其次,验证扫描设备在其所处的流通环节的地理位置坐标是否与存储的信息一致,若是,则执行下一步,反之,反馈非法操作信息;
最后,验证扫描设备在其所处的流通环节的扫描次数和动作信息,若匹配,则执行完成对扫描设备的验证,反之,反馈非法操作。
进一步的,线上购买时,消费者需通过登记备案的实名IP地址、入网账号和/或电话号码进行购买、查验、评价和投诉操作;
线下购买时,查验操作由消费者通过零售商持有的查验设备完成;
消费者购买商品后的验证通过在商品身份及动态监测后台服务端登记备案的实名IP地址、电话号码和/或入网账号进行验证。如消费者未在商品身份及动态监测后台服务端进行登记备案的,该消费者应当在商品身份及动态监测后台服务端补办登记备案事项后方能进行查验;国家行政、司法部门,有关机构和权利人等需要进行商品真伪查验或调取数据的,需通过经商品身份及动态监测后台服务端登记备案过的实名IP地址、电话号码、入网账号、专用接口等进行查验或调取数据操作;无关主体和设备不能进行商品身份识别码查验操作。
本发明的设计原理:研究证明,单一商品具有四个方面的特性:1、商品的身份具有唯一性(当然这是在按要求赋予它身份时);2、商品的产出主体具有唯一性;3、商品的正常运动轨迹具有唯一性;4、商品的归宿(指最终持有或消耗的人或其他主体)具有唯一性。因此,只有在充分认清商品特性的基础上,才有可能找到正确的防伪技术研究、应用方向,才有可能应用相应的技术、采取相应措施来达到让制假、售假者所不能的目的。
商品追溯体系的建立,不能只着眼于从出厂到零售区间,而应当是从生产原材料采购、原材料使用、商品产出检验、出厂销售、中间销售、物流、零售、部分商品零售后再流通、商品寿终等方面全方位、无遗漏环节的实质意义上的全程闭环商品身份信息管理体系。如果我们不能实现实质意义上的单一商品全程闭环信息管理,势必会造成商品追溯系统部分乃至全部效能的丧失。因此, 我们应当转变思路,探寻最简化、最有效,最全面的解决方案。本发明设计时,一是要满足商品的全程追溯等管理需要;二是要完全消除对商品身份的核销依赖。
与现有技术相比,本发明具有以下有益效果:
一、本发明通过从商品生产源头抓起,明确商品身份,围绕商品流通及消费终端各环节,从始至终都让每一件商品的来龙去脉能清楚展现并得到实时监控。本发明基于对每一件商品唯一数字化身份识别码的全程动态监测,通过对商品产出企业定位(地理位置坐标定位)、商品交易各相关主体定位、商品流转各环节实时位置定位、最终购买人定位,据此获得并固定每一件商品唯一的运动轨迹,形成每一件商品不可被仿制、不可被利用的独有防伪信息特征。
二、基于以下方面因素:(1)制假者不可能具备与正品生产、流通、物流企业和消费者相同的合法身份,相同的设备(商品身份赋码设备、扫描设备、查验设备),相同的地理位置和商品持有资格;(2)假冒商品也不可能具备与正品相重合的地理位置和运动轨迹;(3)消费端对商品身份查验主体和设备的限定,排除非适格人查验商品身份的资格。从而使商品身份识别码不再需要核销,商品也不再需要附加额外溯源和其它防伪成本(如一次性包装、标识等)。因此,仿制或利用真品外观、标识、身份、包装等都将失去意义;发现、追踪、打击他们(它们)也就轻而易举。由此可以实现让制假者不能和不敢制假的实质性溯源和防伪效果,商品溯源和防伪成本也随之降低。
三、采用本发明所提供的技术方案,一旦有商品出现在不应当出现的位置,呈现出异常运动轨迹,出现在不适格的人手中等状态发生,那么就可以作出假冒判定。这样就能创造交易透明、干净、公平的市场环境,堵死制假、售假的可能途径,维护正常市场交易秩序,促进商品品质提升和社会经济健康发展。
具体实施方式
下面结合实施例对本发明作进一步说明,本发明的实施方式包括但不限于下列实施例。
实施例
本实施例提供了一种商品身份监测防伪方法,该防伪方法的设计原理是通过商品身份识别码对商品生产和流通和消费的各个环节进行全程跟踪、监控,以使得商品的流通构成闭环的流通和监控,处于闭环中的商品即为合法商品,反之为非法商品。通过上述方式从根源上杜绝制假、售假行为。本方法所述涉及的闭环的流通和监控可以延伸至:原材料生产-原材料采购;原材料使用-商品生产;商品销售-商品购买;商品再销售-最终消费或持有等等不同阶段,形成环环相扣的闭环链条,实现真正意义上的从源头抓起,有始有终。具体的说,本方法主要包括以下步骤:(1)商品生产阶段:建立商品身份及动态监测后台服务端,在生产环节通过赋码设备赋予每一件商品唯一的身份识别码并存储商品唯一的身份识别码和赋码信息;其中,赋码设备的信息在后台服务端进行登记备案;(2)商品流通阶段:在每一个流通环节通过该流通环节所对应的扫描设备对商品进行扫描,验证商品的身份识别码与后台服务端存储的商品唯一的身份识别码是否匹配,若匹配,则为合法商品,反之,为不合法商品;其中,扫描设备的信息及对应的流通环节信息需在商品身份及动态监测后台服务端进行登记备案。
与传统的防伪措施不同的是,本实施例还将消费者(消费端)涉及的商品的购买环节同样纳入了监控体系中。具体的说,在商品购买时,消费者需对商品进行查验,即商品的查验环节:消费者在购买商品时,通过查验设备对商品进行查验,验证商品的身份识别码、查验设备信息与商品身份及动态监测后台 服务端存储的信息是否匹配,若匹配,则为合法商品,反之,为不合法商品;其中,查验设备信息需在后台服务端进行登记备案。相应的,在商品售出后,消费者对商品进行验证,即验证环节:商品售出后,商品身份及动态监测后台服务端记录出售信息;消费者购买商品后,通过商品的身份识别码向商品身份及动态监测后台服务端请求验证,若身份识别码和出售信息与商品身份及动态监测后台服务端的记录匹配,则为合法商品,反之,为非法商品。
商品身份及动态监测后台服务端(以下简称后台服务端)为整个系统的数据及监控支撑系统,赋码环节和每个流通环节的监控动作均记录在商品身份及动态监测后台服务端,以做到有迹可循、有案可查。涉及线上环节时,商品身份及动态监测后台服务端也可以直接用于线上平台的搭建。
身份识别码,是商品生产企业按照统一标准赋予每一商品具有区别于其它商品的独一无二的商品身份识别代码。身份识别码统一依照:国别代码+商品生产企业注册登记代码+商品类别代码+商品品种代码+商品等级代码+商品生产时间+商品序列代码等等所需内容组成的商品身份信息识别代码,概言之,身份识别码为可以达到前述编码要求,能进行扫描识别,在限定使用范围中不被无限次使用的纯数符码、条码、二维码或复合型码等。
赋码设备、扫描设备、查验设备。赋码设备、扫描设备、查验设备为登记备案的设备,即赋码设备、扫描设备、查验设备将设备信息及所处的流通环节信息发送至后台服务端,后台服务端接收上述信息后记录并存储,完成赋码设备、扫描设备、查验设备的登记备案。各流通环节中的扫描动作,均需登记备案的扫描设备完成,方为有效的验证。其中,赋码设备、扫描设备、查验设备的设备信息为设备的名称、型号、地理坐标,设备所处流通环节的信息包括设备所属主体、所处地理位置坐标和操作次数等。
一件商品的流通环节包括:商品生产-商品检验合格-生产人销售-入出库-中间商-物流运输-商品消费者-退货-物流运输-中间商-生产企业的单次封闭循环。本实施例基于前述商品的封闭循环,在各环节中实行扫描监控,相当于每个环节都是对商品的再次验证,合法的商品才流入下一环节,反之,判断为非法商品剔除。
本实施例中,在各环节扫描设备对商品进行扫描验证为重要步骤之一,在实现对商品扫描后,商品身份及动态监测后台服务端还需对扫描设备进行验证,方法如下:(Ⅰ)读取信息发送源的设备信息及所处的流通环节信息;(Ⅱ)将读取的设备信息及所处的流通环节信息和动作信息与存储的设备信息及所处的流通环节信息和动作信息进行对比,若匹配,则判断扫描设备为登记备案的扫描设备,反之,反馈非法操作信息。通过该步骤,可实现对扫描设备合法性的监控,避免他人采用非法的扫描设备实现商品的扫描,杜绝扫描验证环节的作假行为。其中,步骤(Ⅱ)中,后台服务端对扫描设备所处流通环节的信息验证如下:首先,验证扫描设备所处的流通环节是否与存储的信息一致,若是,则执行下一步,反之,反馈非法操作信息;其次,验证扫描设备在其所处的流通环节的地理位置坐标是否与存储的信息一致,若是,则执行下一步,反之,反馈非法操作信息;最后,验证扫描设备在其所处的流通环节的扫描次数,并记录每次扫描动作信息,若扫描设备在其所处流通环节的扫描次数和动作信息与存储的扫描次数信息和动作信息一致,则执行完成对扫描设备的验证,反之,反馈非法操作。例如,商品检验合格环节需要进行四次扫描验证,则每一次扫描设备的扫描验证均记录在后台服务端,后台服务端在下一次验证时会统计其该扫描设备在先验证的次数,若该次数大于或等于4次,则判断此次扫描设备的扫描动作为非法动作,若小于4次,则为合法动作。
本方法让生产人、销售人、物流人、购买人、平台、监管部门等均可以实时准确的掌握商品动向,让消费者能使用简易的方法正确识别真假,能通过简易的方法和途径进行投诉维权等措施,彻底切断制假、售假人可能通过的制假、售假途径,堵住监控、监管漏洞,让监管部门和平台及相关人能实时监控和发现问题,能及时主动的纠正违法行为和维护权利人的合法权益。从而做到让生产人清晰、权利人清晰、商品身份清晰、销售人清晰、物流人清晰、消费者清晰等,排除所有非法渠道,让所有生产销售的每一件商品都能清楚它的来龙去脉,简化商品监控、验证方法,彻底消除对商品身份的核销依赖,降低现有商品防伪成本,实现从源头上和全流程杜绝本方法适用领域假冒伪劣商品的目的,达到让制假者不能和不敢制假的最终效果。
采用本发明涉及线上平台时,还可建立相应的配套体系:
一、市场主体监控体系,包括:
(1)严格实行入网生产销售人的资质审查。平台对商品生产销售人的工商执照、相关生产许可证、组织机构代码证、税务登记证、开户许可证、信用代码证、场地使用证明、法定代表人(负责人、业主)身份证、投资人身份证、物流合同、商品检验报告、商标证、专利证、名优商品证、IP地址、固定电话、商品赋码和扫描识读设备登记备案等相关证明文件实行严格的资质及相关事项的审查认证。有条件的应当与相关政府监管部门进行联网资质审查认证。
(2)平台对入网商品经(代)销人的工商执照、相关许可证、组织机构代码证、税务登记证、开户许可证、信用代码证、场地使用证明、法定代表人(负责人、业主)身份证、投资人身份证、物流合同、商品授权销售证明和商品身份数据、商品检验报告、商品合法进口证明和商品身份数据、IP地址、固定电话、商品扫描识读设备登记备案……等相关证明文件实行严格的资质及相关事 项的审查认证。有条件的应当与相关政府监管部门进行联网资质审查认证。
(3)平台对入网商品消费者的身份证,实名电话号码、IP地址、入网账号、入网支付账号……等实行严格的相关事项审查认证。有条件的应当与相关政府监管部门进行联网资质审查认证。
(4)平台对入网物流人的工商执照、相关许可证、组织机构代码证、税务登记证、开户许可证、信用代码证、场地使用证明、法定代表人(负责人、业主)身份证、投资人身份证、IP地址、固定电话、商品扫描识读设备登记备案……等相关证明文件实行严格的资质及相关事项的审查认证。有条件的应当与相关政府监管部门进行联网资质审查认证。
(5)有必要时平台应对入网销售人的法定代表人(负责人、业主)进行实人核查,对实际生产、销售场地进行实地核查。
二、市场主体信用评价体系,包括:
(1)平台对入网销售人实行按商品质量、服务质量等主要评价指标进行分类设置评价窗口,由商品消费者分别进行相关评价。平台在公示对当事销售人的评价结果时,只公示各项评价指标的比例(或积分)和被评价的事项及事由等,不显示评价人的信息。
(2)平台对入网消费者进行所购商品的真伪鉴别、进行相关评价、进行投诉维权时,只允许消费者使用已经过平台登记备案的实名常用IP或电话号码执行操作,非经平台登记备案过的IP或电话号不能进行鉴别、评价、投诉等操作。
(3)对于进行恶意评价的消费者或进行虚假交易的相关人,平台应当进行记录并进行相应处理。对于侵害相关人合法权益的,触犯法律法规的,平台应当通报给政府相关监管部门依法处理。
三、消费者投诉维权体系
(1)平台和政府相关监管部门应当按照不同类别分类设立网上投诉受理窗口。平台和相关监管部门可同步接受入网消费者或他权利人的投诉。
(2)平台和政府相关监管部门接到投诉后,应当依职责进行调查。调查结论确定后,平台和政府相关监管部门应当根据各自的职责、职权并依据法律法规、规则等的相关规定,分别对涉案人进行相应的处理。
(3)平台和有条件的政府相关监管部门应当进行联网,实现信息共享,实时监管。联合预防和主动打击假冒伪劣,共同维护健康地市场交易秩序,共同维护权利人的合法权益。
按照上述实施例,便可很好地实现本发明。值得说明的是,基于上述设计原理的前提下,为解决同样的技术问题,即使在本发明所公开的结构基础上做出的一些无实质性的改动或润色,所采用的技术方案的实质仍然与本发明一样,故其也应当在本发明的保护范围内。

Claims (10)

  1. 一种商品身份监测防伪方法,其特征在于,包括以下步骤:
    (1)商品生产阶段:建立商品身份及动态监测后台服务端,在生产环节通过赋码设备赋予每一件商品唯一的身份识别码并存储商品唯一的身份识别码和赋码信息;其中,赋码设备的信息在后台服务端进行登记备案;
    (2)商品流通阶段:在每一个流通环节通过该流通环节所对应的扫描设备对商品进行扫描,验证商品的身份识别码与后台服务端存储的商品唯一的身份识别码是否匹配,若匹配,则为合法商品,反之,为不合法商品;其中,扫描设备的信息及对应的流通环节信息需在商品身份及动态监测后台服务端进行登记备案。
  2. 根据权利要求1所述的一种商品身份监测防伪方法,其特征在于,还包括消费者查验环节:消费者在购买商品时,通过查验设备对商品进行查验,验证商品的身份识别码、查验设备信息与商品身份及动态监测后台服务端存储的信息是否匹配,若匹配,则为合法商品,反之,为不合法商品;其中,查验设备信息需在后台服务端进行登记备案。
  3. 根据权利要求2所述的一种商品身份监测防伪方法,其特征在于,还包括消费者验证环节:商品售出后,商品身份及动态监测后台服务端记录出售信息;消费者购买商品后,通过商品的身份识别码向商品身份及动态监测后台服务端请求验证,若身份识别码和出售信息与商品身份及动态监测后台服务端的记录匹配,则为合法商品,反之,为非法商品。
  4. 根据权利要求3所述的一种商品身份监测防伪方法,其特征在于,所述 步骤(2)中对商品进行扫描的步骤如下:
    (21)扫描设备扫描商品读取商品的身份识别码;
    (22)扫描设备将读取的身份识别码上传至商品身份及动态监测后台服务端;
    (23)商品身份及动态监测后台服务端将接收到的身份识别码与存储的商品唯一的身份识别码进行比对,若匹配,则为合法商品,反之,判断为非法商品。
  5. 根据权利要求4所述的一种商品身份监测防伪方法,其特征在于,所述步骤(2)中扫描设备的信息包括;设备的名称、型号、设备地理位置;流通环节信息包括:扫描设备所属主体、主体地理位置、需扫描次数和动作信息。
  6. 根据权利要求5所述的一种商品身份监测防伪方法,其特征在于,商品身份及动态监测后台服务端在接收扫描设备上传的商品的身份识别码时,执行以下步骤:
    (I)读取信息发送源的扫描设备的信息及所处的流通环节信息;
    (II)将读取的信息与登记备案的信息进行比对,若匹配,则判断扫描设备为登记备案的扫描设备,并执行步骤(23),反之,反馈非法操作信息。
  7. 根据权利要求6所述的一种商品身份监测防伪方法,其特征在于,所述流通环节包括检验环节、出厂环节、入出库环节、经销商提货环节、物流运输环节、商品购买环节、退货环节中至少一个环节。
  8. 根据权利要求7所述的一种商品身份监测防伪方法,其特征在于,所述流通环节包括检验环节、出厂环节、入出库环节、经销商提货环节、物流运输环节、商品购买环节和退货环节。
  9. 根据权利要求8所述的一种商品身份监测防伪方法,其特征在于,所述步骤(II)中,商品身份及动态监测后台服务端对扫描设备所处流通环节的信息验证如下:
    首先,验证扫描设备所处流通环节信息是否与存储的流通环节信息一致,若是,则执行下一步,反之,反馈非法操作信息;
    其次,验证扫描设备在其所处的流通环节的地理位置坐标是否与存储的信息一致,若是,则执行下一步,反之,反馈非法操作信息;
    最后,验证扫描设备在其所处的流通环节的扫描次数和动作信息,若匹配,则执行完成对扫描设备的验证,反之,反馈非法操作。
  10. 根据权利要求9所述的一种商品身份监测防伪方法,其特征在于,线上购买时,消费者需通过登记备案的实名IP地址、入网账号和/或电话号码进行购买、查验、评价和投诉操作;
    线下购买时,查验操作由消费者通过零售商持有的查验设备完成;
    消费者购买商品后的验证通过在商品身份及动态监测后台服务端登记备案的实名IP地址、电话号码和/或入网账号进行验证。
