El documento D01 describe un método para el acabado de un material de construcción a base de cemento que consta de una serie de etapas. En una primera etapa se aplica un tapaporos o base sobre la superficie del cemento. Sobre dicha capa se aplica una segunda capa de resina sintética que contiene pigmentos y que puede ser entre otros materiales, de poliuretano. Por último se aplica una capa de resina sintética transparente que puede ser poliuretano como capa protectora de la anterior. Vemos que este documento describe un proceso en tres etapas igual al proceso descrito en la solicitud de patente pero no hace mención alguna a que los pigmentos puedan ser foto luminiscentes. El documento D02 describe una composición para un recubrimiento a base de pigmentos disueltos en un medio acuoso como por ejemplo una resina que puede ser poliuretano. Los pigmentos pueden ser orgánicos o no e incluir propiedades reflectantes, luminiscentes o fluorescentes. El material de construcción sobre el que va aplicado puede ser cerámico como ladrillo, bloque o teja. Este documento describe una composición y su forma de aplicación. Vemos que no incluye varias capas pero sí que podemos notar que incorpora parte del proceso descrito en la solicitud de patente, en concreto lo relativo a la segunda capa a base de poliuretano mezclado con pigmentos foto luminiscentes. La combinación de ambos documentos rompe la actividad inventiva de las tres primeras reivindicaciones. El documento D03 describe un procedimiento para el acabado superficial de piezas de construcción mediante un revestimiento que consta de las siguientes capas: -Imprimación base formada por una solución de poliuretano para reforzar la pieza y facilitar la fijación de capas sucesivas. -Capa de poliuretano con cargas de pigmentos y aditivos -Aplicación de 2 a 6 capas de poliuretano como protección y acabado. Este documento describe un procedimiento muy similar, no especifica si los pigmentos pueden ser foto luminiscentes y además la última capa protectora no es una sola sino varias capas. El material utilizado para las tres capas puede ser poliuretano al igual que en la solicitud de patente. El documento D04 describe un proceso para la terminación superficial de paneles de suelo. Se aplica una primera capa de material base o tapaporos que puede incluir pigmentos y que se deja secar a tª ambiente durante unos 50 minutos. Sobre esta capa se aplica una segunda a base de un polímero como el poliuretano en el que van disueltos pigmentos y que igualmente se deja secar a tª ambiente. Por último se aplica una capa protectora y se deja secar. El documento D05 describe la decoración de la superficie vista de un ladrillo aplicando en primer lugar un tapa poros y a continuación una capa decorativa que puede ser de poliuretano y que puede incorporar motivos decorativos. Se considera que la solicitud de invención es nueva pero no tiene actividad inventiva para las reivindicaciones 1 a 3 según los Art.6.1 y 8.1 de la Ley de Patentes 11/86. The patent application also claims the procedure for obtaining the ceramic piece characterized by the following phases: -On the visible surface of the piece a first layer of transparent acrylic solvent-based polyurethane is applied and the piece is allowed to dry for an order time 45 minutes -A second layer is applied, based on polyurethane mixed with photo luminescent pigments and allowed to dry for 2 to 3 hours. -A third layer and last layer is applied, based on transparent polyurethane, whose finish may be glossy and matt, depending on the specific needs of each case. Document D01 describes a method for finishing a cement-based building material that consists of a series of stages. In a first stage a cap or base is applied on the surface of the cement. A second layer of synthetic resin containing pigments and which may be, among other materials, of polyurethane is applied on said layer. Finally, a layer of transparent synthetic resin that can be polyurethane as a protective layer of the previous one is applied. We see that this document describes a three-stage process equal to the process described in the patent application but makes no mention that the pigments can be luminescent photo. Document D02 describes a composition for a coating based on pigments dissolved in an aqueous medium such as a resin that can be polyurethane. The pigments can be organic or not and include reflective, luminescent or fluorescent properties. The construction material on which it is applied can be ceramic such as brick, block or tile. This document describes a composition and its form of application. We see that it does not include several layers but we can see that it incorporates part of the process described in the patent application, specifically the one related to the second layer based on polyurethane mixed with photo-luminescent pigments. The combination of both documents breaks the inventive activity of the first three claims. Document D03 describes a procedure for surface finishing of construction pieces by means of a coating consisting of the following layers: - Base primer formed by a polyurethane solution to reinforce the piece and facilitate the fixing of successive layers. -Polyurethane layer with loads of pigments and additives -Application of 2 to 6 layers of polyurethane as protection and finish. This document describes a very similar procedure, it does not specify whether the pigments can be luminescent photo and also the last protective layer is not a single but several layers. The material used for the three layers can be polyurethane as in the patent application. Document D04 describes a process for surface termination of floor panels. A first layer of base material or cap is applied, which may include pigments and is allowed to dry at room temperature for about 50 minutes. On this layer a second one is applied based on a polymer such as polyurethane in which pigments are dissolved and also allowed to dry in the environment. Finally, a protective layer is applied and allowed to dry. Document D05 describes the decoration of the exposed surface of a brick by first applying a pore cover and then a decorative layer that can be made of polyurethane and which can incorporate decorative motifs. The application for invention is considered to be new but has no inventive activity for claims 1 to 3 according to Art.6.1 and 8.1 of Patent Law 11/86.
