Abstract

Description

本発明は、一般的には放送コンテンツに係り、より詳細にはタイムシフトされた放送コンテンツにおけるコマーシャルの挿入に関する。
先行技術においては、コマーシャルを保存しておき、メモリからのブロックの再生によってライブのストリームを一時的に置換することによりライブの放送ストリームに該コマーシャルを挿入することが知られている。従って、ライブ放送ストリームにおけるコマーシャルブロックは、ユーザにとってより関心のある他のコマーシャルブロック（例えば地方の広告又はコマーシャル）によって置換されることができる。図１においては、保存されたコンテンツ（例えばコマーシャル３及び４）が、メモリからのコマーシャルブロック３及び４の再生によってライブの放送ストリーム１００を一時的に置換することによって、番組ブロックＡ、Ｂ及びＣを含むライブの放送ストリーム１００に挿入される。このようにして、ライブの放送ストリーム１００におけるコマーシャルブロック１及び２は、他のコマーシャルブロック３及び４によって置換されることができる。新たなデータストリーム２００における置換されたコマーシャルブロック３及び４は、ユーザによってより関心のある地方の広告又はコマーシャルであっても良い。しかしながら、この方法においては、図１に示されるように、挿入されるコマーシャルのブロック３及び４は、これらブロックが置換するブロック１及び２と等しい長さだけ継続する必要がある。このことは、この方法の適用可能性を著しく制限する。
先行技術においては、図２に示すように、より長い長さのコマーシャル５又は短い長さのコマーシャル６によってライブ放送ストリーム１００中のコマーシャル１及び２を置換するために、付加的なメモリによってライブのテレビジョン放送ストリーム１００を遅延させることも知られている。受信器は、ライブ放送ストリーム１００中の番組ブロックＡ、Ｂ及びＣを遅延させ、遅延されたストリーム３００を生成するためだけでなく、メモリを利用する。図２に示されるように、ライブ放送ストリーム１００における利用可能なギャップ（１）よりも長いコマーシャル５を挿入したいとユーザが欲する場合、該ライブ放送の再開が遅延される。しかしながら、該遅延は、より短く継続する新たなコンテンツのブロック（６）を挿入するように置換されるべき次のコンテンツのブロックにおいて利用され得る。このようにして、図１の方法を用いて可能であるよりも、コンテンツのブロックを置換するための大きな自由度がもたらされる。しかしながら、これらの処理においては、広告主の利益が保護されない。なぜなら、より長いコマーシャル及び時にはコマーシャル全体が、観測者に無視されるからである。
それ故本発明の目的は、先行技術に関連するこれらの及び他の欠点を克服する方法及び装置を提供することにある。
従って、データストリームに代替コマーシャルを挿入する方法であって、前記データストリームは番組部分とコマーシャル部分とを持つ方法が提供される。前記方法は、前記データストリームの１以上の前記コマーシャル部分を検出するステップと、前記検出された１以上の前記コマーシャル部分を、より多くの又はより少ない前記代替コマーシャル部分によって置換するステップとを有する。
前記方法は更に、前記検出するステップに後続する、前記データストリーム中の前記コマーシャル部分を保存するステップを有しても良い。この場合には、前記置換するステップは、前記データストリームからの前記保存されたコマーシャル部分及び外部ソースからの他のコマーシャル部分の少なくとも一方から、前記代替コマーシャル部分を選択するステップを有しても良い。前記方法は更に、前記外部ソースからの他のコマーシャル部分を保存するステップを有しても良い。
前記方法は更に、前記データストリームの１以上の前記番組部分を検出し、前記検出された１以上の番組部分を保存するステップを有しても良い。
前記置換するステップは、ユーザの１以上の基本設定を指示するステップを更に有しても良い。前記指示するステップは、ユーザによる手動の指示であっても良い。前記指示するステップは、ユーザの視聴の好みを示すユーザプロファイルを形成する推薦システムからの自動的な指示であっても良い。前記ユーザの１以上の基本設定は、好ましい代替コマーシャル部分、好ましい代替コマーシャル部分の頻度、及び好ましい代替コマーシャル部分の長さから成る群から選択されても良い。
前記方法は更に、前記番組部分及び前記代替コマーシャル部分を持つ出力データストリームを出力するステップを有しても良い。前記代替コマーシャル部分は前記検出されたコマーシャル部分よりも多くても良く、前記方法は、少なくとも１つの代替コマーシャル部分を間に持つサブ部分に前記番組部分の少なくとも１つを分割するステップを更に有しても良い。前記代替コマーシャル部分は前記検出されたコマーシャル部分よりも少なくても良く、前記方法は、少なくとも２つの前記番組部分をより大きな番組部分に結合するステップを更に有しても良い。
また、データストリームに代替コマーシャルを挿入する装置であって、前記データストリームは番組部分とコマーシャル部分とを持つ装置が提供される。前記装置は、前記データストリームの１以上の前記コマーシャル部分を検出する検出装置と、前記検出された１以上の前記コマーシャル部分を、より多くの又はより少ない前記代替コマーシャル部分によって置換するスケジューラ装置とを有する。
前記装置は更に、前記検出に後続して、前記データストリーム中の前記コマーシャル部分を保存するメモリを有しても良い。
前記装置は更に、外部ソースからの他のコマーシャル部分を保存するメモリを有しても良い。この場合、前記装置は更に、前記他のコマーシャル部分を持つ第２のデータストリームを受信するために前記検出装置に実施上接続された第２のチューナを有しても良い。
前記検出器は更に、前記検出装置は更に前記データストリームから１以上の前記番組部分を検出し、前記装置は前記１以上の検出された番組部分を保存する（代替としては「遅延させる」と呼ばれる）メモリを更に有しても良い。

本発明は多くの及び種々のタイプのコンテンツに適用可能であるが、ビデオコンテンツの環境において特に有用であることが分かっている。それ故、本発明の適用可能性をビデオコンテンツに限定することなく、本発明は斯かる環境において説明される。しかしながら、当業者は、本発明の方法が、オーディオコンテンツのような他のタイプのコンテンツも利用することができることを理解するであろう。
ここで図３を参照すると、図１及び２に示されたものと同じライブ放送データストリーム１００が示されている。本発明は以下「放送」データストリームに関して説明されるが、「放送」データストリームは単に例として議論されるものであって、本発明がこれに限定されるものではないことを当業者は理解するであろう。例えば本発明は、ブロードバンドネットワークを利用してインターネットを介して見ることができるストリーミングビデオコンテンツにも同様に適用可能である。しかしながら、ライブ放送データストリーム１００は、データストリーム４００によって置換される。ここでは、２つの大きなコマーシャル１及び２が、より多くのより小さなコマーシャル７乃至１０によって置換される。図示されていないが、前記ライブ放送ストリーム中のより小さなコマーシャルはまた、より少ない大きなコマーシャルによって置換されても良い。多くの小さなコマーシャルを、少ない大きなコマーシャルによって置換することは、データストリームの先頭においてタイムシフト（遅延）を必要とし得る。ユーザは適切なユーザインタフェースを介して、多くの小さなコマーシャル７乃至１０か、又は少ない大きなコマーシャルかのいずれかに、基本設定（preference）を指示することができる。同様に図３に示されるように、ブロックＡ及びＢはサブブロックＡ１及びＡ２並びにＢ１及びＢ２に分割され、それぞれ間にコマーシャルを挿入される。図では２つのサブブロックに分割されているが、ライブ放送データストリーム１００のブロックＡ及びＢは、３以上のサブブロックに分割されても良い。図３においてはブロックＣはタイムシフトｔｓを除き変更されていないが、同様に２以上のサブブロックに分割されても良い。
ここで図４を参照すると、上述した方法を実行する装置４０１の図が示されている。図４において、ビデオ及びコマーシャルデータが実線で示され、制御信号が破線で示されている。装置４０１は、テレビジョン４０２又は表示モニタと関連して利用される、コンピュータ、セットトップボックス、ＶＣＲ、ＤＶＤ又はチューナのような外部装置であっても良く、この場合にはライブ放送ストリーム１００はテレビジョン放送信号、ケーブル信号又は衛星信号であっても良い。装置４０１はテレビジョン４０２と分離可能に図示されているが、装置４０１はテレビジョン４０２に一体化されていても良い。テレビジョン４０２は、プロセッサ４０６、記憶装置４０８、表示画面４１０及び１以上のスピーカ４１２を含む。プロセッサ４０６は、記憶装置４０８に命令のセットの形で含まれても良い記録装置４０８、表示画面４１０及びスピーカ４１２の動作を制御するために、記録装置４０８、表示画面４１０及びスピーカ４１２に実施上接続される。ライブ放送データストリーム１００はオーディオストリームであっても良く、この場合前記装置はラジオ又は他のオーディオチューナであっても良い。斯かる構成においては、表示画面４１０を持っても持たなくても良い放送又は衛星ラジオのようなオーディオチューナによって、テレビジョン４０１が置き換えられる。
図４において、第１のチューナ４１４が、番組Ａ、Ｂ及びＣ並びにコマーシャル１及び２を含む、ライブ放送データストリーム１００を受信する。検出器４１６は、ライブ放送データストリーム１００におけるコマーシャルの境界を検出し、コマーシャル１及び２が新ブロックメモリ４１８に転送される。検出器４１６は好ましくはプロセッサとして実装され、該プロセッサは本発明の方法を実行するための命令のセットを含む記憶装置に実施上接続されていても良い。テレビジョン４０２のプロセッサ４０６は斯かる検出器４１６と一体化されていても良く、この場合には該プロセッサ４０６は、前記テレビジョンの通常の機能及び本発明の方法を実行するための命令のセットを含む１以上の記憶装置４０８に実施上接続される。ライブ放送データストリーム１００から元のコマーシャル１及び２を保存することに加え、他のコマーシャル７乃至１０が第２のデータストリームから第２のチューナ４２０によって受信され、同様に新ブロックメモリ４１８に保存されても良い。このようにして、前記新ブロックメモリは、挿入のために利用されるべきコマーシャルで充填される。前記コマーシャルはライブ放送データストリーム１００に含まれるものであっても良いし、及び／又は例えばインターネットのような別のネットワークを通した代替ソース（第２のデータストリーム４２２）からのものであっても良い。新ブロックメモリ４１８を充填する代替の方法は当業者には良く知られている。
検出器４１６はまた、ライブ放送データストリーム１００のどの部分（例えばＡ、Ｂ及びＣ）が番組（例えばテレビジョンのショー）であるかを検出し、タイムシフトメモリ４２４をこれら部分を記録する（又はそうでなければ遅延させる）ように制御する。新ブロックメモリ４１８及び／又はタイムシフトメモリ４２４はまた、上述した記憶装置としても働く。更に、分離して図示されているが、新ブロックメモリ４１８とタイムシフトメモリ４２４とは、新ブロックメモリ４１８とタイムシフトメモリ４２４とに割り当てられた部分を持つ単一の記憶装置であっても良い。検出器４１６は更に、スケジューラ４２６に対して、コマーシャルと番組との間の境界を示す。スケジューラ４２６は、どのコマーシャルがいつ挿入されるべきかを決定する。この目的のため、該スケジューラは、どのコマーシャルブロックが新ブロックメモリ４１８にあるかを分かっている。
スケジューラ４２６はまた、ユーザの基本設定（preference）を考慮に入れることができる。該ユーザの基本設定は、適切なユーザインタフェースを介して入力されることができ、好ましいコマーシャル並びに好ましいコマーシャルの挿入頻度及び長さに関するものである。スケジューラ４２６はまた、ユーザの視聴（又は聴取）習慣及び／又はユーザの明示的な推薦に基づいてユーザプロファイルを構築する推薦システムによって、ユーザの好みを自動的に考慮に入れても良い。斯かる推薦システムは、本分野においては良く知られている。スケジューラ４２６は、各時点において適切なストリームを選択するセレクタ４２８を制御することにより、及びタイムシフトメモリ４２４又は新ブロックメモリ４１８のいずれかの読み出しを制御することにより、構築されたスケジュールを実行し、斯かるストリーム４００をテレビジョン４０２（又はオーディオチューナ）に出力する。テレビジョン４０２は、出力信号４００を従来の方法で処理し、ユーザに対して表示画面４１０においてビデオ部分を表示し、スピーカ４１２においてオーディオ部分を提示する。
本発明の方法は、コンピュータソフトウェアプログラムによって実行されるのに特に適しており、斯かるコンピュータソフトウェアプログラムは好ましくは本方法の個々のステップに対応するモジュールを含む。斯かるソフトウェアは勿論、集積回路又は周辺装置のようなコンピュータ読み取り可能な媒体に実施化され得る。
本発明の好適な実施例と考えられるものが示され説明されたが、本発明の精神から逸脱することなく形態又は詳細における種々の修正及び変更が容易に為され得ることは勿論理解されるであろう。それ故、本発明は説明され示された通りの形態に限定されるものではなく、添付される請求の範囲内となる全ての変更をカバーするように構成されるべきである。
先行技術において知られた、元のデータストリーム中のコマーシャルが代替コマーシャルを伴うデータストリーム中の置換されたコマーシャルと同じ長さを持つ場合の、代替コマーシャルを伴うデータストリームと比較した元のデータストリームを示す。 先行技術において知られた、元のデータストリーム中のコマーシャルがより長い又は短い継続時間を持つ代替コマーシャルを伴うデータストリーム中のコマーシャルによって置換される場合の、代替コマーシャルを伴うデータストリームと比較した元のデータストリームを示す。 元のデータストリーム中のコマーシャルが、代替コマーシャルを伴うデータストリームにおけるコマーシャルの数よりも少ない場合の、代替コマーシャルを伴うデータストリームと比較した元のデータストリームを示す。 本発明の方法を実行する装置の図を示す。

Claims (23)

  1. データストリームに代替コマーシャルを挿入する方法であって、前記データストリームは番組部分とコマーシャル部分とを持ち、前記方法は、
    前記データストリームの１以上の前記コマーシャル部分を検出するステップと、
    前記検出された１以上の前記コマーシャル部分を、より多くの又はより少ない前記代替コマーシャル部分によって置換するステップと、
    を有する方法。
  2. 前記検出するステップに後続する、前記データストリーム中の前記コマーシャル部分を保存するステップを更に有する、請求項１に記載の方法。
  3. 前記置換するステップは、前記データストリームからの前記保存されたコマーシャル部分及び外部ソースからの他のコマーシャル部分の少なくとも一方から、前記代替コマーシャル部分を選択するステップを有する、請求項２に記載の方法。
  4. 前記外部ソースからの他のコマーシャル部分を保存するステップを更に有する、請求項３に記載の方法。
  5. 前記データストリームの１以上の前記番組部分を検出し、前記検出された１以上の番組部分を保存するステップを更に有する、請求項１に記載の方法。
  6. 前記置換するステップは、ユーザの１以上の基本設定を指示するステップを更に有する、請求項１に記載の方法。
  7. 前記指示するステップは、ユーザによる手動の指示である、請求項６に記載の方法。
  8. 前記指示するステップは、ユーザの視聴の好みを示すユーザプロファイルを形成する推薦システムからの自動的な指示である、請求項６に記載の方法。
  9. 前記ユーザの１以上の基本設定は、好ましい代替コマーシャル部分、好ましい代替コマーシャル部分の頻度、及び好ましい代替コマーシャル部分の長さから成る群から選択される、請求項６に記載の方法。
  10. 前記番組部分及び前記代替コマーシャル部分を持つ出力データストリームを出力するステップを更に有する、請求項１に記載の方法。
  11. 前記代替コマーシャル部分は前記検出されたコマーシャル部分よりも多く、前記方法は、少なくとも１つの代替コマーシャル部分を間に持つサブ部分に前記番組部分の少なくとも１つを分割するステップを更に有する、請求項１０に記載の方法。
  12. 前記代替コマーシャル部分は前記検出されたコマーシャル部分よりも少なく、前記方法は、少なくとも２つの前記番組部分をより大きな番組部分に結合するステップを更に有する、請求項１０に記載の方法。
  13. データストリームに代替コマーシャルを挿入する装置であって、前記データストリームは番組部分とコマーシャル部分とを持ち、前記装置は、
    前記データストリームの１以上の前記コマーシャル部分を検出する検出装置と、
    前記検出された１以上の前記コマーシャル部分を、より多くの又はより少ない前記代替コマーシャル部分によって置換するスケジューラ装置と、
    を有する装置。
  14. 前記検出に後続して、前記データストリーム中の前記コマーシャル部分を保存するメモリを更に有する、請求項１３に記載の装置。
  15. 外部ソースからの他のコマーシャル部分を保存するメモリを更に有する、請求項１３に記載の装置。
  16. 前記検出装置は更に前記データストリームから１以上の前記番組部分を検出し、前記装置は前記１以上の検出された番組部分を保存するメモリを更に有する、請求項１３に記載の装置。
  17. 前記データストリームを受信するために前記検出装置に実施上接続された第１のチューナを更に有する、請求項１３に記載の装置。
  18. 前記他のコマーシャル部分を持つ第２のデータストリームを受信するために前記検出装置に実施上接続された第２のチューナを更に有する、請求項１５に記載の装置。
  19. 前記データストリームは放送ビデオデータストリームである、請求項１３に記載の装置。
  20. 前記データストリームはストリーミングビデオデータストリームである、請求項１３に記載の装置。
  21. 前記データストリームはオーディオデータストリームである、請求項１３に記載の装置。
  22. コンピュータ読み取り可能な媒体において実施化された、データストリームに代替コマーシャルを挿入するためのコンピュータプログラムであって、前記データストリームは番組部分とコマーシャル部分とを持ち、前記コンピュータプログラムは、
    前記データストリームの１以上の前記コマーシャル部分を検出するためのコンピュータ読み取り可能なプログラムコード手段と、
    前記検出された１以上の前記コマーシャル部分を、より多くの又はより少ない前記代替コマーシャル部分によって置換するためのコンピュータ読み取り可能なプログラムコード手段と、
    を有するコンピュータプログラム。
  23. 機械によって読み取り可能であり、前記機械によって実行可能な命令のプログラムを実施化する、データストリームに代替コマーシャルを挿入するための方法ステップを実行するプログラム記憶装置であって、前記データストリームは番組部分とコマーシャル部分とを持ち、前記方法は、
    前記データストリームの１以上の前記コマーシャル部分を検出するステップと、前記検出された１以上の前記コマーシャル部分を、より多くの又はより少ない前記代替コマーシャル部分によって置換するステップとを有する、プログラム記憶装置。
