【発明の詳細な説明】
【０００１】
【産業上の利用分野】本発明は、所定のトライアル・ユ
ーセッジ（試行使用）特権の期限切れの後で自動的に期
限切れになるアプリケーション及びコンポーネントのト
ライアル・バージョンの分散を含んでいる、ライセンス
されたアプリケーション・プログラム及びアプリケーシ
ョン・プログラム・コンポーネントの分散を管理するシ
ステム及び方法に関する。
【０００２】
【従来の技術】この文書の目的に対して、用語“アプリ
ケーション・プログラム”は、アプレット(applets) 及
び他のアプリケーション・プログラム・コンポーネント
を含むべく画定される。コンポーネントは、不完全なプ
ログラム・フラグメントである。ユーザは、以下に説明
する、本発明のアプリケーション・ビルダー(Applicati
on Builder) のような、適切なツールを用いて新しいア
プリケーションの中にアプリケーション・プログラム・
コンポーネントを統合することができる。アプリケーシ
ョン・プログラム及び他の型のコンピュータ・ソフトウ
ェアを分散するための多数の異なる“トライ−アンド−

【発明が解決しようとする課題】過去のソフトウェア・
セキュリティ・システムは、パスワードを知ることまた
はプログラムの使用を可能にする物理的トークンを持つ
ことをエンド・ユーザに要求すること、を含んでいる、
多数のコピー保護スキームを用いてプログラム複写を防
止することを試みが、そのようなコピー保護システム
は、既存のトライ−アンド−バイ・ソフトウェア配布シ
ステムにおいて一般的に用いられていない。問題は、ワ
イヤまたは他の通信チャネルにわたりユーザに送られた
プログラム・ファイルが本質的にコピー可能なので、プ
ログラムが分散型コンピュータ・システムにわたり分散
されるときに特にアキュートである（激しい）。本発明

プログラムのオーナーに、それらのプログラムの試行使
用(trial use) を要求したパーティーについて信頼性の
ある情報を与えることである。本発明の別の目的は、可
能な限り容易にプログラムのトライアル・バージョンを
使用するように可能な限り自動的に限定された使用権利

する権利）の取得を行うことである。本発明のシステム
及び方法の別の目的は、ユーザがファイルをアクセスす
る権利を現在与えられているときだけにユーザに対する

能なバージョンがユーザに利用可能である間の期間及び
記憶位置を制限するシステム及び方法を提供することで
ある。本発明のシステム及び方法の別の目的は、実行が
ユーザに試みられるときにアプリケーション・プログラ
ムを実行する権利をユーザが与えられるときだけにユー
ザに対するアプリケーション・プログラムの実行可能な
バージョンの生成を制限することである。

【課題を解決するための手段】本発明の上記目的は、分
散型コンピュータ・システムにおいてユーザによるアプ
リケーション・プログラムの使用を管理する方法であ
り、アプリケーション・プログラムは、分散型コンピュ
ータ・システムに結合されたサーバ上にアプリケーショ
ン・プログラムの記憶バージョンとして最初に記憶され
る、方法であって、アプリケーション・プログラムをア
クセスするためのユーザ要求を認識し、所定のアクセス
条件が満足されるか否かを決定し、アクセス条件が満足
されたときにだけ受け取り及び記憶のためにユーザに関
連付けられたコンピュータにアプリケーション・プログ
ラムの送信バージョンを送信し、ユーザが受け取ったア
プリケーション・プログラムを実行する権利を現在有す
ることをプログラムの実行の前に検証し、かつ検証が肯
定的であれば送信バージョンからアプリケーション・プ
ログラムの実行可能バージョンを生成する段階を具備す
る方法によって達成される。
【０００７】本発明の方法では、所定の条件は、検証及
び生成段階を実行するアプリケーション・ビルダー・モ
ジュールに対する有効ライセンスの所有権を含むように
してもよい。本発明の方法では、決定する段階は、ユー
ザに所定のしかしまだ満足されないアクセス条件を満足
しかつ受け入れるための機会を供給し、かつユーザによ
りアクセス条件の明示的受け入れを認識する段階を具備
するようにしてもよい。本発明の方法では、アプリケー
ション・プログラムに対するトライアル・ライセンスを
受け入れるための機会を供給することを含むようにして
もよい。本発明の方法では、アプリケーション・プログ

ログラムのバージョンとを生成し、アクセス条件が満足
されるときにだけ送信バージョンを生成するためにコン

記憶のためにユーザに関連付けられたクライアント・コ

プログラムを実行する権限を現在有していることをクラ
イアント・コンピュータによるアプリケーション・プロ
グラムの実行の前に確認するライセンシ・ベリファイ

センス・ベリファイヤが、クライアント・コンピュータ

ステムは、クライアント・コンピュータに設置されかつ

テムに結合されたサーバ上に最初に記憶されたアプリケ
ーション・プログラムのユーセッジ（使用）を管理する
本発明の方法及びシステムは、アプリケーション・プロ
グラムをアクセスするためのユーザ要求を認識するこ
と、所定のアクセス条件が満足されるか否かを決定する
こと、アクセス条件が満足されたときだけに受け取り及
び記憶の要求を行うユーザに関連付けられたコンピュー
タへアプリケーション・プログラムのバージョンを送信
すること、更にユーザがその受け取ったアプリケーショ

【００２０】フォーマットにおける相違は、ヘッダ・レ
コードに含まれる情報のようなアプリケーション・プロ
グラム及びユーザ（適用可能であるところでは）に関連
付けられ、かつ実行可能プログラム及び他のフィールド
の暗号化されたまたは復号された条件（状態）に関連付
けられた補助的ファイル情報(ancillary file informat
ion)の存在及び内容に一般的に関係する。これらのフォ
ーマットのそれぞれは、図３〜図６に関して以下に詳述
される。この文書の目的に対して、用語“復号”(decod
e)及び“暗号解読”(decrypt)は、一組の情報の暗号化
を逆にする処理を参照すべく同意語的に用いられる。同
様に、形容詞“復号化された”(decoded) 及び“暗号解
読された”(decrypted)は、暗号化された情報の対応す
るセットから生成された一組の非暗号化された情報(une
ncrypted information) を参照すべく同意語的に用いら
れる。
【００２１】図３を参照すると、アプリケーション・プ
ログラム・トライアル・バージョン１３８のサーバ・フ
ォーマット１８０の概略図が示されている。サーバ・フ
ォーマットは、非暗号化されたアプリケーション・プロ
グラム１８１を含み、かつアプリケーションＩＤ１８
３、ライセンス・ターミネーション・デート１８５、及
びライセンシーＩＤ１８４に対する情報フィールドをオ
プション的に含みうる。これらのファイルは、特定のユ
ーザによる選択の前なので、オプショナルであり、ファ
イルが全てのポテンシャル・ユーザに対して汎用的であ
りかつそのような情報（アプリケーションＩＤを除く）
は、アプリケーション・プログラム・ファイルに対して
適用可能でない。特定化されたサーバ・フォーマット
は、アプリケーションＩＤ １８３、ライセンス・ター
ミネーション・デート１８５、及びライセンシーＩＤ
１８４フィールドのそれぞれを含みかつ、汎用サーバ・
フォーマットが要求しているユーザに特定化されかつク
ライアント・コンピュータへの送信の前に送信フォーマ
ットを生成すべく暗号化されるときに、サーバ上の実際
のファイルとして生成されかつ記憶されうるかまたは一
時的にだけ存在しうる。アプリケーション・プログラム
のサーバ・フォーマットされたバージョンは、暗号化さ
れたフォームに記憶されうるが、暗号解読に続く暗号化
は、クライアント・コンピュータ・アプリケーション・
ビルダ１１２に関連付けられたパブリック・キーでアプ
リケーション・プログラムを暗号化することを要求され
るということに注目する。
【００２２】また、好ましい実施例におけるアプリケー
ション・プログラムのサーバ・フォーマットは、（クラ
イアント・コンピュータによって用いられるべき）サー
バのパブリック・キー１８７のコピー、アプリケーショ
ン・プログラムに対する文書（ドキュメンテーション）
１８８、並びにアプリケーション・プログラム及びリラ
イセンシング・ターム(relicensing terms) に対するト
ライアル・ライセンシング・タームを表しているテキス
ト１８９を含む。一度ユーザがトライアル・ユーズ（試
行使用）に対するアプリケーション・プログラムを選択
したならば、ユーザは、アプリケーション・ビルダーの
ライセンスされたバージョンに関連付けられる。このア
プリケーション・ビルダー・ライセンスは、予め存在し
うるかまたはアプリケーション・プログラムのトライア
ル・バージョンの選択及びダウンローディングに関して
ユーザに割り当てられうる。いずれの情況でも、アプリ
ケーション・ビルダーは、ユーザにライセンスされかつ
ライセンシー識別子（アイデンティファイアー）は、そ
のユーザに関連付けられる。サーバ１０４は、同じアプ
リケーション・プログラムの送信フォーマットを生成す
るためにユーザに関連付けられたパブリック・キー１１
３に基づいてサーバ・フォーマット１８０に記憶される
アプリケーション・プログラムを暗号化する暗号化モジ
ュール(Encryption Module) １３５を含む。
【００２３】図４を参照すると、アプリケーション・プ
ログラム・トライアル・バージョン１３８の送信フォー
マット(Transmission Format) １８６の概略図が示され
ている。送信フォーマットは、アプリケーション・プロ
グラム実行可能コード１８１の暗号化されたバージョ
ン、アプリケーション・プログラムＩＤ １８３、特定
のユーザに対する適切なライセンシーＩＤ １８４、ラ
イセンス・ターミネーション・デート１８５、並びにパ
ブリック・キー、文書及びライセンス情報フィールドの
のコピー１８７、１８８、１８９を含む。好ましい実施
例では、送信フォーマット１８６の全てのフィールド
は、アプリケーション・プログラム及び／又は制御情報
の盗聴及び無許可複写または変更を防ぐべくユーザのア
プリケーション・ビルダー・パブリック・キー１１３で
暗号化される。
【００２４】更に、好ましい実施例では、制御情報（即
ち、ヘッダ・フィールド１８３〜１８５）は、ユーザの
アプリケーション・ビルダー・パブリック・キーでのフ
ァイル１８６全体の暗号化の前にサーバのプライベート
・キーでまず暗号化される。この方法で二重暗号化は、
制御情報を保護するために用いられる。より一般的、ア
プリケーション・プログラムそれ自身のいずれも、かつ
ヘッダ・フィールド１８３、１８４、１８５のいずれ
も、ネットワーク１０６にわたるサーバ１０４からクラ
イアント・コンピュータ１０２への送信の間にクリア・
テキストとして現れないということが望ましい。用語
“ヘッダ”フィールドまたは情報がこの説明における識
別情報フィールドに印加され、かつそのような情報フィ
ールドがファイルにおける複数の連続的レコード（例え
ば、図３、４、及び６）として簡略化のために示される
と同時に、識別情報は、アプリケーション・ビルダー１
１２がアプリケーション・プログラムの実行の前の検証
及び復号手順の間中に情報を位置決めしかつインタープ
リトすることができる限りアプリケーション・プログラ
ム・ファイルの所定の位置に配置されうるということが
理解されるべきである。例えば、図５は、ライセンスＩ
Ｄ １８４、及びライセンス・ターミナル・デート１８
５が、部分Ａ、Ｂ、及びＣに分割される、アプリケーシ
ョン・プログラム１の本体内に位置決めされるような送
信フォーマットのバージョンを示しているブロック図で
ある。アプリケーション・プログラムの本体内のそのよ
うな識別及び保護情報の混合は、説明したフォーマット
の全てに対して一般に適用可能である。アプリケーショ
ン・プログラムそれ自身内の識別情報の配置は、アプリ
ケーションの許可されたユーザでさえも、ライセンシー
ＩＤ及びライセンス・ターミネーション・デートを含ん
でいる、識別情報を位置決めしかつ変更することを非常
に困難にすることによって保護を向上する。
【００２５】個別の図に示されていない、アプリケーシ
ョン・プログラム・トライアル・バージョンのクライア
ント・ストレージ・フォーマットは、ファイルの前方に
“予めぶらさがった”(pre-pended)制御情報（ヘッダ・
フィールド１８３〜１８５）の暗号解読されたコピーを
有する、送信フォーマット(Transmission Format) １８
６と同じである。暗号解読された制御情報は、それがユ
ーザによる操作(manipulation)の対象であるが、それよ
りも実行時間において暗号化された制御情報と比較され
るので、アプリケーション・ビルダーによって“信用さ
れて”(trusted) いない。代替実施例では、クライアン
ト・ストレージ・フォーマットは、送信フォーマット(T
ransmission Format) と同じであり、かつ制御情報は、
クリア・テキスト・フォームで記憶されない。
【００２６】図６を参照すると、アプリケーション・プ
ログラム・トライアル・バージョン１３８の実行フォー
マット(Execution Format)１９６の概略図が示されてい
る。実行フォーマット１９６は、アプリケーション・プ
ログラムの暗号解読されかつ復号されたバージョンを含
む。それは、アプリケーション識別子１８３、ライセン
シー識別子１８４、またはライセンシー・ターミネーシ
ョン・デート１８５を必ずしも含む必要はない。そのよ
うな情報は、ファイルに一緒に運ばれうるけれども、そ
れは、実行可能コードを表さないしかつ検証及び復号の
後で更なる保護目的の役に立たない。好ましい実施例で
は、実行可能コードは、クライアント・コンピュータの
ＲＡＭ１１８またはＣＰＵ１０７におけるアプリケーシ
ョン・プログラムの実行の間に一時的に利用可能なだけ

ログラムを復号した後でクライアント・コンピュータ１

【００２７】図７を参照すると、一つ以上のトライアル
・アプリケーション・プログラムがクライアント・コン
ピュータ１０２にダウンロードされかつそれに記憶され
た後、そのクライアント・コンピュータに関連付けられ
たユーザは、アプリケーション・プログラムの一つを実
行することを決定しうる。本発明の一実施例では、ユー
ザは、利用可能なアプリケーション・プログラムのリス
ト１９３を含んでいる、ユーザ・インターフェイス１０
８の表示画面上のメニュー１９２が与えられる。次いで
ユーザは、アプリケーション・プログラム、例えば、ア
プリケーション２を選択しうる。クライアント・コンピ
ュータは、選択したアプリケーション・プログラム(Sel
ected Application)１９４の期間満了日(Expiration Da

ン・プログラムの文書フィールド１８８に見出される。
ライセンス・ターム及びリライセンシング情報（フィー
ルド１８９から）のような、他の情報をビューするため
の更なるメニューもまた供給されうる。これらのディス
プレイは、局所的に記憶され、完全にライセンスされた
プログラムに対する同様なディスプレイにアプリケーシ
ョン・ビルダーによって統合されうる。
【００２８】図８を参照する、分散型コンピュータ・シ
ステム１００のユーザによりアプリケーション・プログ
ラムの使用を管理するための本発明の方法３００の実施
例が示されている。アプリケーション・プログラムは、
サーバ１０４上にアプリケーション・プログラムのサー
バ・フォーマット・バージョン１８０として初めに記憶
される。実行は、アプリケーション・プログラムのトラ
イアル・バージョンに対するユーザの要求に応じてステ
ップ３０２で開始する。ステップ３０４では、サーバ１
０４は、サーバ・コンピュータに接続されたクライアン
ト・コンピュータからの情報及びプログラム・アクセス
に対する要求を監視する。アプリケーション・ビルダー
１１２は、クライアント・コンピュータ１０２による要
求に応じてサーバとの通信を起動（開始）することによ
ってサーバに対するエージェントとして作動しうる。ス
テップ３０６で、サーバ１０４は、アプリケーション・
プログラムのトライアル・バージョンをアクセスするた
めにクライアント・コンピュータ１０２の一つに関連付
けられたユーザからの要求を認識する。
【００２９】ダウンローディングに対してアプリケーシ
ョン・プログラム（またはアプリケーション・ビルダ
ー）を選択することにより、ユーザは、要求したプログ
ラムがライセンス同意の条件下でのみトライラル・ユー
ズ（試行使用）のためにユーザに利用可能になるリマイ
ンダーをオプション的に与えられる。ライセンス同意の
タームは、次いで、表示画面上にユーザのビューのため
に表示され、かつユーザは、ライセンス・タームを受け
入れるべく（可能的にサーバに対するエージェントとし
て作動しているアプリケーション・ビルダー１１２を通
して）サーバによって促される。本発明の一実施例で
は、ライセンスの受け入れは、選択したアプリケーショ
ン・プログラムがダウンロードされる前にユーザによる
肯定的動作(affirmative action)によって明示的に行わ
れるのが好ましい。例えば、ユーザは、識別名(identif
ying name)を入力すること、またはサーバへの送信のた
めにサーバによって与えられた、例えばユーザのライセ
ンシーＩＤのような検証コードをリタイプすることを要
求されうる。代替的に、受け入れは、ユーザがライセン
ス・タームを受け入れることを断わらない限り、ライセ
ンは、受け入れられかつダウンローディング・コメンス
をファイルするように、さらに受動的でありうる。
【００３０】ステップ３０８では、サーバは、アプリケ
ーション・プログラムに対する所定のプログラム・アク
セス制限をクライアント・コンピュータ特権と比較し、
かつ所定のアクセス条件が要求しているクライアント・
コンピュータによって満足されるか否かを決定する。ス
テップ３１０では、サーバは、クライアント特権がアプ
リケーション・プログラム・アクセス要求事項を満足す
るか否かを決定する。好ましい実施例におけるアクセス
要求事項は、（Ａ）ユーザまたは関連クライアント・コ
ンピュータによるアプリケーション・ビルダーに対する
有効ライセンスの所有権、（Ｂ）ユーザのアプリケーシ
ョン・ビルダーからのユーザのアプリケーション・ビル
ダー・パブリック暗号化キーの受け取り、及び（Ｃ）選
択したアプリケーション・プログラムのトライアル・バ
ージョンに対するライセンシング・タームの明示的ユー
ザ受け入れ、である。ユーザからの情報は、ユーザ及び
用いられているコンピュータ・プラットフォームの型を
一般に識別する。ユーザについてのこの情報は、要求し
たアプリケーション・プログラムの所有者へ自動的に供
給することができ、それによりこのプログラムのトライ
アル・ユーズ（試行使用）を要求したパーティーについ
て信頼性のある情報を所有者に供給する。
【００３１】ステップ３１２では、アクセス条件が満足
されないならば、ユーザ選択アプリケーション・プログ
ラムのトライアル・バージョンへのアクセスが否定され
る（アクセス制限が満足されるまで少なくとも一時的
に）。しかしながら、アクセス条件が満足されるならば
（ステップ３１４）サーバ１０４は、サーバ上のサーバ
・フォーマット(Server Format) バージョンからのユー
ザ選択アプリケーション・プログラムの送信バージョン
(Transmission Version)を生成し、次いでクライアント

の全てまたはかなりの部分は、アプリケーション・プロ
グラムの送信フォーマット・バージョンで暗号化され
る。好ましい実施例えは、アプリケーション・プログラ

実行及び使用のためにクライアント・ストレージ・フォ
ーマットでメモリ１０９に記憶されるのが好ましい。ア
プリケーション・プログラムは、いまクライアント・コ
ンピュータ上に常駐する。ユーザがプログラムをすぐに
実行することを選択しうると同時に、ユーザは、また、
最初にまたは将来の日においてさらなる時に、プログラ

シーＩＤと比較しかつアプリケーション・プログラムの
ライセンス期間満了日１８５を現在の日付と比較する。
ユーザの状態が確認されたときにだけアプリケーション
・ビルダー１１２は、実行のためにそれを準備するよう
に暗号化されたアプリケーション・プログラムを暗号解
読する。暗号解読されたアプリケーション・プログラム
は、クライアント・コンピュータの不揮発性メモリにけ
っして記憶されず、かつ実際のプログラム実行の間に暗
号解読されたフォームでのみ存在するのが好ましく。
【００３３】アプリケーション・プログラムで符号化さ
れたライセンス期間満了日をアンビエント(ambient) コ
ンピュータ・システム・デートと比較することによって
供給された保護は、ある場合にはクライアント・コンピ
ュータ・アンビエント・デートを変更することによって
回避されうるということが認識される；しかしながら、
そのような変更は、ユーザがそのような測度または測定
(measures)を用いる傾向がないユーザのコンピュータに
おけるシステム・オペレーション及びファイル管理の中
に十分な他の問題を一般に導入する。セキュリティ測度
は、実際のデートがクライアント・コンピュータ、等に
対して設定されたアンビエント・デートを越えるかどう
かを決定するためにクライアント・コンピュータ上の他
のファイルに対するファイル生成デートを検査すること
のような、他のデート検査手順を更に含みうる。

い実施例のより詳細な説明がここに供給される。ユーザ
は、アプリケーション・ビルダー１１２をクライアント
・コンピュータ１０２上に設置する（ステップ４０
２）。アプリケーション・ビルダー１１２は、（サン・
マイクロシステムズ，インコーポレーティッドのよう
な）ソフトウェア・ベンダーによって供給されるかまた
は分散型コンピュータ・システムにわたりサーバ上のプ
ロバイダによって利用可能になるアプリケーション・プ
ログラムに関連するプログラム・モジュールである。ア
プリケーション・ビルダーは、種々のセキュリティ検査
機能及びプログラム暗号解読機能を実行することによっ
てアプリケーション・プログラム・プロバイダに対する
ローカル・エージェントとして作動する。アプリケーシ
ョン・ビルダー１１２は、クライアント・コンピュータ
上への設置後に暗号化キーを構築する（ステップ４０
４）。好ましい実施例では、ＲＳＡプライベート／パブ
リック・キー・ペアが生成される；しかしながら、他の
型の暗号化キーがインプリメントされうる。

用いるような、ユーザがトライ−アンド−バイ・ユーセ
ッジ・スキーム下で試用することに興味があるアプリケ
ーション・プログラムを識別する（ステップ４０６）。
そのようなウェブ・ブラウザを用いてアクセスされる例
示的ウェブ・ページは、図２に示されておりかつ上述さ
れた。ユーザは、ユーザがサブメニュー１６９のパレッ
トにおけるアプリケーション・プログラム名上でマウス
をクリックするような試用を行うことを欲するプログラ
ムを位置決めする。また、ユーザは、メニュー・アイテ
ム１６６を選択することによって適用可能なライセンシ
ング・ターム及び条件上の、メニュー・アイテム１６８
の一つを選択することによって利用可能なアプリケーシ
ョン・プログラム上の、メニュー・アイテム１６５を選
択することによってトライ−アンド−バイ・プログラム
に関係している、ダウンローディングに対してアプリケ
ーション・プログラム、またはアプリケーション・ビル
ダーを選択する前に、一般的な情報を要求しうるか、ま
たはメニュー・アイテム１６７を選択することによって
アプリケーション・ビルダー上の一般的な情報を要求し
うる。
【００３６】トライアル・ユーズに対するアプリケーシ
ョン・プログラムの識別は、分散型コンピュータ・シス
テムのトライ−アンド−バイ・サーバ１０４からトライ
アル・ライセンスを要求するための手順を始動する（ス
テップ４０８）。好ましい実施例では、アプリケーショ
ン・ビルダー１１２は、選択したトライ−アンド−バイ
・アプリケーション・プログラムに対するトライアル・
ライセンスを要求することにおけるユーザのエージェン
トとしてかつトライアル・アプリケーション及びライセ
ンスを供給することにおけるサーバのエージェントとし
て作動する。これは、クライアント・コンピュータがア
プリケーション・ビルダーの有効ライセンス・コピーま
たは有効トライアル・コピーを有することを確認する
（ステップ４１２）、サーバにおけるトライアル・ライ
センス・アプリケーション・プログラム・モジュール(T
rial License Application Program Module)（ＴＬＡＰ
Ｍ）１３４を起動する（ステップ４１０）。
【００３７】ユーザに関連付けられたクライアント・コ
ンピュータ１０２は、アプリケーション・ビルダーの有
効的にランセンスされたコピーまたはトライアル・コピ
ーを有さないならば、クライアントは、ライセンシング
・タームをリビューしかつアプリケーション・ビルダー
のトライアル・コピーが生成されかつユーザに供給され
る前に与えられたタームに同意することを促される（ス
テップ４１４）。ユーザによるライセンス・タームの受
け入れは、トライアル・ライセンスに対する要求を行う
ことにおいて暗示的でありうるか、または好ましい実施
例ではユーザは、アプリケーション・プログラム（及び
／又はアプリケーション・ビルダー）が、ライセンス・
タームが与えられた後、及びトライ−アンド−バイ・プ
ログラムがユーザのコンピュータに送られる前に、例え
ば受入れ問合わせ（受入れ照会）に対して肯定的応答を

効ランセンス・コピーまたは有効トライアル・コピーを
有するということを確認したならば、それは、ユーザの
アプリケーション・ビルダー・パブリック・キーを要求

な、トライアル・ライセンス期間満了条件を指定するヘ
ッダをオプション的に含む。トライアル・ライセンス期
間満了日は、ハード・ユーズ・デート制限を課しうる
か、またはソフト・ユーズ制限を課しうる。ハード及び

【００３９】クライアント・コンピュータは、トライア
ル・アプリケーション・プログラムの暗号化された送信
フォーマット・バージョンを受け取りかつユーザに関連
付けられたコンピュータ上に局所的にそれを記憶する
（ステップ４２０）。暗号化された送信フォーマット・
バージョンは、クライアント・コンピュータ上に暗号化
されたフォームで記憶されかつ、アプリケーションがク
ライアント・コンピュータによる実行のために装填され
るときにだけ復号されたバージョンを生成すべく暗号解
読される。トライアル・アプリケーション・プログラム
１１７は、サーバからだけ受け取ることができかつクラ
イアント・コンピュータ上のアプリケーション・ビルダ
ー１１２の実行に関してクライアント・コンピュータ上
に記憶することができる。一度アプリケーション・プロ
グラムが局所的に記憶されたならば、クライアント・コ
ンピュータは、ユーザの要求で、トライアル・アプリケ
ーション・プログラムの実行を開始することができる
（ステップ４２６）。次いでアプリケーション・ビルダ
ーは、特定のクライアント・コンピュータがその特定プ
ログラムに対する有効ライセンスを有しかつトライアル
・アプリケーション・プログラムに対するライセンスが
期間満了していないということを確認する。
【００４０】本発明の一実施例では、この検証は、アプ
リケーション・ビルダーによりアプリケーション・プロ
グラム・ファイルを読取ること（ステップ４２８）、そ
してファイルのライセンシーＩＤ １８４を、クライア
ント・コンピュータにライセンスされるアプリケーショ
ン・ビルダーに関連付けられたクライエントＩＤ（また
はクライエントＩＤｓのリスト）と比較すること（ステ
ップ４３０）を含む。また、それは、ライセンス・ター
ミネーション・デート(License Termination Date)１８
５を現在の日付（即ち、コンピュータのアンビエント・
デート）と比較すること及びターミネーション・デート
１８５がクライアント・コンピュータ上に記憶されるア
ンビエント・デートよりも遅いということを確認するこ
とを含む（ステップ４３２）。クライアントＩＤの明示
調査は、有効的にライセンスされたアプリケーション・
ビルダー１１２の存在が無許可の使用を防ぐために十分
なセキュリティでありうるので常には必要ではないであ
ろう。クライアントＩＤは、クライアント・コンピュー
タにランセンスされたアプリケーション・ビルダー１１

ョン・ビルダー・ライセンスの所持（所有）は、アプリ
ケーション・プログラム・プロバイダとクライアント・
コンピュータに関連付けられたユーザとの間に十分な信
用を確立しうる。
【００４１】アプリケーション・ビルダーがライセンス
の検証を終了したとき、それは、プログラムがクライア
ント・コンピュータＣＰＵにおける実行に対して装填さ
れうるようにアプリケーション・ビルダーのプライベー
ト・キーを用いてトライアル・アプリケーション・プロ
グラムを暗号解読する（ステップ４３４）。上述したよ
うに、記憶され、二重に暗号化された制御情報は、アプ
リケーション・ビルダーのプライベート・キー１１３及
びサーバのパブリック・キー１８７を用いて暗号解読さ
れ、そして暗号解読された制御情報は、ユーザがトライ
アル・アプリケーション・プログラムを実行する権利を
有することを確認するために用いられる。好ましい実施
例では、トライアル・アプリケーション・プログラム１
１７は、アプリケーション・ビルダーがライセンス（ク
ライアントＩＤがライセンシーＩＤと一致しかつターミ
ネーション・デートがパスされていない）の検証に対し
てかつ実行可能コードの中にアプリケーションのトライ
アル・バージョンを暗号解読するために必要であるの
で、アプリケーション・ビルダー１１２を走らせると同
時にランチ（着手）されなければならないということが
分かるであろう。全ての制御情報は、制御情報の暗号化
されたコピーに対してアプリケーション・ビルダーによ
って確認され、かつミスマッチ（不一致）が存在するな
らば検証は失敗する。更に、アプリケーション・プログ
ラムのトライアル・バージョンは、所定の確信有効基準
に従ってアプリケーション・ビルダーのリリース（解放
・割り当て解除）番号の有効性をチェックすることのよ
うな、更なる検証段階を含みうる。
【００４２】この方法で、アプリケーション・プログラ
ムが人間読取り可能フォームに存在する間の時間は、
（アプリケーション・プログラムの実行の間に）時間に
おいて及び（プロセッサ・メモリにおける）記憶位置に
おいて制限される。非暗号化されたプログラム・コード
の時間及び物理的位置を制限することは、非暗号化され
たコードの無許可複写に対する機会を最小にする。暗号
化されたプログラムがコピーされたとしても、それがそ
の上に設置される各クライアント・コンピュータに対し
て固有である、マッチング・アプリケーション・ビルダ
ーのプライベート・キーが暗号解読に要求されるので、
それは、そのクライアント・コンピュータに対するライ
センスされたアプリケーション・ビルダーなしで用いる
ことができない。
【００４３】アプリケーション・プログラムに対する以
下に説明するものに類似する限定及び手順は、アプリケ
ーションのトライアル・バージョンが得られかつ実行さ
れうるようにアプリケーション・ビルダー１１２のトラ
イアル・バージョンを要求しかつ受け取ることに適用さ
れうる。好ましい実施例ではアプリケーション・ビルダ
ー１１２のトライアル・バージョンは、しきい値日付が
パスした後にプログラムのオペレーションを防ぐ時限爆
弾を含む。段階４２８〜４３２のアプリケーション・ビ
ルダーが、アプリケーション・プログラムに対するトラ
イアル・ライセンスが満了したということを決定したな
らば、アプリケーション・ビルダーによって取られる動
作は、二つの代替有効期限満了日手順のどれがインプリ
メントされるかに依存する：ハード有効期限満了日手順
またはソフト有効期限満了日手順。
【００４４】ハード有効期限満了日手順がインプリメン
トされるときに、アプリケーション・ビルダーは、アプ
リケーション・プログラムのトライアル・バージョンが
有効期限満了になりかつユーザに対する使用に対して先
に利用可能にされたアプリケーション・プログラムが新
しいライセンスにいまライセンスされなければならない
クライアント・コンピュータ上のユーザにメッセージを
与える。ある一定の条件下で、ユーザは、別のトライア
ル・ライセンスを得るための機会を与えられうる；しか
しながら、ユーザが同じアプリケーション・プログラム
上で二つ以上のトライアル・ライセンスを供給されたな
らば、供給されたそのようなトライアル・ライセンシー
の数は、可能なトライアル・ユーズ誤用を最小にすべく
制限されうる。例えば、二つ以上のトライアル・ライセ
ンスが単一アプリケーションに対して供給されたところ
では、機会の合計は、１から１０（１〜１０）の範囲、
好ましくは１から３（１〜３）のトライアルの範囲にあ
るということが予想される。
【００４５】ソフト有効期限満了日手順がインプリメン
トされるならば、ユーザは、プログラムのトライアル・
バージョンが有効期限満了になり、かつユーザが短い期
間に対してトライアル・バージョンを用い続けることが
できると同時に、未来の終了デート“年／月／日”によ
り、ユーザがアプリケーション・プログラムを用いるこ
とを続けることができるために、ユーザは、アプリケー
ション・プログラムのライセンスされたコピー、または
新しいトライアル・バージョンを得ることが必要であ
る、といことが警告される。ソフト有効期限満了日バー
ジョンは、ユーザによりそのアプリケーション・プログ
ラムの使用を突然的に妨げる位置にプロバイダが置かれ
ないという利点があり、そこで例えば、ユーザは、十分
な警告でタスクを終了しうる。ソフト有効期限満了日警
告において与えられた未来の終了日は、有効期限満了日
からの未来における日の数である（例えば７日間の猶予
期間）かまたは警告がユーザに与えられたアンビエント
・デートから先に進んだ日の数として計算されうる。後
者の手順は、ユーザに対するある警告なしでプログラム
が有効期限満了にならないという利点を有する。他のソ
フト有効期限満了日計算スキームも、また、インプリメ
ントされうる。特定の終了手順は、アプリケーション・
ビルダーに関連付けられたクライアントＩＤに基づきユ
ーザの異なるクラスに対してまたは特定のユーザに対し
ても供給されうる。
【００４６】本発明は、２〜３の特定の実施例を参照し
て記載されたが、記載は、本発明の説明のためであり本
発明を限定することを意図しない。特許請求の範囲によ
って画定された真の精神及び範疇から逸脱することなく
種々の変更が当業者に生起されうる。

【発明の効果】本発明の方法は、分散型コンピュータ・
システムにおいてユーザによるアプリケーション・プロ
グラムの使用を管理する方法であり、アプリケーション
・プログラムは、分散型コンピュータ・システムに結合
されたサーバ上にアプリケーション・プログラムの記憶
バージョンとして最初に記憶される、方法であって、ア
プリケーション・プログラムをアクセスするためのユー
ザ要求を認識し、所定のアクセス条件が満足されるか否
かを決定し、アクセス条件が満足されたときにだけ受け
取り及び記憶のためにユーザに関連付けられたコンピュ
ータにアプリケーション・プログラムの送信バージョン
を送信し、ユーザが受け取ったアプリケーション・プロ
グラムを実行する権利を現在有することをプログラムの
実行の前に検証し、かつ検証が肯定的であれば送信バー
ジョンからアプリケーション・プログラムの実行可能バ
ージョンを生成する段階を具備するので、他のエンド・
ユーザが必ずしもプログラムのオーナーのライセンス条
件に同意しないので、他のエンド・ユーザに対してアプ
リケーション・プログラムの実行可能なコピーを配布す
ることからユーザを防ぐことができる。
【００４８】本発明のプログラム・ユーセッジ管理シス
テムは、分散型コンピュータ・ネットワーク上のクライ
アント・コンピュータに関連付けられたユーザによるア
プリケーション・プログラムのユーセッジを管理するプ
ログラム・ユーセッジ管理システムであって、分散型コ
ンピュータ・システムに結合され、かつアプリケーショ
ン・プログラムを記憶するメモリ記憶装置を有している
サーバ；クライアント・コンピュータに結合され、アプ
リケーション・プログラムをアクセスするためのユーザ
要求を認識しかつアプリケーション・プログラムに関連
付けられた所定のプログラム・アクセス条件がクライア
ント・コンピュータによって満足されるか否かを決定す
るコントローラ；クライアントに関連付けられた識別情
報を組み込むプログラム・ファイルの送信バージョン
と、少なくとも部分的に暗号化されるアプリケーション
・プログラムのバージョンとを生成し、アクセス条件が
満足されるときにだけ送信バージョンを生成するために
コントローラに応答するプログラム・ファイル・フォー
マッタ；アクセス条件が満足されたときにだけ受け取り
及び記憶のためにユーザに関連付けられたクライアント
・コンピュータへアプリケーション・プログラムの送信
バージョンを送信するトランスミッタ；クライアント・
コンピュータに関連付けられたユーザがアプリケーショ
ン・プログラムを実行する権限を現在有していることを
クライアント・コンピュータによるアプリケーション・
プログラムの実行の前に確認するライセンシ・ベリファ
イヤ；及びクライアント・コンピュータに結合され、ラ
イセンス・ベリファイヤが、クライアント・コンピュー
タに関連付けられたユーザがアプリケーション・プログ
ラムを実行する権限を現在有していることを検証したな
らばアプリケーション・プログラムの送信バージョンか
らアプリケーション・プログラムの復号マシン実行可能
バージョンを生成するプログラム・デコーダを備えてい
るので、他のエンド・ユーザが必ずしもプログラムのオ
ーナーのライセンス条件に同意しないので、他のエンド
・ユーザに対してアプリケーション・プログラムの実行
可能なコピーを配布することからユーザを防ぐことがで
きる。

Claims (11)

    【特許請求の範囲】
  1. 【請求項１】 分散型コンピュータ・システムにおいて
    ユーザによるアプリケーション・プログラムの使用を管
    理する方法であり、前記アプリケーション・プログラム
    は、前記分散型コンピュータ・システムに結合されたサ
    ーバ上に前記アプリケーション・プログラムの記憶バー
    ジョンとして最初に記憶される、前記方法であって、 前記アプリケーション・プログラムをアクセスするため
    のユーザ要求を認識し、 所定のアクセス条件が満足されるか否かを決定し、 前記アクセス条件が満足されたときにだけ受け取り及び
    記憶のために前記ユーザに関連付けられたコンピュータ
    に前記アプリケーション・プログラムの送信バージョン
    を送信し、 前記ユーザが前記受け取ったアプリケーション・プログ
    ラムを実行する権利を現在有することを前記プログラム
    の実行の前に検証し、かつ前記検証が肯定的であれば前
    記送信バージョンから前記アプリケーション・プログラ
    ムの実行可能バージョンを生成する段階を具備すること
    を特徴とする方法。
  2. 【請求項２】 前記所定の条件は、前記検証及び生成段
    階を実行するアプリケーション・ビルダー・モジュール
    に対する有効ライセンスの所有権を含むことを特徴とす
    る請求項１に記載の方法。
  3. 【請求項３】 前記決定する段階は、 前記ユーザに前記所定のしかしまだ満足されないアクセ
    ス条件を満足しかつ受け入れるための機会を供給し、か
    つ前記ユーザにより前記アクセス条件の明示的受け入れ
    を認識する段階を具備することを特徴とする請求項１ま
    たは２に記載の方法。
  4. 【請求項４】 前記アプリケーション・プログラムに対
    するトライアル・ライセンスを受け入れるための機会を
    供給することを含んでいる請求項３に記載の方法。
  5. 【請求項５】 前記アプリケーション・プログラムの前
    記送信バージョンは、少なくとも部分的に暗号化される
    ファイルを含むことを特徴とする請求項２に記載の方
    法。
  6. 【請求項６】 前記送信バージョンから前記アプリケー
    ション・プログラムの前記実行可能バージョンを生成す
    る段階は、前記暗号化された部分を暗号解読することを
    含むことを特徴とする請求項５に記載の方法。
  7. 【請求項７】 前記アプリケーション・プログラムの前
    記送信バージョンは、前記ユーザに関連付けられたパブ
    リック・キーで暗号化され、前記暗号解読は、対応して
    いるプライベート・キーで実行され、前記ユーザ関連パ
    ブリック・キー及び対応するプライベート・キーは、前
    記アプリケーション・ビルダー・モジュールによって生
    成されることを特徴とする請求項６に方法。
  8. 【請求項８】 分散型コンピュータ・ネットワーク上の
    クライアント・コンピュータに関連付けられたユーザに
    よるアプリケーション・プログラムのユーセッジを管理
    するプログラム・ユーセッジ管理システムであって、 前記分散型コンピュータ・システムに結合され、かつ前
    記アプリケーション・プログラムを記憶するメモリ記憶
    装置を有しているサーバ；前記クライアント・コンピュ
    ータに結合され、前記アプリケーション・プログラムを
    アクセスするためのユーザ要求を認識しかつ前記アプリ
    ケーション・プログラムに関連付けられた所定のプログ
    ラム・アクセス条件が前記クライアント・コンピュータ
    によって満足されるか否かを決定するコントローラ；前
    記クライアントに関連付けられた識別情報を組み込む前
    記プログラム・ファイルの送信バージョンと、少なくと
    も部分的に暗号化される前記アプリケーション・プログ
    ラムのバージョンとを生成し、前記アクセス条件が満足
    されるときにだけ前記送信バージョンを生成するために
    前記コントローラに応答するプログラム・ファイル・フ
    ォーマッタ；前記アクセス条件が満足されたときにだけ
    受け取り及び記憶のために前記ユーザに関連付けられた
    前記クライアント・コンピュータへ前記アプリケーショ
    ン・プログラムの前記送信バージョンを送信するトラン
    スミッタ；前記クライアント・コンピュータに関連付け
    られたユーザが前記アプリケーション・プログラムを実
    行する権限を現在有していることを前記クライアント・
    コンピュータによる前記アプリケーション・プログラム
    の実行の前に確認するライセンシ・ベリファイヤ；及び
    前記クライアント・コンピュータに結合され、前記ライ
    センス・ベリファイヤが、前記クライアント・コンピュ
    ータに関連付けられたユーザが前記アプリケーション・
    プログラムを実行する権限を現在有していることを検証
    したならば前記アプリケーション・プログラムの前記送
    信バージョンから前記アプリケーション・プログラムの
    復号マシン実行可能バージョンを生成するプログラム・
    デコーダを備えていることを特徴とするプログラム・ユ
    ーセッジ管理システム。
  9. 【請求項９】 前記コンピュータ・システムは、前記ク
    ライアント・コンピュータに設置されかつその上で実行
    しているアプリケーション・ビルダー・プログラム・モ
    ジュールを含み、前記アプリケーション・ビルダー・プ
    ログラム・モジュールは、前記ライセンス・ベリファイ
    ヤ及び前記プログラム・デコーダを含むことを特徴とす
    る請求項８に記載のシステム。
  10. 【請求項１０】 前記アプリケーション・プログラムに
    関連付けられた前記所定のプログラム・アクセス条件
    は、前記クライアント・コンピュータ上の前記アプリケ
    ーション・ビルダー・プログラムの有効コピーからの暗
    号化キーの受け取りを含むことを特徴とする請求項９に
    記載のシステム。
  11. 【請求項１１】 前記アプリケーション・プログラムの
    前記送信バージョンは、前記ユーザに関連付けられたパ
    ブリック・キーで少なくとも部分的に暗号化され、前記
    プログラム・デコーダは、対応しているプライベート・
    キーで前記アプリケーション・プログラムの前記送信バ
    ージョンを復号し、かつ前記ユーザ関連パブリック・キ
    ー及び対応しているプライベート・キーは、前記アプリ
    ケーション・ビルダー・モジュールによって生成される
    ことを特徴とする請求項９に記載のシステム。
