- the devices presented in the patents US 3 763 496A (MILLER A ) / US 3,085,247A (BIXBY GUY T ) and US 2,821,715 A (THIEMIG OTTO H ) that were addressed to me in opposition, are different.
- the devices presented in the patents US 3,763,496 A , and US 3,085,247 A include a protective film that takes place on the tie for the protection of the latter.
- the device U.S. 2,821,715 A has a protective film that runs only on the hand.
- the device US 3,085,247 A comprises a protective film which unwinds, from a casing which is fixed by sliding in the tie knot, provided with an intermediate bar to hold the rectangular protective film on the tie and terminated by a counterweight to the end of the protective film to hold it on the surface of the tie.
- This device is bulky, unattractive, complicated appearance and does not allow the stable position of the protective film on the bottom of the tie.
- the device US 3,763,496 A has a protective film which is unfolded from a casing which is fixed by sliding on the side of the tie with, at the end, a button which is supposed to hold the end of the tie with that of the protective film.
- the device U.S. 2,821,715 A Comprises, as the other two cited patents, a protective film which unwinds only one hand, which may suggest the invention of the protection of the tie.
- the device US 3,763,496 A features a fastening system that attaches to the tie from a casing that attaches by slipping by the side of the tie, much like that of the ballpoint pen, which can unbalance the case as the side set on the housing must be thicker and therefore heavier than its opposite side which itself ends without a fixing device. Thus, the case can be fastened sideways without straining the protective film properly.

- the disadvantage of this fixing device is that it is difficult to position it visually on the node, the latter being under the chin and that the intermediate bar uses the same fixing method as that of the patent US 3,763,496 A with the aforementioned drawbacks.
- the two sides of the tie are pinched together, which makes it heavier, while the pan hidden by the front part of the tie is very small and is protected by the front part which is covered with the protective film.
- the device according to the invention is presented under 2 concepts, one elaborated, the other simplified, and is the subject of a new invention
- the tie is introduced from above the device between the housing and its attachment. Its triangular end slips into the protective film whose lower part is of the same shape and sufficient to imprison consists of a return of the film on its back, to constitute a pocket, a minimum height and maintain the end of the tie.
- This device allows the protective film to be guided during its unwinding on the tie and to remain permanently in place, from the base of the tie to under the knot, which is the originality of the invention.
- the device according to the invention consists of 3 elements according to particular embodiments: A case that attaches under the bow of the tie to the most exposed front. A protective film wound on a cylinder with a winding knob and a fastening system. A flexible fixing rod, which, in external tension, allows the passage of the tie; and in internal tension, on a pressure, compresses the tie against the housing and makes it hold.
- the attached drawings illustrate how they work (The figures are identical for both concepts):

FIG. 10 according to the first concept, represents, in profile, the empty casing with, below, the slot (2), to guide the protective film and allow its unwinding and winding
The device according to the invention, designated as "refill" consists of a transparent or opaque protective film , the shape and dimensions of those of the tie and its end, according to the evolution and fashion. The protective film, intended to cover the visible and exposed face of the tie, is fixed by an adhesive ( 15 ) and wound on a hollow cylinder ( 11 ) or solid ( 11α ) and held by another adhesive ( 14 ) before use . Its triangular end consists of a back of the film on the back, a minimum height to form a pocket ( 16 ) sufficient to hold and imprison the end of the tie. The pocket allows the end of the tie to remain in place during the unwinding of the film The cylinder, according to the first concept, has 2 washers ( 12 ) to guide the film. One of them is fixed on one side, at the end of the cylinder, and on the other, between the end of the cylinder and the winding knob ( 8 ). The refill is introduced into the case by the side ( 1 ). When the adhesive ( 14 ) is removed, the protective film remains wound on itself, thanks to the static electricity that its winding generated, before introducing it into the housing and only the end of the film unfolds.
Figure 11 , according to the first concept, represents the refill with the adhesive ( 14 ) which holds the film integrally wound around the cylinder, with 2 washers ( 12 ) at each end of the cylinder to direct unwinding and winding of the film protective, before use.
FIG. 12 according to the second concept represents the refill with the adhesive ( 14 ) which keeps the film integrally wound around the cylinder, with an axis on one side and, on the other ( 17 ) terminated by the winding knob ( 8). ) the other.
Figure 13 shows the two cylinder concepts with the point of attachment of the adhesive ( 15 ) and the back of the protective film with the pocket ( 16 ).
Figure 14 shows , in profile and for both concepts, the attachment with the adhesive on the cylinder.
Figure 15 shows , according to the first concept, the refill ready to enter the opening of the housing ( 1 ). By introducing the cylinder ( 11 ) into the housing, around the needle ( 9 ) which serves as its axis, the film slips into the opening of the slot placed under the housing ( 2 ). The edge of the upper part of the film pocket is positioned against this opening to allow to slide the end of the tie.
Figure 16 shows , for the two concepts, the refill with the wrapped film around, held by the adhesive ( 14 ) fixed and detached.
The device according to the invention has the attachment of the refill in the housing. The refill comprises the protective film wound around the cylinder with the end of the winding button ( 8 ) having the rounded shape of the open side of the housing. The latter is coated with asperities that allow the fingers to grasp it by rotating it to rewind the protective film after use. Being integral with the cylinder slid inside the housing, the winding button traps the ball ( 10 ) of the end of the shaft ( 9 ) allowing it to stay outside against the opening of the housing.
The device according to the invention allows the cylinder and the winding knob to turn together when the film unwinds or wraps and to be held in the housing inside and to hold in the latter without external fixation. It comprises the needle ( 9 ) which is fixed horizontally, such as a metal shaft whose end is taken in the mass of the housing, and terminated by a ball ( 10 ) at the other end of a diameter greater than its axis. The ball, which is introduced into the winding button, allows the cylinder ( 11 ) of the protective film to fit in the housing and rotate. The needle is part of the cylinder fixing device.
Figure 17 shows , in longitudinal section, and in cross section, the device of the invention for fixing the refill in the housing. Inside the winding button, two flexible tongues ( 13 ), of flexible plastic, are fixed, one facing the other ( a ) with, between them, a space less than the volume of the ball ( 10 ) placed at the end of the needle ( 9 ) of the housing. The said tabs deviate ( b ) when the ball presses on entering the head of the winding and take their place ( c ) after the passage of the ball, keeping it captive. To remove the charging of the case, once the film is wound, simply pull on the winding button. The tabs, on the pressure of the ball, deviate, let the ball pass and take their place ( a ), releasing the recharge of the case.
The device according to the invention has the attachment of the housing on the tie. The rod fixed to the rear housing part (3/4) surrounds the tie, to direct it in the protective film (16), avoiding that it ensure during the course of the film and allows to fit the housing on the tie, once the protective film unrolled. At the pressure of the finger on the face of the housing, against the chest, the attachment is extended and compresses the tie between the rod and the housing, making it hold on the tie. The attachment comprises two receptacles (3/4) each placed at the rear, at the end and sides of the housing. A plastic rod, rigid in the center on three quarters of its length (5), ends with a portion (6) flexible and less thick on each side. The ends of the rod (18) are cylindrical in width. Each of them is held in flexion in the lower part of the receptacle, by a stop (3a / 4a) which prevents them from relaxing. The ends undergo a thrust, which causes their extension, out of their stop ( 3 a / 4 a) with their cylindrical end ( 18 ), and position them flat in their length, under the reservoir of the receptacle (3b / 4b).
Figure 18 shows, according to the first concept, seen from the rear, the fastening rod device comprising the shaft (5/6) fixed at each end in the receptacles (3/4), with the tip of the tie placed in the pocket ( 16 ) of the protective film.
Figs. 19 (A / B) show , viewed from above, the rear fixing of the casing before and after the pressure and, in longitudinal section, ( A ) the rod in bending before the pressure, ( B ) after the pressure.
La figure 22 représente, vue de dessus, la fixation (5) située à l'amère du boîtier, à plat avant le montage, en extension (y) et en flexion (z).The device according to the invention has the fastening of the case on the tie, according to a second concept. The fastening consists of a thin metal rod ( 5 ) fixed by a stud ( 3 and 4 ) on each side on the rear part of the case, surrounds the tie, to direct it in the protective film, avoiding it out during the unwinding of the film and allows to hold the case on the tie, once the protective film unrolled. The extended opening position ( y ) allows the front portion of the tie to slide between the housing and the flexible shaft and enter the triangular pocket of the protective film. The bending closure position ( z ) allows the flexible rod to compress the tie between it and the housing. Pulling the case outward, the rod returns to its original position and releases the tie.
FIG. 20 represents, seen from the rear, the fixing device comprising, the casing in which the refill is placed, the protective film located between the rear of the casing and the metal rod ( 5 ) in the extended position ( y ), open, and the bending position in the closed position ( z ).
Figure 21 shows profile of the passage of the protective film between the housing and the metal insert, and in cross section, the attachment of the two elements (3/4).
Figure 22 shows , seen from above, the fastener ( 5 ) located at the bitter case, flat before mounting, extension ( y ) and bending ( z ).
