2. Statement motivated according to articles 29.6 and 29.7 of the Regulations for the execution of Law 11/1986, of March 20, on Patents on novelty and inventive activity; quotes and explanations in support of this statement

The purpose of the request is a structure designed to house garbage containers and the like, thus protecting them from possible acts of vandalism. The request contains eleven claims, of which only the first one is independent and the second and the tenth and indirectly the others depend on it.

The first claim characterizes the invention by the mechanism of lifting and lowering and opening and closing, located on the sides of the base of the structure or box that houses the container.

The second claim characterizes the invention because each mechanism for lifting and lowering the platform and opening and closing the lid consists of two guides associated respectively with the platform and the lower face of the lid and an arm with a lower leg-like part which ends in a sliding element by the guide associated to the platform and a bifurcated upper part in two branches, one that pivots at a point below the lid and the other that ends in a sliding element by the guide associated to the lid

The tenth claim characterizes the invention by the actuator, which has one end linked to the bottom of the box and another end linked to a point of the lid close to the side of the lid and box joint.

Once the relevant search has been done, the characterizing elements of the invention have not been found in the state of the art, nor does it seem that it can be obtained in an obvious way by an expert based on the disclosures found. The documents cited are considered the closest to it, but do not anticipate the claimed characteristics. Thus D1 (Antolí) and D2 (Cascallana) disclose structures for underground containers with lifting and opening and lowering and closing mechanisms, but the disclosed mechanisms are scissor devices located under the base of the platform and not on the sides of it. . Somewhat further away are D3 (Ecogest) and D5 (Bauer) in which the lifting and opening mechanism is neither on the sides of the platform nor under it, but completely separated from it. Finally D4 (Cardoso) discloses a system similar to the previous ones but it abounds more in the characteristics of the procedure of unloading the contents of the container in a pickup truck.

Thus, taking into account the foregoing considerations and in the opinion of the examiner, the attributes of novelty, within the meaning of article 6 of the current Patent Law 11/1986 and of inventive activity, within the meaning of article 8 of the mentioned Law, to the first to eleventh claims of the application.
