Description

  • Betreffend das europäische Patent 2 911 940 ( DE 60 2012 024 407 ) hat der 7. Senat (Nichtigkeitssenat) des Bundespatentgerichts auf Grund der mündlichen Verhandlung vom 13. November 2023 durch die Vorsitzende Richterin Kopacek und die Richter Dipl.-Ing. Wiegele, Dr.-Ing. Schwenke, Dr. von Hartz und Dipl.-Chem. Dr. Deibele
    für Recht erkannt:
    • I. Das europäische Patent 2 911 940 wird mit Wirkung für das Hoheitsgebiet der Bundesrepublik Deutschland im Umfang der Ansprüche 1 bis 8 für nichtig erklärt.
    • II. Die Kosten des Verfahrens trägt der Beklagte.
    • III. Das Urteil ist im Kostenpunkt gegen Sicherheitsleistung in Höhe von 120 % des jeweils zu vollstreckenden Betrags vorläufig vollstredkbar.
    • IV. Der Streitwert wird auf 500.000,- € festgesetzt.
