在又一示出的实施方式中,上述目标作品被存证于所述区块链的分布式数据库,从而为上述目标作品的具体内容或共创过程提供存证依据。本实施例中不限定上述目标作品被存证于上述区块链的分布式数据库的具体形式,可以将上述目标作品的全文存储于上述区块链的分布式数据库,以基于区块链的防篡改机制为目标作品存证;也可以将上述目标作品的数学摘要(如哈希摘要)存储于上述区块链的分布式数据库,以基于区块链及数学摘要算法的防篡改机制为目标作品存证;等等。
类似地,本实施例也并不限定存证上述目标作品的存证信息发送方身份,当上述原始创作用户客户端作为区块链的节点设备时,上述目标作品可以是由上述原始创作用户客户端所发送至区块链的;当上述区块链为联盟链,且上述原始创作用户客户端或参与共创用户客户端作为与联盟成员节点连接的用户客户端时,上述目标作品可以是由上述原始创作用户客户端、或参与共创用户客户端发送给上述联盟成员节点、并由上述联盟成员节点将上述目标作品的存证信息发送到区块链的。
步骤104,调用与所述目标作品的版权分配对应的智能合约,执行所述智能合约声明的基于所述参与共创行为数据向所述参与共创用户分配版权份额的逻辑,向所述参与共创用户分配所述目标作品的版权份额。
经区块链的节点设备的共识、验证,上述与作品版权分配对应的智能合约可以被部署在区块链中。本实施方式所述的向所述参与共创用户分配版权份额的逻辑可以包括基 于所述参与共创行为数据而对参与共创用户进行目标作品的版权份额的规则。例如,参与共创用户每完成一次预设的参与共创行为,即应获得相应的版权份额奖励;或者为参与共创用户的参与共创行为预设阈值,判断参与共创用户所完成的参与共创行为是否达到预设阈值,若达到即应获得目标作品的相应的版权份额奖励;或者还可以为参与共创用户完成的不同类型的参与共创行为分别设置权重,基于参与共创用户完成的参与共创行为的类型和数量统计参与共创用户是否完成预设阈值的参与共创行为,等等,在本说明书中不作限定。本领域的技术人员可以根据具体的业务场景,设计出符合作品共创业务生态发展的作品版权分配逻辑规则,从而为作品共创业务的生态发展做出贡献的参与共创用户分配与之贡献匹配的版权份额,激励参与共创用户。
上述实施例所述的向所述参与共创用户分配所述目标作品的版权份额,包括由上述与作品版权分配对应的智能合约向参与共创用户的地址或账户转移相应额度的版权份额。如前所述,上述目标作品的版权份额,即是将目标作品的版权划分为的若干份额或份额,或者与上述若干份额或份额所对应的资产。上述资产可以包括所述区块链上流转的数字资产,如根据该区块链的协议设定的在区块链上流通的数字代币(Token),也可以包括与所述区块链外资源对应的额度值,如链外的现金、不动产、贵金属、版权份额证明、甚至数字社区流通的虚拟资源等资源对应的额度值。
在一示出的实施方式中,上述版权份额表现为上述区块链上流转的数字通证(Token),以便于在区块链上通过智能合约转账的形式,方便直接地为参与共创用户分配目标作品的版权。在本实施方式中,除了在区块链的分布式数据库上收录上述用于调用智能合约以转账的第一目标交易,上述转移的版权份额还可以直接体现在参与共创用户的区块链账户的Token余额的增加中,类似于以太坊区块链的用户账户设置。
在又一示出的实施方式中,当上述版权份额表现为与所述区块链外设定资源对应的额度值时,上述第一目标交易被区块链的分布式数据库收录即视为为上述目标作品的版权份额分配提供存证,或由上述智能合约向所述区块链的分布式数据库发送向参与共创用户转移与所述版权份额对应的链外资产额度值的交易,从而为区块链外的设定资源的转移提供凭证。
在一种示出的实施方式中,上述对智能合约的共识可以包括对智能合约所声明的作品版权分配逻辑规则的共识,从而可以保证上述作品版权分配逻辑经多方验证;而且,本领域的技术人员应知,智能合约的调用执行结果也需经区块链节点设备的共识验证,方可将上述调用执行结果收录在区块链的分布式数据库中。因此,相比较于中心化服务 方制定、执行规则,本说明书中一个或多个实施例所提供的作品版权分配方法,具有较为明显的公平公正性。
以下,以目标作品为文学作品为例,上述用于版权分配的智能合约内可建立版权份额和Token的对应关系,并建立基于参与共创用户的参与共创行为所应获得的版权份额或Token分配规则:上述参与共创行为可包括:关注、点赞、评论、转发、邀请等社交传播行为,校验文案、撰写章节等创作行为;上述分配规则可包括:根据参与共创用户的社交传播行为所引发的UV(用户日访问量)、PV(用户单次访问量)、阅读量、阅读有效性、二次传播、是否购买或者购买量等一个或多个指标,为参与共创用户分配相应版权份额额度的Token,或根据参与共创用户所共创的作品内角色的重要性、参与作品续写连载的内容量,为参与共创用户分配相应版权份额额度的Token。当然,上述智能合约还可部署动态评估分配逻辑,在预定时间内,基于参与共创用户参与共创行为的总和给予相应的版权份额分配,等等。
在又一示出的实施方式中,在用户在获取到相应的版权份额后,作为目标作品的股东,还可享有基于上述目标作品的收益而获得股权收益的权利。相应地,上述智能合约还声明有版权份额收益分配逻辑;所述方法还包括:
从所述区块链的分布式数据库内获取第二目标交易,其中,所述第二目标交易包括向所述智能合约发送的所述目标作品的版权收益;
调用所述智能合约,执行所述智能合约声明的版权份额收益分配逻辑,基于所述参与共创用户所获得的所述目标作品的版权份额,向所述参与共创用户分配所述版权收益。
与上述版权份额类似,本实施例所述的版权收益可包括区块链上流转的数字资产、或与所述区块链下资产对应的资产,例如既可以对应于区块链内的代币(token)、数字资产等智能资产,还可以对应于区块链外的现金、证券、优惠券、房产等链外资产,甚至还可以包括用户数字社区中流通的数字资产、积分等特征值,本说明书并不对此进行限制。
上述一个或多个实施例所述的用于分配作品版权的智能合约可以基于参与共创用户的参与共创行为,为参与共创用户分配相应的目标作品版权份额,上述版权份额可表现为股份凭证,或直接表现为资产,从而给予参与共创用户资源收益,鼓励其更加积极地参与对目标作品的传播或创作中来。进一步地,当上述目标作品产生版权收益后(上述版权收益可直接被接收在上述与作品版权分配对应的智能合约的账户中,也可以通过资 源转移的方式,间接转移至上述与作品版权分配对应的智能合约的账户中),还可依据上述参与共创用户所获得的版权份额,为其分配相应的版权收益(即版权份额收益)。智能合约可以在任何时候基于参与共创用户的参与共创行为而被调用,节约了线下沟通的时间成本和人力成本,公平公正,提高了资源转移的效率,有效激励了用户通过提升自身的业务活跃度而增加用户个体的资源收益。
与上述基于区块链的作品版权分配方法的流程实现对应,本说明书的实施例还提供了一种基于区块链的作品版权分配装置。上述装置可以通过软件实现,也可以通过硬件或者软硬件结合的方式实现。以软件实现为例,作为逻辑意义上的装置,是通过所在设备的CPU(Central Process Unit,中央处理器)将对应的计算机程序指令读取到内存中运行形成的。从硬件层面而言,除了图3所示的CPU、内存以及存储器之外,该数据处理装置所在的设备通常还包括用于进行无线信号收发的芯片等其他硬件,和/或用于实现网络通信功能的板卡等其他硬件。
图2所示为本说明书一个或多个实施例所提供的一种基于区块链的作品版权分配装置20,应用于包括原始创作用户客户端、参与共创用户客户端和第一节点设备的区块链网络;所述装置20应用于所述第一节点设备,包括:
获取单元202,用于从所述区块链的分布式数据库内获取第一目标交易,所述第一目标交易包括所述参与共创用户对目标作品的参与共创行为数据,其中所述目标作品由所述原始创作用户原始创作;
执行单元204,用于调用与所述目标作品的版权分配对应的智能合约,执行所述智能合约声明的基于所述参与共创行为数据向所述参与共创用户分配版权份额的逻辑,向所述参与共创用户分配所述目标作品的版权份额。
在又一示出的实施方式中,所述参与共创行为数据包括所述参与共创用户对目标作品的传播行为数据或创作行为数据或其他行为数据。
在又一示出的实施方式中,所述第一目标交易还包括所述目标作品的唯一性识别码。
在又一示出的实施方式中,所述目标作品被存证于所述区块链的分布式数据库。
在又一示出的实施方式中,所述版权份额为所述区块链上流转的数字资产通证。
在又一示出的实施方式中,所述智能合约还声明有版权份额收益分配逻辑;
所述获取单元202,进一步用于从所述区块链的分布式数据库内获取第二目标交易, 其中,所述第二目标交易包括向所述智能合约发送的所述目标作品的版权收益;
所述执行单元204,进一步用于调用所述智能合约,执行所述智能合约声明的版权份额收益分配逻辑,基于所述参与共创用户所获得的所述目标作品的版权份额,向所述参与共创用户分配所述版权收益。
在又一示出的实施方式中,所述区块链为联盟链,所述第一节点设备包括提供目标作品的共创服务的联盟成员方节点设备。
上述装置20中各个单元的功能和作用的实现过程具体详见上述方法中对应步骤的实现过程,相关之处参见方法实施例的部分说明即可,在此不再赘述。
以上所描述的装置实施例仅仅是示意性的,其中所述作为分离部件说明的单元可以是或者也可以不是物理上分开的,作为单元显示的部件可以是或者也可以不是物理模块,即可以位于一个地方,或者也可以分布到多个网络模块上。可以根据实际的需要选择其中的部分或者全部单元或模块来实现本说明书方案的目的。本领域普通技术人员在不付出创造性劳动的情况下,即可以理解并实施。
上述实施例阐明的装置、单元、模块,具体可以由计算机芯片或实体实现,或者由具有某种功能的产品来实现。一种典型的实现设备为计算机,计算机的具体形式可以是个人计算机、膝上型计算机、蜂窝电话、相机电话、智能电话、个人数字助理、媒体播放器、导航设备、电子邮件收发设备、游戏控制台、平板计算机、可穿戴设备或者这些设备中的任意几种设备的组合。
与上述区块链交易方法实施例相对应,本说明书的实施例还提供了一种计算机设备,该计算机设备包括存储器和处理器。其中,存储器上存储有能够由处理器运行的计算机程序;处理器在运行存储的计算机程序时,执行本说明书实施例中区块链的节点设备执行的基于区块链的作品版权分配方法的各个步骤。对区块链的节点设备执行的基于区块链的作品版权分配方法的各个步骤的详细描述请参见之前的内容,不再重复。
与上述基于区块链的作品版权分配方法实施例相对应,本说明书的实施例还提供了一种计算机可读存储介质,其上存储有计算机程序,所述计算机程序被处理器运行时,执行本说明书实施例中区块链的节点设备执行的基于区块链的作品版权分配方法的各个步骤。对区块链的节点设备执行的基于区块链的作品版权分配方法的各个步骤的详细描述请参见之前的内容,不再重复。
以上所述仅为本说明书的较佳实施例而已,并不用以限制本说明书,凡在本说明书 的精神和原则之内,所做的任何修改、等同替换、改进等,均应包含在本说明书保护的范围之内。
在一个典型的配置中,计算设备包括一个或多个处理器(CPU)、输入/输出接口、网络接口和内存。
内存可能包括计算机可读介质中的非永久性存储器,随机存取存储器(RAM)和/或非易失性内存等形式,如只读存储器(ROM)或闪存(flash RAM)。内存是计算机可读介质的示例。
计算机可读介质包括永久性和非永久性、可移动和非可移动媒体可以由任何方法或技术来实现信息存储。信息可以是计算机可读指令、数据结构、程序的模块或其他数据。
计算机的存储介质的例子包括,但不限于相变内存(PRAM)、静态随机存取存储器(SRAM)、动态随机存取存储器(DRAM)、其他类型的随机存取存储器(RAM)、只读存储器(ROM)、电可擦除可编程只读存储器(EEPROM)、快闪记忆体或其他内存技术、只读光盘只读存储器(CD-ROM)、数字多功能光盘(DVD)或其他光学存储、磁盒式磁带,磁带磁磁盘存储或其他磁性存储设备或任何其他非传输介质,可用于存储可以被计算设备访问的信息。按照本文中的界定,计算机可读介质不包括暂存电脑可读媒体(transitory media),如调制的数据信号和载波。
还需要说明的是,术语“包括”、“包含”或者其任何其他变体意在涵盖非排他性的包含,从而使得包括一系列要素的过程、方法、商品或者设备不仅包括那些要素,而且还包括没有明确列出的其他要素,或者是还包括为这种过程、方法、商品或者设备所固有的要素。在没有更多限制的情况下,由语句“包括一个……”限定的要素,并不排除在包括所述要素的过程、方法、商品或者设备中还存在另外的相同要素。

Claims (16)

  1. 一种基于区块链的作品版权分配方法,应用于包括原始创作用户客户端、参与共创用户客户端和第一节点设备的区块链网络;所述方法包括:
    所述第一节点设备从所述区块链的分布式数据库内获取第一目标交易,所述第一目标交易包括所述参与共创用户对目标作品的参与共创行为数据,其中所述目标作品由所述原始创作用户原始创作;
    调用与所述目标作品的版权分配对应的智能合约,执行所述智能合约声明的基于所述参与共创行为数据向所述参与共创用户分配版权份额的逻辑,向所述参与共创用户分配所述目标作品的版权份额。
  2. 根据权利要求1所述的方法,所述参与共创行为数据包括所述参与共创用户对目标作品的传播行为数据或创作行为数据或其他行为数据。
  3. 根据权利要求1或2所述的方法,所述第一目标交易还包括所述目标作品的唯一性识别码。
  4. 根据权利要求1或2所述的方法,所述目标作品被存证于所述区块链的分布式数据库。
  5. 根据权利要求1所述的方法,所述版权份额为所述区块链上流转的数字资产通证。
  6. 根据权利要求1或5所述的方法,所述智能合约还声明有版权份额收益分配逻辑;所述方法还包括:
    从所述区块链的分布式数据库内获取第二目标交易,其中,所述第二目标交易包括向所述智能合约发送的所述目标作品的版权收益;
    调用所述智能合约,执行所述智能合约声明的版权份额收益分配逻辑,基于所述参与共创用户所获得的所述目标作品的版权份额,向所述参与共创用户分配所述版权收益。
  7. 根据权利要求6所述的方法,所述区块链为联盟链,所述第一节点设备包括提供目标作品的共创服务的联盟成员方节点设备。
  8. 一种基于区块链的作品版权分配装置,应用于包括原始创作用户客户端、参与共创用户客户端和第一节点设备的区块链网络;所述装置应用于所述第一节点设备,包括:
    获取单元,用于从所述区块链的分布式数据库内获取第一目标交易,所述第一目标交易包括所述参与共创用户对目标作品的参与共创行为数据,其中所述目标作品由所述原始创作用户原始创作;
    执行单元,用于调用与所述目标作品的版权分配对应的智能合约,执行所述智能合约声明的基于所述参与共创行为数据向所述参与共创用户分配版权份额的逻辑,向所述参与共创用户分配所述目标作品的版权份额。
  9. 根据权利要求8所述的装置,所述参与共创行为数据包括所述参与共创用户对目标作品的传播行为数据或创作行为数据或其他行为数据。
  10. 根据权利要求8或9所述的装置,所述第一目标交易还包括所述目标作品的唯一性识别码。
  11. 根据权利要求8或9所述的装置,所述目标作品被存证于所述区块链的分布式数据库。
  12. 根据权利要求8所述的装置,所述版权份额为所述区块链上流转的数字资产通证。
  13. 根据权利要求8或12所述的装置,所述智能合约还声明有版权份额收益分配逻辑;
    所述获取单元,进一步用于从所述区块链的分布式数据库内获取第二目标交易,其中,所述第二目标交易包括向所述智能合约发送的所述目标作品的版权收益;
    所述执行单元,进一步用于调用所述智能合约,执行所述智能合约声明的版权份额收益分配逻辑,基于所述参与共创用户所获得的所述目标作品的版权份额,向所述参与共创用户分配所述版权收益。
  14. 根据权利要求13所述的装置,所述区块链为联盟链,所述第一节点设备包括提供目标作品的共创服务的联盟成员方节点设备。
  15. 一种计算机设备,包括:存储器和处理器;所述存储器上存储有可由处理器运行的计算机程序;所述处理器运行所述计算机程序时,执行如权利要求1到7任意一项所述的方法。
  16. 一种计算机可读存储介质,其上存储有计算机程序,所述计算机程序被处理器运行时,执行如权利要求1到7任意一项所述的方法。
