To all whomit may concern.-

Be it known that I, W. C. BARBER, of 'Van Wert,

inthe county of Polk, and State of Georgia, have in vented a new and improved water-Fence; and I do hereby declare that the following is a full, clear, and exact description thereof, vwhich will enable 'others skilled in the art to make and use the same, reference being had to the accompanying drawings, forming part of this specification, in which- Figure 1 is va side view of my improved felice, looking down-stream.

Figure 2 is a top view of the same.

My invention has for its object to furnish an i111- proved'fence for streams,`and other places exposed to high water and freshets, which shall be so constructed and arranged as to open and allow 'the water and driftwood to pass through, and which shall at the same time be strong, simple in construction, vand durable; and

It consists in the fence, constructed as hereinafter more fully described.

A are the rails or poles, which should be of such a length as to reach a little more than half way across the stream'. I

The outer ends of the poles or rails A are strung upon wires or rods B, the upper and lower ends of which are secured to posts, trees, or other suitable' supports.

' rlhe inner ends ofthe rods or rails A incline downstream, and are laid across each other in the manner of the angle or corner, of a worm-fence.

' With a fence thus constructed, lshould there occur a rise of water or freshet, the pressure of the vwater and the drift-Wood, or other drift that may be carried down by the Water, Will force the poles or rails apart,

and causethem to swing toward the banks, leaving the course of the stream unobstructed; When the water subsides, the rails or poles can easilybe laid up a am.

gIn this way, lands subject to be overiowed can be fenced, by placing suitable supports at suitable distances apart, and connecting a set of swinging poles or rails with each side of said supports, so as,.wh en the rails or poles are laid up, to form a continuous fence. L

Having thus described my invention,

I claim as new, and desire to secure byLettcrs Patentt An improved water-fence, formed by Stringingl the outer ends of the poles or rails A upon wires or rods B, supported at top and bot-tom with suitable snp-- ports, leaving the inner ends of said poles or rails A free to be laid crosswise upon each other, in the mannelof a worm-fence, substantially as herein shown and described, and for the purpose set forth.
