Detailed Description
The following description of the exemplary embodiments of the present application, taken in conjunction with the accompanying drawings, includes various details of the embodiments of the application for the understanding of the same, which are to be considered exemplary only. Accordingly, those of ordinary skill in the art will recognize that various changes and modifications of the embodiments described herein can be made without departing from the scope and spirit of the present application. Also, descriptions of well-known functions and constructions are omitted in the following description for clarity and conciseness.
First embodiment
Fig. 1 is a flowchart of a block chain-based copyright protection method according to a first embodiment of the present application, which is applicable to a case of performing copyright on a digital work generated by a user terminal device, and is particularly applicable to a case of automatically implementing copyright protection on a newly generated digital work. The method can be executed by user terminal equipment, and the user terminal equipment can be a mobile phone, a tablet computer, a notebook computer, a wearable device and the like of a user. Further, the method may be performed by a blockchain lightweight node in the user terminal device or an application program with digital work storage function interacting with the blockchain. The lightweight node refers to deployment data deployed with a blockchain, such as an intelligent contract, a consensus mechanism, and the like, but a blockchain network node which does not store or store part of blockchain data and transaction data may participate in a transaction request interaction process of the blockchain. The lightweight node may be deployed in the user terminal device, for example, may be loaded in an operating system of the user terminal device, may be installed in the user terminal device as an independent third-party application, and the like. In the present application, the third party application has access to an application (e.g., camera application, album application, etc.) in the user terminal device that generates and/or stores digital works. The application with digital work storage function interacting with the blockchain may be some data storage class application installed in the user terminal device, and the application may interact with the blockchain network.
The method can be executed by the block chain-based copyright protection device provided by the embodiment of the application, and the device can be realized in a hardware and/or software manner, and can be integrated in user terminal equipment, specifically, in a lightweight node of a block chain in the user terminal equipment, or in an application program with a digital work storage function interacting with the block chain. Referring to fig. 1, the method may specifically include:
s101, detecting that a newly generated digital work to be protected exists, and signing the work information of the digital work to be protected by adopting a private key of a block chain account of a user to obtain a private key signature of the work information.
The digital works in the application can be works existing in a digital form during creation, such as articles directly created on user terminal equipment, shot images, audios and videos and the like. The work information in the present application is related information of the digital work, which may include, but is not limited to, work content information and work creation time. The content information of the work can be the content of the digital work to be protected, and specifically can be the original text of the digital work to be protected; the content information of the work may also be an encrypted value of the content of the digital work to be protected, and specifically, may be an encrypted value obtained by encrypting the original content of the digital work to be protected by using a preset cryptographic algorithm (such as a hash encryption algorithm, an asymmetric encryption algorithm, and the like). Optionally, the embodiment of the application may select a specific type of the content information of the work according to an actual scene, so that the flexibility is strong. For example, when the content of the digital work to be protected is small, the content of the digital work can be directly used as the content information of the work to simplify the operation process of copyright protection; when the content of the digital work to be protected is larger or has a security requirement, the encrypted value of the content of the digital work can be selected as the content information of the work, and the infringement work can be quickly judged through the encrypted value on the premise of not disclosing the content of the digital work.
Optionally, in the embodiment of the present application, whether a newly generated digital work to be protected exists in the user terminal device may be detected in real time or at regular time, and a specific detection process may be to detect whether a newly added digital work exists in the user terminal device, and if so, the newly added digital work is taken as the digital work to be protected. Optionally, when detecting whether there is a new digital work in the user terminal device, the application program for generating the digital work may be detected to detect whether the digital work is newly generated, or the storage space for storing the digital work may be detected to detect whether the digital work is stored in a new digital work.
Alternatively, considering that the digital work (i.e. the newly added digital work) newly stored in the storage space of the user terminal device may already be subjected to copyright protection, for example, the image newly stored in the user terminal device is an image downloaded from the internet, and the image is already subjected to copyright protection by the user terminal device to which the image belongs when being generated. At this time, in order to avoid performing copyright protection on digital works repeatedly, in the embodiment of the present application, if it is detected that a newly added digital work exists in the storage space of the user terminal device, it may be determined whether the newly added digital work has performed copyright protection in the block chain; and if the protection is not carried out, taking the newly added digital work as a newly generated digital work to be protected. The specific determination process will be described in detail in the following embodiments.
Optionally, the user terminal device of the present application registers a blockchain account in the blockchain network, and further has a pair of public and private keys of the blockchain account, when detecting that a newly generated digital work to be protected exists by the method introduced above, the user terminal device may obtain the work content information (such as the content of the digital work to be protected or an encrypted value of the content of the digital work to be protected) and the work creation time of the digital work to be protected, and then sign the digital work content information and the work creation time by using the private key of the blockchain account of the user terminal device, so as to obtain the private key signature of the work information of the digital work to be protected.
Optionally, in this embodiment of the application, if it is detected that there are a plurality of newly generated digital works to be protected, and the plurality of digital works to be protected are similar digital works, such as a plurality of photos obtained by continuous shooting. At this time, the operation of signing the work information of the digital work to be protected by adopting the private key of the user's blockchain account to obtain the private key signature of the work information can be executed on a plurality of digital works to be protected; or selecting one from a plurality of digital works to be protected to execute the operation of signing the work information of the digital works to be protected by adopting the private key of the block chain account of the user to obtain the private key signature of the work information. This embodiment is not limited to this. Can be selected according to actual conditions.
S102, generating a copyright protection transaction request according to the work information and the private key signature of the work information, and sending the copyright protection transaction request to a block chain network for uplink storage.
The copyright protection transaction request in the application is generated by calling a copyright protection intelligent contract by user terminal equipment and is used for requesting a block chain network to carry out copyright protection on the digital works.
Optionally, in the embodiment of the application, after generating the private key signature for the work information of the digital work to be protected, the user terminal device invokes the intelligent copyright protection contract, and generates the copyright protection transaction request including the work information of the digital work to be protected and the private key signature thereof according to the work information of the digital work to be protected and the private key signature of the work information generated in S101, and sends the copyright protection transaction request to the blockchain network. And receiving and executing the copyright protection transaction request by the nodes in the block chain network, acquiring the work information of the digital work to be protected and the private key signature thereof contained in the transaction request as transaction data, and storing the transaction data in the block chain network to realize the copyright protection of the digital work to be protected. The copyright protection of the digital works is realized through the block chain network, and the safety and the reliability of the copyright protection process of the digital works are ensured.
Optionally, in this application, the copyright protection transaction request generated by the user terminal device may further include a public key of a blockchain account of the user terminal device, in addition to the work information of the digital work to be protected and the private key signature thereof described above. Correspondingly, when the block chain network node performs uplink storage on the work information of the digital work to be protected and the private key signature thereof, the public key of the block chain account of the user terminal equipment is also subjected to uplink storage, so that other nodes verify the identity of the user to which the digital work belongs through the public key and the private key signature of the work information.
Optionally, the digital work to be protected after uplink storage is performed by the method of the present application may be used as a digital work subjected to copyright protection, and subsequently, when a certain target digital work used by another user is the same as the work content information of the digital work subjected to copyright protection, and the time for the other user to use the target digital work is after the time for creating the authorized digital work, it indicates that the behavior of the other user to use the target digital work belongs to an infringement behavior, and the digital work can be continuously used after a certain copyright fee needs to be paid to the blockchain account of the user to which the authorized digital work belongs. The scheme of the application can well help the general public to carry out copyright protection on digital works created in daily life (such as photos taken in life) so that the copyright protection is not limited between photographers and well-known creators.
According to the technical scheme of the embodiment, after the user terminal equipment detects that the newly generated digital work to be protected exists, the user terminal equipment automatically adopts the private key of the block chain account of the user to sign the work information of the digital work to be protected and then performs chain link storage, so that the copyright protection of the digital work is completed. The scheme of this embodiment can realize that after user terminal equipment has new digital works to generate, need not user's manual upload, can carry out copyright protection to the digital works who generates automatically, improves the convenience of digital works copyright protection for the digital works of ordinary masses have also realized copyright protection, have reduced copyright protection's the popularization degree of difficulty.
Second embodiment
Fig. 2 is a flowchart of a block chain-based copyright protection method according to a second embodiment of the present application, and this embodiment performs further optimization based on the first embodiment, specifically explaining a process of detecting that a newly generated digital work to be protected exists. As shown in fig. 2, the method specifically includes the following steps:
s201, start.
S202, detecting whether a newly added digital work exists in the storage space of the user terminal equipment, if so, executing S203, and if not, continuing to execute S202.
Optionally, in the application, the user terminal device may detect whether a newly added digital work exists in a storage space (including a local storage space and a cloud storage space) of the user terminal device in real time or at regular time, for example, for a digital work such as an image, whether a newly added image exists in an album (including a local album and a cloud album) of the user terminal device may be detected. If the newly added digital work exists, step S203 is executed to further determine whether the newly added digital work is the digital work to be protected, and if not, the operation of detecting the newly added digital work in the step is continuously executed.
Optionally, in this embodiment of the present application, there are many methods for detecting whether there is a newly added digital work in the storage space of the user terminal device, which may include, but are not limited to, the following:
in one implementation, if it is detected that the user terminal device triggers the generation and storage operations of the digital work, the digital work is used as a newly added digital work in the storage space.
Specifically, the implementable mode can be applied to real-time detection of newly added digital works, and by detecting an application program (such as a shooting application program, a drawing application program, a singing application program and the like) for generating the digital works in the user terminal device, if the generation operation and the storage operation of the digital works are triggered after the relevant operation of the user is detected to respond to the user, the digital works are necessarily generated and stored in the user terminal device, namely the digital works are the newly added digital works in the storage space. For example, a photo application installed in the user terminal device may be detected, and if it is detected that the photo application responds to the operation of the user and takes and stores a photo, the photo may be used as the newly added digital work in the detected storage space.
Optionally, since the newly added digital work detected in the implementable manner is generated by an application program that generates the digital work, which is usually an original work, the application may also directly use the newly added digital work determined by the implementable manner as a newly generated digital work to be protected, skip the operations of S203-S204, and directly execute the operation of S205.
In the second implementation mode, the storage space of the user terminal equipment is periodically scanned to determine the newly added digital works.
Specifically, the executable embodiment may be applicable to periodically detecting a newly added digital work, and may be to periodically (for example, every other day) scan a digital product stored in the storage space of the user terminal device, and determine the newly added digital work in the storage space after the last scan.
Optionally, some digital works in the storage space of the user terminal device may not be original by the user, but downloaded from the network, so in order to improve the efficiency of determining the digital works to be protected, in the embodiment of the present application, only the digital works generated by the application program generating the digital works in the storage space may be scanned. For example, for an image-like digital work, only the photograph taken by the camera is scanned, and neither the screenshot nor the downloaded picture is scanned.
Optionally, as time goes on, the number of digital works stored in the storage space of the user terminal device increases, and if a newly added digital work is determined each time, all the digital works in the storage space are scanned once, which may cause the power consumption of the user terminal device to increase more and more. For example, a list may be maintained locally, and the scanned digital work is recorded in the list, or scanned annotations and the like may be added to the scanned digital work in the storage space. Correspondingly, because the newly added digital works detected each time are labeled before, when the implementable mode is adopted to determine the newly added digital works, the storage space of the user terminal equipment can be periodically scanned, and the digital works which are not labeled in the storage space are used as the newly added digital works. For example, the digital works which are not recorded in the locally maintained list in the storage space may be used as new digital works; the digital works which are not added with the scanned annotations in the storage space can be used as new digital works and the like. The advantage of this setting is that the efficiency of confirming the newly added digital works is greatly improved.
Optionally, in the embodiment of the present application, the first implementable manner and the second implementable manner may be combined to detect whether a newly added digital work exists in a storage space of the user terminal device, so as to further improve the accuracy and comprehensiveness of determining the newly added digital work.
S203, if it is detected that the new digital works exist in the storage space of the user terminal equipment, judging whether the new digital works are subjected to copyright protection in the block chain, if so, returning to continue to execute S202, and if not, executing S204.
Optionally, in this application, in order to improve the accuracy of copyright protection, in step S202, it is detected that the newly added digital work existing in the storage space of the user terminal device may not be a work originally generated by the user, but a work downloaded or copied from the internet by the user. Specifically, because the block chain stores the work information of the digital works which have been subjected to copyright protection, whether the work content information of the newly added digital works exists or not can be searched in the block chain at this time; if not, the newly added digital work is not subjected to copyright protection in the block chain network, S204 can be continuously executed to take the newly added digital work as the newly generated digital work to be protected, otherwise, S202 is continuously returned to detect the newly added digital work in the user terminal equipment.
Optionally, in the present application, the specific execution process of determining whether the newly added digital work has been subjected to copyright protection in the block chain may be: if the content information of the digital work stored in the blockchain network is the content of the digital work, the user terminal device may generate an inquiry transaction request including the content of the newly added digital work and send the inquiry transaction request to the blockchain network, so as to request the blockchain node to execute the inquiry transaction request, and feed back whether the content of the newly added digital work exists in the blockchain network. If the new digital work does not exist, the new digital work is not subjected to copyright protection in the blockchain network. If the content information of the digital work stored in the block chain network is the encrypted value of the content of the digital work, the user terminal device may encrypt the content of the newly added digital work according to a preset cryptographic algorithm, then generate an inquiry transaction request including the content encrypted value, and send the inquiry transaction request to the block chain network, so as to request the block chain node to execute the inquiry transaction request, and feed back whether the content encrypted value exists in the block chain network. If the new digital work does not exist, the new digital work is not subjected to copyright protection in the blockchain network.
Optionally, because a large amount of power consumption is consumed in the process of encrypting the content of the digital work, in the embodiment of the present application, the user terminal device may also send the content of the newly added digital work to the external device, and the external device performs an operation of encrypting the content of the newly added digital work according to a preset cryptographic algorithm. The external equipment can be centralized equipment, and the centralized equipment calculates to obtain an encrypted value and feeds the encrypted value back to the user terminal equipment; the external device may also be a block chain node device, and the block chain node device calculates the encrypted value, then directly searches whether the encrypted value is stored in the block chain network, and feeds back the search result to the user terminal device.
Optionally, in order to improve the accuracy of determining whether the newly added digital work is subjected to copyright protection in the blockchain, the embodiment of the present application may also be configured to obtain the work creation time of the searched newly added digital work after the work content information of the newly added digital work is found in the blockchain, and if the time is later than the creation time of the newly added digital work detected in S202, it may also be considered that the newly added digital work detected in S202 is not subjected to copyright protection in the blockchain, and the blockchain network needs to delete the stored related information of the digital work subjected to copyright protection.
And S204, if the newly added digital work is not subjected to copyright protection in the block chain, taking the newly added digital work as the newly generated digital work to be protected.
S205, signing the work information of the digital work to be protected by adopting the private key of the block chain account of the user to obtain the private key signature of the work information.
Wherein the work information includes work content information and work creation time. The work content information is the content of the digital work to be protected or the encrypted value of the content of the digital work to be protected.
And S206, generating a copyright protection transaction request according to the work information and the private key signature of the work information, and sending the copyright protection transaction request to the block chain network for uplink storage.
According to the technical scheme of the embodiment, when the user terminal equipment detects that the newly added digital works exist in the storage space and judges that the newly added digital works are not protected by copyright in the block chain network, the newly added digital works are used as newly generated digital works to be protected, and the block chain account private key of the user is automatically adopted to sign the work information of the digital works to be protected and then carry out cochain storage, so that the copyright protection of the digital works is completed. The scheme of the embodiment improves the accuracy and comprehensiveness of the newly generated digital works to be protected, so that the copyright protection of the newly generated digital works is automatically realized accurately.
Third embodiment
The embodiment of the application is further optimized on the basis of the above embodiments. Specific case introduction of how to implement the block chain-based copyright protection method of the present application is given for different execution subjects, respectively. Optionally, an execution main body of the block chain-based copyright protection method according to the embodiment of the present application may be a block chain lightweight node in the user terminal device or an application program with a digital work storage function interacting with the block chain. If the execution main body of the method is the block chain lightweight node in the user terminal equipment, the lightweight node can be loaded into an operating system of the user terminal equipment, or the lightweight node can also be installed into the user terminal equipment as an independent third-party application program.
In the first case, the execution subject of the embodiment of the present application is a lightweight node loaded into an operating system of a user terminal device. The lightweight node can realize functions through software, is integrated in an operating system, and provides an upper-layer interactive interface for data interaction with an application program client installed on user terminal equipment through the upper-layer interactive interface. The upper layer interactive interface may also be an interface configured by an operating system. The lightweight node also provides a network interaction interface for data interaction with other blockchain network nodes in the blockchain network through the network interaction interface.
Specifically, in this case, the lightweight node loaded into the operating system of the user terminal device may perform data interaction with an application program that generates and stores a digital work through an upper layer interaction interface thereof, determine and obtain work information of a newly-added digital work in the user terminal device, then perform data interaction with other blockchain network nodes in the blockchain network through a network interaction interface to determine whether the newly-added digital work is a newly-generated digital work to be protected, and if so, the lightweight node may sign the work information of the digital work to be protected by using a private key of a blockchain account of the user to obtain a private key signature of the work information, generate a copyright protection transaction request including the work information and the private key signature thereof, and send the copyright protection transaction request to the blockchain network through the network interaction interface to perform uplink storage. Optionally, if the newly added digital work is determined by data interaction with the application program generating the digital work through the upper layer interaction interface, the newly added digital work may also be directly used as a newly generated digital work to be protected.
Illustratively, aiming at image-like digital works, a lightweight node loaded into an operating system of user terminal equipment can detect a photographing application program in the user terminal equipment through an upper-layer interactive interface, detect that a new photo is photographed and stored, take the photo as a newly generated digital work to be protected, acquire work information of the photo through the upper-layer interactive interface, sign the work information of the photo by adopting a private key of a user's block chain account to obtain a private key signature of the work information of the photo, generate a copyright protection transaction request containing the work information of the photo and the private key signature thereof, and send the copyright protection transaction request to a block chain network through a network interactive interface to perform uplink storage.
And in the second case, the execution subject of the embodiment of the application is an independent third-party application program installed in the user terminal equipment. It should be noted that the third-party application is a lightweight node and needs to have a right to access a target application in the user terminal device, where the target application is an application for generating and/or storing a digital work.
Specifically, in this case, since the third-party application installed in the user terminal device has the authority to access the target application in the user terminal device, it can detect whether the application generating the digital work newly generates and stores the digital work (i.e., newly added digital work) through the authority, and can also periodically scan whether the storage space in the application storing the digital work has newly added digital work; and then, carrying out data interaction with other blockchain network nodes in the blockchain network, judging whether the newly-added digital work is a newly generated digital work to be protected, if so, acquiring the work information of the digital work to be protected by the third-party application program through the access right of the third-party application program, signing the work information of the digital work to be protected by adopting a private key of a blockchain account of a user, acquiring a private key signature of the work information, generating a copyright protection transaction request containing the work information and the private key signature, and sending the copyright protection transaction request to the blockchain network for uplink storage. Optionally, if the newly added digital work is determined by the application program for detecting and generating the digital work by the third-party application program, the newly added digital work may also be directly used as the newly generated digital work to be protected.
For example, assuming that the lightweight node is installed in the user terminal device as an independent third-party application and has a function of accessing an album of the user terminal device, at this time, the third-party application may scan the album at regular time, determine whether there is a newly added photo therein, perform data interaction with other block chain network nodes in the block chain network, determine whether the newly added photo is a newly generated photo to be protected, if so, the third-party application may obtain the work information of the photo from the album, sign the work information of the photo by using a private key of a block chain account of the user, obtain a private key signature of the work information of the photo, generate a copyright protection transaction request including the work information of the photo and the private key signature thereof, and send the copyright protection transaction request to the block chain network for uplink storage.
And thirdly, the execution subject of the embodiment of the application is an application program with a digital work storage function and interacting with the blockchain. In this case, the application having the function of storing the digital work may directly interact with the blockchain network, or may interact with the blockchain network through a backend server thereof. Optionally, the application may be an application for locally storing the digital works in the user terminal device, for example, an album application on the user terminal device; the application program may also be an application program with a function of storing the cloud-end digital works, such as a network disk, a cloud service (icloud), and the like.
Specifically, in this case, the execution main body itself is an application program with a digital work storage function, so that the application program can scan whether a newly added digital work exists in its own storage space or not at regular time when data is stored; and then the application program performs data interaction with other blockchain network nodes in the blockchain network, judges whether the newly-added digital work is a newly-generated digital work to be protected, if so, obtains the information of the digital work to be protected, signs the work information of the digital work to be protected by adopting a private key of a blockchain account of a user, obtains a private key signature of the work information, generates a copyright protection transaction request containing the work information and the private key signature thereof, and sends the copyright protection transaction request to the blockchain network for uplink storage.
For example, assuming that the application is a cloud service application installed in a user terminal device, the cloud service application may scan whether a newly added photo exists in a cloud storage space of the cloud service application after image synchronization (or at regular time), then perform data interaction with other blockchain network nodes in a blockchain network, determine whether the newly added photo is a newly generated photo to be protected, if so, the cloud service application may obtain work information of the photo, sign the work information of the photo by using a private key of a blockchain account of a user, obtain a private key signature of the work information of the photo, generate a copyright protection transaction request including the work information of the photo and the private key signature thereof, and send the copyright protection transaction request to the blockchain network for uplink storage.
In the technical scheme of the embodiment, the execution main body can be a lightweight node loaded in an operating system of the user terminal equipment; the method can also be a lightweight node installed in user terminal equipment as an independent third-party application program, and can also be an application program with a digital work storage function and interacting with a block chain.
