Claims priority, application Germany January 14, 1953 3 Claims. (Cl. 131-478) This invention relates to a utensil and more particularly to a combination writing implement and holder for cigars or cigarettes.

a compact smoking and writing unit which may easily be carried in the pocket of a users suit or the like.

It is a further object of the invention to provide means facilitating the manufacture of a simple, elegant and inexpensive utensil, which may be subjected to dilferent uses, successively as well as simultaneously.

Other objects and advantages will become apparent from the ensuing detailed description and the accompanying drawings which show preferred embodiments of the invention.

Referring to the drawing in detail and particularly to Fig. 2, is a tubular holder member tapered or provided with a conically shaped outer wall at one of its ends 11 which is provided with internal threads 13a. Cartridge 12 containing a writing fluid is inserted through the open end 11 so that the threads 13 of the cartridge head 14 engage the corresponding threads 1311, whereby the writing head 14 proper protrudes from the holder end 11. Somewhat above threads 13 channel means or ports 15 are located which extend at an angle from the outer wall 15a into the interior 12a of said tubular holder member 10. Adjacent the opposite end 11a of the holder member, there is disposed a disk 16 provided with perforations 16a and fixed within said holder member in any suitable manner, said perforated disk 16 providing a recess or chamber 17 for the insertion of a filter 17a, if desired, for trapping undesirable constituents of tobacco smoke (Fig. 5). Cigarette 19 is inserted into the open end 11a of holder 10 which forms a sleeve 18 preferably of such size as to maintain a friction fit with conventional cigarettes.

Over the lower end of holder 10 cap 20 is engaged at 20b by friction. Cap 20 forms a second tubular or hollow member and is flattened at one of its ends to form a 2,777,447 Patented Jan. 15, 1957 month piece 21. Smoke passes through perforated sleeve 18 and disk 16, lengthwise of the channel 12a surrounding cartridge 12 (the latter being centrally located within the interior of said tubular member 10 and spaced from the inner wall 12b thereof defining said interior of said tubular member 10) through radial ports or channels 15, and thence through cap 20 and into the mouth of the smoker.

Because of the circuitous path of the smoke, the elfective length of the smoke channel is increased and since the settling out of undesirable colloidal smoke particles is in large measure a function of the length of the smoke channel, a cooler, purer smoke is inhaled.

In operation as a writing utensil, the cigarette is discarded and the cap removed from the lower end of the holder. The larger end 20a of the cap 20 is then aflixed over the open sleeve 18 of the holder by friction as illustrated in Fig. 3. When the cartridge is exhausted of writing fluid, it may be removed by unthreading from the holder and a new cartridge may be inserted in its place. I

If desired, cap 20 may be used as a cigar holder permitting concurrent use of the device for writing and smoking.

Whereas ball point pens sometimes become clogged due to drying out of the writing fluid at the point where it leaves the cartridge, the novel utensil reduces this tend ency. The heated smoke surrounds the cartridge thereby increasing the fluidity of the writing fluid, which is generally a pasty mass. The smoke also surrounds tip 14, which is preferably made of metal, thereby expanding it and creating a further increase in fluidity to the ink adjacent the tip. When used for writing shortly after smoking, the expansion of the tip andthe increased fluidity permit any obstructing ink particles to be flushed out, thereby obviating the common necessity for shaking or attempting a few trial lines to initiate operation of the writing utensil.

- While the holder is of minimum length and the unit is compact in size, when combined with the cap, the writing implement is of average size and is comfortable to use and hold. At the same time, the whole unit, when used as a smoking utensil, is not of such size as to be conspicuous. In either position, the balance point will be located near the center so no special weighing will be required to approximate the feel of ordinary unifunctional devices. 1

In the preferred embodiment which is illustrated, the holder and cap are preferably constructed of plastic material. The cartridge is of conventional construction, the threads and protruding end being made of metal. Perforated disk 16 is preferably made of metal but may be made of plastic, foraminous material, and the like.

The device is capable of substantial modification with out departing from the spirit and scope of the invention. Disk 16 may be made removable permitting the insertion of a filter cartridge 17a, if desired. The space 12a surrounding cartridge 12 within the holder may be filled with an insulating or filter material and the holder itself may be provided with an integral sleeve of insulation to encase the cartridge so that the effects of heating will be localized at the tip only. In place of a ball point unit, a mechanical pencil 30 may be substituted with little additional modification. In place of attachment through threads, the connection of the parts may be effected through frictional fit at 31, 32. Different materials of construction may likewise be employed.

In review, therefore, the novel structure comprises a first elongated hollow holder member 10 having a writing implement 14 at one end and a sleeve member 18 for holding a smoking article 19 at the other end and further a second hollow member for selectively engaging said sleeve member 18 or a wall of said first member at 20b rearwardly of said writing implement.

It can thus be seen that there has been provided ac-' cording to the invention an article of manufacture carrying a writing implement and a cigarette holder for alternative use comprising first and second tubular members 10, 20 each provided with two ends, the end 20a of said one tubular member 20 being frictionally engageable with either end 14a or 11a of the other tubular member 10, one end 14 of said first tubular member being defined by a conically shaped outer wall 151; terminating in a cartridge-equipped ball tip, said first tubular member having channel means 15 extending from without through said comically shaped wall 151: into the interior 12a of said first tubular member and for communication with the other end 11a of said first tubular member, said cartridge being centrally located Within the interior 12a of said first tubular member and being spaced from the inner wall 12b of the latter defining said interior, and one end 2011 of said second member 20 having an inner wall 20b fitting over said sonically shaped wall 14a for engagement thereover and leaving between the latter wall and said inner wall of said second tubular member a sufficicntly large space 1411 to extend through the latter said communication from said other end of said first tubular member past said cartridge and through said channel means 15 to said other end 21a of said second tubular member when said tubular members are in engaged position.

Having thus described the invention, what is claimed as new and desired to be secured by Letters Patent, is:

l. in a device adapted for alternative use as a holder for a smoking article as well as a writing instrument; two tubular members, one of said members being of sub stantially uniform diameter throughout a major portion of its length and carrying at one end a cartridge-equipped ball tip, the other end of said one member being provided with a recess to receive said smoking article therein, the other member being provided with a mouth piece at one end and being of a diameter sufiiciently large at the other end to frictionall'y engage said one member over said ball tip end for smoking purposes and over said reeessed end to lengthen said writing instrument, selectively, and said one tubular member having channel means extending adjacent said ball tip from the outer surface of said one tubular member through its wall, to thereby establish communication between said other end of said one tubular member and said mouth piece, respectively.

2. An article of manufacture carrying a writing implement and a cigarette holder for alternative use comprising first and second tubular members each provided with two ends, the end of one of said tubular members being frictionally engageable with either end of the other tubular member, one end of said first tubular member being defined by a conically shaped outer wall terminating in .a cartridge-equipped ball tip, said first tubular member having channel means extending from without through said comically shaped wall into the interior of said first tubular member and for communication with the other end of said first tubular member, said cartridge being centrally located within the interior of said first tubular member and being spaced from the inner wall of the latter defining said interior, and one end of said second member having an inner wall fitting over said conically shaped wall for engagement thereover and leaving between the latter wall and said inner wall of said second tubular member a sufliciently large space to extend through the latter said communication from said other end of said first tubular member past said cartridge and through said channel means to said other end of said second tubular member when said tubular members are in engaged position.

3. An arh'cle according to claim 2, wherein said other end of said second tubular member is in the form of a mouth piece, and said other end of said first tubular member forming an open chamber for the insertion of a smoking article.
