【発明の属する技術分野】
本発明は、発注者が発注しようとする任意の作業について、その作業を請け負う請負者を発注者に仲介する請負者仲介方法および装置、記憶媒体、プログラムに関するものである。

【従来の技術】
近年、商品購入・作業発注などさまざまな分野で、インターネットを利用して仲介者に多くの候補を紹介してもらい、ユーザはその中から発注先を決定する仲介システムが存在している。

【発明が解決しようとする課題】
しかし、従来の仲介システムは、交渉の最初の段階で、発注者の名前や連絡先など発注者を特定する特定情報が交渉相手に開示されてしまう。

発注者にとっては、結果的には通知する必要がなかった交渉相手にまで、自分の特定情報が渡ることで、その交渉相手から不必要な広告を送られることがあり、あるいは、今後その交渉相手に発注する場合、何らかの不利益を蒙るのではないか、という不安感が付きまとう。

また、発注内容について発注者よりも交渉相手の専門知識量が格段に高い場合、発注者からすると、交渉に関して何の支援もなく交渉相手と折衝することは大いに不安である。

本発明の目的は、上記問題点の解決を図り、発注者自身が交渉の過程で自分の個人情報を開示するタイミングと開示先を決定することができるようにすることにある。また、本発明の目的は、仲介システムの評価が反映された交渉相手を発注者に提示することにある。さらに、本発明の目的は、交渉段階における発注者や交渉相手の発信情報を監視し、発注者側の専門知識を補い正当な交渉を実現することにある。

【課題を解決するための手段】
本発明にかかる請負仲介方法および装置、記憶媒体、プログラムは、発注者から発注すべき発注内容を受け付けると、請負候補者が前記発注者を特定できない状態で、両者間の交渉を仲介し、交渉の結果、改めて発注者が指定した請負候補者に対してのみ前記発注者の特定情報を通知することを特徴とする。

さらに、本発明にかかる請負仲介方法および装置、記憶媒体、プログラムは、交渉を仲介する際、発注者から請負候補者に発せられた質問に不備が無いか否かを判定し、不備がある場合は、情報を補足して質問を請負候補者に通知することを特徴とする。

さらに、本発明にかかる請負仲介方法および装置、記憶媒体、プログラムは、交渉を仲介する際、発注者から前記請負候補者に発せられた質問に対して、前記請負候補者の過去における回答で流用できる回答がある場合は、該回答に基づいて回答情報を表示することを特徴とする。

さらに、本発明にかかる請負仲介方法および装置、記憶媒体、プログラムは、請負候補者が請負可能な作業内容を含む請負者情報を請負者データベースに蓄積し、発注者から発注内容を受け付けると、その発注内容と請負可能な作業内容に合致する請負候補者情報をデータベースから抽出して発注者に提示し、この請負候補者情報に基づいて、発注者に請負候補者を選択させることを特徴とする。

【発明の実施の形態】
以下、一般ユーザが住宅建築を発注する場合を想定した本発明の実施例を図面に基づいて説明する。

図１に実施形態を示す。本発明は、仲介装置１００、ネットワーク１１０、ユーザ端末１２０、建築会社端末１３０で構成される。
【００１６】
仲介装置１００は、さらに、登録プログラム１０１、建築会社抽出プログラム１０２、仲介処理プログラム１０３、工程評価プログラム１０４、建築会社データベース１０５（以下、「建築会社ＤＢ」と記す）、案件データベース１０６（以下、「案件ＤＢ」と記す）、評価データベース１０７（以下、「評価ＤＢ」と記す）で構成される。

登録プログラム１０１は、建築会社から申請される自社の連絡先情報、名称・所在などの識別情報、自社の得意とする建築分野や希望地域などの請負可能な発注内容を登録する。建築会社抽出プログラム１０２は、ユーザから発注を受け、発注内容および建築会社の評価を基準に発注可能な建築会社の候補をユーザに提示し、その中からユーザが交渉相手として選択した建築会社を識別し、交渉相手となった建築会社へ交渉発生を通知する。仲介処理プログラム１０３は、発注者と交渉相手とされた建築会社の間の交渉を仲介すると同時に建築会社の交渉過程を評価する。工程評価プログラム１０４は、ユーザが選択した最終的な発注先の建築会社を識別し、その建築作業の進捗状況を評価する。建築会社データベース１０５は、登録プログラム１０１が収集した建築会社の情報などを蓄積するとともに、各社の総合評価を管理する。案件ＤＢ１０６は、各交渉案件の関連情報や交渉メッセージなどを蓄積する。評価ＤＢ１０７は、仲介処理プログラム１０３、工程評価プログラム１０４が下した建築会社の評価情報を回答別、会社別に蓄積する。

ネットワーク１１０は、インターネット網を想定しているが、ユーザ端末１２０および建築会社端末１３０が、仲介装置１００によって作成されるＷｅｂページに接続して各種データを交換を行ったり、仲介装置１００と電子メールをやり取りすることが可能なデジタルデータ対応の通信網であればよい。

ユーザ端末１２０および建築会社端末１３０は、ワークステーション、パソコン、携帯電話、ノートパソコン、ＰＤＡ（Personal Digital Assistantパーソナル・データ・アシスタント）など、ＷＷＷ（World Wide Web）上のＷｅｂページに接続可能であり、あるいは、電子メールの送受信が可能な端末であればよい。

本発明に係わる全体的な処理概念フローを図２に示す。最初に建築会社の建築会社端末１３０によって、登録プログラム１０１の作成するＷｅｂページにアクセスされ、建築会社の連絡先情報、名称・所在などの識別情報、自社の得意とする建築分野や希望地域などの請負可能な発注内容に関するデータが仲介装置１００に送信される（Ｓ２００）。

図８に登録画面８００の例を示す。住宅建築会社によって、登録画面８００から、自社の企業名８０１、メールアドレス８０２、請負希望地域８０３、専門分野８０４、および、セールスポイント８０５が入力される。登録ボタン８０６が押下されると、登録プログラム１０１へ以上のデータが送信される。この画面例には図示されていないが、登録する情報として、さらに、住所、電話番号、銀行口座、責任者、自社ホームページ等、ユーザや仲介装置１００運営者がこの住宅建築会社を調べ、または、経理処理を行うために必要な情報をさらに加えてもよい。

次に、登録プログラム１０１は、建築会社端末１３０から送信されてきた建築会社の登録申請データを建築会社ＤＢ１０５に入力して、登録結果を建築会社端末１３０へ回答する（Ｓ２０１）。図３に、建築会社ＤＢ１０５で蓄積される建築会社テーブル３００を示す。建築会社テーブル３００には、住宅建築会社を識別するＭＡＫＥＲ−ＩＤ３０１、企業名３０２、メールアドレス３０３、請負希望地域３０４、専門分野３０５、会社別評価テーブル６００に基づいてランク付けされた総合評価３０６を有する。登録画面８００で入力されたセールスポイント８０５のデータも建築会社ＤＢ１０５に蓄積され、図示していないが、建築会社テーブル３００にセールスポイント８０５へのリンク情報を保持している。図９に登録プログラム１０１が建築会社端末１３０に提示する登録結果画面９００を示す。登録結果画面９００には、企業名９０１、ＭＡＫＥＲ−ＩＤ３０１に対応する会社ＩＤ９０２を提示する。

登録結果画面９００の文面にもあるように、登録プログラム１０１は、自動的に建築会社ＤＢ１０５へ建築会社を登録するのではなく、登録申請があった場合、登録プログラム１０１は、図示していない表示装置にその登録申請データを表示し、それに対応して、仲介装置１００運営者が、建築業界の情報や消費者センターといった消費者苦情対応機関の情報などからその建築会社の事前審査を行うこともあり得る。その結果登録可能である会社については、運営者が図示していない入力装置から登録可情報を入力し、登録可情報のあった会社の情報のみを登録プログラム１０１が建築会社ＤＢ１０５に登録し、登録回答画面へ表示してもよい。また、登録プログラム１０１は、Ｗｅｂページではなく、電子メールで建築会社端末１３０へ回答してもよい。

次に、建築会社抽出プログラム１０２がＷＷＷ上に公開する建築依頼画面１０００にユーザ端末１２０でユーザがアクセスし、建築の依頼情報をユーザ端末１２０から建築会社抽出プログラム１０２に送信する（Ｓ２０２）。図１０に建築依頼画面１０００の画面例を示す。建築依頼画面１０００には、ユーザ名１００１、メールアドレス１００２、建築予定地域１００３、希望する建築分野１００４、コメント１００５を入力する領域と、以上の情報を建築会社抽出プログラム１０２へ送信する登録ボタン１００６がある。因みに、入力すべき依頼情報は以上の情報に限るものではない。仲介装置１００運営者が必要とする情報を追加できる。

建築会社抽出プログラム１０２は、ユーザからの依頼情報を受信し、案件ＤＢ１０６にその依頼情報を登録し、交渉候補の建築会社をユーザ端末１２０に提示し、ユーザが選択した交渉相手をユーザ端末１２０から受信して、該当する建築会社へ通知する（Ｓ２０３）。

具体的には、建築会社抽出プログラム１０２は、ユーザ端末１２０からの建築依頼情報を受けると、案件ＤＢ１０６の案件テーブル４００に新規レコードを作成し、この案件に付した案件ＩＤ４０１、ユーザ名４０２、メールアドレス４０３、希望する建築分野４０４を書き込むとともに、この案件のために設けられるユーザ向け交渉専用Ｗｅｂページを作成し、そのｕｒｌ４０７も案件テーブルへ書き込む。図示していないが、建築会社抽出プログラム１０２は、ユーザに最初に提示した会社のＭＡＫＥＲ−ＩＤ３０１を案件テーブル４００で管理してもよい。また、ユーザからのコメント１００５データも案件ＤＢ１０６で管理される。

次に建築会社抽出プログラム１０２は、依頼建築予定地域１００３、希望する建築分野１００４をキーに建築会社テーブル３００の希望地域３０４、専門分野３０５を参照して、合致するＭＡＫＥＲ−ＩＤ３０１を抽出して、ユーザ端末１２０に対して、交渉相手候補通知画面１１００を提示する。

建築会社抽出プログラム１０２が交渉候補の会社を抽出する際、さらに、コメント１００５データと、建築会社ＤＢ１０５に記録された建築会社のセールスポイント８０５をマッチングさせて提示会社を抽出してもよい。

図１１に交渉相手候補通知画面１１００を示す。交渉相手候補通知画面１１００には、当案件に関するユーザ名１１０１、希望する建築分野１１０２、交渉相手と交渉するための交渉専用画面１２００のＵＲＬ１１０３、交渉相手をユーザが選択するため各交渉候補に付される選択ボタン１１０４、建築会社抽出プログラム１０２が抽出した各建築会社の社名１１０５、仲介処理プログラム１０３および工程評価プログラム１０４により今まで評価した各建築会社の総合評価１１０６、各建築会社のセールスポント１１０７が表示される。また、ユーザ端末１２０から仲介装置１００にユーザの選択結果を通知する選択完了ボタン１１０８が用意されている。交渉相手として選択された建築会社の情報は仲介装置１００に通知されると、建築会社抽出プログラム１０２によって、案件テーブル４００の交渉会社４０５に記録される。

図示していないが、案件ＩＤ４０１を交渉相手候補通知画面１０００に表示し、これを専用ＵＲＬにアクセスする際の認証番号に利用してもよい。また、交渉候補通知は電子メールでユーザ端末１２０に伝え、ユーザ端末１２０が電子メール内に表示されたｕｒｌへアクセスすることで、候補会社通知画面１１００が表示されるようにしてもよい。

Ｓ２０４で、Ｗｅｂページ上の交渉相手通知画面１１００により、ユーザ端末１２０は交渉相手の候補となる建築会社の情報を入手する。Ｓ２０５で、その画面から交渉相手をユーザが選択し、選択情報をユーザ端末１２０から仲介装置１００へ選択情報を通知する。

Ｓ２０６で、その情報に基づき建築会社抽出プログラム１０２は、案件テーブル４００へ選択された交渉会社４０５を書き込む。建築会社テーブル３００のメールアドレス３０３を参照して、交渉相手として選択された会社へ、交渉案件が発生した旨を電子メールで建築会社端末１３０へ送信する。そして、建築会社端末１３０はこの電子メールを受理することで、交渉案件の発生を認識する。ただし、Ｓ２０６では、ユーザの個人情報は、建築会社には通知されない。

次に、Ｓ２０９で、ユーザはユーザ端末１２０から建築会社に対する問い合わせをし、また、Ｓ２０８で、建築会社は建築会社端末１２０からユーザに対する回答をする一連の交渉および個人情報開示通知のプロセスを、仲介処理プログラム１０３が管理する（Ｓ２０７）。

仲介処理プログラム１０３は、ユーザに対して交渉専用画面１２００を設け、ユーザ問い合わせやそれに対する建築会社の回答を表示する。一方、仲介処理プログラム１０３は、建築会社に対しては電子メールで、ユーザの問い合わせを送り、また、建築会社の回答を受付ける。そして、仲介処理プログラム１０３は、案件ＤＢ１０６内に、各情報のログファイルとともに、評価ＤＢ１０７内の案件別回答評価テーブル５００に建築会社の回答の評価結果を記録し、また、回答内容が他の案件にも流用できる場合は流用回答テーブル７００にその回答を記録する。また、仲介処理プログラム１０３は、案件別回答評価テーブル５００の記録結果に応じて、逐次会社別評価テーブル６００を書き換え、さらに建築会社テーブル３００の該当建築会社の総合評価３０６を更新する。

案件別回答評価テーブル５００は、案件毎に用意されたファイルである。図５に示すように、その内容は、案件ＭＡＫＥＲ−ＩＤ５０１、質問毎に付された質問ＩＤ５０２、回答毎に付された回答ＩＤ５０３、および、各回答に対する仲介装置１００運営者が判定した評価５０４〜５０５、回答の内容に問題があり再度回答を指示されたか否かを示す再回答フラグ５０６、最終的に受注した会社がＳ２１３で入力して参考情報について仲介装置１００運営者が判定した評価５０７〜５１０で構成される。

会社別評価テーブル６００は、会社毎に用意されるファイルで、案件ＩＤ６０１毎のレコードに各案件の評価点を管理する。図６に示すように、テーブル項目としては、案件ＩＤ６０１、個人情報開示を示す実績フラグ６０２、正式受注を示す決定フラグ６０３、交渉段階の回答の平均評価６０４・６０５、再回答を指示された度数６０６、正式発注後の各工程の評価６０７〜６１０で構成される。

流用テーブル回答７００は、案件ＤＢ１０６に蓄積され、建築会社ごとに用意される。テーブル項目は、回答内容７０１、質問ＩＤ７０２、回答ＩＤ７０３で構成される。

図１２にユーザ端末１２０からアクセスした交渉専用画面１２００の画面例を示す。ユーザ端末１２０に提示される交渉専用画面１２００はフレーム構成になっており、左フレーム欄にはユーザが操作する目次情報が掲示され、当案件の識別番号１２０１、ユーザ名１２０２、右フレームにどの交渉相手との情報交換画面を表示するかをユーザに選択させる選択ボタン１２０３、交渉相手の会社名１２０４、建築会社から新たに回答があった旨を表示する新着ロゴ１２０５、最終的な交渉のためにユーザが個人情報の開示を許す交渉相手を決定するための個人情報開示先決定画面１３００へ遷移するための情報通知画面遷移ボタン１２０６、および、終了ボタン１２０７が用意されている。図示されていないが、最終的な発注先決定を仲介装置１００に通知する画面が新たに設けられた場合は、その画面への遷移ボタンが用意される。

また、右フレームの交渉相手との情報交換画面には、今まで情報交換された履歴になっている履歴目次１２０８、情報表示入力領域１２０９、現在表示中の情報と関連しない情報を入力するための画面を情報表示入力領域１２０９に用意する新規情報入力ボタン１２１０、現在表示中の情報に関連する情報を入力するための画面を情報表示入力領域１２０９に用意する回答情報入力ボタン１２１１が用意される。右フレームの画面は、ユーザが選択ボタン１２０３で選択した建築会社との交渉に関する情報が表示される。

履歴目次１２０８の各目次は、各発言情報が仲介装置１００に受信された日時、誰の発言かを識別する記号、発言の題名が表示される。また、関連する目次は各メッセージの関係が認識しやすいように樹系図形式などで視覚化される。

交渉相手の建築会社に対しては、この時点では、まだこの交渉専用画面１２００の存在は通知されず、仲介処理プログラム１０３がユーザの発信情報の内容を電子メールで建築会社端末１３０に送信し、建築会社端末１３０からの返信は仲介処理プログラム１０３が受信し、その内容を交渉専用画面１２００に掲載する。仲介処理プログラム１０３が電子メールを建築会社端末１３０へ送信する際は、どの案件に関する情報なのかも明示しない。以上のような情報交換形式によって、建築会社１３０が案件によって交渉内容に優劣をつけることは困難になる。

Ｓ２１０で、交渉を繰り返す中で、ユーザは最終的な交渉を対面で行いたいと思う交渉相手へ自分の個人情報を開示する許可を仲介装置１００に通知する。特に住宅建築においては、建築会社と対面して交渉を詰めなければ、最終的な発注先を決定することが困難なため、このステップが用意される。

具体的には、交渉専用画面１２００の情報通知画面遷移ボタン１２０６を押下され、個人情報開示先画面１３００に遷移し、そこで開示先が選択される。

図１３に個人情報開示先決定画面１３００の画面例を示す。個人情報開示先決定画面１３００には、当案件の識別情報１３０１、ユーザの名称１３０２、各交渉相手の会社に付される選択ボタン１３０３、会社名１３０４、および、決定ボタン１３０５が用意される。ユーザは、交渉相手全てを選択してもよいし、あるいは、一つも選ばなくてもよい。一つも選ばない場合は、図１３に図示されていないが、新たな建築会社を紹介するよう要求する指示ボタンが用意され、指示ボタンが押下されると、ユーザ端末１２０からその要求情報が仲介装置１００へ送信され、これを機に建築会社抽出プログラム１０２が新たな抽出処理を行う。

Ｓ２１１で、決定ボタン１３０５が押下されると、選択された情報がユーザ端末１２０から仲介装置１００に送信され、仲介処理プログラム１０３が、案件テーブル４００の個人情報通知会社４０６に開示先会社のＭＡＫＥＲ−ＩＤ３０１を書き込み、開示先会社のメールアドレス３０３に対して、ユーザに関する個人情報を電子メールで通知する。こうして、建築会社端末１３０は、発注の獲得とユーザの個人情報を受理することになる。

図１４は、仲介処理プログラム１０３が発信するユーザ情報通知メール１４００の例である。ユーザ情報通知メール１４００により、建築会社端末１３０に対して、初めて案件の識別子１４０１、ユーザを特定するためのユーザ名１４０２、メールアドレス１４０３が開示されるとともに、ユーザとの交渉のための専用掲示板のｕｒｌ１４０４が伝えられる。この専用掲示板は、ユーザ向け交渉専用画面１２００の右フレームだけが表示される。この専用掲示板にアクセスできるようになって、建築会社は初めてこの案件１４０１に関して今までなされた情報交換履歴が履歴目次１２０８によって認識できることになる。なお、この建築会社向け交渉専用掲示板ｕｒｌ１４０４は、図示されていないが、案件テーブル４００で管理される。

Ｓ２１１で、ユーザ端末１２０は、さらにユーザが決定した最終的な発注先を送信する。Ｓ２１２で、仲介処理プログラム１０３が、その情報を評価ＤＢ１０７に記録し、最終発注先に通知するとともに、以後の工程について評価を行う。

Ｓ２１３で、正式に受注した建築会社は、その後、仲介装置１００の運営者から指示された情報を、指定されたｕｒｌのＷｅｂページに表示された工程審査参考情報入力画面１５００から、審査のための参考情報として建築会社端末１３０から送信する。

図１５に、工程審査参考情報入力画面１５００の画面例を示す。この画面には、案件ＩＤ１５０１、建築会社名１５０２が既に表示されている。建築会社は建築会社端末１３０より、報告する工期１５０３を選択し、その実績期間１５０４、資材の種類および製品名１５０５を入力するとともに、図面で指定された箇所の画像を送るため、指定撮影箇所１５０６を選択し、画像のディレクトリを指定する。全てを入力した時点で、建築会社は報告ボタン１５０９を押して、建築会社端末１３０から、これらの情報を仲介装置１００へ送信する。

仲介装置１００の工程評価プログラム１０４は、受信された参考情報を図示していない表示装置へ表示し、仲介装置１００の運営者が図示していない入力装置から判定した評価を、案件別回答評価テーブル５００および会社別評価テーブル６００へ記録し、最終的に建築会社テーブル３００の総合評価３０６を更新する。

Ｓ１６００で、建築依頼画面１０００に入力されたユーザの依頼情報が受信されると、建築会社抽出プログラム１０２は、案件テーブル４００で新規レコードを生成するとともに新たな案件ＩＤ４０１を設定し、建築依頼画面１０００から入力されたユーザ名４０２、メールアドレス４０３をレコードに記録した上で、コメント１００５を案件ＤＢに蓄積する。

Ｓ１６０１で、建築地域１００３を読み込み、建築会社テーブル３００から希望地域３０４が合致する建築会社を抽出する。

次に、Ｓ１６０２で建築会社抽出プログラム１０２は、希望分野１００４を読み込み案件テーブル４００の希望分野４０４へ記録する。そして、Ｓ１６０３で、希望地域が該当する建築会社レコードから、さらに専門分野３０５が合致する建築会社のレコードを抽出する。なお、この際、ユーザが入力したコメント１００５と建築会社のセールスポイント８０５を照らし合わせ、合致するキーワードがある建築会社を選択してもよい。

図１０の例では、希望分野が「シック」であるから、先に抽出された４社の内、「０１０１」・「０１０４」・「０１０７」の３社が抽出される。

Ｓ１６０４で、建築会社抽出プログラム１０２は、さらに、抽出された建築会社の総合評価３０６を比較する。図３の例では、「０１０１」の総合評価が「５」、「０１０４」は「４」、「０１０７」は「２」となっている。

Ｓ１６０５で、建築会社抽出プログラム１０２は、最終的にユーザ端末１２０に表示する建築会社とその表示順を決定し、Ｓ１６０６で、交渉相手通知画面１１００を作成・表示する。図１１の例では、総合評価が「３」未満の会社はユーザに表示しないように予め設定しているため、「０１０７」は表示されない。また、建築会社は総合評価の高い順に表示するよう予め設定しているので、「０１０１」・「０１０４」の順で表示されている。
