It is, of course, well known to provide vanity cases or other containers having some means, such as a recess or the like, to receive a lipstick holder when the lipstick is not in use. It is also well known toprovide a lipstick holder of the type which is generally cylindrical in shape and has two relatively rotatable parts which, when progressively rotated with respect to each other, cause the lipstick to be progressively protruded from the holder. My invention has tot do with such vanity cases or the like and with lipstick holders of the described type. It has been a principal object of the invention to provide a cosmetic case, such as` a vanity case, having new and improved means for supporting a lipstick holder of the described type and construction in inoperative position when not in use, and also including other means for engaging one end of the lipstick holder to support the same in a position ready for use and, at the same time, holding the engaged part of the holder from rotation so that the other part may be relatively rotated to cause the lipstick itself to move out from the holder into a position in which it may be used.

Other objects and features of novelty of the invention will appear from the description of the invention in the following speciiication and the accompanying drawings, in which:

A vanity case or like device, including the means provided by my invention -for holding a lipstick holder is disclosed in FIGS. l, 2 and 3 of the drawings and comprises a base part 2 and a cover part 4, these being connected by hinges 6. These parts may be of any size and shape in horizontal cross section and, in this embodiment of the invention, they are rectangular in shape. The base part 2 may, if desired, be divided into compartments 8 and -10 by a partition 12 and one of these compartments 10 is of suicient length to receive a lipstick holder 14, while the other compartment 8` may be used for any purpose and may, if desired, be lilled with powder. Obviously compartment 8 may be eliminated without affecting the invention in any way.

The lipstick holder 14 is of well-kno-wn type and Eonstruction and comprises an end part 16 and an elongated cylindrical part 18 which extends from the end part 16. The two parts 16, 18 are relatively rotatable with respect to each other and a lipstick is held within the two parts,

3,053,381 Patented Sept. 11, 1962 which are so constructed that when they are rotated relatively to each other, as by holding the cylindrical part 18 and rotating the end part 16, the lipstick will be progressively protruded from the open end of the cylindrical part 18 so that it may be used. The end part 16 of the lipstick container has a characteristic shape in cross-section which is preferably some shape other than smooth circular. In the embodiment of the invention disclosed in FIGS. 1 to 3 the end part 16 is of generally circular shape in cross section but is provided with alternate ridges and grooves for a purpose which lwill appear hereinafter.

Means are provided within the compartment 10 of the base part 2 for releasably holding the lipstick holder 14 in inoperative position in which it is recumbent in a position substantially parallel with the bottom 20 of the base part 2. In the embodiment disclosed in FIGS. l, 2 and 3 these means comprise a iirst holding member 30 which is disposed adjacent, but spaced inwardly from, the end wall 32 of the base part 2 which is removed from the partition 12. This holding member 30 comprises an upstanding part 34 which is parallel tothe end wall 32 and which has an opening 36 therein which is of such size and shape that -it 4will receive the end part 16 of the lipstick container 14. A second holding member is provided within the compartment 10 for engaging the end of the lipstick container which is remote from the end part 16 thereof. This second holding member comprises an L-shape part formed of spring strip metal, or other resilient material, the lower part 40 of which is connected to the bottom 20 of the case by a screw, rivet or the like and the second part 42 of which extends upwardly substantially at right angles to the bottom 20 and generally parallel to the end wall 2. This part 42 is spaced from the first holding member 311 by such a distance that when the end part 16 of a lipstick holder is placed within the opening 36 in the first holding member the other end of the lipstick holder will engage the upstanding member 42 of the second holding member, which will thereby be resiliently deformed away from the first holding part 30, thus resiliently and releasably holding the lipstick holder in position between the two holding members. It will be apparent that the lipstick holder may easily be removed from this recumbent or inoperative position by grasping the cylindrical part 18 of the holder and lifting the end held by the resilient member 42, after which the end 16 of the container may be removed from the opening 36 in the irst holding member 30.

Means are provided by the invention for holding one of the two relatively rotatable parts of the lipstick holder so that the other part may 'be rotated with respect thereto to cause the lipstick to be protruded from the holder, these means Ifor holding one end of the holder being so positioned -that when such one end is positioned therein the holder will be in an operative position from which it may be easily moved to apply the lipstick. In the embodiment of the invention disclosed in FIGS. l to 3 this means comprises a part 50 which is preferably formed integrally with the first upstanding holding member 30, both of such integrally formed parts being preferably made from a single piece of sheet metal. In this form of the invention the sheet metal forming the part 50 comprises a central, flat part which is connected in face-toface abutment with the upper surface of the bottom wall 20 adjacent the upstanding holding member 30. The edges of this part are turned upwardly and inwardly toward each other forming parts 52, 54 which overlie the central part in spaced relation thereto. The spaced facing edges of these upper parts are cut away as shown at 56, 58 in part-circular shape to provide a substantially circular `opening the edges of which are shaped to correspond to the shape of the end part 16 of the lipstick holder and therefore, in the embodiment o-f the invention being described, these edges are formed with alternate ridges and grooves having configurations complementary to those of the end part 16 of the lipstick holder, whereby that end part may Ibe received wi-thin the opening 60 defined by the part- circular edges 56, 58, whereby the end part 16 will be held from rotation by interengagement of the ridges and grooves on that end part with those formed in the edges defining the opening 60.

It will be seen that the lipstick holder may usually be carried within the base part 2 of the case in the recumbent position shown in FIG. l, in which its one end 16 is disposed within the opening 36 in the one holding member 30 and the other end thereof will be resiliently engaged and held by the upstanding part 42 of the second holding member. When it is desired to use the lipstick the holder may easily be removed from this recumbent position by lifting its one end away from member 42 and then withdrawing its other end 16 from the opening 36 in holding member 30. The end part 16 of the holder may then =be positioned within the opening 60 in the holding member Si) and in this position Ithe ridges and grooves on the end part 16 ywill interengage with those surrounding the opening 60, thereby preventing rotation of the end part 16 of the holder. In this position the holder will be upright, as shown in FIG. 3, and its cylindrical part 14 may easily be rotated with respect to the part 16 thereof which, as described, is held from rotation. Such rotation of the part 14 with respect to part 16 of the holder will cause the lipstick to be progressively protruded, as shown in FIG. 3.

In accordance with the invention the parts which hold the lipstick in recumbent position and the parts which hold one end thereof from rotation may be formed as integral parts of the case itself, such a construction being particularly desirable if the parts of the case are molded from a plastic material. Such an embodiment of the invention is disclosed in FIG. 4 of the drawings, and in this embodiment the member 60 which receives one end of the lipstick holder is cast integrally with end wall 2 of the lower member of the case and has an opening 52 in it to receive the one end of the lipstick holder when it is in its recumbent position. The member 64 which holds the other end of the lipstick holder in its recumbent position is a thin, upstanding wall member which is formed integrally with the bottom 20 and has resilience in a direction toward and away from the end wall 2. The socket for receiving, and holding from rotation, the one end part 16 of the lipstick holder is disposed substantially midway between the holding members 60 and 64 and is formed integrally with the bottom 20. This end-receiving socket comprises a circular wall 66 extending upwardly from the upper surface of the bottom ifi and having its inner surface formed to correspond in shape with that of the end part 16 of the lipstick container. It will, of course, be apparent that the socket member which receives the end part 216 of the container and holds the same from rotation to permit the lipstick to be protruded from its holder may be disposed in any position and angular relation with respect to the base part 2 and with respect to the other holding means therein, all Within the scope of the invention.

In a `further form which the invention may take the socket member which is -shaped to receive one end of the lipstick holder and hold the same from rotation, may be pivotally mounted with respect to the upper and lower parts of the vanity case. Such an embodiment is disclosed in FG. 5, lin which there is shown a vanity case having the upper and lower parts 70, 72 connected by hinge 74, and having a socket member 76 which is pivotally and rotatably mounted on an end wall of the upper or lower part of the case for movement with respect to the upper and lower parts of `the case. Any suitable means according to this invention may be employed for holding the lipstick holder in recum'bent position.

In certain embodiments of the invention it may be desirable lor necessary to provide some means within the socket which supports the lipstick holder in its raised or operative position for engaging the end part of the holder to hold the same more firmly. One form which such means may take is disclosed in FIGS. 6 and 7 and comprises a member formed of spring metal having arms S0, 32 extending at right angles to each other and lying in face to face engagement with the bottom wall 84 of the socket. The outer end of each of these arms is turned upwardly, as shown at 86, to form a plurality of upwardly extending resilient members forming an annular series of spring fingers for receiving and resiliently holding the lower end SS of a lipstick holder. As shown `in FIG. 6, the lower end 88 of the container may be formed without ridges and grooves or without any other non-circular shape and, in such cases, the spring fingers 8S will resiliently engage and hold the end part of the lipstick holder, permitting the upper cylindrical part thereof to be rotated rela-tively to the part within the socket and engaged by the spring fingers. However, the resilient fingers 86 may be disposed within a socket which is shaped to conform to the characteristic shape of the end part of the holder, in which case these resilient fingers provide additional means for holding the end part of the holder from rotation.

While I have described and illustrated several forms which my invention may take, it will be apparent to those skilled in the art that other embodiments, as well as modifications of those disclosed, may be made and practiced without departing in any way from the spirit or scope of the invention, for the limits of which reference must be made to the appended claims.

What is claimed is:

l. A cosmetic case comprising a base part having a bottom, a cover for the base part, and a generally cylindrical lipstick container disposed in said base part, said container being of the type having an end part and a generally cylindrical part extending longitudinally therefrom which two parts may be rotated relatively to each other to cause the lipstick to progressively protrude from the container, means in said base part releasably holding the lipstick container in one of two positions in said base part, said means comprising a first holding member extending upwardly generally at right angles to the bottom and having an opening therein, an end of the lipstick container being received and held in said opening to retain the same in a recumbent position, a second holding member which is generally parallel with said first member and is resilient in a direction toward and away from the first holding member whereby the container is held -with its one end in the opening in the first holding member and its other end resiliently engaged and held `by the second holding member, and a third holdinlg member Within said base part having a socket therein having means to receive said end part of the lipstick container and hold it from rotation while supporting the container in a vertical position to permit the two parts thereof to be rotated relatively to each other.

2. A cosmetic case comprising a base part having a bottom, a cover for the base part, and a generally cylindrical lipstick container disposed in said base part, said container being of the type having an end part and a generally cylindrical part extending longitudinally therefrom, which two parts may be rotated relatively to each other to cause the lipstick to progressively protrude from the container, means in said base part releasably holding the lipstick container in one of two positions in said base part, said means comprising two parallel upstanding members, one of said holding members having an opening therein, one end part of the container being received and held in said opening to retain the same in a recumbent position, the other of said holding members being resilient toward and away from the first holding member and being spaced therefrom by such a distance that when the one end part of the container is positioned within the opening in the first holding member the opposite end of the container is resiliently engaged by the second holding member, and a third container holding member mounted on said bottom and having an open socket therein having means to receive the end part of the container and hold the same from rotation While sup porting the container in an operative position to permit the cylindrical part thereof to be rotated relatively to the end part to cause the lipstick in the container -to be protruded.
