making the lid of the underground containers can be attached to inclined locations and the solution to this problem characterizes the invention. Specifically, in the first claim the invention is characterized by the following elements:

a) The lid is formed by a square plate with a support system and support in the container. b) The lid is attached to the container floatingly by means of vertical supports whose height can be adjusted independently of each other. c) Each support is provided with a ball joint with locking means d) The lower end of each support is connected to a plate welded to the upper edge of the container e) The upper end of each support is coupled to a receptacle provided in coincidence with the lower part of the lids f) The lifting mechanism of the container is incorporated in a loading crossbeam attached to a frame, in turn attached to the upper part of the walls of the container.

Having made the relevant search, no disclosure has been found in the prior art that anticipates the characterizing elements of the invention in the first claim. The problem of leveling the lid of the container with the floor of the street is raised, but the solutions disclosed are different.

Thus, document D1 (Equipment and services) proposes a similar solution, based on vertical stems, but not floating because it lacks the label and plate claimed in the first claim of the application.

The same can be said of documents D2 (Bammens) and D3 (Cardoso) in which threaded stems are disclosed as a technical solution to set the desired inclination. It can be said, therefore, that these are different solutions to the same problem of flushing the lid of the underground container.

Thus, taking into account the above considerations and in the opinion of the examiner, the attributes of novelty, within the meaning of article 6 of the current Patent Law 11/1986, and of inventive activity, within the meaning of article 8 of said law to the first to fourth claims of the application.
