das Gebrauchsmuster 1 828 874 teilweise nicht rechtsbeständig war, hat der 5. Senat
(Gebrauchsmuster-Beschwerdesenat) des Bundespatentgerichts auf die mündliche Verhandlung
vom 1. August 1968 durch die Senatsräte Schlitzberger Dipl.-Ing. Landgrebe und Dipl.-Ing.
Köhler beschlossen :
Auf die Boochiiorde der Antragstellerin wird der Beschluß
derGebraucbsmusterbtoilung 1 des Deutaehen Patentamts
vom 18. Oktober 1967 aufgehoben. Es wird festgestellte
u
daß das Gebrauchsmuster 1 828 874 im Umfang der Ansprüche 1
2 3s ? !. 9 10p 11 nicht zu Recht bestanden hat.
Die Beschwerde der Antrs'ssß ; egnerin gegen den genannten
Beschluß wird zurückgewiesen.

Gründe'

I.
Das am 2. Februar 1959 angemeldete am'30. März 1961 eingetra-
geneund am 2. Februa. r 196 infolge Ablaufs der (verlängerten)
Schutzdauer erloochene 1 828 874 der Antrags-
gegnorin,für das die rriorität der Erstanmeldunß in den Nieder-
landen vom 3. Februar H958 (Dir. 224 A, in Anspruch ssRommen
""art betrifft eine"Torricb.'s s Ausstreuen kSrnion cdcr
pulvrigen Materials". Dem branchsmuster Hosen die Ansprüche
1bis 3 und 19 bis 23 in öor Fassung vom 9. März 196 suie die
Ansprüche 4 bis 1 ! 8 in der Fassung vo 7. November 1960 ;
n G-runde.
Für das vorliegende Verfhen sind hiervon folgende SuLtsn-

nachunten erstrecken.
10. Vorrichtung nach Anspruch 9, dadurch kennssoichnct, daß
die sich nach unten erstreckenden Ansätze (50) wenigstens
nahezu in einem imaginären Kegelmantel liegen, dessen Mittel-
linie sich mit der zweiten Drehachse (45) des Wühlgliedes (53)
deckt.,
11. Vorrichtung nach einem der Ansprüche 7 bis 10, dadurch
gekennzeichnet, daß die Ansätze mittels eines wenigstens nahezu
konzentrisch um die Stange liegenden Ringes miteinander ver-
bunden sind.
Am 7. Februar 1966 hat die Antragstellerin beim Deutschen Patent-
amt beantrat festzustellen, daß die SßhutzLnsprüche 1, 2, 3,

pchwenkbare Anordnung des uhlgliodes und die Mittel zur Be-
festigung seiner Ansätse an der Stange.

der Behälterwand in Berührung kommen.
Die fransösisohe Patentschrift 967 775 und die zugehörige
Zusatzpatentsohrift 59 083 betreffen Zerstaubermaschinen für
fein verteia Schwefclpulvrjl das in einen Luttstrom als
Trägermittel eingeführt imd mit diesem dann sur Schädlines-
Abgesehenausgetragen wird. Abgesehen von der gattungsartigen
Verschiedenheitunterscheidet sich die bekannte Vorrichtung

auchhinsichtlich der Arbeitsweise uea Loskerungssliedcßjt das
infolge der ihm'erteilten Auf-und Abwärtebewoguns einon
Stampfoffektausübt,ohnesichdabei frei um 3600 drehen zu

Versprühen eines puderforsigen Insektenvertilgungsmittels
im Luftstrom betrifft. Das eigentliche als Gelenkßtab oder

weder um seine Achse frei drehbar noch exzentrisch an seiner
Antriebswellebefestigt.

Von den Düngerstreuern nach der deutschen Auslosesehrift
1 017 836 und den ihv im esentlichnn entsprechenden vorver-
öffentlichtcnUnterlagendesdeutschenGebrauchsmusters
1 756 924 unterscheidet eich der Gegenstand des Anspruchs 1
gmäßH&uptantragdurehdieAusbildung der Wühlgliodansätze,
die radial von der der abstehen und nicht auf einet
imaginären Kegelmantol'liegend bis in B'ähe der Behälterwand
nach unten zuführt sind.
BeidemDünger-undElkatrouer nachder deutschen Patent-
schrift 930 297 findet ein ühißlied Verwendung dao swar
unterschiedlich lane Ansätsc aufeist, das aber weder eine
Taumelbewegung auszuführen vermaß noch um 360 frei drehbar
ist.
Ob der danach neue Gegenstand des Streitgebrauchsiauaters fort-

schrittlich ist, nnn dahingestellt bleiben. Jedenfalls weist
er keilie ausreichenclc auf.
Ausgehend von dom als druclschiftliche Torveroffentlichung

festzustellen, daß bereits vor dem Tage der hier in Anspruch

Streuvorrichtungen für körnigos und pulvarförmiges Gut,, ins-
