(Cl. 248--101) This invention relates to a bag holder and more specifically to a bag holder that provides a positive bag holding action and maintains the mouth of the bag in open position during use.
In the past many devices have been used to hold bags for the collection of garbage and refuse in the upright position including clamping jaws and clamping collars. It has been found that clamping jaws and clamping collars are not completely accept-able in normal use for difficultyis encountered in placing the empty bag in these devices. Often the devices will not sustain the weight of a partially filled bag of garbage when they are merely clamped.
It has been found that by piercing the bag and locking the bag between a fixed backup plate and a pivoted piercing assembly the bag will be securely held in an open position until it is manually released.
The pivoting point of the piercing assembly has been located on the side collar member to provide a self-locking feature for holding the bag. An increase in weight of the bag as it is filled exerts a downward pull on the piercing assembly causing the assembly to rotate slightly and press the wall of the bag onto the backup plate thereby causing a firmer grip on. the bag as the weight in the bag increases.
Without this self-locking feature, a positive clamping pressure would have to be provided through a spring or a toggle clamp arrangement to prevent disengagement of the bag,
The bag holder of this invention is suitable for quick and simple removal ofa filled bag and insertion of a new one. No special bag top configurations are necessary to accommodate applicants device.
The bag holder may be used with or without a cabinet as desired.
The construction of the bag holder is more clearly shown in the attached drawings wherein:
FIGURE 1 is an assembly view of applicants device.
FIGURE 2 is a perspective view with the door of the holder slightly cut away to show the bag in position,
FIGURE 3 is a cross sectional view across line 3-3 with the cover in closed position.
FIGURE 4 is a cross sectional view across line 4-4 showing the bag in the back frictional finger, with the cover in closed position,
FIGURE 5 is a cross sectional view across line 5-5 with the cover in closed position,
FIGURE 6 is a perspective view of another embodiment of this invention.
The preferred embodiment is shown in FIGURE 1 where a bottom support 10 is attached to the side member 12, back member 14, and side member 16 of the cabinet body of the holder. If desired the bottom support 10 may be omitted though it is preferred to utilize bottom support 10 to add rigidity when the cabinet is utilized. Louvers 18 may be utilized in the side member 12, back member 14, or side member 16 if desired to promote air circulation to discourage the breeding of flies. Door 20 is attached to side member 16 by means of a hinge 22. The door 20 is provided with a suitable door closure assembly 24 which may be any known closure presently used in the art. If desired a rein-forcing strip 26 may be added to the front edge 28 of side member 12.
. piercing control arms refuse, garbage, or other 3,314,632 Patented Apr. 18, 1967 The side collar member 30 comprises upper flange member 32, top section 34, backup plate 36 with apertures 38, and lower flange 40.
The upper flange member 32 and lower flange member 40 are fastened to side member 12 in any suitable manner as by welding.
It is preferred to have the top section 34 of the side collar member 30 placed parallel to the upper edge 42 of side member 12 when said collar member is attached to side member 12, though in some applications it may be desired to place the side collar member 30 below the upper edge 42.
The side collar member 44 is the same as side collar member 30 and is attached to side member 16 in the same manner as side collar member 30 is attached to side member 12. The back collar member 46 is attached to back member 14 in the same manner as collar members 30 and 44 are attached to their respective side members.
The pivoted piercing assembly 48 is attached by hinges 50 to the top section .34 of its respective side collar member 30, and comprises a piercing plate 52 with attached piercing control arm 54. Pivotedl piercing assembly 49 is similar to pivoted piercing .assembly 48 as shown in FIGURE 1,
As shown in FIGURE 2 it is preferred to have the 54 located inside the edge of the bag 66 to assist in maintaining the bag 66 in the open position.
It is also preferred to have the upper edge 21 of door 20 overhanging the piercing control arms 54 to prevent material from contacting said arm when such materials are deposited in the bag. Side members 12 and 16 may be slightly cut away at their upper edges 13 and 17 respectively to receive upper edge 21 of door 20 when the door is closed to maintain the upper edge of the door in substantially the same plane as top section 34 of side collar member 30.
A cover 60 is moveably attached to back member 14 by means of hinge 62 however, any other suitable pivoting arrangement may be used. A gasket 64 made of rubber, foam plastic or other material may be used to seal the top of the holder but such gasket is not necessary.
When the bag holder is ready for operation the cover is opened and the door is opened.
An empty bag of paper or the like with. its mouth extending upwardly is first inserted under the .back frictional fingers 58 with the pivoted piercing assemblies 48 and 49 pivoted upwardly in open position. Next, the pivoted piercing assemblies are pivoted closed with the opposite sides of the bag 66 each held between its respective pivoted piercing assembly andbackup plate with the piercing spikes penetrating the bag and entering the apertures of the backup plate to firmly grip the bag. Door 20 and cover 60 are then closed.
In another embodiment of this invention the cabinet side members 12 and 16, back member 14, door 20, and bottom support 10 are not utilized. Side collar members 30 and 44 are then securely welded or fastened by other means to back collar member 46 at opposite ends thereof as shown in FIGURE 6.
The bag holder of this invention may be made of metal,
plastic, or other suitable material.
The bag holder is useful'for holding bags containing garbage, refuse or other materials. Changes in and modifications of the construction described may be made Without departing from the spirit of the invention.
Having thus described the invention what is claimed is:
1. A bag holder comprising:
(a) a back collar member,
(b) side collar members attached to opposite ends of the back collar member,
(c) piercing assemblies pivotably attached to each side collar member,
(d) each side collar member having apertures,
(e) said piercing assemblies having piercing means which enter said apertures when the piercing assemblies are placed in closed position,
2. A bag holder comprising:
(a) a back collar member,
(b) side collar members attached to opposite ends of the back collar member,
(c) piercing assemblies pivotably attached to each side collar member,
(d) each side collar member having apertures,
(e) said piercing assemblies having piercing spikes which enter said apertures when the piercing assemblies are placed in closed position,
(i) a cover member moveably attached to said back collar member.
3. A bag holder comprising:
(a) a base member,
(b) a back member attached to the base member,
(c) side members attached to opposite sides of the 'base member and said back member,
(d) side collar members attached to each side member,
(e) a back collar member attached to the back side member,
(f) piercing assemblies pivotably attached to each side collar member,
(g) said side collar members having apertures,
(h) said piercing assemblies having piercing spikes which enter said apertures when the piercing assemblies are placed in closed position,
(i) a cover member moveably attached to said back member, and
(j) a door member moveably attached to a side member.
4. A bag holder comprising:
(a) a base member,
(b) a back member attached to the base member,
(c) side members attached to opposite sides of the base member and said back member,
(d) side collar members attached to each side member,
(e) a back collar member attached to the back side member,
( f) piercing assemblies pivotably attached to each side collar member,
(g) said piercing assemblies .each having a piercing plate with an attached piercing control arm,
(h) said side collar members having apertures,
(i) said piercing plate having piercing spikes which enter said apertures when the piercing assemblies are placed in a closed position,
(j) a cover member moveably attached to said back member,
(k) a door member moveably attached to a side member,
(1) said door member having its upper edge overhanging the piercing control arms.
5. The bag holder as set forth in claim 4 wherein at least one side member has a louver therein.
6. The bag holder as set forth in claim 4 wherein the back member has a louver therein.

Claims (1)
1. A BAG HOLDER COMPRISING: (A) A BACK COLLAR MEMBER, (B) SIDE COLLAR MEMBERS ATTACHED TO OPPOSITE ENDS OF THE BACK COLLAR MEMBER, (C) PIERCING ASSEMBLIES PIVOTABLY ATTACHED TO EACH SIDE COLLAR MEMBER, (D) EACH SIDE COLLAR MEMBER HAVING APERTURES, (E) SAID PIERCING ASSEMBLIES HAVING PIERCING MEANS WHICH ENTER SAID APERTURES WHEN THE PIERCING ASSEMBLIES ARE PLACED IN CLOSED POSITION.
