따라서, 본 발명자들은 최근 생활속에서 널리 활용되는 인터넷과 단말기 장치를 통해 매우 불특정 다수인이 쉽게 개인의 창작물에 접근 및 감상하고 거래할 수 있는 새로운 플랫폼 구현을 강구함으로써 본 발명을 완성하였다.
본 발명은 전술한 종래 기술의 문제점을 해결하기 위한 것으로, 본 발명의 목적은 창작물의 개인 간 활발한 거래를 가능하게 하는 플랫폼을 제공하는 것이다.

상기 어문저작물은 말과 글로 표현된 저작물을 의미하는 것으로, 시나 소설, 수필, 각본, 논문, 강연, 또는 설교 등이 포함될 수 있으나, 이에 제한되는 것은 아니다.
상기 음악저작물은 음에 의해 표현된 저작물을 의미하는 것으로, 상기 음은 악기에 의해 표현될 수도 있고, 사람에 의해 표현될 수도 있으며, 악보로 기록되거나 악보에 기록되지 않은 모든 음악저작물을 포함할 수 있다.
상기 연극저작물은 연극이나 무용, 뮤지컬 등과 같이 동작으로 표현되는 저작물을 의미하는 것으로, 동작을 직접 몸짓으로 표현할 수도 있고, 상기 몸짓을 그림이나 무보로 기록하여 표현한 것도 포함할 수 있다.

상기 도형저작물은 지도, 도표, 설계도, 약도, 모형, 그 밖의 도형으로 표현된 저작물을 의미할 수 있다.
또한, 상기 다양한 종류의 창작물은 유형물 및 무형물로 구분될 수 있고, 상기 유형물 및 무형물은 그 특징으로 인해 게시 방식이나 거래 방식이 상이할 수 있다.
상기 유형물은 형체가 있는 창작물로, 창작물의 거래를 위해 해당 물건의 직접적인 전달이 요구될 수 있다. 예컨대, 상기 유형물은 그림이나, 조각상 등 창작자가 직접 제작한 유일무이한 창작물일 수 있다.
반면, 상기 무형물은 형체가 없는 창작물로, 글(ex. 각본, 소설 등)이나 음악 등 디지털 데이터로 다양하게 복제가 가능한 형태일 수 있고, 상기 유형물 및 무형물은 당해 거래 통상의 지식에 비추어 자명하게 구분될 수 있다.

도 3을 참조하면, 상기 사용자 인터페이스(130)는 창작물 정보, 구매 버튼, 공유 버튼, 조회수, 판매 가격, 판매 조건, 전부 열람 버튼 등을 표시할 수 있고, 사용자는 상기 사용자 인터페이스(130)를 통해 창작물을 살펴보고, 판매 가격을 고려하여 창작물 거래 여부를 결정할 수 있다.
상기 사용자 인터페이스(130)는 다양한 형태로 구현될 수 있으며, 상기 창작물 거래 시스템(100)의 본연의 목적을 달성하기 위한 구현 형태라면 특별히 제한되지 않고 적용될 수 있다.
특히, 최근 제품 거래를 위한 웹 페이지나 플랫폼의 구현 형태는 널리 알려져 있으므로, 이를 고려하여 상기 창작물 거래 시스템(100)에 대한 지속적인 업데이트를 진행할 수 있다.
이 때, 상기 창작물은 유형물 또는 무형물로 구분될 수 있고, 유형물이나 무형물에 따라서 창작물의 등록 방식이 상이할 수 있다.

구체적으로, 상기 무형의 창작물이 음악인 경우, 해당 음악의 복제권, 공연권, 공중송신권(방송권, 전송권, 디지털 음성송신권), 전시권, 배포권, 대여권 및 2차 저작물 작성권의 전부 또는 일부의 사용을 허락하는 경우 그에 부합하는 거래 가격을 설정할 수 있고, 해당 권리를 포함하는 저작권 모두를 전부 이전시키는 경우 더욱 높은 거래 가격을 설정할 수 있으며, 상기 창작물 거래 시스템(100)은 상기 창작물의 다양한 판매 옵션 설정과 관련된 인터페이스(130)를 구현할 수 있다.
또한, 상기 창작물이 무형물인 경우, 상기 창작물 거래 시스템(100)은 상기 창작물의 공개 정도에 따라서 별도의 열람 비용을 설정하거나, 열람에 따라 광고를 노출시킬 수 있다.

상기 “카테고리”는 언어, 국가, 창작물 종류, 형태 등 상기 창작물의 개념을 분류함에 있어서 일반화되고 보편화된 범위로서, 상기 창작물에 대한 분류를 통해 상기 창작물 거래 시스템(100)을 이용하는 사용자가 자신이 원하는 성질의 창작물에 편리하게 접근할 수 있다.
도 4를 참조하면, 상기 창작물 거래 시스템(100)은 상기 창작물 게시부(111)에 등록된 창작물과 이미 알려진 창작물의 유사도를 분석하는 유사도 판단부(113);를 더 포함할 수 있다.
상기 유사도 판단부(113)는 사용자에게 창작물의 유사도와 관련된 정보를 제공함으로써 해당 창작물의 거래시 참고할 수 있고, 상기 유사도는 필요에 따라 점수나 등급 등 다양한 방법으로 산출될 수 있다.
상기 창작물은 저작물의 속성상 다양한 형태로 복제되거나 도용될 수 있고, 타인의 창작물을 도용한 창작물을 등록하고 판매하는 상황이 야기될 수 있다.
따라서, 상기 창작물 거래 시스템(100)은 타인의 창작물에 대한 도용을 방지하기 위해 이미 알려진 창작물과의 유사성을 분석하고, 해당 창작물의 도용 여부에 대한 정보를 제공할 수 있다.
상기 창작물 거래 시스템(100)은 유사도 판단을 소프트웨어 알고리즘(algorithm)을 포함할 수 있고, 다양한 방법을 통해 사용자가 등록한 창작물과 기존에 알려진 창작물을 대비시켜 가장 유사한 창작물을 선별할 수 있다.
기존에 알려진 창작물의 범위는 제한되는 것은 아니며, 상기 창작물 거래 시스템(100)의 데이터베이스나 전 세계의 웹페이지 등을 대상으로 유사성이 높은 창작물을 검색하고, 미리 정해진 방법으로 창작물 간의 유사값을 산출할 수 있다.
상기 유사도 판단부(113)는 데이터 통계를 산출하기 위한 것으로, 당해 시스템 구축을 위한 소프트웨어나 알고리즘, 서버, 네트워크, 데이터베이스 구조 등은 당해 기술에 널리 알려져 있다.
도 4를 참조하면, 상기 창작물 거래 시스템(100)은 상기 가격결정방식 설정부(112)에 매도 의사를 설정하지 않은 경우, 상기 창작물에 대한 매수 의사 또는 매수 예상액을 전달하는 매도 요청부(114);를 더 포함할 수 있다.
사용자는 매도를 목적으로 하지 않고 오직 공개만을 목적으로 창작물을 공개시킬 수도 있으며, 이 경우에는 별도의 매도 의사를 설정해놓지 않았으므로 상기 창작물에 대한 거래를 진행할 수 없다.
따라서, 상기 매도 요청부(114)는 상기 창작물 거래 시스템(100)에 공개된 창작물에 별도의 매도 의사가 설정되지 않은 경우 타인이 상기 창작물에 대한 매수 의사를 전달할 수 있고, 상기 요청을 통해 상기 창작물을 등록한 사용자는 매도 여부를 결정할 수 있다(도 5).
이 때, 상기 창작물을 등록한 사용자는 상기 매수 의사에 동의하는 방식으로 거래를 성립시키거나, 상황에 따라 상기 매도 요청을 고려하여 상기 창작물에 별도의 매도 의사를 설정함으로써 상기 창작물에 대한 거래를 도모할 수 있다.
상기 매도 요청부(114)는 상기 매수 의사와는 별개로 매수 예상액을 전달하는 방식으로 불특정 다수가 상기 창작물의 가치를 평가할 수 있고, 상기 창작물을 등록한 사용자는 상기 매수 예상액을 고려하여 상기 창작물에 별도의 매도 의사를 설정함으로써 상기 창작물에 대한 거래를 도모할 수 있다.
도 5를 참조하면, 상기 유사도 판단부(113) 및 매도 요청부(114)는 상기 창작물 게시부(111)를 구현한 인터페이스(130) 상에서 사용자가 용이하게 동작할 수 있는 형태로 함께 구현될 수 있으나, 그 구현 형태가 특별히 제한되는 것은 아니다.
전술한 본 발명은, 프로그램이 기록된 매체에 컴퓨터가 읽을 수 있는 코드로서 구현하는 것이 가능하다.
컴퓨터가 읽을 수 있는 매체는, 컴퓨터 시스템에 의하여 읽혀질 수 있는 데이터가 저장되는 모든 종류의 기록장치를 포함한다. 컴퓨터가 읽을 수 있는 매체의 예로는, HDD(Hard Disk Drive), SSD(Solid State Disk), ROM, RAM, CD-ROM, 자기 테이프, 플로피 디스크, 광 데이터 저장 장치 등이 있다.
전술한 본 발명의 설명은 예시를 위한 것이며, 본 발명이 속하는 기술분야의 통상의 지식을 가진 자는 본 발명의 기술적 사상이나 필수적인 특징을 변경하지 않고서 다른 구체적인 형태로 쉽게 변형이 가능하다는 것을 이해할 수 있을 것이다. 그러므로 이상에서 기술한 실시예들은 모든 면에서 예시적인 것이며 한정적이 아닌 것으로 이해해야만 한다. 예를 들어, 단일형으로 설명되어 있는 각 구성 요소는 분산되어 실시될 수도 있으며, 마찬가지로 분산된 것으로 설명되어 있는 구성 요소들도 결합된 형태로 실시될 수 있다.
본 발명의 범위는 후술하는 청구범위에 의하여 나타내어지며, 청구범위의 의미 및 범위 그리고 그 균등 개념으로부터 도출되는 모든 변경 또는 변형된 형태가 본 발명의 범위에 포함되는 것으로 해석되어야 한다.

Claims (8)

  1. 인터넷을 통해 구현되는 창작물 거래 시스템에 있어서,
    사용자 계정과 연결되고, 창착물 세부 사항을 등록하는 창작물 게시부;
    매도 의사와 함께 경매 또는 정가제 여부를 결정하는 가격결정방식 설정부; 및
    복수의 사용자 계정을 상호 연결하는 서버;를 포함하는, 창작물 거래 시스템.
  2. 제1항에 있어서,
    상기 창작물은 어문저작물, 음악저작물, 연극저작물, 미술저작물, 사진저작물, 영상저작물, 및 도형저작물로 이루어진 군에서 하나 이상 선택된, 창작물 거래 시스템.
  3. 제1항에 있어서,
    상기 창작물은 유형물 또는 무형물로 구분되고,
    유형물의 경우, 상기 창작물 게시부에 상기 유형물의 이미지 파일을 등록하고,
    무형물의 경우, 상기 창작물 게시부에 상기 무형물의 전부 또는 일부를 등록하는, 창작물 거래 시스템.
  4. 제3항에 있어서,
    상기 창작물이 무형물인 경우,
    상기 창작물의 판매 조건에 저작권 이전 여부를 함께 등록하고, 저작권 이전 여부에 따라 거래 가격을 달리 설정하는, 창작물 거래 시스템.
  5. 제3항에 있어서,
    상기 창작물이 무형물인 경우,
    상기 창작물의 공개 정도에 따라서 별도의 열람 비용을 설정하거나, 열람에 따라 광고를 노출시키는, 창작물 거래 시스템.
  6. 제1항에 있어서,
    상기 창작물 게시부에 상기 창작물과 관련된 인덱스 및 카테고리를 설정하고,
    사용자의 검색에 따라 관련된 창작물을 노출시키는, 창작물 거래 시스템.
  7. 제1항에 있어서,
    상기 창작물 게시부에 등록된 창작물과 이미 알려진 창작물의 유사도를 분석하는 유사도 판단부;를 더 포함하는 창작물 거래 시스템.
  8. 제1항에 있어서,
    상기 가격결정방식 설정부에 매도 의사를 설정하지 않은 경우,
    상기 창작물에 대한 매수 의사 또는 매수 예상액을 전달하는 매도 요청부;를 더 포함하는 창작물 거래 시스템.
