Description
- Mit dem Fortschreiten der medizinischen Technologie gibt es eine Anzahl medizinischer Prothesen und Vorrichtungen, die in Menschen für Rekonstruktions- und/oder kosmetische Zwecke implantierbar sind. Diese umfassen Brustimplantate; Penisimplantate; Muskulatur- und andere Weichgewebeimplantate; Schrittmacher; Ventile; künstliche Gelenke und Glieder wie Knie, Schultern, Beine, Finger etc.; Stifte, Schrauben, Platten, Stangen; Nägel und andere Klammern und Träger. Um die fortgesetzte Sicherheit und die Gesundheit von Patienten, die diese Implantate erhalten, sicher zu stellen, wurde das Safe Medical Device Gesetz von 1990 erlassen, welches vorschreibt, daß Hersteller von implantierbaren medizinischen Vorrichtungen der Klasse III ein Vorrichtungsregister zur Verfolgung ihrer Vorrichtungen schaffen, Meldung der Patienten und auf andere Weise diese Implantate zu überwachen, nachdem sie in einen Patienten plaziert worden sind. Zur Einhaltung dieses Gesetzes ist ein Verfolgungsverfahren vorgeschlagen worden, welches vom Chirurgen, der die Vorrichtung implantiert, erfordert, ein Formular oder eine Karte mit den demographischen Patientendaten und Implantatsdaten zu vervollständigen und an den Hersteller oder einen Dritten Registrierungsservice zurückzusenden. Dieses Verfahren erfordert sowohl eine sorgfältige Sammlung der Daten durch den Chirurgen oder seine Angestellten, als auch sichere inventorische Steuerverfahren, um sicherzustellen, daß die Daten dem korrekten Implantat richtig zugeordnet werden. Ferner besteht ein Risiko des vollständigen Verlusts der Daten aufgrund von fehlgeleiteten oder verloren gegangenen Mitteilungen. Ferner kann der Zugang zu diesen Daten im Falle einer Notfallsituation oder anderer Umstände, die die Fähigkeiten eines Patienten, sich an die richtige Information, die dann das medizinische Personal zum Zugang zum Register und den darin erhaltenen Daten befähigen würde, zu erinnern oder diese zu übermitteln, verhindert sein.
- Es hat im Stand der Technik Vorschläge gegeben, die Implantate selbst zu markieren, beispielsweise mit einer strahlenundurchlässigen (radiopaquen) Markierung oder einer anderen Markierung, die die Informationen über das Implantat enthält, wie in US 4863470 offenbart. Idealer Weise können diese Daten durch Röntgen- oder andere nicht-invasiven Verfahren sichtbar gemacht werden. Wie auch immer, es bestehen Probleme bei diesen Vorschlägen nach dem Stand der Technik. Zunächst würde ein Brustimplantat mit einer strahlenundurchlässigen Markierung zumindest teilweise Gewebe verdecken oder maskieren, das gesehen werden soll, um Artefakte durch Tumore oder dergleichen für die Krebsdiagnose nachzuweisen. Offensichtlich ist dieses äußerst unerwünscht, da das Auftreten von Brustkrebs ein signifikantes Risiko für viele Frauen darstellt. Zusätzlich wird die wiederholte Aussetzung von Röntgenstrahlung allgemein nicht als gesund oder erwünscht betrachtet und ist zumindest eine zusätzliche Belastung, die einige Kosten für das Abrufen oder den Zugang zu den Implantatdaten nach sich zieht. Demzufolge wurden strahlenundurchlässigen Markierungen nicht als geeignete Langzeitlösung für dieses Problem betrachtet.
- Das US-Patent 4,875,483 von Vollmann et al. offenbart einen implantierbaren Schrittmacher mit einer daran befestigten Identifizierungs "Marke", der in einem Transponder, der mit einem einzigartigen Code codiert ist, enthalten ist. Diese Identifikationsmarke ist ein Teil des Schrittmachers, so daß sie mit dem Schrittmacher implantiert wird, wodurch der Transponder nach der Implantation durch Ablesen des einzigartigen Codes identifiziert werden kann. Nichts desto weniger muß der Schrittmacher mit einer internen Energiequelle versehen werden, und so werden Schrittmacher und Transponder in dieser Vorrichtung beide durch die interne Energiequelle (Batterie) mit Energie versorgt.
- Erfindungsgemäß wird eine implantierbare Prothese geschaffen, die zur Implantation in einen Menschen eingerichtet ist, die ein Transponder besitzt, der mit einer einzigartigen Marke, die an der Prothese befestigt ist, versehen ist, so daß der Transponder dann implantiert wird, wenn die Prothese implantiert wird, wodurch der Transponder nach Implantation durch Ablesen der einzigartigen Marke leicht identifiziert werden kann, dadurch gekennzeichnet, daß der Transponder ferner Mittel zur Energieversorgung durch eine entfernte Leseeinrichtung aufweist, wodurch die Notwendigkeit, daß eine Batterie im Transponder enthalten sein muß, vermieden werden kann.
- Auf den Transponder kann nachfolgend mit einem elektromagnetischen Handlesegerät in einem schnellen, preiswerten und nicht-invasivem Verfahren zugegriffen werden. Der passive Transponder kann am Implantat mit jeglichen geeigneten Mitteln befestigt sein. Beispielsweise kann bei einem Brustimplantat die mehrschichtige Hülle für das Implantat um den Transponder laminiert werden, um dadurch diesen permanent und sicher am Implantat zu befestigen. Der Transponder kann in die Seitenwand der Hülle laminiert werden, oder zwischen Schichten, die den Siegelflecken umfassen, der an die Hülle angebracht ist, um die Bohreröffnung (mandrel opening) abzudichten. In ähnlicher Weise kann der Transponder auf die Oberfläche der meisten anderen Implantate an einem unauffälligen Ort laminiert werden. Bei einigen anderen Implantaten kann der Transponder in eine Öffnung oder Inlay eingebracht und am Platz eingesiegelt werden.
- Da passive Transponder handelsüblich in einer zylindrischen Form in einer Größe von mindestens 2 mm Durchmesser und 11 mm Länge erhältlich sind, wird der Patient keinerlei Beschwerden oder gar die Gegenwart des Transponsers spüren. Der Transponder kann auch mit jedem geeigneten Codierschema codiert sein. Ein kommerziell erhältlicher Transponder ermöglicht zur Zeit die Speicherung von bis zu 64 binären Datenbits. Diese Datenkapazität kann die direkte Speicherung von vielen, falls nicht allen, erwünschten Informationen ermöglichen, die in einem Vorrichtungsregister eingetragen und gehalten werden sollen. Ferner ist zu erwarten, daß die Speicherkapazität der Transponder sich erhöht, wenn mit der Zeit eine Fortentwicklung stattfinden wird. Alternativ kann eine Zahl, eine Sammlung von Zahlen, eine Kombination von Zahlen und Buchstaben oder ein anderer indirekter Code gespeichert werden, der nach dem Ablesen dazu verwendet werden kann, um auf die Datenbank zuzugreifen, die selbst erwünschte Information beinhaltet. Selbstverständlich wird, falls die Information direkt im Implantat gespeichert ist, diese sofort bei Ablesen des Transponders verfügbar. Dieses schafft in Notsituationen leichten Zugang zur Information. Alternativ wird es in Anbetracht der weitverbreiteten Verfügbarkeit, Zugänglichkeit und Verwendung von Computern über Telekommunikationsnetzwerke mit Telefonleitungen nicht allgemein als ungünstig begrenzend betrachtet, vorzusehen, daß der vom Transponder abgelesene Code dann dazu verwendet wird, um auf eine geeignete Datenbank zuzugreifen, um die demographischen Daten des Patienten, den Herstellernamen, das Herstellungsdatum, den Namen des Chirurgen, das Datum der Implantation usw. zu erhalten.
- Ein dazugehöriges elektromagnetisches Handlesegerät ist auch kommerziell erhältlich, das ein magnetisches Niederfrequenzfeld emittiert, um den passiven Transponder zu aktivieren und ihn dazu zu veranlassen, seine codierten Daten an das Lesegerät zu übermitteln. Bei diesem speziellen kommerziellen Gerät muß keine Batterie oder irgend eine andere elektrische Energiequelle im passiven Transponder enthalten sein. Dies reduziert ferner die notwendige Größe des Transponders und macht diesen besonders geeignet für diese Anwendung.
- Während die Hauptvorteile und Merkmale der Erfindung oben beschrieben wurden, wird ein besseres und vollständigeres Verstehen der Erfindung durch Bezugnahme auf die Zeichnungen und auf die Beschreibung der bevorzugten Ausführungsform, die folgt, erhalten.

- Wie in Fig. 1 gezeigt, ist ein Brustimplantat 20 in eine weibliche Brust 22 implantiert und umfaßt eine Silikonhülle 24, die mit einem geeigneten Füllmaterial 26 aufgeblasen ist. An der hinteren Seite des Implantats 20 ist der Transponder 28 gezeigt, der zwischen benachbarten Schichten 30, 32 der Hülle 24 laminiert ist. Der Transponder 28 kann jeder passive Transponder, wie ein Trovan Model ID100, erhältlich von Electronic Identification Systems Ltd. of Santa Batbara, California, sein. Dieser spezielle Transponder ist dafür ausgelegt, unabhängig von der Umgebung zu sein und zum Betrieb geeignet zu sein, während er direkt in Flüssigkeiten eingetaucht ist. Ferner kann er sphärisch aus jeglicher Richtung durch die meisten Materialien abgelesen werden und umfaßt - was am wichtigsten ist - die Materialien, die Implantate für den menschlichen Körper aufweisen. Der Transponder kann direkt mit bis zu 64 binären Datenbits codiert werden, um fast eine Trillion möglicher unterschiedlicher Codekombinationen zu schaffen. Es wird angenommen, daß die FDA - Genehmigung für seinen Einsatz, wie sie Teil der offenbarten und beanspruchten Erfindung ist, bevorsteht.
- Ein Handlesegerät 34 ist ebenfalls in Fig. 1 gezeigt und kann ein Trovan Model LID500 oder ein anderes geeignetes Gerät sein. Sein Betriebsprinzip umfaßt die Emission eines magnetischen Feldes niederer Frequenz zur Aktivierung des passiven Transponders 28. Der Transponder 28 als solcher besitzt keine Energiequelle und erhält stattdessen die für seinen Betrieb notwendige Endergie vom magnetischen Feld, das durch das Lesegerät 34 generiert wird. Dies ermöglicht es, daß der Transponder 28 eine im Grunde genommen unbegrenzte Lebensdauer besitzt. Das Handlesegerät 34 ist in Verbindung mit einer Dekodersteuerung 36 gezeigt, die Zugriff auf eine Datenbank 38 entsprechend dem im Transponder 28 enthaltenen abgelesenen Code hat, um so Zugriff auf solche Daten zu haben, die entsprechend dem Transponder 28 gespeichert wurden. Alternierend kann wie oben erwähnt, das Handlesegerät 34 dazu verwendet werden, Zugriff auf den im Transponder 28 enthaltenen Code zu haben, wobei andere Mittel dazu verwendet werden, um eine Datenbank zum Herunterladen der erwünschten Informationen zu kontaktieren. Derartige Mittel können den Einsatz von Telefon und Modem, um ein Register in einem geographisch zentralen Ort abzufragen, umfassen.
- Wie in Fig. 2 gezeigt, kann der Transponder 28 zwischen benachbarten Schichten 40, 42 des Siegelfleckens laminiert sein, der üblicherweise dazu verwendet wird, die Mandrelöffnung 46 in einer Hülle 48 eines Brustimplantats 50 zu verschließen. Für andere Implantate können geeignete Befestigungsorte leicht bestimmt werden, wobei auf die Vermeidung von Belastungen des Patienten sowie auch die Optimierung der Ablesbarkeit des Transponders mit dem Handlesegerät entsprechend berücksichtigt werden muß.
- Wie in Fig. 3 gezeigt, kann ein Pektoralmuskelimplantat 52 in geeigneter Weise einen passiven Transponder 54 enthalten. Der passive Transponder 54 kann an seinem Ort eingeformt werden, oder es kann eine Öffnung oder ein Inlay zur Plazierung des Implantats vorgesehen werden, wobei die Implantatoberfläche danach endbearbeitet werden kann.
- Wie in den Fig. 4 und 5 gezeigt, kann ein weiches Kinnimplantat 56, oder ein hartes Kinnimplantat 58 ebenfalls einen darin befestigten passiven Transponder 60, 62 haben. Wie in Fig. 6 gezeigt, weist ein Brustwarzenimplantat 64 einen passiven Transponder 66, der intern befestigt ist, auf. In all diesen Transplantaten wird die Befestigung des passiven Transponders ausgeführt, um minimale Belastung oder Empfindungen bei Patienten zu erreichen, als auch, um Beeinträchtigungen des kosmetischen Aussehens des Implantats zu vermeiden. Wie in Fig. 7 gezeigt, kann ein otoplastisches Implantat 68 einen darin befestigten passiven Transponder 70 besitzen. Wie in Fig. 8 gezeigt kann ein Penisimplantat 72 einen darin befestigten passiven Transponder 74 aufweisen.
- Wie in Fig. 9 gezeigt, kann ein Schrittmacher 76 ebenfalls einen passiven Transponder 78, der entweder auf seiner Oberfläche, oder unterhalb dessen Metallschutzhülle befestigt ist, aufweisen. Die Erfinder haben gefunden, daß das Ablesen des passiven Transponders durch das Handlesegerät, sogar wenn der Transponder durch metallische Oberflächen verdeckt ist, durchgeführt werden kann. Wie in Fig. 10 gezeigt, kann ein Herzventil 80 einen passiven Transponder 82, der an seiner Kante befestigt ist, aufweisen, um Beeinträchtigungen seines Betriebs oder seiner Befestigung zu vermeiden.
- Wie in den Fig. 11 und 12 gezeigt, kann eine Gesamtkniegelenkprothese 84 oder eine Schulterprothese 86, deren meiste Teile aus Titan oder dergleichen hergestellt sind, ebenfalls in geeigneter Weise einen passiven Transponder 88, 90 tragen.
- Wie in Fig. 13 gezeigt, kann der passive Transponder 92 in einer Rinne 94 oder dergleichen aufgenommen sein und mit einem Dichtmittel 96 bedeckt werden, so daß die Oberfläche des Transponders 98 ununterbrochen glatt ist, wie bei vielen Transpondern erwünscht.
- Wie in den Fig. 14 und 15 gezeigt, kann ein Femurbefestigungsimplantat 100 oder ein orthopädisches Nagelsystem 102 in günstiger Weise einen passiven Transponder 104, 106 aufweisen, der darin eingelegt ist. Wie in Fig. 16 gezeigt ist, kann eine Fingergelenkprothese 108 ebenfalls einen passiven Transponder 110 aufweisen, der an einem Ort angeordnet ist, der nicht mit dem bewegbaren Gelenkteil 112 der Prothese 108 interferriert. Wie in den Fig. 17 und 18 gezeigt, kann ein craniomaxillofaciales Plattensystem 114 oder jedes andere Plattensystem 116 ebenfalls in geeigneter Weise passive Transponder 118, 120 umfassen. Als Alternative zur Inlayanbringung wie in Fig. 13 gezeigt, kann ein Loch 122 an jeden geeigneten Ort eines Implantats 124 gebohrt werden und der passive Transponder 126 dort eingesetzt werden und an dem Ort durch eine Dichteinrichtung 128 abgedichtet werden, wobei die äußere Oberfläche der Dichteinrichtung 128 endbearbeitet wird, um eine glatte Oberfläche auf dem Implantat 124 zu schaffen.
- Wie beschrieben, kann eine große Variation an Implantaten aus allen Materialarten in geeigneter Weise einen passiven Transponder aufweisen, der implantiert werden kann, und dann durch das Handlesegerät abgelesen werden kann. Diese Kompatibilität und Leichtigkeit des Betriebs ermöglicht den Einsatz eines passiven Transponders bei im Grunde genommen jeglichem Implantat. Die Erfinder haben hier representative Proben derartiger Implantate offenbart.
Claims (17)
1. Implantierbare Prothese (20), die zur Implantation in einen Menschen
eingerichtet ist, die einen Transponder (28), der mit einer einzigartigen
Kennmarke codiert ist, besitzt, wobei der Transponder so an der
Prothese so angebracht ist, daß dann, wenn die Prothese implantiert
ist, der Transponder implantiert ist, wodurch der Transponder (28)
leicht nach Implantation durch Ablesen der einzigartigen Kennmarke
identifiziert werden kann, dadurch gekennzeichnet, daß der
Transponder ferner Mittel aufweist, um durch eine entfernte
Leseeinrichtung (34) mit Energie versorgt zu werden, wodurch die
Notwendigkeit, daß eine Batterie im Transponder enthalten sein muß,
umgangen wird.
2. Prothese wie in Anspruch 1 beansprucht, wobei der Transponder
Mittel (34) zum Lesen der einzigartigen Kennmarke in nicht invasiver
Weise aufweist.
3. Prothese wie in Anspruch 2 beansprucht, wobei der Transponder
Mittel (34) zum elektromagnetischen Lesen der Kennmarke aufweist.
4. Prothese wie in irgendeinem der Ansprüche 1 bis 3 beansprucht,
wobei der Transponder (28) Mittel aufweist, daß er mit einer Zahl
ausgewählt aus einem Bereich von 0-64 binären Bit codiert werden
kann.
5. Prothese wie in irgendeinem der vorangehenden Ansprüche
beansprucht, wobei der Transponder (28) innerhalb des Profils der
Prothese angebracht ist.
6. Prothese wie in Anspruch 5 beansprucht, wobei der Transponder
(28) in einer Öffnung in der Prothese eingesiegelt ist.
7. Prothese wie in einem der vorangehenden Ansprüche beansprucht,
wobei die Prothese ein weiches Gewebeimplantat (56) ist.
8. Prothese wie in Anspruch 7 beansprucht, wobei die Prothese ein
Brustimplantat (50) mit einer Umhüllung (48) ist.
9. Prothese wie in Anspruch 8 beansprucht, wobei der Transponder
(28) am Implantat so befestigt wird, daß er zwischen Schichten (40,
42) der Hülle laminiert ist.
10. Prothese wie in Anspruch 9 beansprucht, wobei das Implantat ferner
einen Abdichtflecken (44) auf der Hülle aufweist, wobei der
Transponder (28) in den Abdichtflecken laminiert ist.
11. Prothese wie in irgend einem der Ansprüche 1 bis 6 beansprucht,
wobei die Prothese ein Knochenrekonstruktionsimplantat (58) ist.
12. Prothese wie in irgend einem der Ansprüche 1 bis 6 beansprucht,
wobei die Prothese ein Gelenk-Rekonstruktionsimplantat (100) ist.
13. Prothese wie in Anspruch 12 beansprucht, wobei die Prothese ein
Gelenkersatz (84) ist.
14. Prothese wie in irgend einem der Ansprüche 1 bis 13 beansprucht,
in Kombination mit einer Datenbank, wobei die einzigartige
Kennmarke des Transponders (28) zur Bestimmung entsprechender in
der Datenbank abgespeicherter Werte verwendet ist.
15. Prothese wie in Anspruch 14 beansprucht, die ferner eine Decoder-
Steuerung (36) in Verbindung mit dem Transponder (28) zum Zugriff
auf die entsprechenden in der Datenbank abgespeicherten Daten
aufweist.
16. Prothese wie in Anspruch 14 beansprucht, die ferner ein
Telefonmodem in Verbindung mit dem Transponder zum Zugriff auf die
entsprechenden in der Datenbank gespeicherten Daten aufweist.
17. Prothese wie in den Ansprüchen 1 bis 4 oder 14 beansprucht, wobei
die Prothese ein Brustimplantat (20) mit einer elastomeren Hülle (24),
einem mehrschichtigen, an die Hülle geklebter
Elastomehrabdichtflecken ist und wobei der Transponder (28)
zwischen die Schichten (40, 42) des Abdichtfleckens laminiert ist.
