3권 분립이 분명한 대한민국은 입법권이 국회에 있으며, 20대 대한민국 국회에서 국회의원들이 발의한 법안의 수는 2018년 8월 10일 현재 13,582개이며, 이는 하루 평균 20~30개 사이의 법안이 발의된다는 것을 의미한다. 이외에도 정부 부처나 지자체에서 법안, 조례 및 규칙 등을 발의하기도 한다.
제정 또는 개정되는 법안은 국민 전체를 대상으로 하는 것도 있지만 각각 고유의 다양한 분야를 대상으로 하는 것도 있으며, 관심이 있는 일반 국민은 물론이고 해당 분야에 관련된 사람들은 본인이 속한 분야에서의 법의 추이를 모니터링 하여 이를 생활 또는 사업에 활용하는 것이 일반적이다.
예를 들면, 환경단체는 어떤 환경법 및 어떤 환경규칙 등이 발의되고 소멸하는가가 중요한 관심이 있으며, 청년들은 창업이나 취업과 관련된 법에 대해 관심이 많을 수밖에 없고, 일반인은 주거 임대료와 관련된 법안 등이 주요 관심사가 될 것이다.

상기 다른 기술적 과제를 달성하기 위한 본 발명에 따른 법안 모니터링 방법은, 제1항에 기재된 상기 법안 모니터링 시스템을 이용하여 법안을 모니터링 하는 방법에 관한 것으로, 법안수집단계, 법안검색단계, 검색 식 분석 & 저장 단계 및 법안 큐레이션 서비스 단계를 수행한다. 상기 법안 수집 단계에서는 상기 법안 모니터링 서버가 상기 법안을 수집한다. 상기 법안 검색 단계에서는 상기 법안 모니터링 시스템에 접근할 권한을 부여받은 사용자가 상기 법안 모니터링 서버가 제공하는 상기 최적의 검색 식 중에서 선택한 검색 식 또는 직접 작성한 검색 식으로 해당 법안을 검색한다. 상기 검색 식 분석 & 저장 단계에서는 상기 법안 모니터링 서버에서 수행하며, 상기 사용자가 선택 또는 직접 작성한 검색 식을 사용자와 함께 사용자와 관련한 검색 식으로 저장하고, 상기 사용자와 관련한 검색 식을 분류하여 해당 사용자의 관심 분야를 특정하여 저장한다. 상기 법안 큐레이션 서비스 단계에서는 상기 법안 검색 단계에서 검색 식으로 요청한 법안 및 상기 검색 식 분석 & 저장 단계에서 저장한 특정 사용자에 대한 정보를 여론조사기관, 정책홍보기관 및 선거홍보기관 중 적어도 한 곳에 제공한다.
상술한 바와 같이 본 발명에 따른 법안 모니터링 시스템 및 법안 모니터링 방법은, 국회, 정부 및 지자체에서 제안, 개정 또는 폐지되는 법안을 수집한 후 사용자의 검색 필드 및 조건 검색을 확장하고, 법안 모니터링 서버가 검색 식 저장 및 검색 자동화를 수행할 수 있도록 함으로써 각종 입법 정보의 검색을 용이하게 하고, 정책이나 선거의 홍보 및 여론 조사를 효과적으로 할 수 있도록 하는 장점이 있다.

도 1을 참조하면, 본 발명에 따른 법안 모니터링 시스템(100)은, 법안 모니터링 서버(110)를 중심으로, 국회(120), 정부(130), 지자체(140) 및 사용자(150)로 구성된다는 것을 알 수 있다. 여기서 국회(120), 정부(130), 지자체(140) 및 사용자(150)는, 각각 국회(120), 정부(130), 지자체(140)에서 운용하는 시스템 또는 서버를 의미하며, 사용자(150)는 사용자(150)가 사용할 수 있는 컴퓨터나 무선단말기와 같은 전자장치를 의미한다.
법안 모니터링 서버(110)는 국회(120), 정부(130) 및 지자체(140)의 입법활동의 결과로 제안, 개정 또는 폐기되는 법, 법령, 조례 및 규칙을 수집하고, 사용자(150)의 요청에 대응하는 법안을 사용자(150)에게 제공하는 기능을 수행한다. 설명의 편의를 위해 본 발명에서는 법, 법령, 조례 및 규칙을 법안이라는 대표용어로 기재한다. 입법(국회입법)은 국회의 고유 기능이지만, 정부(부처)도 입법(정부입법) 및 법령을 제안하며, 지자체도 조례 및 규칙 등을 제정하므로, 본 발명에서는 국회, 정부 및 지자체의 입법 활동의 결과로 제정, 개정 및 폐지되는 법안을 수집할 것을 제안한다.
또한, 법안 모니터링 서버(110)는, 수집한 법안을 사용자(150) 등이 검색하는데 사용된 검색 식을 분석하고, 검색 식, 검색 식의 분석 결과를 해당 검색 식을 활용한 사용자(150)의 정보와 함께 저장한다. 검색 식을 분석하면 해당 검색 식을 사용한 사용자의 관심 분야를 유추할 수 있으며, 이를 통해 검색 식을 사용한 사용자의 관심 분야 및 관심 법안을 확인하고 이를 구분하여 저장할 수 있을 것이다. 저장된 사용자의 관심 분야 및 관심 법안에 대한 정보와 사용자가 사용한 검색 식은, 이후에 동일 사용자가 본 발명에 따른 법안 모니터링 서버(110)에 액세스하였을 때 자신이 이전에 사용한 검색 식을 확인하거나, 해당 사용자가 이전에 사용한 검색 식을 재사용할 수 있도록 하는 실시 예도 가능하다. 사용자의 관심 분야 및 관심 법안으로 사용자를 분류하여 놓고, 분류된 사용자의 정보를 해당 사용자의 동의를 얻어 여론조사기관, 정책홍보기관 및 선거홍보기관에 제공할 수도 있을 것이다. 사용자 정보를 상기 3개의 기관(여론조사기관, 정책홍보기관 및 선거홍보기관)이 사용하는 방식 및 효과에 대해서는 후술한다.
이외에도 법안 모니터링 서버(110)는 특정 법안이나 특정 분야의 검색에 적합하다고 판단되는 검색 식을 사전에 생성한 후 저장하고, 사용자(150)가 원하는 경우 이를 제공하여 검색에 익숙하지 않은 사용자(150)가 선택하여 활용할 수 있도록 한다.
사용자(150)가 검색 식을 입력하면 법안 모니터링 서버(110)에서 해당 법안을 제공하게 되는데, 본 발명에서는 검색 식의 검색 대상이 되는 검색 필드와 검색의 조건에 대해서도 아래와 같은 확장성을 확보하였다. 즉, 본 발명에서는 검색 필드로 해당 법안의 원문을 필수적으로 포함하도록 하며, 검색 조건에 포함되는 검색대상 용어에 대해 AND 즉 전체 대상 용어의 공통점은 물론이고, 전체 대상 용어의 부분 공통점(OR)과 특정 대상 용어의 누락(NOT)을 지시하는 조건도 활용할 수 있도록 하였다.
실제 본 발명의 효과 중 하나인 검색필드의 확장성을 확인하기 위해 의안정보시스템에 대해 아래와 같은 실험을 수행하였다.
의안정보시스템에 액세스하여 '환경, 녹색, 규제'라는 대상 용어를 입력하였을 때, 검색 필드가 법안의 제안이유 및 제안내용일 때에는 0(zero)건의 관련 법안이 검색되었지만, 검색 필드로 원문을 포함하였을 때에는 상당한 수의 관련 법안이 검색되었다. 즉, 검색 필드로 법안의 원문이 포함된다는 것은 법안의 검색이 법안의 공급자 중심이 아니고 법안의 수요자 중심으로 이동한다는 것을 의미한다. 즉 사용자가 쉽게 검색할 수 있도록 한다는 취지가 반영되기 위해서는 검색 필드를 적절하게 선택할 수 있도록 한다는 것이 중요하다는 것을 확인한 것이다.
본 발명의 효과 중 조건 검색의 확장성은 아래와 같다.
청년 취업과 창업에 관한 법안을 검색하기 위해, 아래와 같은 조건을 기재하였다고 가정한다.

만일 AND 조건만을 활용할 수 있다면 총 60(3*5*2*2)개의 경우의 수에 따라 검색될 수 있을 뿐이다. 그러나 OR 조건이 포함되고, NOT 기능이 추가된다면 다양하고 더 많은 경우의 수가 된다는 것은 추가로 설명하지 않아도 쉽게 예상할 수 있을 것이다.
본 발명에 따른 법안 모니터링 서버(110)는 의사결정 커뮤니티 또는 의견교류 커뮤니티를 제공할 수 있다. 예를 들면, 특정 사안을 법안 모니터링 서버(110)에 등재하고 이를 확인한 사용자(150)가 법안 모니터링 서버(110)에 개인 의견을 피력하거나 찬반에 대한 의견을 기재할 때, 법안 모니터링 서버(110)가 이를 정리하여, 특정인이나 특정 단체가 이를 사용함으로써 정책 입안에 보조할 수 있도록 하는 것이다. 사용자(150)의 일방적인 의견 표시를 기재하도록 하는 것은 물론 사용자(150) 간의 대화가 가능하도록 설정하는 실시 예도 가능하다. 법안 모니터링 서버(110)에 액세스하여 의견을 개진하고 의견을 교환하는 과정에서 단순하게 의견만을 반영하도록 하는 것이 아니라, 의견을 피력한 사용자(150)와 다른 의견을 가지고 있는 사용자(150)의 토론에 의해 정책 등이 올바른 방향으로 진행될 수 있도록 할 것이다.
사용자(150)는 법안 모니터링 서버(110)에 접속하여 제정, 개정 및 폐지되는 법안을 모니터링 할 수 있는 권한을 부여받은 회원을 지칭하며, 사용자(150)로는 개인은 물론 법인도 가능하고, 법안 모니터링 서버(110)에 저장된 다양한 정보를 활용하고자 한다면 어떠한 단체도 회원으로 가입할 수 있다.
예를 들면, 실제 입법활동을 하고 있는 국회(120), 정부(130) 및 지자체(140)는 물론 여론조사기관, 정책홍보기관, 선거홍보기관 등 다양한 단체가 그 대상이 될 수 있을 것이다.
개인 사용자는 사회생활에 필요한 법안을 검색하고 이를 활용할 수 있기 때문에 사용자로 등록할 이익이 있으며, 입법 활동 중 민의를 반영하기 위하여 국회(120), 정부(130) 및 지자체(140)도 사용자로 등록할 이익이 있다.
이외에도, 지역, 관심사, 취향 등으로 분류한 사용자의 정보를, 사용자의 사전 동의를 얻은 후, 여론조사기관, 정책홍보기관 및 선거홍보기관에 제공함으로써, 여론조사, 정책홍보 및 선거홍보를 효과적으로 할 수 있도록 하는데 도움을 줄 수 있다.
여론조사는 특정 사안에 대해 일반 국민의 의견을 물어볼 수 있다는 점에서 장점이 있다. 그러나 특정 사안과 별로 관련성이 없는 일반인이 포함된 대상에 대해 수행하여 얻은 여론조사 결과를 토대로 정책을 결정한다면, 자칫하면 정확한 민의가 반영되지 않은 정책을 수립할 가능성이 크다는 것은 쉽게 예상할 수 있을 것이다. 따라서, 본 발명에서는 특정 사안에 대해 이전부터 관심이 있었던 일반인에 대한 정보를 여론기관에 제공하고 해당 여론기관은 이러한 정보를 적절하게 활용함으로써, 전문성이 어느 정도 인정되거나 조사의 내용과 관련이 있는 사람을 대상으로 여론조사를 수행할 수 있도록 한다는 점에서 여론조사 결과의 신뢰성을 높일 수 있다는 장점이 예상된다.
예를 들면, 선거의 홍보가 그 대상을 불특정 다수에 대해서 하는 것보다는 필요한 특정 대상으로 진행하는 것이 효과적이라는 점과 그 궤를 같이하고, 이러한 특징은 정책의 홍보 분야에서도 동일하게 판단할 수 있을 것이다.
상술한 바와 같은 검색 식의 가공, 가공된 검색 식의 사용자 등에 대한 정보를 유료화한다면, 서비스의 공공성 과는 별도로 수익성 있는 사업도 가능할 것이다.
도 2는 본 발명에 따른 법안 모니터링 방법의 일 실시 예를 나타낸다.
도 2를 참조하면, 본 발명에 따른 법안 모니터링 방법(200)은 도 1에 도시한 법안 모니터링 시스템(100)을 통해 수행되며, 회원모집단계(210), 법안수집단계(220), 법안검색단계(230), 검색 식 분석 & 저장단계(240), 모니터링 자동화단계(250) 및 법안 큐레이션 서비스단계(260)를 수행한다.
회원모집단계(210)는 법안 모니터링 서버(110)에서 수행하며, 개인, 법인, 국회, 정부, 지자체, 여론조사기관, 정책홍보기관 및 선거홍보기관을 대상으로 사용자(회원)를 모집한다. 실시 예에 따라서 회원모집단계(210)는 법안 모니터링 서버(110)의 운영자에 의해서 수행하는 것도 가능하다. 회원의 모집 방법이나 과정은 이 분야의 통상의 기술자라면 누구나 쉽게 구현할 수 있으므로, 여기서는 자세하게 설명하지 않는다.
법안수집단계(220)에서는 법안 모니터링 서버(110)가 법안을 수집한다. 최근에는 국회, 정부부처 및 지자체에서 운영하는 전자시스템에서 법안을 전자문서로 공개하는 경우가 많으므로 법안 모니터링 서버(110)가 법안을 전자 매체를 통해 직접 수집하는 방식과 법안 모니터링 서버(110)의 운영자가 수집한 것을 법안 모니터링 서버(110)에 전달하거나 입력하는 방식으로의 수집하는 방식 중 적어도 하나의 방식으로 수집하게 될 것이다.
법안검색단계(230)에서는 법안 모니터링 시스템(100)에 접근권한을 부여받은 사용자(150)가 법안 모니터링 서버(110)가 제공하는 검색 식 중에서 선택한 검색 식 또는 직접 작성한 검색 식으로 관심 법안을 검색한다. 상술한 바와 같이, 법안 모니터링 서버(110)가 제공하는 검색 식은, 법안 모니터링 서버(110)가 미리 생성하여 저장해 놓은 검색 식과 사용자가 이전에 사용한 것을 법안 모니터링 서버(110)가 저장해 놓은 검색 식을 포함하며, 해당 검색 식을 메뉴의 형식으로 제공할 때 사용자(150)가 이들 중 하나를 선택하고, 이에 따라 법안 모니터링 서버(110)는 해당 검색 식의 내용에 따른 검색을 수행하여 결과를 산출한다.
검색 식 분석 & 저장단계(240)는 법안 모니터링 서버(110)에서 수행하며, 사용자(150)가 선택 또는 직접 작성한 검색 식을 사용자의 정보와 함께 사용자와 관련한 검색 식으로 저장하고, 사용자와 관련한 검색 식을 분류하여 해당 사용자의 관심 분야 및 관심 법안을 특정하여 저장한다. 관심 분야 및 관심 법안과 함께 저장된 사용자 정보는, 사용자의 성향을 판단할 수 있는 자료로 사용될 수 있으며, 따라서 이러한 정보는 여론조사기관, 정책홍보기관 및 선거홍보기관과 같은 공공성이 강한 단체에 제공하였을 때 효과적으로 활용할 수 있을 것이다.
모니터링 자동화단계(250)는 법안 모니터링 서버(110)에서 수행하며, 검색 식 분석 & 저장 단계(240)에서 저장한 검색 식으로 검색을 자동 수행하고, 검색 결과를 해당 사용자에게 자동으로 제공한다. 이는 법안 검색의 연속성을 보장하는 것으로, 특정 사용자가 최초로 검색한 후 일정시간 또는 시일이 경과 한 후 동일한 검색 식으로 재검색을 직접 수행하는 것이 아니라 자동으로 수행하도록 함으로써, 특정 사용자는 1회의 검색만을 직접 수행하고 이후에는 정해진 시간 또는 기간단위로 연속하여 검색하고 그 결과를 서비스받을 수 있도록 함으로써 반복되는 검색을 사용자가 직접 수행하지 않으면서도 필요한 정보를 필요한 때에 서비스받을 수 있도록 한다. 또한, 법안 모니터링 서버(110)는 법안수집단계(220)에서 수집한 법안 중 새로 개정, 개정, 발의 및 폐지되는 법안을 사용자의 검색 요청과는 별도로 모니터링 하여 정리한 법안상태변동을 저장하고, 법안상태변동은 후술하는 법안 큐레이션 서비스단계(260)에서 활용하도록 한다.
법안 큐레이션 서비스단계(260)는 법안 모니터링 서버(110)에서 수행하며, 법안 검색 단계(230)에서 검색 식으로 요청한 법안 및 검색 식 분석 & 저장 단계(240)에서 저장한 특정 사용자에 대한 정보를 여론조사기관, 정책홍보기관 및 선거홍보기관 중 적어도 한 곳에 제공한다. 또한, 별도로 모니터링 한 법안상태변동을 취향 또는 전문성에 따라 선별한 회원에게 제공하는 법안상태변동 알림 서비스도 제공한다. 법안상태변동 알림 서비스를 수신한 회원 중 변동된 법안의 구체적인 내용에 대해서 관심이 있는 회원은 법안 모니터링 시스템(100)에 직접 액세스하여 확인하면 될 것이다. 법안상태변동은 해당 회원에게 자동으로 통보 형식으로 알릴 수도 있지만, 통보를 받지는 못했다고 하더라도 관심이 있는 회원이 선택하여 확인할 수 있도록 하는 실시 예도 가능하다.
이상에서는 본 발명에 대한 기술사상을 첨부 도면과 함께 서술하였지만 이는 본 발명의 바람직한 실시 예를 예시적으로 설명한 것이지 본 발명을 한정하는 것은 아니다. 또한, 본 발명이 속하는 기술 분야에서 통상의 지식을 가진 기술자라면 누구나 본 발명의 기술적 사상의 범주를 이탈하지 않는 범위 내에서 다양한 변형 및 모방 가능함은 명백한 사실이다.

    상기 법안 모니터링 서버에서 수행하며, 개인, 법인, 국회, 정부, 지자체, 여론조사기관, 정책홍보기관 및 선거홍보기관 중 적어도 한 곳을 대상으로 사용자(회원)를 모집하는 회원모집단계; 를 더 수행하는 법안 모니터링 방법.
  6. 제3항에서,
    상기 법안 모니터링 자동화단계에서는,
    상기 법안수집단계에서 수집한 법안 중 새로 제정, 개정, 발의 및 폐지되는 법안을 사용자의 검색 요청과는 별도로 정리하여 법안상태변동으로 저장하고,
    상기 법안큐레이션 서비스 단계에서는, 상기 법안상태변동을 취향 또는 전문성에 따라 선별한 회원에게 제공하는 법안상태변동 알림 서비스를 더 제공하는 법안 모니터링 방법.
