具体实施方式
首先参照图1中示出的非限制性示例性实施例,系统10包括音频视频装置12(例如电视机),其包括与TV处理器18通信的TV调谐器16,TV处理器18访问有形计算机可读存储介质20,例如基于盘的存储器或固态存储器。电视机12能够在一个或多个扬声器22上输出音频。电视机12能够使用与处理器12通信的内置有线或无线调制解调器24接收来自因特网的流视频,处理器12可执行软件实现的浏览器26。在TV处理器18的控制下,视频被呈现在TV显示器28上,TV显示器28例如、但不限于为高清晰度TV(HDTV)平板显示器。可使用例如射频或红外方式从遥控器(RC)30无线地接收对处理器18的用户命令。可使用除电视机以外的音频-视频显示装置,例如智能电话、游戏主机、个人数字组织器、笔记本电脑以及其他类型的计算机等。
由与电视机12通信的地面广播天线34接收的、来自一个或多个地面TV广播源32的TV节目可在显示器28和扬声器22上呈现。地面广播节目可遵照数字ATSC标准,并可在其中承载地面广播EPG,但是,地面广播EPG可经由以太网或电缆通信链路或卫星通信链路从例如因特网的替代性源接收。
来自有线电视首端(head end)36的TV节目也可在电视机处被接收,用于在显示器28和扬声器22上呈现TV信号。当仅期望基本电缆时,来自墙壁的电缆典型地承载QAM或NTSC格式的TV信号,并直接插入美国的电视机底架上的“F型连接器”38,然而,在其他国家用于此目的的连接器可以变化。形成对比的是,当用户具有例如扩展的有线电缆订购时,来自首端36的信号典型地通过STB40被发送,STB40可与电视机底架分离或集成在电视机底架中,但在任何情况下,其向电视机发送HDMI基带信号。
类似地,从由与家用卫星天线相关联的集成接收器/解码器(IRD)44接收的TV广播信号的卫星源42传送的HDMI基带信号可被输入到电视机12,用于在显示器28和扬声器22上呈现。另外,可从因特网46接收流视频,用于在显示器28和扬声器22上呈现。流视频可在计算机调制解调器24上接收,或者,其可在电视机12外部的、家中的调制解调器48上被接收,在有线或无线以太网链路上被输送到电视机12,并在电视机底架上的RJ45或802.11x天线上被接收。
图2示出了示例性电视机12的细节。如所示出的,ATSC格式的地面信号被输入到TV调谐器16,如同使用基本电缆且墙壁电缆被插入F型连接器38的情况下以NTSC或QAM格式的基本电缆一样。另一方面,流因特网视频可在DOCSIS调谐器50上接收,并在DOCSIS解码器/解调器52上进行解调/解码。典型地,DOCSIS部件与电视机12分立地封装,但在某些实施例中可被包括在电视机12的底架中。
取决于所接收的信号格式,调谐器16的输出可被发送到NTSC解码器/解调器54,或者QAM解码器/解调器56,或者ATSC解码器/解调器58。来自NTSC解码器/解调器54的输出能被直接发送到显示器28和扬声器22,以便进行呈现。另一方面,来自数字解码器/解调器56、58的输出典型地被发送到传输流解复用器60,传输流解复用器60在所选择的流中将想要的节目从其他节目分离,并将想要的节目发送到MPEG视频解码器62,MPEG视频解码器62又对想要的MPEG节目进行解压缩,并将解压缩后的节目发送到TV显示器28,以便进行呈现。来自解复用器60的音频可被发送到音频解码器64,音频解码器64又将解码后的音频发送到扬声器22,以便进行呈现。
与上面讨论的解码器/解调器、解复用器以及MPEG解码器序列形成对比的是,来自STB40或是IRD44的视频在由电视机12进行接收时采用的是基带HDMI。相应地,来自STB40或IRD44的信号直接被发送到TV显示器28以便进行呈现,而在STB40或IRD44与TV显示器28之间不具有进一步的视频解压缩。来自STB40或IRD44的音频仍可采用例如AC3的格式,其在扬声器22上播放之前需要解码,故音频可通过音频解码器64发送,如所示出的那样。类似地,来自ATSC地面源32的音频可采用AC3格式,因此可通过音频解码器64发送。来自DOCSIS解码器/解调器52的因特网视频可通过解复用器60和解码器62、64来发送,如所示出的那样。
现在参照图3,在方框66处,电视机12的用户使用屏幕上的用户界面(UI),可在首次加电时或在其后从菜单通过设置例程来设置电视机的各种特性。举例而言,对于电视机内的一个或多个可授权部件,可向用户询问其是否想要使用该部件。例如,这一点可通过向用户询问其是否希望自动扫描广播频谱以检测频道来隐含地完成,在这种情况下,可推断为将会需要ATSC解码器/解调器58和MPEG解码器62,因此,将会需要使用这些部件的许可。另外,在后一种情况下可推断为可能需要地面广播EPG的许可,而如果地面广播并当前没有被用作输入源的话,可能不需要这样的许可。
或者,再一次地,用户可以选择通过内置调制解调器24或从外部调制解调器48接收因特网视频,如果选择后者的话,不需要为因特网浏览器26获得许可;否则,需要使用因特网浏览器26的许可。
进行到方框68,对于基于方框66处的用户设置选择推断为将会需要的各个许可,电视机12通过例如因特网上传或者通过双向电缆系统等等回传对于该许可的请求。或者,如下面进一步阐释的那样,请求可通过电话做出。无论如何做出,该请求连同电视机的唯一标识(例如,电视机型号码和序列码的散列值,在某些实施例中,如果希望的话,该散列值被加密)通常标识出了基于方框66处的用户输入而需要许可的部件。或者,该唯一标识符可以是装置12的高清内容保护(HDCP)密钥选择矢量(KSV),或是媒体访问控制(MAC)地址,或是数字传输内容保护(DTCP)证书,以上的一种或多种可以使用装置12的序列号和/或型号名进行散列。这一散列结果可被发送至服务器。服务器现在可以唯一地标识该装置。在装置需要维修且装置内包含的唯一ID改变的情况下,管芯设备的在前身份可被有利地植入新的经散列ID。为了简化这一ID移植,服务器可以在接收到初始的经散列ID和指示装置已维修且需要新的唯一ID的通知(例如,来自装置12)之后生成唯一密钥,将其发送给修理后的所述装置。在某些实现中,装置12的用户可以手动调用初始ID,将其发送给服务器,而服务器则使用该初始ID,将在前由装置12使能的许可的记录植入新的ID。
请求可以在设置时间做出。或者,请求可被缓存,以便在以后上传,例如在感测到适当的宽带连接时。在任何情况下,请求可被发送到位于预先存储的因特网地址的因特网服务器,或发送到电缆首端,或发送到另一适当的许可实体或代理。
方框70表示假设通过授权,则电视机12以许可信息的形式接收返回的许可,该许可信息典型地为这样的代码:其必须被输入到TV处理器18,以启用或解锁相关联的部件。或者,相关联的部件可能需要软件代码来工作,且在该装置被发售时,与可许可特性有关的关键代码被省略,此关键代码在方框70中被供给,以启用该部件的可许可特性。在提供关键代码之前,该部件的可许可特性事实上不仅仅被封锁,而是实际上完全地缺失,尽管执行可许可特性所需的软件代码的其他部分随装置一起被发售。
在方框72处,代码可被自动输入到电视机的适当的内部部件,或者,代码可在电视机上显示,借助屏幕上显示的UI提示用户使用例如RC30来输入该代码。代码的正确输入激活电视机内的有关部件。方框74简单地表示出,许可费数据被维持并用于生成由许可代理机构开给电视机制造商的帐单信息,并且,还可用于生成市场数据,如下面所讨论的那样。在通过上面提到的手段上传到许可实体/代理之前,该数据可被保存在电视机中。
图4示出如果希望的话,可在用户设置例程之外做出自动许可判断。在图4所示的实例中,在决策菱形框76处开始,判断电视机中是否存在预定的物理条件,例如,特定类型的连接,从该连接可推断出将会需要何种可许可部件。在图4的实例中,物理条件为调谐器16的自动增益控制(AGC)电路中电压的存在,该电压可在例如在电视机底架处连接到地面天线34时或在来自墙壁的电缆连接到F型连接器38时出现。
当测试寻找的物理条件存在时,逻辑流向方框78,在此实例中,激活NTSC解调器54。这么做是认识到NTSC解调器典型地不需要许可,从而避免不必要地请求许可,调谐器16上的信号首先被测试,以便判断其是否为NTSC信号。决策菱形框80表示该测试可以为“噪音”是否在该信号中存在。
如果测试表明仅NTSC信号存在,则逻辑结束,否则,逻辑流向方框82,以便激活QAM解码器/解调器56。如果仅检测出QAM(通过QAM解码器/解调器56识别出QAM信号和/或无噪音),则逻辑结束,然而,如果QAM解码器/解调器56没有识别出信号,这表示该信号既不是QAM也不是(根据决策菱形框80)NTSC,因此推断该信号为需要使用ATSC解码器/解调器58的ATSC,ATSC解码器/解调器58在方框86处被激活,以便对该信号进行处理。在方框88处,由TV处理器18获得到上面介绍的许可实体/代理的上行链路,以便使用电视机的唯一ID获得上面所讨论的许可代码,在方框90处,该代码被接收并在必要时使用,以便允许使用ATSC解码器/解调器58。
或者,在处理器18被编程为向许可实体/代理发送以下消息的假设下,方框90处的步骤能被省略且ATSC解码器/解调器58立即被激活:将在激活ATSC解码器/解调器58之后生成许可账目。
又一次地,如图4中的虚线所示,逻辑可首先从决策菱形框84流向方框88、90以获得许可“解锁”代码,接着,流回到方框86以使用该代码激活ATSC解码器/解调器58,从而确保直到以下时刻之前不能使用ATSC解码器/解调器58:已通知许可实体/代理该ATSC解码器/解调器58的使用、已向针对必需的ATSC许可对电视机进行了认证,以及已判断在商业规则下应下载许可代码以完成该请求。
可被使用的、依据在发售电视机后自动获得所需部件许可以避免在电视机销售前为不必要的许可付费的附加示例性推断规则包括,如果存在ATSC,将会发现QAM的可能性较小;如果存在ATSC,ATSC频道的总数将会远远小于QAM频道的数目。另外,当从外部调制解调器48接收到信号时,音频视频节目不需要使用内置浏览器26,因此,通过以太网链路接收到视频而不在内部调制解调器24上接收信号可被推断为意味着未使用浏览器26。
图5-7示出了可在设置过程中使用以获得许可的逻辑。使用例如RC30,人们可输入92请求,以便从例如呈现在音频视频显示产品94(其可由电视机12实现)上的屏显设置菜单进行可用地面或有线或卫星频道的自动扫描。在响应中,AV显示产品发送对于例如ATSC解码器/解调器58的激活请求,该激活请求可包括调谐器ID和产品94ID和/或解码器/解调器58ID/产品94ID。假设许可实体/代理基于从产品94接收的信息判断该产品有权得到所请求部件的许可,在96处使用来自例如服务器98的一个或多个许可实体/代理的激活代码来执行ATSC解码器/解调器58的激活。
许可实体/代理可保留日志,该日志显示哪些产品以及这些产品中的哪些部件已经被激活,基于该日志,可生成许可账目数据以向产品94的制造商给出对于被激活部件的许可账单。在任何情况下,100表示产品94接收激活响应,例如激活代码,从而在101处激活解调器/解码器58,其将产品94转变为具有处理ATSC能力的装置。可使用屏显通知向用户通知现在可使用产品94来观看ATSC节目。
图6示出替代性实施例。使用例如RC30,人们可输入102请求,以便从例如呈现在音频视频显示产品94(其可由电视机12实现)上的屏显设置菜单进行可用地面或有线或卫星频道的自动扫描。在响应中,在104处,准备包括许可实体/代理的电话号码的电话信息,借助例如用户界面或通过呈现在产品94上的方式,通知106用户该信息。通过说出该号码或将电话保持为邻近产品94上的扬声器,以便使用例如语音响应单元(VRU)110接收由电话检测的并用于自动拨打该号码的双音多频(DTMF)音,用户将该信息输入108到电话中。
另一替代性实施例涉及向服务器发送短消息服务(SMS)消息,以便发送上述信息,或涉及扫描电视机或部件上的条形码,以便向服务器发送请求信息,从而获得许可。在任何情况下,可在启动时和/或在运行期间周期性地完成对需要哪些许可的判断。
在112处由例如因特网服务器的许可实体/代理114产生调谐器激活,上面讨论的激活代码被发送116到VRU110,其向用户呈现该代码,以便在120处完成激活处理。在101处执行可许可部件(例如ATSC解码器/解调器58)的激活,其将产品94转变为具有处理ATSC能力的装置。可使用屏显通知向用户通知现在可使用产品94观看ATSC节目。

作为替代的是,许可信息可使用短消息服务(SMS)代码或通过使用条形码来交换。为了使用条形码,电视机可包括对多种部件上的条形码进行成像的照相机,该条形码被处理器18解释为标识信息。
在某些实例中,如果仅需要有限数量(例如两个)NTSC频道,可请求并授予有限的且较为便宜的许可,以便允许通过NTSC解调器访问仅仅这两个频道,其中许可被请求并被授予例如立体声音频解码器的任何部件,传统的装置(典型地,VCR)使用这样的音频。

方框148显示,依据向请求装置发送激活代码,生成许可账目数据。这种账目数据能够用于使得请求装置制造商向许可机构支付对于作为请求主体的部件的报酬。在方框150处,被授权装置数据库被修改,以便记录许可的授予。
可基于许可的授予在方框152处生成市场数据。举例而言,可将在具有可许可部件的情况下发售的装置的总数与授予请求装置的许可的数量进行比较,以便确定该部件相较于请求装置中的其他部件的使用率。例如,可能注意到,特定电视机型号的30%的发售装置曾经请求激活ATSC调谐器。此数据能够进一步关联到在装置注册过程中获得的人口统计学数据,使得例如能够获知,在请求激活TV调谐器的30%的装置中,哪一地理区域或者哪一人口年龄组等等更有可能请求这种激活。使用由购买者提交的装置注册信息,还可确定在请求激活ATSC调谐器的装置中,例如,90%的这些装置为第二台或第三台家用电视机,因此,其可被推断为缺少有线电视或卫星连接。
优选为,一旦可许可部件已经通过获得对其的许可而得到激活,其不能在随后由用户解除激活,从而避免对于同一部件的多重许可支付。相应地,TV处理器18可被编程为,至少在解除激活将需要另一个许可来重新激活的情况下,如果对于已经激活并许可的任何部件输入任何来自用户的解除激活命令的话,拒绝来自用户的解除激活命令。
许可的验证也可由TV处理器提供,使得例如如果电视机请求了部件许可但对应的特性在某个时间段内从未使用,则电视机能够撤销该许可请求,结果可退还任何许可费。
图9示出了客户机装置12可以从第三方服务器200接收诸如可许可小程序或其他可许可软件之类的可许可部件,其中第三方服务器200具有访问计算机可读存储介质204(诸如,基于磁盘的存储装置或固态存储装置)的处理器202,用以执行以下逻辑的相关部分。“第三方”指的是与除客户机12的生产商之外的实体有关的服务器。另一方面,客户机装置12的生产商则与生产商服务器206有关,服务器206具有访问计算机可读存储介质210(诸如,基于磁盘的存储装置或固态存储装置)的处理器202,以执行以下逻辑的相关部分。

输入装置(30),与处理器(18)通信以指示对提供可许可部件的至第三方服务器(TPS)(200)的链接的选择;
计算机可读存储介质(20),具有处理器(18)可执行的指令用以:
从TPS(200)获取该可许可部件;以及
作为响应,从TPS(200)获取该可许可部件;
通知与客户机装置(12)的生产商有关的客户机装置生产商服务器(CDMS)(206)该可许可部件已被从TPS(200)获取,由此方便该可许可部件的版税的记账。
9.如权利要求8所述的客户机装置,其中客户机装置(12)接收有关该可许可部件从TPS(200)经网络下载可用的信息。
10.如权利要求8所述的客户机装置,其中客户机装置(12)通知CDMS(206)该客户机装置(12)已经获取该可许可部件并且已经使能该可许可部件。
11.如权利要求8所述的客户机装置,其中客户机装置(12)通知CDMS(206)该客户机装置(12)已经获取该可许可部件并且请求来自CDMS(206)的批准以使能该可许可部件。
12.如权利要求11所述的客户机装置,其中客户机装置(12)基于从CDMS(206)接收到的肯定的“不同意”回复来判定对使能该可许可部件的批准没有被同意,并且作为响应,不使能该可许可部件。
13.如权利要求11所述的客户机装置,其中客户机装置(12)基于在超时时段期满之前没有从CDMS(206)接收到任何回复来判定对使能该可许可部件的批准没有被同意,并且作为响应,不使能该可许可部件。
14.如权利要求11所述的客户机装置,其中客户机装置(12)基于从CDMS(206)接收到的肯定的“同意”回复来判定对使能该可许可部件的批准得到了同意,并且作为响应,使能该可许可部件。
15.如权利要求11所述的客户机装置,其中客户机装置(12)基于在超时时段期满之前没有从CDMS(206)接收到任何回复来判定对使能该可许可部件的批准得到了同意,并且作为响应,使能该可许可部件。
16.一种与客户机装置(12)的生产商无关的第三方服务器(TPS)(200),其中该客户机装置(12)的生产商与客户机装置生产商服务器(CDMS)(206)相关联,该TPS(200)包括:
处理器(202);
计算机可读存储介质(204),具有处理器可执行的指令用以:
使得可许可特征下载至客户机装置(12);以及
与CDMS(206)通信以通知该CDMS(206)所述客户机装置(12)已经获取了该可许可部件由此方便版税记账。
17.如权利要求16所述的TPS,其中TPS(200)响应于接收到来自客户机装置(12)的对由TPS(200)提供的超链接的选择,将该可许可部件下载至客户机装置(12)。
18.如权利要求16所述的TPS,其中TPS(200)执行与该可许可部件下载至客户机装置(12)相关联的版税记账。
19.如权利要求16所述的TPS,其中TPS(200)不执行与该可许可部件下载至客户机装置(12)相关联的版税记账。
