本申请要求在2018年6月25日提交中国专利局、申请号为201810662615.9的中国专利申请的优先权,该申请的全部内容通过引用结合在本申请中。

本申请涉及区块链网络技术,例如涉及一种基于版权登记信息的后处理方法、装置、设备和介质。
背景技术
作者在创作了文字作品、口述作品、音乐作品、喜剧作品、曲艺作品、舞蹈作品、杂技作品、美术作品、摄影作品、工程设计图、产品设计图、地图、示意图、模型作品、建筑作品和电影作品等原创著作后,一般需要对其创作的作品在第一时间进行版权(著作权)登记确权,而后再公开使用。
在版权登记确权之后,除了创作者自己使用之外,一般还会涉及到版权的转让和许可使用等交易操作,或者存在不经过创作者的允许而非法使用的情况,那么创作者需要基于版权登记信息进行维权。也即,基于版权登记信息还有很多后处理操作需求。
现有版权交易和维权的方案中,有些是通过线下进行的,有些是通过线上进行的。线下进行,即双方私下协商,该方案协商内容比较透明,但是显然效率较低,特别是在互联网时代下,网上存在海量原创信息,有时候难以获得创作者的信息,一一协商也非常耗费时间。而线上进行,即通过互联网服务平台进行的后处理操作,则存在处理操作不透明的问题,如交易价格不公开,维权证据难确认的问题。

本申请实施例提供一种基于版权登记信息的后处理方法、装置、设备和介质,以提高版权登记信息后处理的处理效率,且提高处理透明度和可信性。
本申请实施例提供了一种基于版权登记信息的后处理方法,应用于版权服务平台,包括 获取版权登记信息;基于所述版权登记信息,获取版权后处理操作的至少两个参与方信息,以及后处理信息;将所述参与方信息和后处理信息,作为事务请求在区块链网络中发送,以请求添加至区块中存储。

实施例一
图1为本申请实施例一提供的一种基于版权登记信息的后处理方法的流程图。本实施例应用于版权登记信息的版权交易和维权等后处理操作的情况,尤其适用于版权交易和维权等后处理操作不透明,处理效率以及公信力低的场景。整套基于版权登记信息的后处理方法通常由版权服务平台和区块链系统配合执行。其中,区块链可以是公有链或联盟链;版权服务平台可以是一个专门用于用户进行版权信息登记的服务器平台,可选的,版权服务平台可以是一个能够与区块链网络中的节点及各客户端进行交互的图腾平台,对应的,版权登记信息为图片版权登记信息。本申请实施例的方案应用于版权服务平台,该方法可以由本申请实施例提供的基于版权登记信息的后处理装置来执行,该装置可采用软件和/或硬件的方式实现。参见图1,该方法具体包括:

其中,版权登记信息是指用于证明版权作者对版权登记内容的所有权的信息。可选的,版权登记信息可以包括:加密版权作者信息和版权内容摘要;或加密版权作者信息、版权内容摘要和可信时间戳信息。
其中,加密版权作者信息是指对用户输入的创作者信息进行加密而生成的;版权作者信 息包括但不限于:姓名、身份证、护照、机构名称、机构证件编号等。版权内容摘要是指对版权内容进行摘要提取处理生成的。可信时间戳信息是指用于代表版权作者拥有版权内容版权的时间戳文件。
版权登记信息还可以包括:加密版权作者信息、版权内容摘要、可信时间戳信息和版权内容描述信息。其中,版权内容描述信息是指对创作内容的整体说明或中心思想概括等,为可选项内容。
具体的,版权服务平台可依据自身存储的需要进行版权后处理操作的版权登记信息的区块链地址和区块编号从区块链网络中获取版权登记信息,也可以从在版权服务平台配置的客户端上通过用户输入的方式来获取版权登记信息。
S120,基于版权登记信息,获取版权后处理操作的至少两个参与方信息,以及后处理信息。
其中,版权后处理操作是指版权作者进行版权登记确权后所进行的操作,可以包括版权转让和许可使用等版权交易操作;还可以包括版权维权操作等。参与方信息可以包括但不限于:姓名、身份证、护照、机构名称或机构证件编号等;后处理信息即为后处理操作的信息,示例性的,不同的版权后处理操作对应不同的后处理信息。
若版权后处理操作为版权维权操作,版权后处理操作信息即为版权维权信息。可选的,基于版权登记信息,获取版权后处理操作的至少两个参与方信息,以及后处理信息可以包括:基于版权登记信息,获取版权维权操作的维权方信息和侵权方信息,以及侵权证据信息。其中,维权方即为版权作者,对应的,侵权方为不经过版权作者的允许而非法使用版权作者版权内容的一方,侵权证据信息可以包括侵权时间、侵权内容及侵权证据网页地址等。
具体的,当版权服务平台接收到任一用户通过版权服务平台或客户端界面,如客户端上的浏览器界面或客户端上应用程序界面等提交待维权作品,并发起维权请求时,将依据待维权的作品信息及存储在区块链中的地址从区块链网络中获取版权登记信息;依据版权登记信息确定维权方信息;并依据版权登记信息在互联网中进行网页抓取、识别匹配以及用户确认等操作,确定侵权证据信息;基于侵权证据信息确定侵权方信息。
若版权后处理操作为版权交易操作,版权后处理操作信息即为版权交易信息。可选的,基于版权登记信息,获取版权后处理操作的至少两个参与方信息,以及后处理信息可以包括:基于版权登记信息,获取版权交易处理的购买方信息和出售方信息,以及交易处理信息;其中,交易处理信息可以包括交易对象信息、时间信息和交易金额信息等。出售方即为版权作者,对应的,购买方即为购买版权作者版权内容或版权的一方;交易对象信息是指交易作品 的信息。
具体的,当版权的所有者以及需要使用或购买作品的购买方之间需进行交易时,可向版权服务平台发起包括待交易作品信息的交易请求;版权服务平台接收到该交易请求后,依据待交易作品信息及存储在区块链中的地址从区块链网络中获取该交易作品的版权登记信息;并根据该版权登记信息确定出售方信息;同时基于待交易作品信息的交易请求和版权登记信息确定购买信息及交易处理信息。
需要说明的是,版权交易操作也可以由版权服务平台组织交易。具体的,版权服务平台向用户展示可供交易的作品信息,并利用精准的图像理解、图文理解等前沿智能识图技术对图片进行智能理解、识别并自动生成标签,便于用户检索到目标图片。当版权服务平台检测到用户购买任一可供交易的作品时,可依据可供交易的作品信息及存储在区块链中的地址从区块链网络中获取版权登记信息;并根据该版权登记信息确定出售方信息和购买方信息,以及交易处理信息。
S130,将参与方信息和后处理信息,作为事务请求在区块链网络中发送,以请求添加至区块中存储。
具体的,版权服务平台可以对参与方信息和后处理信息进行加密等相关处理后作为事务请求传输至区块链网络中,用于指示区块链网络中的区块生成节点将该事务请求存储在区块链中。
示例性的,不同的版权后处理操作确定事务请求的方式不同,同一版权后处理操作也可以有不同种确定事务请求的方法,后续实施例将介绍版权交易信息及版权维权信息确定事务请求,并将该事务请求在区块链网络中发送,以请求添加至区块中存储的几种方法。
本申请实施例提供的技术方案,版权服务平台通过将版权后处理操作信息作为事务请求,发送至区块链网络中进行存储,使得版权后处理操作信息对版权服务平台及交易双方都是透明的,不可篡改的,弱化了版权服务中心的权力,确保了版权后处理操作信息的公信力、准确性及透明性。此外,由于版权后处理操作信息通过区块链技术来保持其可信度,从而能够更好的利用互联网资源,简化了后处理操作的过程,从而提高了版权登记信息后处理的处理效率。
实施例二
图2为本申请实施例二提供的一种基于版权登记信息的后处理方法的流程图。本实施例在上述实施例的基础上,进一步对若版权后处理操作是版权维权操作,基于版权登记信息, 获取版权维权操作的维权方信息和侵权方信息,以及侵权证据信息进行解释说明。参见图2,该方法具体包括:
S210,获取版权登记信息。
S220,通过互联网进行网页抓取。
具体的,当版权服务平台接收到任一用户通过版权服务平台或客户端界面,如客户端上的浏览器界面或客户端上应用程序界面等提交待维权作品,并发起维权请求时,版权服务平台将对待维权作品基于智能识图等功能进行识别;依据识别结果确定抓取目标,依据抓取目标在互联网中进行网页抓取。

其中,快照是一种快速读取当前网页所包含的所有的内容方式,包括当前网页的网址。
具体的,将抓取网页中的内容与版权登记信息所对应的版权登记对象内容进行匹配,若匹配成功,或者匹配度达到预设阈值如80%,则将该抓取的网页确定为疑似侵权网页。为了降低版权服务平台作假概率,以提高证据的真实可靠性,版权服务平台可将疑似侵权网页的快照或该网页的网址作为侵权证据信息,以便区块生成节点依据该网页的网址或快照中包含的网址,访问网络截取网页,作为证据留存,保证了区块链所存储的证据是从互联网中真实能获得的。
S240,提取疑似侵权网页的发布者信息作为侵权方信息,根据版权登记信息确定维权方信息。
其中,发布者是指在网页上发布相关内容的用户,疑似侵权网页的发布者即为在网页上发布与版权作者的版权登记对象内容高度相似的用户。

为了进一步保证参与交易的双方信息的安全,版权服务平台还可以采用参与方提供的公钥来对将参与方信息和后处理信息的部分或全部信息进行加密。示例性的,将参与方信息和后处理信息,作为事务请求在区块链网络中发送,以请求添加至区块中存储还可以包括:将参与方信息和后处理信息的部分或全部信息,采用至少一个参与方提供的公钥加密,而后作为事务请求在区块链网络中发送,以请求添加至区块中存储。

设备12也可以与一个或多个外部设备14(例如键盘、指向设备、显示器24等)通信,还可与一个或者多个使得用户能与该设备12交互的设备通信,和/或与使得该设备12能与一个或多个其它计算设备进行通信的任何设备(例如网卡,调制解调器等等)通信。这种通信可以通过输入/输出(I/O)接口22进行。并且,设备12还可以通过网络适配器20与一个或者多个网络(例如局域网(LAN),广域网(WAN)和/或公共网络,例如因特网)通信。如图所示,网络适配器20通过总线18与设备12的其它模块通信。应当明白,尽管图中未示出,可以结合设备12使用其它硬件和/或软件模块,包括但不限于:微代码、设备驱动器、冗余处理单元、外部磁盘驱动阵列、RAID系统、磁带驱动器以及数据备份存储系统等。
处理单元16通过运行存储在系统存储器28中的程序,从而执行各种功能应用以及数据处理,例如实现本申请实施例所提供的基于版权登记信息的后处理方法。该设备典型的是作为版权服务平台。
实施例十二
本实施例十二是本申请实施例提供的一种用于执行本申请实施例六和七所提供的基于版权登记信息的后处理方法的设备,该设备包括:一个或多个处理器;存储装置,设置为存储一个或多个程序;当所述一个或多个程序被所述一个或多个处理器执行,使得所述一个或多个处理器实现如本申请实施例六和七所提供的基于版权登记信息的后处理方法,适用于区块链网络中的节点。设备典型的是承担区块链系统节点功能的计算设备。其具体结构以及细节内容可参照图11和实施例十一。
实施例十三
本申请实施例十三还提供了一种计算机可读存储介质,其上存储有计算机程序,该程序被处理器执行时可实现上述实施例一至五所述的基于版权登记信息的后处理方法。
本申请实施例的计算机存储介质,可以采用一个或多个计算机可读的介质的任意组合。计算机可读介质可以是计算机可读信号介质或者计算机可读存储介质。计算机可读存储介质例如可以是——但不限于——电、磁、光、电磁、红外线、或半导体的系统、装置或器件,或者任意以上的组合。计算机可读存储介质的更具体的例子(非穷举的列表)包括:具有一个或多个导线的电连接、便携式计算机磁盘、硬盘、随机存取存储器(RAM)、只读存储器(ROM)、可擦式可编程只读存储器(EPROM或闪存)、光纤、便携式紧凑磁盘只读存储器(CD-ROM)、光存储器件、磁存储器件、或者上述的任意合适的组合。在本文件中,计算机可读存储介质可以是任何包含或存储程序的有形介质,该程序可以被指令执行系统、装置或者器件使用或者与其结合使用。
计算机可读的信号介质可以包括在基带中或者作为载波一部分传播的数据信号,其中承载了计算机可读的程序代码。这种传播的数据信号可以采用多种形式,包括但不限于电磁信号、光信号或上述的任意合适的组合。计算机可读的信号介质还可以是计算机可读存储介质以外的任何计算机可读介质,该计算机可读介质可以发送、传播或者传输用于由指令执行系统、装置或者器件使用或者与其结合使用的程序。
计算机可读介质上包含的程序代码可以用任何适当的介质传输,包括——但不限于无线、 电线、光缆、RF等等,或者上述的任意合适的组合。
可以以一种或多种程序设计语言或其组合来编写用于执行本申请操作的计算机程序代码,所述程序设计语言包括面向对象的程序设计语言—诸如Java、Smalltalk、C++,还包括常规的过程式程序设计语言—诸如”C”语言或类似的程序设计语言。程序代码可以完全地在用户计算机上执行、部分地在用户计算机上执行、作为一个独立的软件包执行、部分在用户计算机上部分在远程计算机上执行、或者完全在远程计算机或服务器上执行。在涉及远程计算机的情形中,远程计算机可以通过任意种类的网络——包括局域网(LAN)或广域网(WAN)—连接到用户计算机,或者,可以连接到外部计算机(例如利用因特网服务提供商来通过因特网连接)。
实施例十四
本申请实施例十四还提供了一种计算机可读存储介质,其上存储有计算机程序,该程序被处理器执行时可实现上述实施例六和七述的基于版权登记信息的后处理方法。其具体的描述其参照实施例十三。
注意,虽然通过以上实施例对本申请进行了较为详细的说明,但是本申请不仅仅限于以上实施例,在不脱离本申请构思的情况下,还可以包括更多其他等效实施例,而本申请的范围由所附的权利要求范围决定。

Claims (21)

  1. 一种基于版权登记信息的后处理方法,应用于版权服务平台,所述方法包括:
    获取版权登记信息;
    基于所述版权登记信息,获取版权后处理操作的至少两个参与方信息,以及后处理信息;
    将所述参与方信息和后处理信息,作为事务请求在区块链网络中发送,以请求添加至区块中存储。
  2. 根据权利要求1所述的方法,其中,基于所述版权登记信息,获取版权后处理操作的至少两个参与方信息,以及后处理信息,包括:
    基于所述版权登记信息,获取版权维权操作的维权方信息和侵权方信息,以及侵权证据信息。
  3. 根据权利要求2所述的方法,其中,基于所述版权登记信息,获取版权维权操作的维权方信息和侵权方信息,以及侵权证据信息,包括:
    通过互联网进行网页抓取;
    将抓取网页,与所述版权登记信息所对应的版权登记对象内容进行匹配,以识别疑似侵权网页,将疑似侵权网页的快照或网址作为所述侵权证据信息;
    提取所述疑似侵权网页的发布者信息作为所述侵权方信息,根据所述版权登记信息确定维权方信息。
  4. 根据权利要求2或3所述的方法,其中,将所述维权方信息和侵权方信息,以及侵权证据信息,作为事务请求在区块链网络中发送,以请求添加至区块中存储,包括:
    将所述维权方信息和侵权方信息,以及侵权证据信息添加到第一智能合约中,作为事务请求在区块链网络中发送,其中,所述侵权证据信息为网址,所述第一智能合约用于请求区块生成节点根据所述网址在互联网中获取疑似侵权网页,并添加到区块中存储。
  5. 根据权利要求1所述的方法,其中,基于所述版权登记信息,获取版权后处理操作的至少两个参与方信息,以及后处理信息,包括:
    基于所述版权登记信息,获取版权交易处理的购买方信息和出售方信息,以及交易处理信息;
    其中,所述交易处理信息包括:交易对象信息、时间信息和交易金额信息。
  6. 根据权利要求1或5所述的方法,其中,将所述参与方信息和后处理信息,作为事务请求在区块链网络中发送,以请求添加至区块中存储,包括:
    将所述参与方信息和后处理信息的部分或全部信息,采用所述版权服务平台设置的公钥 加密,而后作为事务请求在区块链网络中发送,以请求添加至区块中存储;
    将所述公钥对应的私钥反馈给参与方。
  7. 根据权利要求1或5所述的方法,其中,将所述参与方信息和后处理信息,作为事务请求在区块链网络中发送,以请求添加至区块中存储,包括:
    将所述参与方信息和后处理信息的部分或全部信息,采用至少一个参与方提供的公钥加密,而后作为事务请求在区块链网络中发送,以请求添加至区块中存储。
  8. 根据权利要求1或5所述的方法,其中,将所述参与方信息和后处理信息,作为事务请求在区块链网络中发送,以请求添加至区块中存储,包括:
    将所述参与方信息和后处理信息添加到第二智能合约中,作为事务请求在区块链网络中发送;其中,所述第二智能合约用于请求区块生成节点生成非对称密钥对,并采用公钥对所述参与方信息和后处理信息的部分或全部信息进行加密;
    接收区块生成节点反馈给所述版权服务平台或参与方的私钥。
  9. 根据权利要求1或5所述的方法,其中,将所述参与方信息和后处理信息,作为事务请求在区块链网络中发送,以请求添加至区块中存储,包括:
    将所述参与方信息和后处理信息添加到第三智能合约中,作为事务请求在区块链网络中发送;其中,所述第三智能合约用于请求区块生成节点反馈密钥提供消息;
    接收区块生成节点反馈的密钥提供消息,根据所述密钥提供消息通知参与方提供非对称密钥,并转发给区块生成节点,以请求区块生成节点根据非对称密钥的公钥对所述参与方信息和后处理信息的部分或全部信息进行加密。
  10. 根据权利要求1或5所述的方法,其中,将所述参与方信息和后处理信息,作为事务请求在区块链网络中发送,以请求添加至区块中存储,包括:
    将所述参与方信息和后处理信息的部分或全部信息进行签名加密,作为事务请求在区块链网络中发送,以请求添加至区块中存储;
    提供信息查询接口或后处理授权证书给参与方,其中,所述信息查询接口或后处理授权证书,用于供参与方根据签名算法从区块链网络中查询获取参与方信息和后处理信息。
  11. 一种基于版权登记信息的后处理方法,应用于区块链网络节点,所述方法包括:
    接收版权服务平台发送的事务请求;
    根据所述事务请求中的版权登记信息的参与方信息和后处理信息,进行处理,并添加至区块中进行存储。
  12. 根据权利要求11所述的方法,其中,所述参与方信息和后处理信息,包括:
    版权维权操作的维权方信息和侵权方信息,以及侵权证据信息;或
    版权交易处理的购买方信息和出售方信息,以及交易处理信息。
  13. 根据权利要求11或12所述的方法,其中,根据所述事务请求中的版权登记信息的参与方信息和后处理信息,进行处理,并添加至区块中进行存储,包括:
    根据所述事务请求中的第二智能合约生成非对称密钥对;
    采用公钥对所述参与方信息和后处理信息的部分或全部信息进行加密,并将加密信息添加至区块中进行存储;
    将私钥反馈给版权服务平台或参与方。
  14. 根据权利要求11或12所述的方法,其中,根据所述事务请求中的版权登记信息的参与方信息和后处理信息,进行处理,并添加至区块中进行存储,包括:
    根据所述事务请求中的第三智能合约生成密钥提供消息;
    将密钥提供消息发送给版权服务平台,以通知所述版权服务平台根据所述密钥提供消息通知参与方提供非对称密钥;
    接收所述版权服务平台转发的非对称密钥的公钥,根据所述公钥对所述参与方信息和后处理信息的部分或全部信息进行加密,并将加密信息添加至区块中进行存储。
  15. 根据权利要求12所述的方法,其中,根据所述事务请求中的版权维权操作的维权方信息和侵权方信息,以及侵权证据信息,进行处理,并添加至区块中进行存储,包括:
    根据所述事务请求中的侵权证据信息内的获取地址,通过互联网抓取网页,作为侵权证据;
    将所述版权维权操作的维权方信息和侵权方信息以及侵权证据,进行处理,并添加至区块中进行存储。
  16. 一种基于版权登记信息的后处理装置,配置于版权服务平台中,所述装置包括:
    登记信息获取模块,设置为获取版权登记信息;
    操作信息获取模块,设置为基于所述版权登记信息,获取版权后处理操作的至少两个参与方信息,以及后处理信息;
    操作信息发送模块,设置为将所述参与方信息和后处理信息,作为事务请求在区块链网络中发送,以请求添加至区块中存储。
  17. 一种基于版权登记信息的后处理装置,配置于区块链网络节点中,所述装置包括:
    事务请求接收模块,设置为接收版权服务平台发送的事务请求;
    处理存储模块,设置为根据所述事务请求中的版权登记信息的参与方信息和后处理信 息,进行处理,并添加至区块中进行存储。
  18. 一种设备,所述设备包括:
    一个或多个处理器;
    存储装置,设置为存储一个或多个程序;
    当所述一个或多个程序被所述一个或多个处理器执行,使得所述一个或多个处理器实现如权利要求1-10中任一所述的基于版权登记信息的后处理方法。
  19. 一种设备,所述设备包括:
    一个或多个处理器;
    存储装置,设置为存储一个或多个程序;
    当所述一个或多个程序被所述一个或多个处理器执行,使得所述一个或多个处理器实现如权利要求11-15中任一所述的基于版权登记信息的后处理方法。
  20. 一种存储介质,其上存储有计算机程序,该程序被处理器执行时实现如权利要求1-10中任一所述的基于版权登记信息的后处理方法。
  21. 一种存储介质,其上存储有计算机程序,该程序被处理器执行时实现如权利要求11-15中任一所述的基于版权登记信息的后处理方法。
