Description

【発明の詳細な説明】 Ａ、産業上の利用分野 本発明は広く文書、ライセンス契約、契約書あるいはコ
ンピュータ・プログラムの受信受諾検査技術に関し、特
に、電子伝送あるいはまた磁気記録されたデータ・オブ
ジェクトの受信受諾を検査する技術に関する。
Ｂ、従来技術 電子伝送あるいはまた磁気記録されたデータ・オブジェ
クトを記憶保護するためのさまざまな従来技術が存在す
るが、現存するこれらすべての技術によると、暗号化と
非暗号化（復号）キーの使用、あるいは前もって許可さ
れた受信者のみがふつう使用できるアルゴリズムが必要
となり、受信側に対しあらかじめ送信の承認を得なけれ
ばならない。現段階ではこれらの技術以外に、受信側が
確かにデータ・オブジェクトを受は取ってその受諾・使
用認可条件に同意し、それを導入して使用したことを自
己検査するためのいかなる技術も存在しない。
コンピュータ・プログラム製品すなわち「ソフトウェア
」の無認可の複写使用およびアクセスは、この分野では
一般的な問題である。米国特許出願第４７５７５３４号
は、該プログラムを記憶保護する暗号技術の一例を示し
ている。ユーザーはパスワードを用い、適確に初期設定
および実施された復号装置を持った指定場所において、
暗号化されたプログラムを再生する。。
同様に米国特許出願第４７５７５３３号は、コンピュー
タ内部でファイルの自動暗号化および復号を用いる、パ
ーソナル・コンピュータの安全保護システムを取り扱っ
ている。
これら及び他の同等従来技術において、暗号化またはそ
の他の技術により使用禁止状態に保護されたデータ・オ
ブジェクト（電子伝送あるいは磁気記録され伝送された
もの）を使用するには、暗号化・復号装置およびパスワ
ードのような「キー」をあらかじめ導入しなくてはなら
ない。これはコンピュータ・プログラミングの営業およ
び使用にとって、特に店頭販売、および構内ワークステ
ーションやパーソナル・コンピュータ・システムでの使
用のため適用業務プログラムをダウンロードするシステ
ムにとっては、後退を意味するものである。後者の例で
は、プログラムやデータ・オブジェクトが受信されても
、精巧なシステムがただ勘定計算のためパスワード等を
詳細に記録・追跡して受信側を認可するのに使われる、
というわけである。
Ｃ９発明が解決しようとする問題点 データ・オブジェクトの電子配布に関する従来技術の前
述した欠点に鑑み、本発明の目的は電子データ・オブジ
ェクトの記憶保護の改善方法、および前もっての受信許
可やパスワード等の認可解放キー導入の必要なくできる
、受信受諾検査の改善方法を提供することである。
また本発明の目的は、電子記録され送信されたデータ・
オブジェクト伝送の自己検査方法を提供することである
。
Ｄ１問題点を解決するための手段 前述の目的は、本発明における新規システムにより満た
される。該システムでは、電子データ・オブジェクトの
送信側すなわち作成者は、該データ・オブジェクトが確
実に受信されたかどうか後に検査することができる。該
システムでは、データ・オブジェクトの受信検査をその
データ・オブジェクトが自己制御する。データ・オブジ
ェクトの送信側すなわち作成者Ｃ，を伝送にあたってま
ずオブジェクトを修正し、ユーザーが最初に受信した時
点では使用操作不可能な形式に変換する。送信側すなわ
ち作成者はデータ・オブジェクト中に検査標識および活
動開始機構を挿入する。これは、検査および活動開始機
構に含まれるある前提条件が満たされたときに、操作不
能データ・オブジェクトを操作可能な状態に変換するも
のである。その後送信側すなわち作成者は、検査標識お
よび活動開始機構を含む修正された使用不可能データ・
オブジェクトを、受信側に送信（あるいは記録および伝
送）すればよい。受信側すなわちユーザーは、修正され
た使用不可能データ・オブジェクトを受は取り、ＣＲＴ
画面デイスプレィやプリンタ等が接続された自分のワー
クステーションあるいはコンピュータ内に、それを導入
すなわちロードする。このときユーザーはデータ・オブ
ジェクトに含まれた活動開始機構の部分を見ることがで
きる。このデータ・オブジェクト導入中に、ユーザーに
応答を要求する画面デイスプレィやメツセージが表示さ
れる。活動開始機構から出されるこのメツセージは解読
可能な形式で画面やプリンタ等に表示されるので、ユー
ザーはそれに応えるかたちでデータ・オブジェクト使用
や導入に関する諸条件への諾否を人力する。その後活動
開始機構を含む該データ・オブジェクト部分がユーザー
の応答を判断して、前提条件が満たされていればデータ
・オブジェクトを使用操作可能な形式（修正されたの検
査標識を含む）に変換し、その結果と必要ならばユーザ
ーの識別情報を記録する。一方もし前提条件が満たされ
なければ、データ・オブジェクトを使用操作可能な状態
へ変換せずに中断する。
これで処理が終了する。
Ｅ、実施例 本発明に係る数個の図は、ユーザーが該ソフトウェア製
品を複写する前に受諾しなくてはならないライセンス諸
条件を持つ、コンピュータ・プログラム（ソフトウェア
製品）伝送システムを典型的な文脈の形で示す、受信側
が確かにデータ・オブジェクトを受は取って、それに関
する諸条件に応じたかどうかの検査という問題に係る、
他の例も多数考えられる６例えば、ふつう受取書や署名
が必要となる配布文書、契約書その他法的公文書、売買
明細、船荷証券など、データ・オブジェクトを実際受は
取ったという追跡記録（データ・オブジェクト内にある
）が要求されるような文書の例が挙げられる。
本発明の実施例は、データ処理分野の例に関する。ここ
での「データ・オブジェクト」は、ワークステーション
あるいはパーソナル・コンピュータ／システムに使用す
るコンピュータ・プログラム（ソフトウェア製品）であ
るとする、こういった環境でのユーザーは、該ソフトウ
ェア製品の複写をとり、家（あるいは自分のワークステ
ーション）に持ち帰って使いたいと思うことが多い。こ
れらのソフトウェア製品にはふつう、買い手（もつと的
確に言うと「ライセンス保持者」）が、パッケージを開
封して中味を使用すると必然的に結ぶことになる、「ラ
ップ・フィルムで覆われた」ライセンス契約書がついて
いて、使用諸条件を詳述している。もしこうした環境で
、プログラムの無認可複写や使用に対して厳しい安全保
護を望むとすれば、ソフトウェア製品を直列化して詳細
な記録を保持しなくてはならず、購入時あるいはライセ
ンス契約時の著名人り受取書、および記録保持と監査の
手順詳細等が必要となる。これはコストと時間の浪費で
ある。
今日における電子通信の環境でより望ましいのは、必要
に応じてアクセス可能でありしかもユーザーが内容を見
たりダウンロード可能なソフトウェア製品を、中央のア
クセス・ポイントにおいて提供することである。中央設
備を「ダイヤル呼出し」するだけで、いかなるユーザー
でもアクセス要求やあらゆるソフトウェア製品の伝送要
求を出すことができるなら、これはさらに望ましい。な
ぜならユーザーはあちこちに移動するし、中央設備への
アクセスを規制するのは困難かつ煩雑だからである。こ
れにより、従来技術における方式、つまり復号（または
安全保護）のためのキーやコードやルーチンは、通常不
可能となり望ましくないということになる。加えて電子
配布・複写方式は、ソフトウェア製品伝送用のディスケ
ットやカセットを作成する際に発生するかなりのコスト
を抑える目的では、市場に相当訴えるものがある。しか
し同時に無認可アクセスや複写使用等の悪用が蔓延する
恐れも合わせ持つ。
本発明は該環境において問題解決を提供する。
本発明による方式は、電子データ・オブジェクト中で実
行されまた、ユーザーすなわち要求者がそれを受信する
と自動実行される。
本発明の実施例は、コンピュータ・プログラム（ソフト
ウェア製品）の電子的伝送システムを示す文脈に関する
。該システムでは、要求者すなわち受信側が確実にソフ
トウェア製品を受は取ってその使用に関する諸条件に応
じたかどうかを、自動的に検査する。
本発明は電子配布されたソフトウェア製品の記憶保護技
術に関する。該ソフトウェア製品のライセンスは、いか
なる特殊アクセス・キーや復号プログラムおよび装置も
以前に与えられていない、要求元エンド・ユーザーが保
持すべきものである。
この技術自体は、電子配布ソフトウェア製品を使用・導
入できるのは該ソフトウェア製品に関する諸条件をエン
ド・ユーザーが受諾してから、という前提を基本にして
いる。普通はディスケットやカセットに同封されている
解読可能な形式のライセンス契約書は、電子配布データ
・オブジェクトすなわちソフトウェア製品の中に組み込
まれていて、−緒に伝送される。本発明による方式は、
ユーザーがソフトウェア製品を評価して受諾または拒否
できるよう、該ソフトウェア製品使用に関する諸条件、
料金および付随する開運データをユーザーに与える。該
方式はまた、ユーザーに対しメツセージと質問を与え、
その回答を記録して、ユーザーがソフトウェア製品を受
信し該ソフトウェア製品に関する諸条件に応じたか否か
を示す証明とする。
ここでユーザーが諸条件を受諾してその旨知らせると該
方式は、使用不可能な状態で伝送されたソフトウェア製
品を「活動開始」する。該方式はまた、ユーザーがソフ
トウニ、アな複写したことを、標識（ユーザーの受諾お
よびユーザー識別を示す）によりマークする。こうして
本発明による方式は、実際のディスケットやカセットに
ついてくるソフトウェア・ライセンス契約書の「ラップ
・フィルムを開封」するのと同様の方法を、電子的に提
供する。ソフトウェア製品にアクセスするためにまずラ
イセンス契約書の諸条件に同意の署名をして復号キーま
たはパスワードを受は取らなくてはならない、という従
来技術の電子配布システムにおける契約書署名方式は不
要となる。
本発明による方式実施に当たっては、ソフトウェア製品
の作成者すなわち送信側が容易すべき項目がいくつかあ
る。第１Ａ及び１８図に示すようにソフトウェア製品作
成者は、該ソフトウェア製品つまり電子配布されるデー
タ・オブジェクト中に、提案書、受諾検査および活動開
始機構（活動開始プログラム）を持つコード・モジュー
ルを含める必要がある。ソフトウェア製品作成者はまた
、活動開始機構への人力データを用意する必要がある。
作成者はまた、ライセンス契約に開運する諸条件を、画
面あるいは出力デイスプレィ・コード（活動開始プログ
ラムにより自動的にアクセスされる）に記録して、言語
で用意しなくてはならない。ライセンス契約の諸条件諾
否に関する適切なメツセージも、作成者がこのデータ中
に含めなくてはならない０作成者はさらに、自己選択に
よる定義情実行指定文字列を、ソフトウェア製品の主モ
ジュールまたはファイルに挿入しなくてはならない。こ
の実行指定文字列は「検査標識」と呼ばれ、ソフトウェ
ア製品が自己認識するものである。これについては後述
する。またこれは、ユーザーがライセンス契約を読み終
わってそれを受諾しライセンス契約の諸条件受諾を示し
た後に、修正されあるいはまた暗号化される。これにつ
いては後述する。
ソフトウェア製品作成者の義務としてはまた、該ソフト
ウェア製品を複写してその開運ファイル名およびモジュ
ール名に「疑似名」を与えて暗号化状態にすること、お
よび該ソフトウェア製品の実ファイル名と疑似ファイル
名の対照を示す相互参照テーブルを用意することである
。実ファイル名が復元されなければソフトウェア製品自
体の使用は不可能である。ユーザーが該ソフトウェア製
品に関する諸条件を受諾すると、活動開始プログラムに
より実ファイル名が復元されて復号される。
前述したように、ソフトウェア製品作成者は復号および
活動開始機構を用意しなくてはならない。
これは短いプログラム・ルーチンである（後述）。
最後に作成者は、パッチ・ファイルまたは導入ルーチン
を容易しなくてはならない。該ルーチンには、ユーザー
がソフトウェア製品使用に関する諸条件受諾を示した後
の受諾・検査処理完了時に、制御が渡される。
ユーザーのコンピュータまたはワークステーションでソ
フトウェア製品を活動開始させるための操作全般につい
て詳述する前に、基本概念を以下に要約しておく。
本発明の実施例にあるプログラムは、実際に配布される
ソフトウェア製品にまとめられるか、あるいはその必要
不可欠部分となる。実際にはこのプログラムは、ユーザ
ーのシステムへのソフトウェア製品導入手順最初の操作
として、ライセンス契約画面を表示してユーザーに適用
されるライセンス契約諸条件を提示する。ユーザーがも
しライセンス契約諸条件を受諾しなければ、本発明の活
動開始プログラム部分が操作を中断し、ソフトウェア製
品を使用可能にする修正を行わずに、ユーザーのオベレ
ーテインク・システムに制御を戻す。結果、何の「障害
」も生じず、エンド・ユーザーは「未開封」のソフトウ
ェア製品に戻るなりそれを適宜削除するなり自由に行え
る。しかしもしユーザーがライセンス契約諸条件に受諾
を示せば、前記実施例のコードによる付加動作が次のご
とく行われる。適用されるソフトウェア製品のモジュー
ルおよびファイル内で、ある定義済フィールドを修正す
ることによりユーザーの受諾を電子的に記録する。また
、元ファイル名を復元して再び使用可能にし、以前使用
不可能だったプログラムを使用可能な形式に変換する。
また最後には、配布ソフトウェア製品の復号および再構
築を行うコード部分を自動的に削除して自己修正し、該
ソフトウェア製品導入モジュールあるいは起動ルーチン
に制御を渡す。
この安全保護および配布に係る新規システムの主な特長
は、電子配布プログラムを本質的に「自己記憶保護」に
したことである。これにより、ライセンス供給および保
証事項を容易にカストマイズすることができ、広範囲の
資産保護手法がソフトウェア製品作成者の随意に使用で
きる。本発明によれば、ライセンス契約および記憶保護
技術が適用される「知的所有物」資産であるソフトウェ
ア製品を、単体あるいはパッケージのかたちでユーザー
へ電子配布される単一ソフトウェア製品または関連証明
書類を含む複数ソフトウェア製品のセットとして、再定
義することが可能となる。パッケージあるいは単体の内
容は、ソフトウェア製品作成者すなわち配布側により決
定される。
プログラミングに関する前記実施例の本質的要素はソフ
トウェア作成者が用意する。この大部分は第２図および
第３Ａないし３Ｅ図に間する。
第２図には簡単な流れ図を示す、これは、前記実施例に
従って配布データ・オブジェクトが受信者のコンピュー
タまたはワークステーションで初期設定および実行され
たとき、該データ・オブジェクト内で実行される操作を
表わす。
第２図に示す最初のステップは、ユーザー側に受信受諾
画面を表示するためのデイスプレィ・データを含むファ
イルへの、システムのアクセスである。メニュー　ライ
センス契約諸条件、保証に関する諸条件などが含まれる
。
第２図に示す次のステップでは、受信受諾情報画面に表
示された諸条件を受諾するか拒否するかユーザーに提示
する。もしユーザーが拒否を示せば、プログラムは中断
してオベレーテインク・システムに戻り、元のオブジェ
クト・モジュールおよびファイルは使用可能な形式に変
換されない。
しかしユーザーが諸条件に対する受諾を示せば、プログ
ラムは次のブロック１から５へ継続する。
ブロック１では、オブジェクト使用を活動開始するプロ
グラムが、作成者により元のオブジェクト・ファイル内
に挿入さ札た実行指定文字列（前述）を探索する。これ
らは修正されまた必要な場合によっては暗号化されて、
ユーザーすなわち受信側の応答（特定ユーザーの識別に
もなる）により人力された情報を持つようになる。
次にプログラムは、暗号化された疑似ファイル名と実フ
ァイル名を置き換えることにより復号を行なって、電子
配布オブジェクトを活動開始する。
これはあらかじめ作成者がデータ・オブジェクトに用意
しておいた相互参照テーブルによって行なわれる。この
テーブルは、ユーザーが諸条件受諾を示さない限り、ア
クセスすることも活動開始プログラムによって実用化す
ることも不可能である。
ブロック３ではプログラムは、必要な場合（検査合計が
使用されているとき）によっては配布されたオブジェク
トの検査合計を再計算する。
ブロック４では活動開始プログラムは、配布オブジェク
トを活動開始するため用意されたコード部分を削除して
自己修正する。ブロック５では相互参照テーブルも削除
し、オブジェクトの初期起動モジュールまたはファイル
（ソフトウェア作成者により名前が指示されたもの）に
制御を渡す。
これにより配布オブジェクトの使用および操作が可能と
なる。
第３Ａないし３Ｅ図は、受信側すなわちユーザーのコン
ピュータまたはワークステーションにて電子配布および
磁気記録されたデータ・オブジェクト（ソフトウェア製
品）を読み込む際の、活動開始プログラム処理の流れ図
である。これに関して詳述する。囲み１に示すようにエ
ンド・ユーザーは、ソフトウェア製品が磁気により記録
・配布されたものであればディスケットを挿入するか、
ホスト・システムから自分のコンピュータあるいはワー
・クステーションのハード・ディスクかフロッピー−デ
ィスク・ドライブへ電子配布ソフトウェア製品のダウン
ロードな要求する０次にユーザーは１の箱に示すコマン
ド”ｇｏＸＸＸ”を人力して、作成者がソフトウェア製
品に挿入した初期設定および活動開始機構を呼び出す。
これが活動開始プログラムを呼び出すコマンドである。
１の箱のＸＸＸは、実用化するソフトウェア作成者を識
別する独自の識別子である。活動開始プログラムには”
ｇｏ、ＣＯＭ”という名が付いているが、ユーザーがラ
イセンス契約を受諾してソフトウェア製品のファイルが
復号され名前が変わると、！’ＬＡ、ＣＯＭ”という名
に変更される。
次に活動開始プログラムは、作成者が規定した最初のラ
イセンス契約および保証に関するメニュー画面をユーザ
ーに対し表示する。たいていの場合この画面には前置き
が含まれ、諸条件が次画面でどのように表示されるかを
説明する。次画面に進むには普通ユーザーはＥＮＴＥＲ
キーを押せばよい。次にプログラムは２の箱へ進み、図
にあるようなユーザー選択メニュー画面を表示する。ユ
ーザーが規定保証に関する項目を読むため１を選択する
と、プログラムは２の箱を出て保証に関する画面（８の
箱）へ進み、それを読んだ後ユーザーは自分のブロック
へ戻る。２を選択すると、ライセンス契約に関する画面
が表示され、システムは図に示すごとく継続する。３を
選択すると、システムは中断してソフトウェア製品は使
用活動開始されず、オベレーテインク・システムに戻る
。その他のキーを押すと、正しい選択キーを押すようユ
ーザーに対しメツセージを表示する。
２のライセンス契約画面を選択すると、作成者がソフト
ウェア製品に挿入しておいた、ライセンス契約に関する
文章等すべてを表示する。その最後の画面でユーザーに
対し、ライセンス契約諸条件の諾否を示すよう、メツセ
ージを表示する。拒否を示せば、システムは中断してソ
フトウェア製品は使用活動開始されず、オベレーテイン
ク・システムに戻る。
受諾を示せば３の箱へ進み、「プログラムライセンス契
約（Ｐ　ＬＡ　）受諾」のプログラム・ルーチンが開始
する。３の箱の最初のステップは、疑似（暗号化）ファ
イル名とソフトウェア製品の実ファイル名の対照を示す
相互参照テーブルの探索である。このテーブルがもしな
ければプログラムは、製品作成者が主ファイルまたはモ
ジュール内に挿入した実行指定文字１１Ｌを探索し、そ
れらを修正する（９の箱にて説明する）。テーブルが見
つかればプログラムは、メモリ内に該テーブルを読み込
み、該テーブルの一行目をアクセスしてモジュールの疑
似（暗号）名でなく正しいファイル名を取り出す。実行
指定文字列が主ファイルあるいはモジュール内に挿入さ
れていれば、次のステッブはそれの修正あるいは暗号化
である。この処理は、テーブル中の全データをアクセス
し終え、全実行指定文字列を修正し終え、関連の全ファ
イルまたはモジュール名を正しい名前に置き換えるまで
継続する。この作業完了後に、場合によっては検査合計
の再計算（それが使用されていれば）が６の箱にて続い
て行なわれる（後述）。
相互参照テーブルがあれば、プログラムは４の箱へ進み
、テーブル処理ルーチンにより疑似名テーブルの全列が
処理されたかどうか検査される。全列が処理されたなら
テーブルは、５の箱で示すごとく削除される。４の箱で
は、プログラム作成者は配布データ・オブジェクトのフ
ァイル内にある文字列の修正および暗号化を要求するこ
とができる。
「テーブル削除」ルーチンは５の箱に示す。テーブルの
全データが処理されると４の箱から続いて実行される。
次に活動開始プログラムは、場合によっては６の箱にて
検査合計を再計算し、次に７の箱に進んでメモリおよび
電子配布ソフトウェア製品から保証に関する画面を削除
する。次に活動開始プログラムは、文字列及びファイル
名を修正（すなわち復号および名前の置き換え）するた
めのコードを削除して自己修正し、名前を自動的に”Ｐ
ＬＡ、ＣＯＭ”と付は替えて、要求があればライセンス
契約に関する画面を表示できるようにする。そして１１
の箱に制御を渡す。
８の箱は２の箱から続き、活動開始プログラムの保証に
関するルーチン部分を示す。
９の箱は３の箱から続き、電子配布ソフトウェア製品の
ファイルのうち、作成者が挿入した文字列を持つ全ファ
イルを探索する、文字列ルーチンを示す。ここでは、該
ファイル内で文字列を修正（または暗号化）する、アク
セスした文字列がすべて発見され修正されると上記３の
箱の受諾ルーチンに戻る。またこの９の箱では、製品使
用に関するさらに高レベルの安全保護が実施される。も
しここにおいて実行指定文字列が適切に修正されなかっ
た場合、ソフトウェア作成者が操作を中断してコード使
用を不可能にすることが簡単に行なえる。文字列探索の
ためアクセスされる各ファイルを検査する、検査ルーチ
ンを含めればよい。つまりこの、ソフトウェア製品によ
る文字列使用の自己検査は、追加機能である。
１０の箱は４の箱から呼び出され、活動開始ルーチンの
中のファイル発見部分を示す、もしソフトウェア作成者
が製品の元ファイル名を暗号化してあれば、ユーザーが
ライセンス契約を受諾してファイルが復号されるまでフ
ァイルの使用は不可能である。発行者すなわち作成者は
、疑似ファイル名と実ファイル名の対照を示す相互参照
テーブルを用意している。このルーチンは、３の箱から
統く４の箱で終了する（前述）。
活動開始プログラムは７の箱から統く１１の箱（前述）
で終了する。ここで活動開始プログラムは、ソフトウェ
ア作成者の用意したパッチ・ファイルあるいは導入プロ
グラム名に制御を渡し、次に実際のソフトウェア製品使
用の初期設定に進む。
評価に値すると思われるのは、元ファイルの名前変更・
暗号化がソフトウェア作成者によって最初に実行される
こと、および作成者が暗号化ファイルとともに疑似名（
暗号名）と実ファイル名の対照を示す相互参照テーブル
を用意することである。この方法により、ユーザーがラ
イセンス契約諸条件を受諾するとルーチンの活動開始部
分が順次活動化され、正しいファイル名が復元される。
このように作成者により、「自己活動化」機構がソフト
ウェア製品内に構築される。該機構はエンド・ユーザー
により（そうと意識せずに）呼び出される。その結果、
ソフトウェア製品は使用不可能な形式に変換される。復
号処理が前もって実施されない限り、ファイル（ファイ
ル名）使用コード・モジュール内の内部参照は正しいフ
ァイル（ファイル名）を発見できないからである。その
復号処理は、ユーザーがライセンス契約諸条件を受諾し
ない限り、実行や呼出しはできない。こうして、電子配
布されたデータ・オブジェクトすなわち作成者により供
給されたソフトウェア製品は、ソフトウェア製品のプロ
グラム・コードのみならず、必要な活動開始テーブル、
適切な画面のセット、およびユーザーのライセンス契約
画面情報諾否を決定する制御コードを多少持つ、活動開
始ルーチンを含む。ユーザーが受諾して活動開始ルーチ
ンがすべて完了すると、活動開始部分と活動開始テーブ
ルはルーチンにより自動的に削除される。
その結果、ユーザーがソフトウェア製品をアクセスした
り実際に使用したりできるようになる前に「キー」ある
いは「復号技術」が削除されることになる。活動開始プ
ログラム・ルーチン（図面により前述）は、見込みユー
ザーの入力情報を暗号化あるいは記録し、その情報をユ
ーザーの複写とともに永久に「マーク」して後にプログ
ラム作成者がアクセスできるようにする手順も含む。該
情報は、ユーザーおよびその複写事実を識別して、後に
無認可の複写が探知されたときその出所を明らかにする
。こうしてプログラム作成者の選択によりさまざまな方
法で（中には検査合計計算や、ソフトウェア製品内修正
文字列検査等、追加の機能もある）、安全保護を容易に
挿入できる。一方ユーザー側では、諸条件を受諾すれば
活動開始ルーチンが呼び出されてソフトウェア製品は使
用可能状態に復元されるので、それ以外にはソフトウェ
ア製品をアクセスするのに特に何ら準備する必要はない
。
この概念は本発明の領域内でさまざまに拡張適用が可能
である０例えば、電子配布データ・オブジェクトは必ず
しもライセンス契約画面を持つプログラムである必要は
なく、受諾検査を必要とする単なる証明メツセージや法
律文書（ドキュメント）でも構わない。ユーザーが受諾
を示すための検査命令文や受諾画面は、受信者がメツセ
ージの受信に応じたときのみ、送信者に伝送肯定応答を
返すのに使用することもできる。またさらに、オブジェ
クト内容は必ずしも、ライセンス契約やメツセージであ
る必要もなく、受信受諾の証明を必要とする契約書、船
荷証券、その他いかなる重要公文書でも構わない。
簡易なプログラム・ルーチンによる実施例に関し本発明
を述べてきたが、当業者によれば、該実施例のルーチン
における自動活動開始・自己検査処理の基本概念を逸月
梵することなく、修正・拡張を行なうことが可能である
。
Ｆ６発明の効果 上述のごとく、本発明によれば、前もっての受信許可や
解放キー、パスワード等なしでできる受信受諾検査の改
善方法、および電子データ・オブジェクトの安全保護を
提供することが可能である。

Claims (2)

    【特許請求の範囲】
  1. （１）それぞれ互いに物理的に離隔された、データ・オ
    ブジェクトの送信者と受信者のための情報通信システム
    であって、上記送信者側に設けられた、上記受信者に配
    布するためのデータ・オブジェクトを用意するための手
    段と、上記データ・オブジェクトを上記送信者から上記
    受信者に配布するためのデータ配布手段と、上記配布さ
    れたデータ・オブジェクトの受領を検証するためのサブ
    システムを有する情報通信システムにおいて、 （ａ）上記送信者側において、上記配布のためのデータ
    ・オブジェクトを使用不可能あるいは非動作状態になる
    ように変更するための手段と、（ｂ）上記送信者側にお
    いて、上記配布の前に上記データ・オブジェクトに有効
    化手段を挿入するための手段と、 （ｃ）上記受信者において、上記変更されたデータ・オ
    ブジェクトを、表示及び動作のためのコンピュータにロ
    ードするための手段と、 （ｄ）上記データ・オブジェクトの上記有効化手段のみ
    に最初にアクセスして、ユーザーの応答を請求するため
    にそれに含まれているデータの一部を表示するための手
    段と、 （ｅ）上記ユーザーの応答を入力して記録するための手
    段と、 （ｆ）上記応答によって条件付けられ、上記有効化手段
    を用いて上記データ・オブジェクトを使用可能または動
    作可能状態に変更するための手段、とを具備する情報通
    信システム。
  2. （２）送信者から受信者へデータ・オブジェクトを配布
    するためのシステムにおいて、上記配布されたデータ・
    オブジェクトの受領を検証するための方法において、 （ａ）上記データ・オブジェクトを使用不可能状態に変
    更するとともに上記データ・オブジェクトに有効化手段
    を挿入する段階と、 （ｂ）上記データ・オブジェクトを上記受信者へ上記使
    用不可能状態で配布する段階と、 （ｃ）上記有効化手段を用いて上記データ・オブジェク
    トを使用可能または動作可能状態に変更する段階とを有
    する、 情報通信方法。
