Abstract

A container (20) stores a beverage and comprises a closure member (21) covering an access aperture (22). An internally-mounted fitting (24) defines the access aperture (22) and a cylindrical mounting (27) for an outer tubular member (28) which extends to a position adjacent the bottom of the container (20). An inner tubular member (32) is positioned coaxially within the outer tubular member (28) and is supported for telescopic movement when the access aperture (22) is unsealed by removing the closure member (21). A vent (34) is provided to permit communication between the access aperture (22) and the interior of the container (20).

1. A beverage container (20, 44) comprising a closure member (21, 39, 46, 50, 52, 53,
59) operable between a first position in which the beverage is sealed inside the
container and a second position in which an access aperture (22) is opened to allow
the beverage to be withdrawn from the beverage container (20, 44), a telescopically
extensible drinking straw (32) positioned within the beverage container (20, 44)
and supported within an outer tubular member (28) such that the uppermost end of
the drinking straw (32) can extend upwardly through the access aperture (22) when
the closure member (21, 39, 46, 50, 52, 53, 59) is operated to the second position, a
fitting (24, 57) sealed to the beverage container (20, 44), the fitting serving to
isolate the access aperture (22) from the interior of the beverage container (20, 44)
and to locate the lowermost end of the outer tubular member (28) adjacent the
bottom (29) of the beverage container (20, 44), and a vent (34) communicating
between the access aperture (22) and the interior of the beverage container (20, 44),
characterised in that the telescopically extensible drinking straw (32) is a
cylindrical tube (32), a sealing means -(33) is arranged operatively between the
outer tubular member (28) and the cylindrical tube (32) to permit the cylindrical
tube (32) to slide upwardly through the opened aperture (22) whilst remaining
sealed within the outer tubular member (28), and the vent (34) is positioned
between the access aperture (22) and the sealing means (33).
2. A beverage container, as in Claim 1, characterised in that the fitting (24, 57) has an
integral mounting (27) secured to the upper end of the outer tubular member (28).
3. A beverage container, as in Claim 2, characterised in that the integral mounting
(27) is secured inside the uppermost end of the outer tubular member (28) and also
26 serves as a guide for the cylindrical drinking straw (32), and the sealing means (33) is carried by the lower end of the cylindrical drinking straw (32).
4. A beverage container, as in Claim ϊ or 2, characterised in that the sealing means (33) is carried by the outer tubular member (28) at a position adjacent to the access aperture (22).
5. A beverage container, as in any preceding claim, characterised in that the access aperture (22) is positioned between the closure member (21,39) and the uppermost part of the fitting (24).
6. A beverage container, as in Claim 5, characterised in that the fitting (24, 57) is located within the aperture (22).
7. A beverage container, as in Claim 5 or 6, characterised in that the fitting (24, 57) is a push fit inside the aperture (22).
8. A beverage container, as in Claim 6 or 7, characterised in that the vent (34) is defined between the fitting and the aperture (22).
9. A beverage container, as in any of Claims 1 to 7, characterised in that the vent (34) is formed through the fitting (24).
10.A beverage container, as" in any of Claims 1 to 7, characterised in that the vent (34) is formed through the outer tubular member (28).
11. A beverage container, as in any of Claims 1 to 4, characterised in that the access aperture (22) is defined within the uppermost portion (45, 48, 57) of the fitting (24,
57).
12. A beverage container, as in Claim 11, characterised in that the uppermost portion
(45, 48, 57) of the fitting (24, 57) projects through an aperture in an upper wall of the beverage container, a seal (43,51) is arranged between the fitting (24, 57) and
27 the upper wall of the beverage container, and the closure member (39, 46, 50, 52,
53, 59) is carried by the uppermost portion (45, 48, 57) of the fitting (24, 57) outside the beverage container.
13. A beverage container, as in Claim 12, characterised in that the fitting (24, 57) has an integral lid (45), and the seal (43, 51) is arranged operatively between the lid
(45) and the upper wall of the beverage container.
14.A beverage container, as in Claim 13, characterised in that the lid (45) is secured to the beverage container by inter-engaging threads (37).
15. A beverage container, as in any of Claims 12 to 14, characterised in that the closure member (46, 53) is formed integral with the uppermost portion (45, 48, 57) which has a weakened zone permitting removal of the closure member (46, 53).
16. A beverage container, as in any of Claims 12 to 15, characterised in that the fitting
(24, 57) is secured to an internal wall (45) of the beverage container.
17. A beverage container, as in any of Claims 12 to 16, characterised in that the aperture in the upper wall (45) has a flared lip (54) which is directed into the beverage container and engages a cylindrical flange of the fitting (24).
18. A beverage container, as in any of Claims 12 to 16, characterised in that the fitting
(24) has an internal flange (24) bearing against the inside of the upper wall (45).
19. A beverage container, as in any of Claims 11 to 18, characterised in that the portion (48) does not project beyond the upper surface of the container wall (45) which carries the closure member (46).
20.A beverage container, as in any preceding claim, characterised in that the fitting
(24) is formed integral with the container wall (45)

21. A beverage container, as in Claim 20, characterised in that the vent is formed through the container wall (45) and the closure member (46) seals both the access aperture (22) and the vent (34).
22.A beverage container, as in any preceding claim, characterised in that the fitting (24) is adhered to the inside of the container.

A beverage container, as in any of Claims 11 to 22, characterised in that the uppermost portion of the fitting (57) is formed integral with the outer tubular member (28) and projects through a seam in the material forming the beverage container, and a closure member (59) is mounted on the uppermost portion of the fitting (57) to surround the access aperture (22).
24.A beverage container, as in any preceding claim, characterised in that a second closure member (21, 39, 46, 50, 52, 53, 59) is provided for opening a second access aperture (22) to allow beverage to be withdrawn through a second telescopically extensible drinking straw in the form of a second cylindrical tube (32) supported within a second outer tubular member (28), a second sealing means (33) is arranged operatively between the second outer tubular member (28) and the second cylindrical tube (32) to permit the second cylindrical tube (32) to slide upwardly through the opened second aperture (22) whilst remaining sealed within the second outer tubular member (28), and a second vent (34) is positioned between the second access aperture (22) and the second sealing means (33).

A beverage container, as in any preceding claim, characterised in that it encloses a carbonated beverage having a pressure greater than atmospheric pressure whereby removal of the closure member (21, 39, 46, 50, 52, 53) will apply the ambient pressure within the container to the effective area presented by the lowermost end
29 of the cylindrical tube (22), and this effective area is designed to be sufficient to extend the cylindrical tube (22) through the access aperture (22) when the closure member is opened.
26.A beverage container,as in Claim 25, characterised in that the sealing means (33) is carried by the cylindrical tube (32) to contribute to the effective area.
27. A beverage container, as in Claim 25 or 26, characterised in that the size of the vent (34) is selected, in relation to the effective area and the pressure within the closed container, to control the rate at which the cylindrical tube (32) will be extended when the closure member is opened.
28. A method of accessing a carbonated beverage within a sealed container (20, 44), characterised by opening an access aperture (22) communicating with a telescopically extensible drinking straw defined by a cylindrical tube (32) stored prior to use within the container, and using the release of internal pressure to extend the cylindrical tube (32) through the aperture (22).
29.A method, as in Claim 28, further characterised by opening a vent (34) to limit the pressure available for extending the cylindrical tube (32).
30. A drinking straw dispenser, for a beverage container (20, 44), having a telescopically extensible drinking straw (32) supported within an outer tubular member (28), and a fitting (24, 57) capable of being sealed to the beverage container to isolate the interior of the beverage container from an access aperture (22) to the drinking straw (32), the fitting (24, 57) being capable of locating the lowermost end of the outer tubular member (28) adjacent the bottom of the beverage container, and the dispenser defining a vent (34) capable of permitting communication between the access aperture (22) and the interior of the beverage
30 container, characterised in that the telescopically extensible drinking straw (32) is a
cylindrical tube (32), a sealing means (33) is arranged operatively between the
outer tubular member (28) and the cylindrical tube (32) to permit the cylindrical
tube (32) to slide axially whilst remaining sealed within the outer tubular member
(28), and the vent (34) is positioned so that it will not be blocked by the sealing
means (33).
31. A drinking straw dispenser, as in Claim 30, characterised in that the access
aperture is defined at least partially by the fitting (24, 27).
32. A drinking straw dispenser, as in Claim 30 or 31, characterised in that the fitting
(24, 57) is provided with a detachable closure member (21, 39, 46, 50, 52, 53 or
59) which will serve as a closure for the beverage container.
31 AMENDED SBiET (ARTICLE 19) Statement under Article 19(1)
New claims 1 to 27 are directed generically to "A beverage container" to traverse the objection to multiple inventions. New Claims 28 to 29 are directed to the method implicit in the operation of the claimed beverage container when containing a carbonated beverage. New Claims 30 to 32 are to the drinking straw dispenser as a separate sub-assembly that could be sold to beverage bottlers for incorporation into their beverage containers; these new claims are of commercial importance in those countries which do not recognise contributory infringement.
The pre-characterised clause of new Claims 1 and 30 are based on the closest known prior art.
New Claim 1 includes features of cancelled Claims 1 and 8.
New Claim 2 is similar to cancelled Claim 3.
New Claim 3 is similar to cancelled Claim 4.
New Claim 4 is similar to cancelled Claim 5.
New Claim 6 is similar to cancelled Claim 2.
New Claim 7 is similar to cancelled Claim 10.
New Claim 8 is similar to cancelled Claim 7.
New Claim 9 is similar to cancelled Claim 6.
New Claim 10 is similar to cancelled Claim 9.
New Claim 1 3 is similar to cancelled Claim 12.
The other new claims are based on features described in the specification and drawings.
The amended claims have no impact on the description or drawings although the Summary of the Invention will need to be brought into accord with the new claims.
